RESOLUTION 1454
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF ARCADIA, CALIFORNIA, GRANTING VARIANCE NO. V 90-003
FOR A SIXTY (60) FOOT HIGH MONOPOLE ANTENNAE SUPPORT
AT AN UNMANNED CELLULAR TELEPHONE EQUIPMENT
FACILITY AT 206 E. LIVE OAK AVENUE.
WHEREAS, on October 26, 1990, an application was filed by Jerome
Buckmelter Associates, Inc. on behalf of Los Angeles Cellular Telephone Company
to erect a sixty (60) foot high monopole antennae support in conjunction with an
unmanned cellular telephone equipment facil~ty, Planning Department Case
No. V 90-003, at the property commonly known as 206 E. Live Oak Avenue, more
particularly described on the attached Exhibit nAn.
WHEREAS, a public hearing was held on November 27, 1990, at which time
all interested persons were given full opportunity to be heard and to present
evidence;
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
ARCADIA HEREBY RESOLVES AS FOLLOWS:
SECTION 1. That the factual data submitted by the Planning Department in
the attached report is true and correct.
SECTION 2. This Commission finds:
1. That there are exceptional or extraordinary circumstances or conditions
applicable to the property involved, or to the intended use of the property, that do
not apply generally to the property or class of use in the same zone or vicinity.
2. That the granting of such variance will not be materially detrimental to
the public health or welfare or injurious to the property or improvements in such
zone or vicinity.
3. That such variance is necessary for the preservation and enjoyment of a
substantial property right of the applicant possessed by other properties in the same
zone and vicinity. .
4. That the granting of such variance will not adversely affect the
comprehensive General Plan.

SECTION 3. That for the foregoing reasons this Commission grants a Zone
Variance for a sixty (60) foot high monopole antennae support in conjunction with
an unmanned cellular telephone equipment facility upon the following conditions:
1. That Variance No. 90-003 be limited to the one monopole with one grid of
antennae. Microwave equipment is not to be a part of this facility under this
Variance, nor under Conditional Use Permit No. 90-017.
2. That the design and finish of any improvements or alterations that will be
visible to the public be subject to Architectural Design Review.
3. That a landscaping plan for the area along the south side of the building be
submitted for review and approval by the Planning Department, and that the
landscaping be installed concurrently with the monopole.
4. That solid metal doors be installed on the existing trash enclosure.
5. That any changes in existing water services be installed by the Arcadia
Water Division at the developer's expense.
6. That structural and wind load calculations for the monopole and
antennae be prepared by a licensed structural engineer and provided to the Building
Division prior to issuance of a building permit.
7. That the subject site be maintained according to the plans filed with the
Planning Department for Variance No. 90-003, and that all of the conditions of
approval shall be complied with prior to the installation of the monopole.
8. That Variance No. 90-003 shall not take effect until the property owner and
applicant have executed the Acceptance Form available at the Planning Department
to indicate their awareness and acceptance of the conditions of approval.
SECTION 4. The decision, findings and conditions contained in this
Resolution reflect the Commission's action of November 27, 1990 and the following
vote:
A YES: Amato, Clark, Hedlund, Szany and Papay
NOES: None
ABSENT: None
SECTION 5. The Secretary shall certify to the adoption of this Resolution and
shall cause a copy to be forwarded to the City Council of the City of Arcadia.

Angeles, State of California, as per map recorded in Book 42 Pages 93
and 94 of Miscellaneous Records, in the Office of the County Recorder
of said County, described as follows:
Beginning at the intersection of the Southerly line of Live Oak
Avenue, 100 feet wide, with the Easterly line of Tyler Avenue, 80 feet
wide, a,s said intersection is shown on the Map of Tract No. 13623, as
per map recorded in Book 278 Page 29 of Maps, in the Office of the
County Recorder of said County; thence Easterly along said Southerly

SUMMARY
This application was filed by Los Angeles Cellular Telephone Company to request
a height of sixty (60) feet for a monopole antennae support at an unmanned
cellular telephone facility (ref. CUP 90-017) at 206 E. Live Oak Avenue. The
Planning Department is recommending approval subject to the conditions listed
in this report.

4t BACKGROUND
This Variance application requests a height of sixty (60) feet in lieu of fifty (50)
feet for a monopole antennae support It was filed in conjunction with
Conditional Use Permit No. 90-017 for the unmanned cellular telephone
equipment facility at 206 E. Live Oak Avenue.
The C-2 (General Commercial) zone does not have any provisions for a height of
sixty (60) feet as requested. Rather, it permits a maximum building height of
forty (40) feet and provides for an additional ten (10) feet to accommodate
accessory structural items. A Modification was granted under CUP 90-017 to
permit the monopole to have a maximum height of fifty (50) feet. The
applicant's engineers, however, have indicated that the additional ten (10) feet
may be crucial to this facility.
PROPOSAL AND ANALYSIS
The proposal is to erect a sixty (60) foot high metal pole next to the south side of
the building which will support one grid of antennae. The equipment for the
facility will be inside the southerly space of the existing commercial building.

Because the existing building is only 18 feet tall, a monopole of any significant
height would have some impact upon the appearance of the subject property.
However, existing power poles in the vicinity are approximately 65 to 85 feet
high, and therefore, the requested additional ten (10) feet would not significantly
increase any impact upon the area.
Site Selection
In establishing a cellular telephone network, the location for a new facility is
determined by the amount of cellular telephone activity in the area, and
eventUllllY, new facilities become necessary to maintain an acceptable signal
quality. The applicant has provided the attached exhibit illustrating their other
cellular facilities in the area. The subject facility is number 287.
In selecting a location for this facility, a study was conducted to establish a "search
ring" (shown on the attachment) within which the facility should be situated.
Ideally, the facility would be at the center of this "search ring", however, the
selected location is available and is a substantial distance from residential uses.

. Site Improvements
The uses in this commercial building are a convenience store, take-out and
delivery pizza outlet, and a drycleaner. The subject store front will be screened to
conceal the electronic equipment from public view and be made to look like a
business office.
The monopole antennae support will be located at the south side of the building
and a security fence will be placed around the base of the monopole. The design
and finish of all improvements or alterations that will be visible to the public
should be subject to review and approval by the Planning Department.
While the site has an adequate amount of landscaping, it is not being properly
maintained. A particular concern is the impact upon the landscaping along the
south side of the building where the monopole will be erected. Also, the existing
trash enclosure located in this area is supposed. to be secured by solid metal doors
rather than the wooden doors. The site's landscaping must be properly
maintained and a plan for the area along the south side of the building should be
submitted for review and approval by the Planning Department
.
Environmental Concerns
Electronic facilities have at times been a source of concern because of potential
health hazards and interference with household electronic appliances. While
exposure to large quantities of electromagnetic radiation, can have adverse
health affects, the amount discharged by cellular telephone equipment does not
even warrant governmental monitoring. A further discussion of this issue is
provided by the applicant's response to the Environmental Checklist Form.
The applicant's monopole will be capable of supporting microwave dish
antennae which have been a subject of concern in regard to health affects.
However, the applicant has no present plans to install microwave antennae, and
any sul;h use would be subject to a public hearing to expand the approval granted
by CUi' 90-017, or an entirely new Conditional Use Permit.
Another concern about electronic facilities is the potential for interference with
household appliances such as televisions, radios, regular telephones, computers
etc. The frequency along which cellular telephones transmits is very narrow and
distinct. The applicant is not aware of any cases where cellular telephones have
interfered with other modes of communication.

Pursuant to the provisions of the California Environmental Quality Act, the
Planning Department has prepared an initial study for the proposed project. Said
initial study did not disclose any substantial or potentially substantial adverse
change in any of the physical conditions within the area affected by the project,
including land, air, water, minerals, flora, fauna, ambient noise and objects of
historical or aesthetic significance. Therefore, a Negative Declaration has been
prepared for this project.
RECOMMENDATION
The Planning Department recommends approval of Variance No. 90-003 subject
to the following conditions:
1. That Variance No. 90-003 be limited to the one monopole with one grid of
antennae. Microwave equipment is not to be a part of this facility under
this Variance, nor under Conditional Use Permit No. 90-017.
2. That the design and finish of any improvements or alterations that will be
visible to the public be subject to Architectural Design Review.

Commission.

Commission should move to deny and direct staff to prepare an appropriate
resolution incorporating the Commission's decision and supporting findings.
