RESOLUTION 1455 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, RECOMMENDING APPROVAL OF AMENDING THE GENERAL PLAN LAND USE DESIGNATION FOR THE PROPERTIES AT 44-50 FOREST AVENUE, 612-620 NORTH FIRST AVENUE AND 701-805 NORTH FIRST AVENUE FROM SINGLE-FAMILY RESIDENTIAL (0-6 DWELLING UNITS PER ACRE) TO MULTIPLE-FAMILY RESIDENTIAL (7+ DWELLING UNITS PER ACRE). WHEREAS, on October 8, 1990, an application was filed by John E. Plount to consider changing the Arcadia General Plan Land Use Designation from Single- family Residential (0-6 dwelling units per acre) to Multiple-family Residential (7+ dwelling units per acre) for the property at 701 North First Avenue. The Planning Department included in this application (Case No. G.P. 90-001) the consideration of other R-2 zoned properties within the subject area, as to provide for greater consistency between the General Plan and the existing zoning of the properties. Said properties are commonly known as 44-50 Forest Avenue, 612-620 North First Avenue and 701-805 North First Avenue, more particularly described as follows: See attached Exhibit "A". WHEREAS, on November 27, 1990, a public hearing was held on said matter at which time all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOL YES AS FOLLOWS: Section 1. That the factual data submitted by the Planning Department in the attached report is true and correct. Section 2. That the Planning Commission finds that said change in the General Plan Land Use Designation would bring the current zoning and General Plan into consistency without inhibiting the existing development of the subject properties and that the public convenience, necessity, general welfare and good plann'ing practice justify this amendment. 1430 1 . . . Section 3. The Planning Commission recommends to the City Council that the General Plan Designation should be changed from Single-family Residential (0-6 dwelling units per acre) to Multiple-family Residential (7+ dwelling units per acre) for the properties at 44-50 Forest Avenue, 612-620 North First Avenue and 701-805 North First Avenue (See attached Exhibit "B"). Section 4. The decision and findings contained in this Resolution reflect the Commission's action of November 27, 1990 and the following vote: A YES: Commissioners Amato, Clark, Hedlund, Szany, Papay NOES: None ABSENT: None Section 5. The Secretary shall certify to the adoption of this Resolution and shall cause a copy to be forwarded to the City Council of the City of Arcadia. NICHOLSON, ASSOCIATE PLANNER CASE NO.: G. P. 90-001 SUMMARY This application was filed by John E. Plount to amend the Arcadia General Plan Land Use Designation of 701 North First Avenue from Single-family Residential (0- 6 dwelling units per acre) to Multiple-family Residential (7+ dwelling units per acre). The Planning Department has also induded other properties within the area which should be considered for change so as to provide for consistency between the General Plan and the existing zoning of the properties. The Planning Department is recommending approval of the proposed amendment to the General Plan, and will convey the Commission's recommendation to the City Council. GENERAL INFORMATION APPLICANT: John E. Plount (owner/developer of the site) and the City of Arcadia LOCATION: 44-50 Forest Avenue, 612-620 North First Avenue and 701-805 North First Avenue REQUEST: To amend the Arcadia General Plan Land Use Designation of the subject properties from Single-family Residential (0-6 dwelling units per acre) to Multiple-family Residential (7+ dwelling units per acre). LOT AREA: Approximately 130,680 square feet (3 acres) FRONTAGE: 368.40 feet on Forest Avenue and 702.57 feet on First Avenue EXISTING LAND USE & ZONING: The subject properties are developed with single-family dwellings, multiple- family units and a Church, as shown on the attached Land Use & Zoning Map. All of the subject properties are zoned R-2. ...~ . . . SURROUNDING LAND USE & ZONING: North South: East: West: Single-family dwellings; zoned R~l & R-2 Foothill Freeway Mixed residential; zoned R-1 & R~2 Foothill Freeway GENERAL PLAN DESIGNATION: Single-family Residential, 0-6 dwelling units per acre HISTORY On December 7, 1971, the City Council directed the Planning Department to initiate zone change proceedings (Z-72-2) for the consideration of changing the R-2 and R-3 zoned properties along First Avenue to a R-1 zone. These proceedings included the properties at 612-620 and 701-805 North First Avenue, and the vacant parcel to the south of 701 North First Avenue (see attached Exhibit "A"). On February 22, 1972, the Planning Commission adopted Resolution No. 766 which recommended to the City Council that the properties fronting on the east and west sides of First Avenue, between Foothill Boulevard and the Foothill Freeway, presently zoned R-2 should remain as R-2 and the properties zoned R-3 be rezoned to R-2. The Commission in its findings determined that the location, size and configuration of most of the parcels were not ideal for R-1 or R-3 development, and that R-2 development would be more suitable. The Commission also noted that the R-2 zone permits single-family dwellings as well as multiple-family dwellings which would avoid creating any nonconforming uses. On May 16, 1972, the Oty Council adopted Ordinance No. 1451 which rezoned the properties R-2. On January 9, 1973, the Planning Department initiate zone change proceedings (Z- 72-10) for the consideration of rezoning the R-1 properties lying southwest of Forest Avenue and First Avenue (i.e., 44-48 Forest Avenue and the landlocked parcels adjacent to the Foothill Freeway per the attached Exhibit "B") to a R-2 zone. On January 23, 1973, the Planning Commission adopted Resolution No. 802 which recommended to the City Council that the above mentioned properties be rezoned to R-2. The Commission in its findings determined that the proposed change would provide uniform zoning in the area. On April 3, 1973, The City Council adopted Ordinance No. 1473 which rezoned the properties R-2. On July 6, 1982, the City Council directed the Planning Department to initiate General Plan change proceedings (G.P. 82-1) for the consideration of amending the Arcadia General Plan Land Use Designation of 702-1012 North First Avenue and, 105 Haven Avenue from Single-family Residential (0-6 dwelling units per acre) to Multiple-family Residential (7+ dwelling units per acre), as shown on attached G.P. 90-001 November 27, 1990 Page 2 . . . Exhibit "C". The lots on the west side of First Avenue were not included in this General Plan change because the lots were much smaller and predominantly developed with single-family dwellings. On August 24,1982, the Planning Commission adopted Resolution No. 1206 which recommended to the City Council the aforementioned change. The Commission in its findings determined that the proposed change in the General Plan would provide for consistency with current zoning and that the public convenient, necessity, general welfare and good planning practice justify the amendment. On September 21, 1982, the City Council adopted Resolution No. 5069 which redesignated the properties as Multiple-family Residential (7+ dwelling units/acre). ANALYSIS Presently, the subject area can be developed with apartment complexes. However, the applicant, John E. Plount, would like to develop a two-unit condominium project on 701 North First Avenue. In order to develop condominiums, the State Subdivision Map Act requires that a subdivision be consistent with the City's General Plan. The City has included in this application the consideration of other R-2 zoned properties to provide for greater consistency between the General Plan and the existing zoning of the properties. Staff feels that the proposed change in the General Plan from Single-family Residential (~ du/ac) to Multiple-family Residential (7+du/ac) would be consistent with good planning practice because: 1) it would bring the curren.t zoning and General Plan into consistency without inhibiting the existing development of the subject properties; and 2) it will encourage a more appropriate transitional land use of multiple-family development adjacent to the Foothill Freeway. Changing the General Plan designation will not permit any development to take place which is not consistent with the existing zoning of the properties. Pursuant to the provisions of the California Environmental Quality Act, the Planning Department has prepared an initial study for the proposed project. Said initial study did not disclose any substantial or potentially substantial adverse change in any of the physical conditions within the area affected by the project including land, air, water, minerals, flora, fauna, ambient noise and objects of historiclll or aesthetic significance. Therefore, a Negative Declaration has been prepared for this project. Before the Planning Commission or the City Council take action on this project, they should "move to approve and me the Negative Declaration and find that the project will not have a significant effect on the environment". The Planning Commission should direct staff to prepare a resolution setting forth the Commission's findings and recommendations to the City Council for adoption at the Commission's next meeting of December 11, 1990.
