RESOLUTION 1450
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
ARCADIA, CALIFORNIA, GRANTING VARIANCE NO. V 90-002 TO
CONSTRUCT AN ArrACHED ENCLOSED PATIO AND APPROVE AN
EXISTING DETACHED SPA WITH ENCLOSURE AT AN EXISTING
LEGAL NONCONFORMING SINGLE FAMILY DWELLING AND
DETACHED TWO-CAR GARAGE AT 515 S. FIRST AVENUE.
WHEREAS, on September 21, 1990, an application was filed by Mr. and Mrs.
Royal Chuan Y Hanisue Chuang, the owners of the subject property, to construct an
attached enclosed patio and approve an existing detached spa with enclosure at an
existing legal nonconforming single family dwelling and detached two-car garage,
Planning Department Case No. V 90-002, on property zoned C-2&H (General
Commercial with the Special Height Overlay) commonly known as 515 S. First
Avenue, more particularly described as follows:
Lot 17 of Block 68 of Tract 866, in the City of Arcadia, County of Los
Angell'S, State of California, as per map recorded in Map Book 16 Pages
198 and 199 in the Office of the County Recorder of said County.
WHEREAS, a public hearing was held on November 13, 1990, at which time
all interested persons were given full opportuil.ity to be heard and to present
evidence;
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
ARCADIA HEREBY RESOLVES AS FOLLOWS:
SECTION 1. That the factual data submitted by the Planning Department in
the attached report is true and correct.
SECTION 2. This Commission finds:
1. That there are exceptional or extraordinary circumstances or conditions
applicable 10 the property involved, or to the intended use of the property, that do
not apply generally to the property or class of use in the sam~ zone or vicinity.
2. Thai the granting of such variance will not be materially detrimental to
the public hl'alth or welfare or injurious to the property or improvements in such
zone or viCinity.

3. That such variance is necessary for the preservation and enjoyment of a
substantial property right of the applicant possessed by other properties in the same
zone and vicinity.
4. That the granting of such variance will not adversely affect the
comprehensive General Plan.
SECTION 3. That for the foregoing reasons this Commission grants a Zone
Variance to construct aI\ attached enclosed patio and approve an existing detached
spa with enclosure at an existing legal nonconforming single family dwelling and
detached two-car garage upon the following conditions:
1. That the following public improvements be provided to the satisfaction of
the Director of Public Works:
a. One parkway tree at a location to be determined by the Department of
Public Works and planted in accordance with City Standard No. 5-13-1.
b. Deficient portions of the sidewalk are to be reconstructed to meet City
Standard No. S-17.
2. That any changes in the existing water service be installed by the Arcadia
Water Division at the applicant's expense.
3. That the required permits, inspections, and approvals be secured for the
spa and enclosure.
4. That if the spa fill line requires backflow protection, it shall be installed
and inspected to the satisfaction of the Arcadia Water Division.
5. That fire protection and building occupancies shall be provided and
maintained to the satisfaction of the Fire Department and Building Division.
6. That the subject site be maintained according to the plans filed with the
Planning Department for application number V 90-002, and that all of the
conditions of approval be complied with prior to completion of the enclosed patio.
7. That application number V 90-002 shall not be effective until the property
owner and applicant have executed the Acceptance Form available at the Planning
Department to indicate their awareness and acceptance of the conditions of
approval.
SECTION 4. The decision, findings and conditions contained in this
Resolution reflect the Commission's action of November 13, 1990 and the following
vote:

SECTION 5. The Secretary shall certify to the adoption of this Resolution and
shall cause a copy to be forwarded to the City Council of the City of Arcadia.

SUMMARY
This application was f11ed to construct an enclosed patio and approve an existing
spa with an enclosure at an existing nonconforming single family residence in a
General Commercial (C-2&H) zone at 515 S. First Avenue. The Planning
Department is recommending approval subject to the conditions listed in this
report.
GENERAL INFORMATION

Commercial (C-2&H) zone.

Approximately 7,793.5 square feet (0.179 acre)
55.0 feet along S. First Avenue
EXISTING LAND USE & ZONING:
A 450 sq. ft. commercial building (c. 1949) and a single family
residence with a detached two-car garage (c. 1936). The
zoning is C-2&H (General Commercial & Height Overlay)

GENERAL PLAN DESIGNATION:
C - Commercial
PROPOSAL AND ANALYSIS
.
The proposal is to add a 384 sq. ft. enclosed patio to the rear of the existing
residence, and, to have an existing spa with a 108 sq. ft. enclosure approved. The
building permit file indicates that the residence was built about 54 years ago.
The residential use has been rendered legal nonconforming by the subsequent
zoning of the area for commercial purposes. Section 9240 et seq. provides for
Variances to permit additions to nonconforming uses.
Both the enclosed patio and spa enclosure are strictly for recreational purposes.
The type of construction of each is not classed as suitable for habitation by the
Uniform Building Code.
The applicant's indicate that the enclosed patio will be used primarily by their
children as a separate study area. The spa and enclosure were installed about two
years ago to provide the daily heat treatments required of Mr. Chuang's chronic
back aches.
Expansions of nonconforming uses are normally prohibited in order to promote
a conforming use of the property. In this case, it is the Planning Department's
opinion that the proposed improvements are not of such significance as to
substantially discourage a potential future commercial use of the property.
. Pursuant to the provisions of the California Environmental Quality Act, the
Planning Department has prepared an initial study for the proposed project. Said
initial study did not disclose any substantial or potentially substantial adverse
change in any of the physical conditions within the area affected by the project,
including land, air, water, minerals, flora, fauna, ambient noise and objects of
historical or aesthetic significance. Therefore, a Negative Declaration has been
prepared for this project.
RECOMMENDATION
The Planning Department recommends approval of Variance No. V 90-002
subject to the following conditions:
1. That the following public improvements be provided to the satisfaction of
the Director of Public Works:

FINDINGS AND MOTIONS
Approval
