RESOLUTION 1459 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, GRANTING CONDmONAL USE PERMIT 91-003 FOR A FOOD COURT RESTAURANT FACIT..ITY AT 1222 SOUTH GOLDEN WEST AVENUE. WHEREAS, on March 11, 1991, an application was filed by Roger Chen for a Conditional Use Permit to operate a 14,179 square foot food court restaurant facility, Planning Department Case No. C.U.P. 91-003, on property commonly known as 1222 South Golden West Avenue, more particularly described as follows: SEE ATIACHED EXHIBIT "A" WHEREAS, a public hearing was held on April 9, 1991, at which time all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: Section 1. That the factual data submitted by the Planning Department in the attached report is true and correct. Section 2. This Commission fmds: 1. That the granting of such Conditional Use Permit will not be detrimental to the public health or welfare, or injurious to the property or improvements in such zone or vicinity. 2. That the use applied for at the location indicated is a proper use for which a Conditional Use Permit is authorized. 3. That the site for the proposed use is adequate in size and shape to accommodate said use. All yards, spaces, walls, fences, parking, loading, landscaping and other features are adequate to adjust said use with the land and uses in the neighborhood. 4, That the site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. 5. That the granting of such Conditional Use Permit will not adversely affect the comprehensive General Plan. 1459 1 . . . 6. That the use applied for will not have a substantial adverse impact on the environment. Section 3. That for the foregoing reasons this Commission grants a Conditional Use Permit for a 14,179 square foot food court restaurant facility upon the following conditions: 1. Fire protection shall be provided to the satisfaction of the Arcadia Fire Department, which may include the following items: A. Fire sprinklers per NFPA-13 standards. B. A central station fire alarm system per NFPA standards #71 and 72E. Plans shall be submitted and approved prior to the installation of the fire alarm system. C The fire alarm to the central station shall be operational prior to occupancy. 2. That Water service shall conform to the Uniform Plumbing Code and any new water service shall be subject to the East Pasadena Water Company. 3. Dedicate a 15 foot corner cut-off for street purposes at the corner of Naomi Avenue and Golden West Avenue prior to the issuance of any business license. 4. That the business hours for the food court restaurant facility shall be limited to 9 a.m. to 10 p.m. during the weekdays and weekends. 5. The shopping center shall be improved per the plans on file in the Planning DepartInent; to include the proposed quantity of landscaping, as shown on the submitted site plan. 6. That the new trees shall be of a minimum size of 15 gallon, and shall be maintained in acoordance with the plans on file in the Planning Department. 7. That the site improvements (i.e., parkin& landscaping) shall be completed prior to the opening of the food court restaurant facility. 8. That the existing pink accent band and planter boxes shall be repainted with a more appropriate color which will further enhance the appearance of the shopping center, subject to the review and approval of the Planning Department. 9. A modification shall be granted for 383 on-site parking spaces in lieu of 385; and that this approval shall not constitute an approval for the general reduction in parking for the total site. Furthermore, the parking modification shall only be for the use approved by C.u.P. 91-003 (a food court restaurant facility). 10. That C.u.P. 91-003 shall not take effect until the owner and applicant have executed a form available at the Planning Department indicating awareness and acceptance of the conditions of approval. 2 1459 . . . 11. Noncompliance with the provisions and conditions of this Conditional Use Permit shall constitute grounds for its immediate suspension or revocation. 12. That the hours of delivery shall be restricted to 7 a.m. to 10 p.m. Section 4. The decision, findings and conditions contained in this Resolution reflect the Commission's action of April 9, 1991 and the following vote: A YES: Commissioners Amato, Oark, Szany, Papay NOES: None ABSENT: Hedlund Section 5. The Secretary shall certify to the adoption of this Resolution and shall cause a copy to be forwarded to the City Council of the Oty of Arcadia. NICHOLSON, ASSOCIATE PLANNER CASE NO.: CONDmONAL USE PERMIT 91-003 SUMMARY This application was filed by Roger Chen to request a conditional use permit for a proposed food court restaurant facility at 1300 South Golden West Avenue. The Planning Department is recommending approval of the applicant's request subject to the conditions outlined in this report. GENERAL INFORMATION APPUCANT: Roger Chen Qessee) LOCATION: 1222 South Golden West Avenue . REQUEST: A Conditional Use Permit for a proposed food court restaurant facility to be located within an existing shopping center, and a parking modification to permit 383 on-site spaces in lieu of 385 spaces required for the shopping center with the proposed food court (Sec. 9269.5). LOT AREA: 240,930 square feet (5.53 acres) FRONTAGE: 637 feet on Golden West Avenue 378 feet on Duarte Road 378 feet on Naomi Avenue EXISTING LAND USE & ZONING: The site is developed with with an existing commercial retail shopping center; zoned C-l & D. SURROUNDING LAND USE & ZONING: . North Multiple-family residential; zoned R-3. South: Multiple-family residential; zoned R-3. . East Commercial retail center and a nonconforming apartment building; zoned C-2. ' West: Multiple-family residential and a automobile service station; zoned R-3 and C-2 respectively. GENERAL PLAN DESIGNATION: The subject site is designated as Neighborhood Commercial. BACKGROUND INFORMATION On July 26,1988, the Planning Commission approved a proposal to remodel the exterior of the shopping center at 1220-1300 South Golden West Avenue (ADR 88- 78). This proposal required modifications, which were approved, for the height of architectural features and the location of two new signs, The exterior remodel of the shopping center was completed in 1989. On January 17, 1989, the City Council granted a conditional use permit (C.U.P, 88-29) to operate a 4,800 square foot restaurant within the existing shopping center (318 on- site parking spaces were provided in lieu of 338 spaces required). However, the applicant at that time did not pursue the approved restaurant use and therefore the application became null and void per Arcadia Municipal Code Section 9275.2.13. . Also, on May 22,1990, the Planning Commission granted a conditional use permit (C.u.P. 90-004) for a proposal to reopen the site's vacated grocery store building at 1300 South Golden West Avenue (formerly the Pantry Market). The conditional use permit was required due to the proposed sale of alcoholic beverages for off- premise consumption within 150 feet of residentially zoned property and for an eating establishment to be within the grocery store with limited seating for 12 persons. The site's grocery store building is still vacant. PROPOSAL AND ANALYSIS The applicant is seeking a conditional use permit to operate a food court restaurant facility of 14,179 square feet within an existing 62,099 square foot shopping center, as shown on the submitted site plan. Staff has been advised by the applicant that the hours of operation will be from 9 a.m. to 10 p.m. during the weekdays and weekends. The food court would provide six individual kitchen areas and a large common seating area of approximately 8,000 square feet. The concept of this facility is to provide diversity in the selection of prepared foods. A total of 318 on-site parking spaces exist on the site. Under current zoning regulations the shopping center would need 315 parking spaces, and with the proposed food court 385 parking spaces would be required. . c. u.P. 91-003 April 9, 1991 Page 2 . . . Improvements to the site would include: 1) a redesign of the parking areas to increase the on-site parking from 318 spaces to 383 spaces; 2) additional landscaped buffers would be installed along Golden West Avenue, Duarte Road and Naomi Avenue; 3) additional landscaping (i.e., trees and ground cover) would be provided within the shopping center's main parking area (along Golden West Avenue); and 4) a total of twelve (12) additional trees would be planted within the existing landscaped parkway areas along Golden West and Naomi Avenue to further buffer the neighboring residential properties from the shopping center. The applicant has not indicated any changes to the exterior of the buildings; however, staff is concerned about the existing pink accent band around the buildings and with the corresponding pink planter boxes which are along the pedestrian walkway. Staff feels that the pink color is garish and that it is not visually harmonious with the surrounding development. Therefore, staff is recommending that the pink accent band and the planter boxes be repainted with a more appropriate color which will further enhance the appearance of the shopping center. A food court restaurant facility is a permitted use in the C-l zone with an approved conditional use permit. It is the Planning Department's opinion that the parking deficiency of 2 parking spaces (383 in lieu of 385) would not be detrimental to the site or to the surrounding neighborhood, It has been the Planning Department's experience that shopping centers of this size with the potential for multiple tenants do not need the required number of parking spaces. Also, usually the two peak business times in a day (lunch and dinner) for such a use would not conflict with the peak business hours for most of the retail stores in a shopping center. Attached for your consideration are the proposed plans. Pursuant to the provisions of the California Environmental Quality Act, the Planning Department has prepared an initial study for the proposed project. Said initial study did not disclose any substantial or potentially substantial adverse change in any of the physical conditions within the area affected by the project including land, air, water, minerals, flora, fauna, ambient noise and objects of historical or aesthetic significance. There is no evidence that the proposed project will have any potential for an adverse effect on wildlife resources. Therefore, a Negative Declaration has been prepared for this project. RECOMMENDATION The Planning Department recommends approval of Conditional Use Permit 91-003 subject to the following conditions: C.U.P.91-003 April 9, 1991 Page 3 . 1. FINDINGS AND MOTIONS Approval If the Planning Commission intends to take action to approve this project, the Commission should move to approve and me the Negative Declaration and find that the project will not have a significant effect on the environment and direct staff to prepare the appropriate resolution incorporating the specific findings and conditions of approval set forth in the staff report, or as modified by the Commission, Denial . If the Planning Commission intends to take action to deny this project, the Commission should move to deny and direct staff to prepare an appropriate resolution incorporating the Commission's decision and findings in support of that decision. .
