RESOLUTION 1457 A RESOLUTION OF lliE PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, GRANTING CONDITIONAL USE PERMIT NO, CUP 90-019 FOR A NEW 39,800 SQUARE FOOT, 24 HOUR SUPERMARKET WIlli LIQUOR SALES FOR OFF-SITE CONSUMPTION AT 16 EAST LIVE OAK AVENUE. WHEREAS, on December 10, 1990, an application was filed by Lang Lampert Architects on behalf of Ralphs Grocery Company to build a new 39,800 square foot, 24 hour supermarket with liquor sales for off-site consumption, Planning Depart- ment Case No. CUP 90-019, on property commonly known as 16 East Live Oak Avenue, more particularly described as follows: Lots 1 to 5 inclusive of Tract 11539 in the City of Arcadia, County of Los Angeles, State of California, and recorded in map book 255, page 35 in the offices of the County Recorder of said County. WHEREAS, a public hearing was held on January 8, 1991, at which time all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: SECTION 1. That the factual data submitted by the Planning Department in the attached report is true and correct. SECTION 2. This Commission finds: 1. That the granting of such Conditional Use Permit will not be detrimental to the public health or welfare, or injurious to the property or improvements in such zone or vicinity. 2. That the use applied for at the location indicated is properly one for which a Conditional Use Permit is authorized. 3. That the site. for the proposed use is adequate in size and shape to accom- modate said use, and all yards, spaces, walls, fences, parking, loading, landscaping and other features are adequate to adjust said use with the land and uses in the neighborhood. 4. That the site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. . . . 5. That the granting of such Conditional Use Permit will not adversely affect the comprehensive General Plan. 6. That the use applied for will not have a substantial adverse impact on the environment, and, that there is no evidence that the proposed project will have any potential for adverse effect on wildlife resources. SECTION 3. That for the foregoing reasons this Commission grants a Condi- tional Use Permit for a new 39,800 square foot, 24 hour supermarket with liquor sales for off-site consumption upon the following conditions: 1. That the conditions outlined in the report from the Department of Public Works be complied with to the satisfaction of the Director of Public Works. 2. That delivery and pick-up activities be prohibited between the hours of 9:00 p.m. to 7:00 a.m., and, that mechanical parking lot sweeping be conducted between the hours of 7:00 a.m. to 10:00 p.m. 3. That landscaping be provided between the parking lot and the south wall of the new buildin~ that the 5' wide landscape buffer be extended northward along the east property line where it is adjacent to residentially zoned property, that the pedestrian access at the southeast corner of the property be maintained, and, that a detailed landscaping and irrigation plan be submitted for review and be subject to approval by the Planning Department. 4. That the loading area be redesigned to accommodate clear two-way (20' wide) through traffic from the alley. 5. That pick-up of discarded/ donation items shall not be permitted, and, any other recycling activities shall be conducted at a minimum distance of 50 feet from any residentially zoned property. 6. Thatfire protection, water supply, and building occupancy shall be provided and maintained to the satisfaction of the Arcadia Fire Department. Such shall include, but not be limited to, a central station fire alarm system per NFPA standard nos, 71 &: 72E; a sprinkler system with central station supervision per NFPA 71; and a third exit. Plans for these and any other installations (such as secu- rity bars) shall be submitted to the City Fire Department for review and approval prior to installation. 7. That the subject site be maintained according to the plans filed with the Planning Department for CUP 90-019, and that all of the conditions of approval shall be complied with prior to occupancy. -2- 1457 . . . 8. That CUP 90-019 shall not take effect until the property owner and appli- cant have executed and returned to the Planning Department an Acceptance Form available from the Planning Department to indicate awareness and acceptance of the conditions of approval. 9. That noncompliance with the provisions and conditions of CUP 90-019 shall constitute grounds for its immediate suspension or revocation. SECTION 4, The decision, findings and conditions contained in this Resolu- tion reflect the COmmission's action of January 8, 1991 and the following vote: AYES: Amato, Oark, Hedlund and Szany NOES: None ABSENT: Papay SECTION 5. The Secretary shall certify to the adoption of this Resolution and shall cause a copy to be forwarded to the City Council of the City of Arcadia. Live Oak Avenue SUMMARY This application was filed by Lang Lampert Architects on behalf of Ralphs Grocery Co. for a new supermarket at 16 E. Live Oak Avenue. The Planning Department is recommending approval subject to the conditions listed in this report. GENERAL INFORMATION APPLICANT: Lang Lampert Architects for Ralphs Grocery Co. LOCATION: 16 E. Live Oak Avenue REQUEST: A Conditional Use Permit and Modifications for a 24 hour, 39,800 sq. ft. supermarket with liquor sales for off-site consumption. SITE AREA: Approximately 110,729 square feet (2.542 acres) FRONTAGES: 367 feet along E. Live Oak Avenue 280 feet along S, Santa Anita Avenue EXISTING LAND USE & ZONING: 26,300 sq. ft. retail building with 170 parking spaces, The zoning is C-2 (General Commercial) SURROUNDING LAND USES & ZONING: North: Gas station, coffee shop, and offices, zoned C-l & C-O South: Single family residences in Los Angeles County E a s t: Strip commercial shops, zoned C-2 West: Garden and patio furniture shop in Temple City GENERAL PLAN DESIGNATION: C - Commercial . . . PROPOSAL AND ANALYSIS The proposal is to construct a new 39,800 square foot supermarket. 75% of the building will be devoted to sales, and 25% will be for warehousing. The new store will be situated similar to the existing building and the parking lot will be redesigned. This store will be open 24 hours and will be selling liquor for off- premise consumption. There are two aspects of the new store that require a Conditional Use Permit: 1. The building will contain more than 20,000 sq. ft. and will be located within 100 feet of residentially zoned property (9263.6.7) 2. It will be a walk-in retail business selling liquor for off-premise consumption that will be open more than 16 hours per day or open between midnight and 6:00 a.m., and will be located less than 150 feet from residentially zoned property (9263.1.2,9275.1.53.6 & 9275.1.53.7) The new building will be situated in the northeast comer of the property. The Conditional Use Permit is required to provide for the Planning Commission's review and determination that the use can be harmoniously adjusted to the surrounding land uses and the community. A letter from the owner of 11103 Lynrose Street is attached. The closest point to a residentially zoned property will be the rear loading area, It will be a distance of approximately 40 feet from the rear property line of the nearest residential lot. This is similar to the existing condition. The proximity may result in nearby residents being disturbed by the sounds of delivery and pick-up activities if conducted at late evening or early morning hours. The existing store limits deliveries by independent vendors to the hours of 7:00 a,m. to noon. Ralphs strives to limit deliveries from its own warehouses to this store to the hours of 7:00 a.m. to 9:00 p.m. and according to the store manager, all delivery activity is usually completed by 6:00 p.m. This voluntary schedule should adequately resolve the potential delivery and pick-up problems. The Municipal Code limits commercial refuse collection to 7:00 a.m, to 5:00 p,m. (5120.9) and requires that all permanent and temporary storage of wares, mer- chandise, crates, bottles, pallets, racks, etc, be stored within the building (9263.6.5) The public entry/exit from the new store will be from the west side of the build- ing.The problems that sometimes arise from late hour liquor sales for off- premise consumption are rarely associated with large supermarkets, and, the proposal does not readily facilitate direct access between the new store and the adjacent residential neighborhoods. The proposed parking lot will be illumi- nated and readily visible from the adjacent streets. Conditional Use Permit No. 90-019 January 8, 1991 Page 2 . . . There are four Modifications requested for this proposal: A. A zero rear (east side) setback in lieu of 20 feet (9263.2.4.a) B. A total of 173 parking spaces in lieu of 199 spaces (9263.3,9263.3.1 & 9269.5) C Two loading zones in lieu of four (9269.10) D. Elimination of the 6' high masonry wall along the southerly and easterly property lines where the parking lot is within 20' of residentially zoned property (9263.5 & 9269.13.A) By definition, the rear of the subject property is the easterly side of the property, It is adjacent to an existing commercial building that fronts Live Oak Avenue and the Code requires a 20 foot setback from this rear property line. However, a setback from this property line would not be of any use to either the proposed building nor to the adjacent commercial building. And, if by definition this east- erly property line were the side of the lot, no setback would be required. There are approximately 170 parking spaces serving the existing 26,300 sq. ft. store (6.5 spaces per 1,000 sq. ft.) The plans for the new 39,800 sq. ft. store include a redesign of the parking area that will provide 173 parking spaces and landscaping that exceeds Code requirements. The proposed ratio is 4.35 spaces per 1,000 sq. ft. and the Code requires 5 spaces per 1,000 sq. ft. (199 spaces) The existing 170 park- ing spaces have been more than adequate for the existing store and the applicant feels that a similar amount of parking will adequately serve the new store. The proposed loading area is 27' x 35', It consists of a 20' x 35' loading dock with a 7' wide ramp along its westerly side. The Code requires one 10' x 25' loading space for each 10,000 gross sq. ft. of building (Le. 4 loading spaces) Based on their experience, the applicant feels that the proposed two spaces with the ramp is adequate for the proposed store. The two spaces will be used by the large semi- trailer trucks and the ramp will be used by the independent vendors. The proposed loading area will partially obstruct the end of the 20' wide alley. At present the alley is used in conjunction with the store's parking lot as a through way between Santa Anita and Myrtus Avenues. Staff suggests that either the loading area be redesigned to maintain dear two-way (20' wide) accessibility through the alley or that it be completely closed to through vehicular traffic. Along the southerly and easterly property lines that are adjacent to residentially zoned property, there exists a 6' high masonry wall, and, at the southeast corner there is a pedestrian walkway. The applicant wishes to avoid the duplicity of placing a new wall immediately adjacent to the existing walls. The 5' wide landscape buffer will be provided along the entire length of the adjacent residentially zoned properties and the pedestrian walkway will be maintained. Conditional Use Permit No. 9()'()19 January 8,1991 Page 3 . . . Pursuant to the provisions of the California Environmental Quality Act, the Planning Department has prepared an initial study for the proposed project. Said initial study did not disclose any substantial or potentially substantial adverse change in any of the physical conditions within the area affected by the project, including land, air, water, minerals, flora, fauna, ambient noise and objects of historical or aesthetic significance. Therefore, a Negative Declaration has been prepared for this project. ARClflTECTURAL DESIGN REVIEW Concurrent with the consideration of this Conditional Use Permit and Modifica- tion application, the Planning Commission is to review the architectural design and may approve, conditionally approve or disapprove the applicant's plans. The new store will be highlighted by a columned walkway and pediment porti- coes with green metallic trellises accenting the west (front) side. The columns will be tan with light brown bases and capitals. The walls will be finished in an off white plaster and the roof will be of a brown concrete tile. The north (Live Oak) side will have pilasters and beltcourses to emulate the front walkway cover and will be accented by light green and blue ceramic tile work. The south (rear) and east (adjacent to an existing building) sides will be accented by beltcourses and a cornice. Originally the columned walkway extended along the south side of the building. Since there are no entrances on that side of the building, that cover has been eliminated. However, the landscape plan does not take that into account, and therefore, landscaping needs to be added along the south side of the building. Staff finds that the applicant's proposal meets the intent of the City's architec- tural criteria and is consistent with surrounding developments. RECOMMENDATION The Planning Department recommends approval of Conditional Use Permit No. 90-019 subject to the following conditions: 1. That the conditions outlined in the attached report from the Department of Public Works be complied with to the satisfaction of the Director of Public Works, Conditional Use Permit No. 90-019 January 8, 1991 Page 4 . . . 2. That either the loading area be redesigned to clearly accommodate two-way through traffic or that the alley be closed to through traffic. 5. Plans for these and any other installations (such as security bars) shall be submitted to the City Fire Department for review and approval prior to installation. 6. That the subject site be maintained according to the plans filed with the Planning Department for CUP 90-019, and that all of the conditions of approval shall be complied with prior to occupancy. 7. That CUP 90-019 shall not take effect until the property owner arid applicant have executed the Acceptance Form available at the Planning Department to indicate their awareness and acceptance of the conditions of approval. 8. That noncompliance with the provisions and conditions of CUP 90-019 shall constitute grounds for its immediate suspension or revocation, FINDINGS AND MOTIONS Approval If the Planning Commission intends to approve this project, the Commission should move to approve and file the Negative Declaration and find that the project will not have a significant effect on the environment and direct staff to prepare the appropriate resolution incorporating the Commission's decision, specific findings and conditions of approval as set forth in the staff report, or as modified by the Commission.
