RESOLUTION 1458 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, GRANTING CONDmONAL USE PERMIT 91-002 FOR A MARTIAL ARTS INSTRUCTION STUDIO AT 142 EAST DUARTE ROAD. WHEREAS, on February 21, 1991, an application was filed by Les Connard for a Conditional Use Permit to operate a 2,325 square foot martial arts instruction studio, Planning Department Case No. c.u.P. 91-002, on property commonly known as 142 East Duarte Road, more particularly described as follows: Lots 1, 2, and 3 of Parcel Map No. 2114, in the City of Arcadia, County of Los Angeles, State of California, as per Map recorded in Book 32, Page 81 of Parcel Maps, in the Office of said County Recorder. WHEREAS, a public hearing was held on March 26, 1991, at which time all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: ::;~ Section 1. That the factual data submitted by the Planning Department in the attached report is true and correct Section 2. This Commission finds: 1. That the granting of such Conditional Use Permit will not be detrimental to the public health or welfare, or injurious to the property or improvements in such zone or vicinity. 2. That the use applied for at the location indicated is a proper use for which a Conditional Use Permit is authorized. 3. That the site for the proposed use is adequate in size and shape to accommodate said use. All yards, spaces, walls, fences, parking, loading, landscaping and other features are adequate to adjust said use with the land and uses in the neighborhood. 4. That the site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. 5. That the granting of such Conditional Use Permit will not adversely affect the comprehensive General Plan. , 1~ 1 . . . 6. That tile"use applied for will not have a substantial adverse impact on the environment. Section 3. That for the foregoing reasons this Commission grants a Conditional Use Permit for a martial arts instruction studio upon the following conditions: 1. That fire safety shall be provided to the satisfaction of the Arcadia Fire Department. 2 That the hours of operation shall be limited to 4 p.m. to 9 p.m. during the weekdays, and 10 a.m. to 1 p.m. on Saturdays. 3. That the total number of employees shall not exceed two (2) individuals. 4. That the instructional area shall not exceed 1,580 square feet, as shown on the proposed floor plan. 5. That the maximum number of students to occupy the subject studio at any one time shall not exceed thirty-five (35). 6. A modification be granted for 109 on-site parking spaces in lieu of 212; and that this approval shall not constitute an approval for the general reduction in parking for the total site. That this parking modification shall only be for the use approved by C.U.P. 9.1-002 ( a martial arts instruction studio). 7. That c.u.P. 91-002 shall not take effect until the owner and applicant have executed a form available at the Planning Department indicating awareness and acceptance of the conditions of approval. 8. Noncompliance with the provisions and conditions of this Conditional Use Permit shall constitute grounds for its immediate suspension or revocation. 9. There shall be a minimum of twenty (20) minutes between classes. 10, That the rear door to the studio shall be restricted to the use of employees and it shall be closed during business hours. Section 4. The decision, findings and conditions contained in this Resolution reflect the COnunission's action of March 26, 1991 and the following vote: A YES: Commissioners Amato, Clark, Szany, Papay NOES: Hedlund ABSENT: None 2 1458 .' . . NICHOLSON, ASSOCIATE PLANNER CONDmONAL USE PERMIT 91-002 CASE NO.: SUMMARY This application was filed by Les Connard to request a, conditional use permit for a proposed martial arts instruction studio at 142 East Duarte Road. The Planning Department is recommending approval of the applicant's request subject to the conditions outlined in this report. GENERAL INFORMATION APPUCANT: Les Connard LOCATION: 142 East Duarte Road ~ REQUEST: A Conditional Use Permit for a proposed martial arts instruction studio to be located within an existing shopping center, and a parking modification to permit 109 on-site spaces in lieu of 212 spaces required for the shopping center with the proposed studio (Sec. 9269.5). LOT AREA: Approximately 89,300 square feet (2.05 acres) FRONTAGE: 80 feet on Second Avenue and 399 feet on Duarte Road EXISTING LAND USE &: ZONING: The site is currently developed with the Alpha Beta shopping center, and its zoning is C-l &: D. SURROUNDING LAND USE &: ZONING: North A commercial retail center and strip commercial businesses; zoned C-2 &: D and C-2 respectively. Single-family dwellings; zoned R-l. Financial institution and duplex units; zoned C-l and R-2 respectively. Eating establishment; zoned R-l. . South: East: West: GENERAL PLAN DESIGNATION: . The subject site is designated as Commercial. PROPOSAL AND ANALYSIS Schools/instructional studios are permitted uses in the C-l zone with an approved conditional use permit. The applicant is seeking a conditional use permit to operate a martial arts instruction studio. He has advised staff that the hours of operation will be from 4 p.m. to 9 p,m. during the weekdays, and 10 a.m. to 1 p.m. on Saturdays, There will be no more than two employees; and the maximum number of students, at anyone time, would not exceed thirty-five. The proposed studio would occupy 2,325 square feet of retail space within a 32,750 square foot retail shopping center which fronts on Duarte Road, as shown on the attached site plan. The retail space for the studio is currently vacant and was previously occupied by a liquor Mart store. - A total of 109 on-site parking spaces exist on the site, Under current zoning regulations the shopping center would need 186 parking spaces, and with the proposed studio 212 parking spaces would be required. The following is a breakdown of the current parking requirements for the shopping'center with the proposed studio; Existing eating establishments: Lucky's Donuts and the Tereyaki House at 20 parking spaces per 1,000 sq. fl (1,485 sq. fl) Existing retail uses: Alpha Beta, Boulevard Oeaners, Mail Boxes, 1 hour Photo, Material Pleasures- fabric arts, O.J.'s, Front Page Fashions, Hair lines and Movie Video at 5 parking spaces per 1,000 sq. ft. (28,940 sq. ft.) Proposed use: Martial arts instruction studio (2,325 sq. ft.) 29.7 spaces 144.7 spaces 37.2 spaces 211.6 spaces . In this particular case the square footage of the proposed "instructional area" C.U.P.91-002 March 26, 1991 Page 2 . determines the required number of on-site parking spaces for the studio. Within the proposed 2,325 square foot martial arts studio there would be an instructional area of approximately 1,580 square feet, which requires 46 parking spaces (1 space per 35 ,square feet of instructional area), However, the existing on-site parking ratio of 1 space per 300 square feet for retail as compared to 46 required spaces results in a net parking space requirement of 38 parking spaces for the studio. Prior to the construction of the shopping center in 1966, a design overlay (Resolution No, 3726) was adopted for the site which requires only 112 parking spaces for the shopping center. One reason for the discrepancy between the existing 109 parking spaces and the 112 spaces required by the design overlay would be the restriping to accommodate required parking for the handicapped. - It is staff's opinion that the current parking requirement of 212 spaces for the site (including the studio) is misleading, because the existing eating establishments within the shopping center are not intense uses, as may be indicated by the current parking requirements. Each eating establishment was approved under a conditional use permit and has limited seating for patrons, as a condition of approval, to insure that the parking demand for such establishments would be similar to that of a general retail business. Also, the applicant recently made thirteen random vehicle counts (survey attached) to determine the availability of on-site parking for his business. The applicant's vehicle counts denote an average of 38 available spaces. Staff has made random vehicle counts on the site, and concurs with the applicant's parking survey. Staffs believes that the subject site provides adequate parking for the proposed martial arts studio, provided that the studio be limited to the proposed hours of operation, number of employees, instructional area and the noted maximum number of students at anyone time. Pursuant to the provisions of the California Environmental Quality Act, the Planning Department has prepared an initial study for the proposed project. Said initial study did not disclose any substantial or potentially substantial adverse change in any of the physical conditions within the area affected by the project including land, air, water, minerals, flora, fauna, ambient noise and objects of historical or aesthetic significance. There is no evidence that the proposed project will have any potential for an adverse effect on wildlife resources. Therefore, a Negative Declaration has been prepared for this project. RECOMMENDATION The Planning Department recommends approval of Conditional Use Permit 91-002 subject to the following conditions: . C.U.P.91-002 March 26, 1991 Page 3 . 1. FINDINGS AND MOTIONS Approval If the Planning Commission intends to take action to approve this project, the Commission should move to approve and file the Negative Declaration and find that the project will not have a significant effect on the environment and direct staff to prepare the appropriate resolution incorporating the specific findings and conditions of approval set forth in the staff report, or as modified by the Commission, Denial If the Planning Commission intends to take action to deny this project, the Commission should move to deny and direct staff to prepare an appropriate resolution incorporating the Commission's decision and findings in support of that decision. .
