HomeMy WebLinkAbout1461 -. - e RESOLUTION 1461 A RESOLUTION OF THE PLANNlNG COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, GRANTING CONDmONAL USE PERMIT 91-006 TO CONSTRUCT A JIFFY LUBE CENTER WITH GASOLINE SERVICE AT 5 WEST HUNTINGTON DRIVE WHEREAS, on May 6, 1991 an application was filed by Anthony Fanticola, to construct a Jiffy Lube center with gasoline service, Planning Department Case No. eu.p. 91-006 at 5 West Huntington Drive (the northwest comer of Huntington Drive and Santa Anita Avenue), more particularly described as follows: The east 100 feet of the south 125 feet of Lot 3 of Tract No. 949, in the City of Arcadia as per map recorded in Book 17, Page 13 of Maps, in the office of the County Recorder of said County. Except the south 20 feet of said land conveyed to the City of Arcadia by deed recorded July 10, 1947 in Book 24803, Page 28, Official Record, WHEREAS, a public hearing was held on June 11, 1991, at which time all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: Section 1. That the factual data submitted by the Planning Department in the attached report is true and correct. Section 2. This Commission finds: 1. That the granting of such Conditional Use Permit will not be detrimental to the public health or welfare, or injurious to the property or improvements in such zone or vicinity. 2. That the use applied for at the location indicated is a proper use for which a Conditional Use Permit is authorized. 3. That the site for the proposed use is adequate in size and shape to accommodate said use. All yards, spaces, walls, fences, parking, loading, landscaping and other features are adequate to adjust said use with the land and uses in the neighborhood. There is adequate on-site parking to accommodate the proposed use. 4. That the site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. 5. That the granting of such Conditional Use Permit will not adversely affect the comprehensive General Plan. -1- 1461 ~ ~ . 6.1hat the use applied for will not have a substantial adverse impact on the environment. Section 3. That for the foregoing reasons this Commission approves a Conditional Use Permit to operate an eating establishment upon the following conditions: 1. That the conditions set forth by the Department of Public Works shall be complied with to the satisfaction of the Director of Public Works. 1) Submit grading and drainage plan prepared by a registered civil engineer subject to the approval of the Director of Public Works. NOTE: Show all existing and proposed parkway trees, pull boxes, meters, power poles, street lights, driveways, sidewalks and handicapped ramps on grading/ drainage plan, 2) Dedicate seven and one-half (7.5) feet at the east side of the subject property to provide for fifty seven and one-half (57.5) feet of right-of-way from the centerline of Santa Anita Avenue. 3) Dedicate a 15 foot radius corner cut-off for street purposes. 4) Plant two (2) parkway trees at locations determined by the Director of Public Works per Arcadia City Standard Drawing 5-13-1. Contact Public Works Department for type and size. 5) Close existing driveways not to be used and reconstmct curb, gutter and sidewalk to match existing. 6) Remove and replace deficient or damaged curb, gutter, sidewalk and/or pavement to satisfaction of the City Engineer. Contact Public Works Department for exact locations of removal and replacement. 7) Construct commercial type P.c.c. driveway apron according to the Arcadia Standard Drawing No. 5-11. No driveway shall be constructed closer than three (3) feet from any curb return. fire hydrant, ornamental light standard, telephone or electrical pole, meter box, underground vault, manhole or street tree. NOTE: No portions of existing gutter and A.c. pavement shall be removed unless prior approval is obtained from Director of Public Works. 8) Reconstruct full width sidewalk on Santa Anita Avenue and Huntington Drive as per Arcadia City Standard Drawing No, 5-17, 9) Gravity drainage outlets, and commercial driveway aprons shall be constructed to conform to Arcadia City Standard Drawing No. 5-11. -2- 1461 . - e 10) Construct a 25 foot radius curb return to the northwest corner of Huntington Drive and Santa Anita Avenue. Concurrent with the construction of the curb return, provide for the relocation of the existing traffic signal with the associated conduit and pull boxes and provide for the extension of the colored paving blocks on Huntington Drive and Santa Anita Avenue. 11) Relocation of existing RID bus stop is to be coordinated between the owner and the Rapid Transit District, subject to approval of the City Engineer. 12) Construct P.e.e. ramp for the handicapped per Arcadia City Standard Drawing No, 5-22, 13) All survey monuments, centerline ties and survey reference points shall be protected in place or re-established where disturbed, This work will be the responsibility of the permittee and shall be at the permittee's expense. 14) The owner shall enter into an Improvement Agreement with the City of Arcadia prior to start of any off-site improvement work and shall post appropriate security subject to approval of the Director of Public Works and the City Attorney. . 15) Submit street improvement plans and traffic signal relocation plan prepared by a Registered Civil Engineer on city provided drawing sheets subject to approval of the Director of Public Works. 16) Public Works Inspector shall be contacted at (818) 574-5400, extension 289, at least 24 hours prior to construction of off~site improvements, All Public Works improvements shall be completed to the satisfaction of Director of PUblic Works prior to final acceptance by Building and Safety Department and prior to occupancy. 17) The above items are to be complied with to the satisfaction of the Director of Public Works in accordance with the applicable provisions of the Arcadia Municipal Code. 2. That fire safety shall be provided to the satisfaction of the Fire Departmen t. 3. That water service shall be provided to the satisfaction of the Water Manager. 4. That a minimum of seven 24" box trees shall be planted on the property (not including parkway trees) and that a landscape and irrigation plan shall be submitted to the Planning Department for its review and approval as part of the Plan Check process. -3- 1461 . e e 5. That the exit onto Huntington Drive shall be limited to "Right Turns Only" and the pavement shall be marked accordingly, as well as a "Right Turn Only" sign (design approved by the Planning Department) posted in the planter area. 6. All signs shall be submitted to the Planning Department and Redevelopment Agency for separate design approval. 7. That the walls along the west an~ north property lines shall be stuccoed the same color as the proposed building.. If the wall along the north property line is owned by the adjacent property, the applicant shall secure written approval from said property owner to stucco the side of the wall on the subject property. The new wall proposed along the west property line shall be stuccoed on both sides. 8. The trash enclosure shall be stuccoed on three sides to match the building with the metal gates shall be painted a color compatible with the building. 9. That the architectural design shall be subject to the review and approval of the Redevelopment Agency. 10. That the building shall be consistent with the plans approved by the Planning Commission and/or Redevelopment Agency. Any changes in material or design shall be subject to the approval of the Planning Director, and if necessary. the Redevelopment Agency. 11. Sales and storage of merchandise shall be confined within one room of not more than 210 square feet. 12. There shall be no distribution or .sale on the subject site of food, carbonated drinks and cigarettes except from dispensers within a building, or other items not incidental to the operation of motor vehicles. Exception: All retail sales shall be limited to beverages, food, dairy and tobacco products that are bottled, canned, packaged or sealed. The display, sale or storage of books, periodicals, magazines, health and beauty aids, household soaps and cleansers, and alcoholic beverages is prohibited. 13. No food, snack or beverage shall be prepared, cooked, heated or warmed on the premises. The room used to display, sell or store the merchandise shall not contain any cooking facilities; i.e., oven, microwave or heating utensil. Exception: The Jiffy Lube waiting area may have coffee available for customers waiting for their cars. 14. There shall be no storage, sale, display or advertisement for sale or lease of motor vehicles, trucks or trailers on the subject site. -4- 1461 . - . 15. That, if the property changes ownership, that no lifts may be installed and the uses permitted limited to the uses set forth in Section 9275.4.7.3 of the Arcadia Municipal Code, 16. The following activities are prohibited: Upholstering work, auto glass work, painting, welding, tire recapping, auto dismantling, and any other uses which is not expressly permitted per Section 9275.4.7 of the A.M.C. 17. Advertising pertaining to retail sales and service signs shall be limited to those set forth in Section 9275.4.7.h and 9275,4.7.k. 18. The manager ofthe Jiffy Lube shall insure that automobiles waiting for Jiffy Lube service do not interfere with the on-site traffic circulation or obstruct vehicles from using the gasoline pumps, 19. That c.u.P. 91-006 shall not take effect until the owner and applicant have executed a form available at the Planning Department indicating awareness and acceptance of the conditions of approval. 20. Noncompliance with the provisions and conditions of this Conditional Use permit shall constitute grounds for the immediate suspension or revocation of said Permit. Section 4. The decision, findings and conditions contained in this Resolution reflect the Commission's action of June 11, 1991 and the following vote: A YES: Commissioners Amato, Clark, Hedlund, Szany ABSENT: Commissioner Papay Section 5. The Secretary shall certify to the adoption of this Resolution and shall cause a copy to be forwarded to the City Council of the City of Arcadia. BUTLER, ASSISTANT PLANNING DIRECTOR CASE NO.: C.U,P.91-006 TO: FROM: SUMMARY An application was filed by Anthony Fanticola to construct a Jiffy Lube center with gasoline service at 5 West Huntington Drive (the northwest corner of Santa Anita Avenue and Huntington Drive). . The Planning Department is recommending approval subject to the conditions outlined in this report. GENERAL INFORMATION APPUCANT: Anthony Fanticola LOCATION: 5 West Huntington Drive REQUEST: Conditional use permit to construct a Jiffy Lube and service station. EXISTING LAND USE &: ZONING The site is currently developed with a Mobil Service Station; zoned C-2 D. SURROUNDING LAND USE &: ZONING . North: South: East West: Developed with medical offices; zoned C-2 D Developed with the Arcadia County Park; zoned 5-2 Developed with Denny's Restaurant; zoned C-2 DH Developed with beauty salon; zoned C-2 D GENERAL PLAN DESIGNATION Commercial c.u.p, 91-006 June 11, 1991 Page 1 . - . PROPOSAL Building The applicant is proposing to demolish the existing 1,600 sq. ft. Mobil service station and remove the existing pump islands and construct a 1,592 square foot Jiffy Lube center with a pump island along Santa Anita Avenue. The 1,592 square feet does not include the basement area or the second floor area over the waiting room and offices. The basement is used for storage of supplies, the oil tanks and access to service pits. Cars are serviced from pits; there are no lifts. The second floor is used for supplies, employees lockers and dressing rooms. The main floor of the building contains two bays, a waiting room, office, and restrooms. Two ors can be serviced from each bay; allowing a total of four cars to be serviced at anyone time. The bays front on Huntington Drive; cars will enter from the north side of the building and exit from the south side fronting on Huntington Drive. The cashier's window serving the gasoline pumps is located on the east side of the building facing Santa Anita Avenue. . The building is 22'-6" in height. The building facade will be predominantly "burnt" colored brick with champagne colored stucco and a dark slate tile roof. Red awnings will be located on the north and east building elevations. The west building elevation will be brick. The building will be set back 20'-0" from Huntington Drive and 50'-0" from the north property line. There will be one self-service pump island along Santa Anita Avenue. The pump island's design is compatible with the building and the same materials are being used; stucco, brick and tile. The pumps can serve four cars at anyone time (two on each side). A stucco wall (to match the stucco on the building) is proposed along the west and north property lines. The trash enclosure is adjacent to the north property line. Parking and Circulation Six parking spaces (including one handicap space) are proposed along the north property line. Six spaces will provide adequate parking for the employees. C.U.P.91-006 June 11, 1991 Page 2 - . . Access to the si.te is from. two driveways; one on Santa Anita Avenue (existing) and one from Huntington Drive. The existing driveway along Huntington Drive is 30'-0" in width. The driveway is proposed to be increased to 39'-0" in width. The Planning Department is recommending that vehicles exiting the site onto Huntington Drive be restricted to "Right Turn" only to avoid conflict with cars entering the site from Huntington Drive. Cars exiting from the Santa Anita Avenue driveway are restricted to right turns only because of the median strip along Santa Anita Avenue. Vehicles enter the Jiffy Lube from the north side of the building and exit on the south side of the building. The applicant has noted that generally there is a minimum number of vehicles waiting for service; however, during peak periods there may be some stacking of vehicles. There is 29'-6" behind the building to accommodate vehicles. The pump island has been located 21'-0" from the building to providing adequate circulation between the building and vehicles parked at the pumps. This will allow vehicles entering from Huntington Drive to drive north on the property to the Jiffy Lube without interfering with service at the gasoline pumps. There is 14'-6" between the pumps and the landscape buffer along Santa Anita Avenue. Landscaping A 7'-0" landscape buffer is proposed along Santa Anita Avenue, reducing to 5'-0" along the east portion of the lot fronting of Huntington Drive. Additional landscaping is proposed at the northeast comer of the lot (8'-0" by 19'-6" buffer); the southwest comer of the lot adjacent to Huntington Drive and in front of the building. The rendering submitted by the applicant shows two trees in the southwest planter area. Staff would recommend that a minimum of seven 24" box trees be planted on the subject property (not including parkway trees). MISCELLANEOUS INFORMATION During the peak hours there will be a maximum of 6 employees. The Jiffy Lu~.and gasoline station will operate seven days a week. The Jiffy Lube's hours of operation are 7:00 a.m. to 7:00 p.m. According to the applicant, there is an average of 60 cars serviced during the day. Saturday is the busiest day, servicing up to 85 cars. It takes approximately 9 to 10 minutes to service each car. The hours of operation of the gasoline service will be 7:00 a.m. to 10:00 p.m. or 11:00 p.m. C.U.P.91-006 June 11, 1991 Page 3 . . . Jiffy Lube provides. limited services such as oil changes, checking the transmission, brake and other flUids, replacing air and oil filters (if necessary), washing windows and putting air in the tires. As noted, there are no lifts and the oil changes are done from pits. ARCHITECTURAL DESIGN REVIEW The subject property is located within the Redevelopment area and subject to Redevelopment Agency Design Review. Concurrent with the consideration of this conditional use permit. the Planning Commission may recommend approval, conditional approval or denial of the applicant's design concept to the Redevelopment Agency, The Planning Department has been working with the applicant for several months to refine and improve the project design and layout. The design has been significantly modified since the original submittal which was for a three bay building with stucco and wood exterior. The Planning Department recognizes that this is one of the prime corners in the. City and that any new construction should reflect the City's concern for high quality design and use of materials. The proposed Jiffy Lube is a prototype; it is predominantly brick with some stucco. The use and color of materials is consistent with the materials set forth in the Design Overlay for the downtown area. It is staff's opinion that the proposed design complies with the intent of the design criteria set forth in the City's Architectural Design Review Regulations. Approval of this conditional use permit, does not include approval of the signs shown on the plans. Said signs require separate design approval. ANALYSIS Staff initially was concerned with on-site circulation, traffic generation and design of the project. The final design addresses these concerns. " The service bays at the existing service station have not been used for years. However, they could reopen the bays at any time and begin servicing on cars without going through the conditional use permit process. Section 9275,4.7.3. of the Arcadia Municipal Code permits the following uses in conjunction with service stations: C.U.P.91-006 June 11, 1991 Page 4 . . . "At an automobile self-service station no activities other than the following shall be conducted: dispensing gasoline, oil, grease, tires, batteries and automobile accessories directly to users of motor vehicles; tuning motors; wheel and brake adjustment and other minor repairs and servicing of motor vehicles only to the extent of installation of tires, batteries and automobile accessories directly to users of motor vehicles...... A Jiffy Lube with gasoline service is consistent with the above provisions of the code. Although a "Jiffy Lube" may create more traffic than a normal gasoline station with service bays, it is not inconsistent with the uses permitted. The Planning Department is recommending as a condition of approval that the manager supervise on-site traffic circulation to insure that automobiles waiting for the Jiffy Lube service do not obstruct traffic circulation and use of the gasoline pumps. The proposed development will be a significant visual improvement to the site. It is a permitted use in the C-2 zone with an approved conditional use permit and will be an appropriate use of the property based upon the conditions recommended i~ the staff report. . The Planning Department does not feel it is necessary to restrict the hours of operation because the subject property is surrounded by commercial uses and the hours of operation will not have an adverse affect on the adjoining properties. Pursuant to the provisions of the California Environmental Quality Act, the Planning Department has prepared an initial study for the proposed project. Said initial study did not disclose any substantial' or potentially substantial adverse change in any of the physical conditions within the area affected by the project including land, air, water, minerals, flora, fauna, ambient noise and objects of historical or aesthetic significance. When considering the record as a whole, there is no evidence that the proposed project will have any potential for adverse effect on wildlife resources or the habitat upon which the wildlife depends. Therefore, a Negative Declaration has been prepared for this project. RECOMMENDATION The Planning Department recommends approval of C.U.P. 91-006 subject to the following conditions. 1. Denial If the Planning Commission intends to take action to deny this project, the Commission should move to deny and direct staff to prepare an appropriate resolution incorporating the Commission's decision and findings in support of that decision. .'
