HomeMy WebLinkAbout1451 . . . RESOLUTION 1451 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, GRANTING CONDITIONAL USE PERMIT NO. CUP 90-017 TO ESTABLISH AND OPERATE AN UNMANNED CELLULAR TELEPHONE EQUIPMENT FACILITY AT 206 EAST LIVE OAK AVENUE. WHEREAS, on October 15, 1990, an application was filed by Jerome Buckmelter Associates, Inc. on behalf of Los Angeles Cellular Telephone Company to establish and operate an unmanned cellular telephone equipment facility, Planning Department Case No. CUP 90-017, on property commonly known as 206 East Live Oak Avenue, more particularly described on the attached Exhibit "A". WHEREAS, a public hearing was held on November 13, 1990, at which time all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: SECTION 1. That the factual data submitted by the Planning Department in the attached report is true and correct. SECTION 2. This Commission finds: 1. That the granting of such Coilditional Use Permit will not be detrimental to the public health or welfare, or injurious to the property or improvements in such zone or vicinity. 2. That the use applied for at the location indicated is properly one for which a Conditional Use Permit is authorized. 3. That the site for the proposed use is adequate in size and shape to accommodate said use, and all yards, spaces, walls, fences, parking, loading, landscaping and other features are adequate to adjust said use with the land and uses in the neighborhood. 4. That the site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. 5. That the granting of such Conditional Use Permit will not adversely affect the comprehensive General Plan. 6. That the use applied for will not have a substantial adverse impact on the environment. . . . SECTION 3. That for the foregoing reasons this Commission grants a Conditional Use Permit to establish and operate an unmanned cellular telephone equipment facility upon the following conditions: 1. That CUP 90-017 be limited to the one commercial space, and to one monopole with one grid of antennae. Microwave equipment is not to be a part of this facility under this Conditional Use Permit. 2. That the design and finish of any improvements or alterations that will be visible to the public be subject to Architectural Design Review. 3. That a landscaping plan for the area along the south side of the building be submitted for review and approved by the Planning Department, and that the landscaping be installed concurrently with the monopole. 4. That solid metal doors be installed on the existing trash enclosure. 5. That any changes in existing water services be installed by the Arcadia Water Division at the developer's expense. 6. That fire protection and building occupancy shall be provided and main- tained to the satisfaction of the Fire Department. Such shall include, but not be limited to a central station fire alarm system per NFPA standard nos. 71 & 72E. Plans for this and any other installations shall be submitted to the City for approval prior to installation, and shall be operational prior to installation of the cellular telephone equipment and any occupancy of the space. 7. That the subject site be maintained according to the plans filed with the Planning Department for CUP 90-017, and that all of the conditions of approval shall be complied with prior to the installation of any equipment or improvements. 8. That CUP 90-017 shall not take effect until the property owner and applicant have executed the Acceptance Form available at the Planning Department to indicate their awareness and acceptance of the conditions of approval. 9. That noncompliance with the provisions and conditions of CUP 90-017 shall constitute grounds for its immediate suspension or revocation. SECTION 4. The decision, findings and conditions contained in this Resolution reflect the Commission's action of November 13, 1990 and the following vote: AYES: NOES: ABSENT: Amato, Clark, Hedlund, Szany and Papay None None -2- 1451 - . . . Uve Oak Avenue SUMMARY This application was filed by Los Angeles Cellular Telephone Company for an unmanned cellular telephone facility at 206 E. Uve Oak Avenue. The Planning Department is recommending approval subject to the conditions listed. in this report. GENERAL INFORMATION APPLICANT: Los Angeles Cellular Telephone Company LOCATION: 206 E. Uve Oak Avenue REQUEST: A Conditional Use Permit for an unmanned cellular telephone equipment facility with antennae. SITE AREA: Approximately 20,300 square feet (0.47 acre) 140 feet along E. Uve Oak Avenue 145 feet along Tyler Avenue FRONT AGES: EXISTING LAND USE & ZONING: 5,700 sq. it retail building with 29 parking spaces. The zoning is C-2 (General Commercial) SURROUNDING LAND USES & ZONING: North: Gas station (abandoned) anda florist shop, zoned C-1 South: Vacant lot, zoned C-M&D . East: Electronic design and assembly facility, zoned C-M&D West: Hardware store, zoned C-2 GENERAL PLAN DESIGNATION: C - Commercial . . . PROPOSAL AND ANALYSIS The proposal is to house cellular telephone equipment in one space of an existing multi-tenant commercial building, and erect a sixty (60) foot high metal pole next to the south side of the building which will support one grid of antennae. The facility would be unmanned, but the storefront will be made to appear as if it were occupied by a business office. Site Selection In establishing a cellular telephone network, the location for a new facility is determined by the amount of cellular telephone activity in the area. Initially, the facilities can be some distance apart. As an existing installation becomes overloaded, its signal range and quality deteriorate. Eventually it becomes necessary to add new facilities to the network in order to maintain an acceptable signal quality. The applicant has provided an exhibit illustrating their other cellular facilities in the area. The subject facility is number 2f37. The proposed facility is a link in the network that is necessary to maintain the signal quality in the area. In selecting a location for this new facility, a study of the area was conducted to establish a "search ring" (shown on the attachment) within which the facility needed to be situated. Ideally, the facility should be at the center of this "search ring". For practical purposes, the applicant has limited his investigations to commercially zoned properties. East Live Oak Avenue is the only commercial strip about which the "search ring" could be established. This "search ring" does not provide for locations further west than Santa Anita Avenue nor further east than Second Avenue. While the intersection of Second and Live Oak Avenues is not the center of the ring, the subject location is readily available and is a substantial distance from any residential uses. A cellular telephone equipment facility is not a commercial use, but, such facilities are permitted in any zone with a Conditional Use Permit (AMC Sec. 9275.1.11) These facilities would be best in a Light Industrial area. However, the nearest available industrial space would be in the Chicago Park area, and that area is not near the applicant's "search ring". The proposed location is immediately adjacent to a Commercial-Manufacturing zone. The subject property was not developed with this kind of user in mind. Staffs opinion is that the elimination of a potential commercial user in this building is not detrimental to the planned uses of the area. The proposed use at this particular site has no detrimental affect upon the immediately adjacent properties. Conditional Use Permit No. 9<Hl17 Novernber13,1990 Page 2 . . . Site Improvements The uses in this commercial building are a convenience store, take-out and delivery pizza outlet, and a drycleaner. There are presently 29 off street parking spaces which is adequate for retail uses (5 spaces per 1,000 sq. ft.) and since the proposed facility will be unmanned, there will be no impact upon the parking situation. The subject store front will be screened to conceal the electronic equipment from public view. The applicant has indicated that the store front will be made to appear like a going business concern. Also a security fence will be placed around the base of the monopole. The design and fmish of any improvements or alterations that will be visible to the public should be subject to review and approval by the Planning Department. While the site has an adequate amount of landscaping, it is not being properly maintained. A particular concern is the impact upon the landscaping along the south side of the building where the monopole will be erected. Also, the existing trash enclosure is supposed to be secured by solid metal doors rather than the wooden doors which are in place. The site's landscaping must be properly maintained and a plan for the area along the south side of the building should be submitted for review and approval by the Planning Department. The applicant has requested a height of sixty (60) feet for the metal monopole. The General Commercial zone permits a maximum building height of forty (40) feet with a provision for an additional ten (10) feet to accommodate accessory structural items. A Modification may be granted to permit the monopole to have a maximum height of fifty (50) feet. While a fifty (50) foot tall monopole would have a significant impact upon the appearance of the subject commercial center. The existing power poles in the vicinity are approximately 85 feet high and a nearby transformer platform is 65 feet high. In this case, the proposed monopole would not have a significant impact upon the area. Because there are no provisions within the General Commercial zone regulations that would provide for a height of sixty (60) feet, a Variance would be the only way to consider the applicant's requested height. Environmental Concerns Electronic facilities have at times been a source of concern to surrounding residents because of potential health hazards and interference with household electronic appliances. While exposure to large enough quantities of electromagnetic radiation, can have adverse health affects, the amount discharged by cellular telephone equipment is not enough to even warrant monitoring. The applicant explained that a television has a high output of such Conditional Use Permit No. 90-017 November 13, 1990 Page 3 . radiation. A further discussion of this issue is provided by the applicant's response to the Environmental Checklist Form. The applicant's monopole will be capable of supporting microwave dish antennae which have been a subject of concern in regard to health affects. However, the applicant has no present plans to install microwave antennae, and any such use would be subject to another Conditional Use Permit. Another concern about electronic facilities is the potential for interference with household appliances such as televisions, radios, regular telephones, computers etc. The frequency along which cellular telephones transmits is very narrow and distinct. Its relation to other frequencies is shown on the attached exhibit. The applicant was not aware of any cases where cellular telephones have interfered with other modes of communication. Pursuant to the provisions of the California Environmental Quality Act, the Planning Department has prepared an initial study for the proposed project. Said initial study did not disclose any substantial or potentially substantial adverse change in any of the physical conditions within the area affected by the project, including land, air, water, minerals, flora, fauna, ambient noise and objects of historical or aesthetic significance. Therefore, a Negative Declaration has been prepared for this project. . RECOMMENDATION The Planning Department recommends approval of Conditional Use Permit No. 90-017 subject to the following conditions: 1. That CUP 90-017 be limited to the one commercial space, and to one monopole with one grid of antennae. Microwave equipment is not to be a part of this facility under this Conditional Use Permit. 2. That the design and finish of any improvements or alterations that will be visible to the public be subject to Architectural Design Review. 3. FINDINGS AND MOTIONS Approval If the Planning Commission intends to take action to approve this project, the Commission should move to approve and file the Negative Declaration and find that the project will not have a significant effect on the environment and direct staff to prepare the appropriate resolution incorporating the specific findings and conditions of approval set forth in the staff report, or as modified by the Commission. Denial If the Planning Commission intends to take action to deny this project, the Commission should move to deny and direct staff to prepare an appropriate resolution incorporating the Commission's decision and supporting findings.
