RESOLUTION 1456 A RESOLUTION OF TIlE PLANNING COMMISSION OF TIiE CITY OF ARCADIA, CALIFORNIA, GRANTING CONDmONAL USE PERMIT 90-018 FOR A MARTIAL ARTS INSTRUCTION STUDIO AT 616 EAST LIVE OAK AVENUE. WHEREAS, on November 13, 1990, an application was filed by Paul De Thouars for a Conditional Use Permit to operate a 995 square foot martial arts instruction studio, Planning Department Case No. C.U.P. 90-018, on property commonly known as 616 East Live Oak Avenue, more particularly described as follows: Lots 3, 4, 5 and 6 of Tract 15233 in the City of Arcadia, County of Los Angeles, State of California, as per Map recorded in Book 332, Pages 29 and 30 of Maps, in the office of said County Recorder. WHEREAS, a public hearing was held on December 11, 1990, at which time all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, TIiE PLANNING COMMISSION OF TIiE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: Section 1. That the factual data submitted by the Planning Department in the attached report is true and correct. Section 2. This Commission finds: 1. That the granting of such Conditional Use Permit will not be detrimental to the public health or welfare, or injurious to the property or improvements in such zone or vicinity. 2. That the use applied for at the location indicated is a proper use for which a Conditional Use Permit is authorized. 3. That the site for the proposed use is adequate in size and shape to accommodate said use. All yards, spaces, walls, fences, parking, loading, landscaping and other features are adequate to adjust said use with the land and uses in the neighborhood. 4. That the site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. 1456 1 . . . 5. That the granting of such Conditional Use Permit will not adversely affect the comprehensive General Plan. 6. That the use applied for will not have a substantial adverse impact on the environment. Section 3. That for the foregoing reasons this Commission grants a Conditional Use Permit for a martial arts instruction studio upon the following conditions: 1. That fire safety shall be provided to the satisfaction of the Arcadia Fire Department. 2. That the hours of operation shall be limited to 10 a;m. to 12 noon and 7 p.m. to 9 p.m. during the weekdays, and 8 a.m. to 1 p.m. on Saturdays. 3. That the total number of employees shall not exceed two (2) individuals. 4. That the instructional area shall not exceed 600 square feet, as shown on the proposed floor plan. 5. That on the weekdays the maximum number of students to occupy the subject studio at anyone time shall not exceed ten (10) during the morning hours of operation and thirty (30) students in the evening hours. Also, on Saturdays the maximum number of students shall not exceed thirty (30). 6. A modification be granted for 58 on-site parking spaces in lieu of 71; and that this approval shall not constitute 'an approval for the general reduction in parking for the total site. That this parking modification shall only be for the use approved by C.U.P. 90-018 ( a martial arts instruction studio). 7. That C.U.P. 90-018 shall not take effect until the owner and applicant have executed a form available at the Planning Department indicating awareness and acceptance of the conditions of approval. 8. Noncompliance with the provisions and conditions of this Conditional Use Permit shall constitute grounds for its immediate suspension or revocation. Section 4. The decision, findings and conditions contained in this Resolution reflect the Commission's action of December 11, 1990 and the following vote: AYES: Commissioners Amato, Clark, Hedlund, Papay NOES: None ABSENT: Szany 2 1456 e e . NICHOLSON, ASSOCIATE PLANNER CONDmONAL USE PERMIT 90-018 FROM: CASE NO.: SUMMARY This application was filed by Paul De Thouars to request a conditional use permit for a proposed martial arts instruction studio at 616 East Live Oak Avenue. The Planning Department is recommending approval of the applicant's request subject to the conditions outlined in this report. GENERAL INFORMATION APPLICANTS: Paul De Thouars LOCATION: 616 East Live Oak Avenue e A Conditional Use Permit for a proposed martial arts instruction studio, and a parking modification to permit 58 on-site spaces in lieu of 71 spaces required for the proposed studio (Sec. 9269.5). LOT AREA: 30,730 square feet (0.71 acres) REQUEST: FRONTAGE: Approximately 204 feet on Live Oak Avenue Approximately 132 feet on Hempstead Avenue EXISTING LAND USE & ZONING: The site is developed with a retail shopping center, and is zoned C-2. SURROUNDING LAND USE & ZONING: North: A church and mixed commercial uses: zoned C-2. South: Singly-family residences which are located within the Los Angeles County area. East: Arcadia Mounted Police facility; unzoned area. West: Mixed commercial; zoned C-2. . GENERAL PLAN DESIGNATION: , Commercial PROPOSAL AND ANALYSIS Schools/instructional studios are permitted uses in the C-2 zone with an approved conditional use permit. The applicant is seeking a conditional use permit to operate a martial arts instruction studio. He has advised staff that the hours of operation will be from 10 a.m. to 12 noon and 7 p.m. to 9 p.m. during the weekdays, and 8 a,m. to 1 p.m. on Saturdays. There will be no more than two employees; and on the weekdays the maximum number of students would not exceed ten during the morning hours of operation and thirty students in the evening hours. Also, there could be a maximum of thirty students on Saturdays. The proposed studio would occupy 995 square feet of retail space within a 9,539 square foot retail shopping center which fronts on East Live Oak Avenue, as shown on the attached site plan. e On-site parking is located in the front and to the rear of the subject building. A total of 58 on-site parking spaces exist on the site, which meets the current on-site parking requirements for the shopping center (i,e., 5 spaces per 1,000 square feet for retail and 10 spaces per 1,000 square feet for a previously approved 1,990 square foot restaurant use per c.u.P. 89-018). In this particular case the square footage of the proposed "instructional area" determines the required number of on-site parking spaces for the studio. Within the proposed 995 square foot martial arts studio there would be an instructional area of approximately 600 square feet, which requires 18 parking spaces. Said spaces result in a net increase of an additional 13 parking spaces for the site. This increase is due to the difference in the parking standards (i.e., 5 required spaces based on 5 spaces per 1,000 square feet for retail as compared to 18 required spaces based on 1 space per 35 square feet of instructional area). With the addition of the proposed martial arts studio, 71 on-site parking spaces are required for the site. It is staffs opinion that the subject site provides adequate parking for the proposed martial arts studio, provided that the studio be limited to the proposed hours of operation, number of employees, instructional area and the noted maximum number of students at anyone time. - Pursuant to the provisions of the California Environmental Quality Act, the Planning Department has prepared an initial study for the proposed project. Said c.u.P. 90-018 12/11/90 Page 2 , initial study did not disclose any substantial or potentially substantial adverse change in any of the physical conditions within the area affected by the project including land, air, water, minerals, flora, fauna, ambient noise, and objects of historical or aesthetic significance. Therefore, a Negative Declaration has been prepared for the project. RECOMMENDA nON The Planning Department recommends approval of Conditional Use Permit 90-018 subject to the following conditions: 1.
