HomeMy WebLinkAbout1453 . . . RESOLUTION 1453 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, GRANTING AN APPROVAL OF APPLICATION NO. MP 90-015 TO UTILIZE SMOKED TRANSPARENT GLAZING ON THE EAST SIDE OF THE OFFICE BUILDING AT 800 S. SANTA ANITA AVENUE. WHEREAS, on October 25,1990, an application was filed by the H. N. and Frances Berger Foundation to replace the existing smoked translucent glazing on the east side of an existing multi-story office building with smoked transparent glazing, Planning Department Case No. MP 90-015, at property commonly known as 800 S. Santa Anita Avenue, more particularly described as follows: Lots I, 2, 3, and 4 in Block 2 of Tract No. 101, in the City of Arcadia, County of Los Angeles, State of California, as per map recorded in Book 13, Page 52 in the office of the Los Angeles County Recorder. Except that portion of Lot 1 described as follows: Beginning at the Northwesterly comer of said Lot I, as shown on said map; thence Easterly along the Northerly boundary line of said Lot 1 a distance of 15.00 feet to a point on tangency with a curve concave Southeasterly having a radius of 15.00 feet; thence along said curve through a central angle of 90 Degrees 00' to a point of tangency with the Westerly boundary line of said Lot I, said point of tangency being 15.00 feet Southerly of the Northerly corner of said Lot 1; thence Northerly along said Westerly boundary line a distance of 15.00 feet to the point of beginning. As granted by deed recorded April 18, 1983 as Instrument No. 83-471214 of Official Records. WHEREAS, a public hearing was held on November 13, 1990 by the Planning Commission at which time all interested persons were given full opportunity to be heard and to present evidence; and NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLWWS: SECTION 1. That the factual data submitted by the Planning Department in the attached report is true and correct. SECTION 2. This Commission finds: A. That approval of application no. MP 90-015 will not be detrimental to the . . . public health or welfare, or injurious to the property or improvements in such zone or vicinity: B. That the requested modification will not have an adverse impact on the adjoining properties to the east. C. That the approval of application no. MP 90-015 will secure an appropriate improvement. SECTION 3. That for the foregoing reasons, this Commission grants approval of application no. MP 90-015. SECTION 4. The decision and findings contained in this Resolution reflect the Commission's action of November 13, 1990 and the following vote: A YES: Amato, Clark, Papay, and Szany NOES: None ABSENT: None ABST AIN: Hedlund SECTION 5. The Secretary shall certify to the adoption of this Resolution and shall cause a copy to be forwarded to the City Council of the City of Arcadia. Santa Anita Avenue To utilize smoked transparent glazing to replace existing fixed smoked translucent window areas in the east side of the second and third floors of an existing office building which abuts residentially zoned property (9263.2.6) Approximately 26.400 square feet (0.606 acre) 176 feet along S. Santa Anita Avenue 150 feet along Alice Street EXISTING LAND USE & ZONING: The site is improved with a 3-story medical office building. The zoning is C-2&H. GENERAL PLAN DESIGNATION: MF - Multiple Family (7+ dwellings per acre) SURROUNDING LAND USES & ZONING: North: Fire Department Headquarters, zoned C-2&H South: Distribution Warehouse, zoned C-2&H E a s t: Mixed residential, zoned R-3&H West: Los Angeles County Golf Course, zoned 5-2 . . . BACKGROUND The medical office building was completed in 1987. There are two floors of office space of approximately 10,000 square feet each. Parking is provided on the ground level and in a subterranean structure. The project was granted the following Modifications in 1985: A. 8'-0" setback from Santa Anita Avenue in lieu of 10'-0" for portions of office building (9320.65.15) B. Windows along east elevation facing abutting. residentially zoned property shall be screened with fixed louvers in lieu of translucent windows (9263.2.6) C. 110 parking spaces in lieu of 111 spaces (9269.5) D. 28 compact parking spaces in lieu of 22 compact spaces maximum (9269.5.1) In completing the final plans, dual glazed panels were installed on the second and third floors, and the louvers approved by Request B were deleted. The exterior pane is smoked and the interior pane is frosted to comply with Section 9263.2.6 which reads as follows: 9263.2.6. WINDOW OPENINGS, BALCONIES, DECKS, OPEN STAIRWAYS, ELEVATED W ALI<WA YS. No window openings, balconies, decks, open stairways, or elevated walkways shall be permitted facing abutting residentially zoned property. EXCEPTION. The aforementioned limitation shall not apply to window areas which are located more than six feet six inches (6'-6") above the floor level or to fixed translucent areas. PROPOSAL The proposal is to replace the existing dual smoked/frosted paned ~dows with dual smoked/clear paned windows. This would not alter the exterior appearance of the building, but it will enable the occupants of the building to see out of the windows toward the residences to the east. PLANNING COMMISSION'S FINDINGS Approval If the Planning Commission intends to take action to approve this application, the Commission should find that approval would secure an appropriate improvement, prevent an unreasonable hardship, or promote uniformity of development, and move to approve MP 90-015 subject to any conditions or revisions it deems appropriate, and direct Staff to prepare the appropriate resolution. Denial If the Planning Commission intends to take action.to deny this application, the Commission should find that the proposal would not secure an appropriate improvement, nor prevent an unreasonable hardship, nor promote. uniformity of development, and move to deny MP 90-015, and direct Staff to prepare the appropriate resolution.
