RESOLUTION 146M A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, GRANTING CONDmONAL USE PERMIT 91-005 TO OPERATE A GYMBOREE PARENT-PARTICIPATION PROGRAM AT 639 WEST DUARTE ROAD WHEREAS, on April 22, 1991 an application was filed by Lynda Farrell, to operate a Gymboree parent participation play movement program for children three months to 4 years of age, Planning Department Case No. c.u.P. 91-005 at 639 West Duarte Road, more particularly described as follows: Tract #3430, Lot commencing south 81 (West 101.24 feet and north 0 (00' west 185.07 feet from the intersection of the north line of Duarte Road 80' wide with the east line of Lot 42, thence north 0 (00'25") in the City of Arcadia, County of Los Angeles, State of California. WHEREAS, a public hearing was held on May 28, 1991, at which time all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: Section 1. That the factual data submitted by the Planning Department in the attacl1ed report is true and correct, Section 2. This Commission finds: 1. That the granting of such Conditional Use Permit will not be detrimen- tal to the public health or welfare, or injurious to the property or improvements in such zone or vicinity. 2. That the use applied for at the location indicated is a proper use for which a Conditional Use Permit is authorized. 3. That the site for the proposed use is adequate in size and shape to accommodate said use. All yards, spaces, walls, fences, parking, loading, land- scaping and other features are adequate to adjust said use with the land and uses in the neighborhood. 4. That the site abuts streets and highways adequate in width and pave- ment type to carry the kind of traffic generated by the proposed use. 5. That the granting of such Conditional Use Permit will not adversely affect the comprehensive General Plan. -1- 1460A - . e 6. That the use applied for will not have a substantial adverse impact on the environment. Section 3. That for the foregoing reasons this Commission approves a Conditional Use Permit to operate a Gymboree parent participation program upon the following conditions: 1. That fire safety shall be provided to the satisfaction of the Fire Department. 2. That c.u.P. 91-005 shall not take effect until the owner and applicant have executed a form available at the Planning Department indicating awareness and acceptance of the conditions of approval. 6. Noncompliance with the provisions and conditions of this Conditional Use permit shall constitute grounds for the immediate suspension or revocation of said Permit. Section 4. The decision, findings and conditions contained in this Resolution reflect the Commission's action of May 28, 1991 and the following vote: A YES: Commissioners Amato, Clark, Hedlund, Szany NOES: None ABSENT: Commissioner Papay Section 5. Gymboree of San Gabriel Valley to operate a Gymboree parent participation play'movement program for children 3 months to 4 years of age at 639 West Duarte Road (the 99l1! center). The Planning Department is recommending approval subject to conditions outlined in this report. GENERAL INFORMATION APPLICANT: LOCATION: Lynda Farrell 639 West Duarte Road, the unit adjacent to the Cable Vision offices REQUEST: Conditional use permit to operate a parent participation play- movement program for children 3 months to 4 years of age. EXISTING LAND USE & ZONING The site is currently developed with a shopping center cont,,;n;ne mixed commercial uses. The site is zoned C-2 H. SURROUNDING LAND USE & ZONING North: South: East: West: Developed with apartments and condominiums; zoned R-3 Developed with the Arcadia Metro Center; zoned C-2 H Developed with an office building; zoned CoO DH Developed with office buildings; zoned C-2 H GENERAL PLAN DESIGNATION Commercial C.U.P.91-005 May 28, 1991 Page 1 PROPOSAL AND ANALYRIS . The applicant is currently conducting Gymboree classes at Our Savior Lutheran Church on Duarte Road (C.U.P. 82-16). Because the Gymboree concept has been so successful, they wish to increase the number of classes. However, the church has no other time slots available to allow the expansion of their use, therefore, they are requesting this conditional use permit to conduct classes in the 99!t Center on Duarte Road. The applicant is proposing to use the 2,100 square foot unit adjacent to the Cable Vision offices (previously occupied by Tan America). Gymboree is a parent-participation play-movement program for children 3 months to 4 years of age. Classes are offered on a weekly basis and involve movement skills, songs and rhythm activities and socialization opportunities for adults and children. Classes will range in size from 5 to 20 participants (the average number will be 12- 15 children) with parents. There is one instructor for the group. Parents are given child development information and instruction in developing their child's motor skills. The days and hours of operation would be four mornings between 9:15 a.m. to 12:15 p.m. and one or two evenings between 5:15 p.m. and 8:15 p.m. There are four classes conducted during each time period. Each class is 45 minutes in . length. . . Currently there are 199 parking stalls on the site; 276 spaces are required. The proposed redesign will add an additiona120 parking spaces for a total of219 spaces. The applicants conducted a parking survey during their proposed hours of operation over a five day period. Based upon the information they have submitted, no more than 58 cars were parked in the lot at anyone time. During staffs frequent inspections of this site, we have never observed any parking problems within this center. Staff does not believe that Gymboree classes will result in a significant increase in traffic on the site or create a need for additional parking. Pursuant to the provisions of the California Environmental Quality Act, the Planning Department has prepared an initial study for the proposed project. Said initial study did not disclose any substantial or potentially substantial adverse change in any of the physical conditions within the area affected by the project including land, air, water, minerals, flora, fauna, ambient noise and objects of historical or aesthetic significance. When considering the record as a whole, there is no evidence that the proposed project will have any potential for adverse effect on wildlife resources or the habitat upon which the wildlife depends. Therefore, a Negative Declaration has been prepared for this project. . C.U.P.91-005 May 28, 1991 Page 2 . . . BECOMMENDATIOlI{ The Planning Department recommends approval of C.U.P. 91-005 subject to the following conditions. 1. That fire safety shall be provided to the satisfaction of the Fire Department. 2. That classes shall be restricted between 9:15 a.m. and 12:15 p.m. and 5:15 p.m. and 8:15 p.m. 3. That C.U.P. 90-015 shall not take effect until the owner and applicant have executed a form available at the Planning Department indicating awareness and acceptance of the conditions of approval. 4. Noncompliance with the provisions and conditions of this Conditional Use permit shall constitute grounds for the immediate suspension or revocation of said Permit. FINDINGS AND MOTIONS ADoroval If the Planning Commission intends to take action to approve this project, the Commission should move to approve and file the Negative Declaration and fina that the project will not have a significant effect on the environment and direct staff to prepare the appropriate resolution incorporating the specific findings and conditions of approval set forth in the staff report (or as modified by the Commission). Denial If the Planning Commission intends to take action to deny this project, the Commission should move to deny and direct staff to prepare an appropriate resolution incorporating the Commission's decision and findings in support of that decision.
