RESOLUTION 1449 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, GRANTING CONDmONAL USE PERMIT 90-016 TO ALLOW THE EXPANSION OF AN EXISTING AUTO BODY SHOP AT 42 WEST LIVE OAK AVENUE WHEREAS, on October 15, 1990 an application was filed by William Skibsted, to allow the expansion of an existing auto body shop, Planning Department Case No, c.u.P. 90-016 at 42 West Live Oak Avenue, more particularly described as follows: Lot 1 of Tract 10898, in the City of Arcadia, County of Los Angeles, State of California as per map recorded in Book 8573, Page 19 inclusive of maps, in the office of said County Recorder. WHEREAS, a public hearing was held on November 13, 1990, at which time all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: Section 1. That the factual data submitted by the Planning Department in the attached report is true and correct. Section 2, This Commission fmds: 1. That the granting of such Conditional Use Permit will not be detrimental to the public health or welfare, or injurious to the property or improvements in such zone or vicinity, 2. That the use applied for at the location indicated is a proper use for which a Conditional Use Permit is authorized. 3, That the site for the proposed use is adequate in size and shape to accommodate said use, All yards, spaces, walls, fences, parking, loading, landscaping and other features are adequate to adjust said use with the land and uses in the neighborhood, There is adequate on-site parking to accommodate the proposed use, 4, That the site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. 5, That the granting of such Conditional Use Permit will not adversely affect the comprehensive General Plan, -1- 1449 . . . 6, That the use applied for will not have a substantial adverse impact on the environment. Section 3, That for the foregoing reasons this Commission approves a Conditional Use Permit to allow the expansion of the auto body shop upon the following conditions: 1. Conditions as outlined in the attached report from the Department of Public Works shall be complied with to the satisfaction of the Director of Public Works, 2, That Fire safety shall be provided to the satisfaction of the Fire Department. 3, That the canvas-type canopies, if approved by the Fire Department with any additional conditions they may have, and the metal awning shall be allowed to remain for a maximum of 45 days from the date of adoption of the resolution, or until the final building inspection has been approved, whichever comes first. 4, The razor wire shall be allowed along the southerly property line, however, barbed wire, razor wire or any similar type of material shall not be installed along WeIland Avenue and the existing barbed wire and razor wire on WeIland shall be removed within 45 days from the date of approval of this conditional use permit. 5. That the size and location of the trash enclosure shall be subject to the approval of the Planning Department, 6, There shall be no outside storage of trash, scrap metal, equipment or material. 7, All automobile repair work and auto body work shall be done inside the building, The carport shall be used for parking only and shall not be used for automotive work. 8. No vehicles shall be parked on the premises and offered for sale, lease or rent. 9, New permits shall be obtained for the electrical and mechanical work and any other work necessary to complete the job, 10, That the new portion of the building shall not be occupied until the sprinkler system has been installed and a certificate of occupancy issued by the Building Division. 11, All on-site improvements (sprinklers, landscaping, trash enclosure, etc.) shall be completed and driveway aprons installed within 45 days from the date of approval of this c.u.p, -2- 1449 . . . 12, All off-site improvements including installation of street lights, landscaping, landscape sprinkler systems, curbs and gutters shall be completed within six (6) months from the date the final building inspection has been approved, 13. That prior to the final building inspection being made, the applicant shall be required to post a bond or other security approved by the City Attorney, to guarantee that the off-site improvements shall be completed within six (6) months from the date the final building inspection has been approved. 13, The subject site shall be maintained as per the plans on file in the Planning Department or as approved by the Planning Department. 14, That c.u.p, 90-016 shall not take effect until the owner and applicant have executed a form available at the Planning Department indicating awareness and acceptance of the conditions of approval. 15, A modification shall be granted for 29 parking spaces in lieu of 34 parking spaces, This approval shall not constitute an approval for any change in use that would require more than 4 parking spaces- per 1,000 square feet of gross floor area, That said parking modification shall be for the garage use only. 16, A modification shall be granted for the deletion of the 5'_0" wide landscape buffer between the parking lot and Weiland Avenue, Said 5'-0" wide landscape buffer shall be provided within the public right-oi-way, 17, Noncompliance with the provisions and conditions of this Conditional Use permit shall constitute grounds for the immediate suspension or revocation of said Permit. Section 4. The decision, findings and conditions contained in this Resolution reflect the Commission's action of November 13, 1990 and the following vote: AYES: Commissioners Amato, Clark, Hedlund, Szany, Papay NOES: None -3- 1449 . . . The original conditional use permit for this project (C.U.P, 88-008) expired before all the conditions of approval had been completed. The Planning Department is recommending approval subject to the conditions outlined in the staff report. GENERAL PLAN DESIGNATION: Commercial BACKGROUND On May 10, 1988, the Planning Commission voted 5 to 0 to allow the expansion of the existing automotive garage with modifications at 42 West Live Oak Avenue, Section 9275.2,13 of the Arcadia Municipal Code states: "If for a period of one year, unless a shorter expiration period is specified as a condition of approval, any use authorized by a Conditional Use Permit is, or has been, unused, abandoned or discontinued or the conditions have not been complied with. said Conditional Use Permit shall become null and void and of no effect." On December 8, 1989, Roy Streeter, Senior Building Inspector, advised ~e Planning Department that the carport and other portions of the building had not been built . per the approved plans, Mr. Skibsted was advised that revised plans had to be submitted to the city prior to doing any further work on the structure. On December 11,1989 Mr. Skibsted met with Mr, Streeter and said he was going to redo the building to comply with code, New plans were submitted to the Building Division During an inspection in March, 1990, the Arcadia Fire Department noted that the auto body shop was occupying their new buildings (which had not been finaled) and did not have a sprinkler system as required. This information was forwarded to the Building Department. On March 30, 1990, Mr. Streeter sent a letter to Mr. Skibsted informing him that the new buildings could not be occupied and they were to vacate the new buildings immediately until they had been finaled by all City Departments and a certificate of occupancy had been issued. On June 6,1990 several of the City Departments met to review the status of construction on this site. It was noted during an inspection of the premises that the body shop was still occupying the new portion of the buildings and that the following had not been completed: 1. Sprinkler system not installed. 2, Off-site work not started. 3, Electrical not complete. 4, Mechanical not complete 5, Other items not completed, i.e., trash enclosure, landscaping, etc. c.u.p, 90-016 November 13, 1990 Page 2 . . . Also it was observed that: (1) work was being conducted outside underneath temporary canvas-type canopies, (2) razor wire had been installed on top of the wall and (3) storage of flammable liquids inside the buildings. A "Notice of Suspension and Intent to Revoke Conditional Use Permit 88-008" was sent to Mr, Skibsted on June 8, 1990. The letter noted all the violations on the property as well as the violations of the conditional use permit, On several occasions from June through September Mr. Skibsted talked to Will Wong in the Planning Department regarding conditions of approval and what needed to be done. Mr. Wong on these occasions advised Mr. Skibstead of what was necessary to proceed and also emphasized that the auto body shop should not be occupying the new portion of the building, However, no progress was made during the time and Mr, Skibsted continued to use the new portion of the building which had not been finaled. On October 3,1990, after a site inspection, the Fire Department sent a letter to Mr. Skibsted advising him that the new building additions were not to be occupied and that the Fire Department still had not received the fire sprinkler plans which were necessary to install the sprinkler system which was a condition of occupancy. On October 10 the Fire Department, Building Department and Planning Department met with Mr, Skibsted regarding the violations on his property and hand delivered a "Notice of Expiration of Conditional Use Permit 88-008" (see attached) advising him that his conditional use permit had expired and was null and void. The letter cited the violations on the property. Mr, Skibsted was again advised at that time that he could not occupy the new building until a new conditional use permit was approved and until he had complied with all conditions of approval including a "certificate of occupancy". Staff further advised him that the canvas-type canopies should be removed immediately as well as the metal st:rUcture at the south portion of the building, Since this meeting, based upon several site inspections, it appears that the new buildings are not being occupied. However, the canvas canopies are still being used and the metal canopy has not been removed. This application is a result of the meeting with Mr, Skibsted, PROPOSAL The applicant has expanded the existing automotive garage by adding 3,735:f: square feet to the garage and a 1,074:1: square foot two story office building with carport. C.U.P. 90-016 November 13, 1990 Page 3 . . . There are 29 parking spaces on the site (including a space where the metal canopy is located), 34 parking spaces are required by code. The landscape buffer adjacent to the wall along Weiland Avenue is located in the public right of way. c.u.P. 88-008 granted a modification for this location. The building construction is complete with the exception of sprinklers, and some mechanical and electrical work; however, the following are violations of C,U.P, 88-008 and zoning code requirements: 1. Working outdoors is not permitted. 2, Razor wire/wall extension is not permitted. 3, Off-site improvements not installed, 4, Building sprinklers not installed. 5. Temporary canvas-type canopies not permitted, 6, Metal canopy at south end of building not permitted (also not shown on the original plans) 7. Outside storage of materials (scrap metal and other items). The following are violations of the Building Code: 1. Occupancy prior to final inspection and occupancy permit, 2. Building sprinklers not installed. 3. Electrical and mechanical work not finaled. 4, Building, plumbing, mechanical and electrical permits have expired as of September 5, 1990. The following are Fire Department violations: 1. Temporary canopies not permitted - do not comply with fue safety standards, 2. Sprinkler system not installed in the entire building (in lieu of installing a fire hydrant). 3, Continuation of a fire hazard (use of canopies, etc.), ANALYSIS We have received the attached letter from Mr, Skibsted noting changes in the plans and "procedures for Planning Commission to consider", 1. Approval of chain link and razor wire on wall at rear of property. Planning Department Comment: Because of the problems in the neighborhood staff does not have a problem with allowing the razor wire along the southerly propety line, Howeyer, barbed wire, razor wire or any C.U.P.90-016 November 13, 1990 Page 4 . . . similar type of material should not be installed on the portions of the wall adjacent to the street. 2, Additional on site parking due to removal of Fotomat. (No comment necessary) 3, Elimination of landscaping at trash bin, Planning Department Comment: The plans as submitted do not show landscaping by the trash bin, 4. Relocation of trash enclosure toward property line on Welland. Planninl: Department Comment: The plans submitted show the trash enclosure adjacent to the property line on WeIland, Staff is recommending that the size of the enclosure be increased from 8'-1" by 16' to 8'-1" by 32', This will accommodate the storage of the trash bin, scrap metal, automobile parts, wheels, etc, which are currently stored outside. The trash enclosure shall be constructed of decorative block with a metal gate painted to a color compatible with the decorative block, 5, Installation of wall around metal canopy at rear of property. Planning Department Comment: The Planning Department believes the metal canopy should be removed, It was installed without permits or approval from the Planning Department. The City discourages the use of metal canopies and there are some which are existing non-conforming and have in a few instances canopies have been approved in areas where they are not visible from the street or adjoining properties. 6. Street lights on telephone poles instead of free standing standards. Planning Department Comment: The Public Works Department based upon the Southern Edison Company's specs, requires lamps to be installed only on octagonal concrete standards; wood poles are not acceptable. 7, Fire sprinklers installed in new and old structures in lieu of fire hydrants, Planning Department Comment: The Fire Department has agreed to this alternative. 8, Request approval to occupy new building prior to completion of street improvements. eU,p.9O-016 November 13, 1990 Page 5 . . . Planning Department Comment: The Planning Department does not have problems with this request as long as all the on..site improvements are completed and driveway aprons have been installed within 45 days from the date of approval of this C.U,P. 9. Allowance of three month period after occupancy to install street lights, landscaping and sprinkler system. 10, Completion of curbs and gutters approximately six months after street lights and landscaping improvements, Planning Department Comment on Items 9 and 10: It is the Planning Department's opinion that the applicant has had adequate time (2 1/2 years) to complete these conditions, We would recommend that these improvements be installed within three months from the date of approval of this c.u.p, Unfortunately, Mr. Skibsted's past record in responding to the City's letters regarding compliance have not been exemplary. The Planning Department feels that the applicant has had sufficient time (over two years) to complete these conditions of approval and does not feel the time frames set forth in Mr. Skibsted's request are justified. Pursuant to the provisions of the California Environmental Quality Act, the Planning Department has prepared an initial study for the proposed project. Said initial study did not disclose any substantial or potentially substantial adverse change in any of the physical conditions within the area affected by the project including land, air, water, minerals, flora, fauna, ambient noise and objects of historical or aesthetic significance. Therefore, a Negative Declaration has been prepared for this project. RECOMMENDATION The Planning Department recommends approval of C,U.P. 90-016 for an auto body shop subject to the following conditions: 1, Conditions as outlined in the attached report from the Department of Public Works shall be complied with to the satisfaction of the Director of Public Works, 2. That Fire safety shall be provided to the satisfaction of the Fire Department. 3, That the canvas-type canopies and the metal awning shall be removed within one week from the date of adoption of the resolution, c.u.p, 90-016 November 13, 1990 Page 6 . 4. FINDINGS AND MOTIONS Approval IT the Planning Commission intends to take action to approve this project, the Commission should move to approve and file the Negative Declaration and find that the project will not have a significant effect on the environment and direct staff to prepare the appropriate resolution incorporating the specific findings and conditions of approval set forth in the staff report (or as modified by the Commission). Denial IT the Planning Commission intends to take action to deny this project, the Commission should move to deny and direct staff to prepare an appropriate resolution incorporating the Commission's decision and findings in support of that decision. The eXisting parkway widths are ten (10) feet on Welland Avenue and twelve (12) feet on Live Oak Avenue. Th is department has revi ewed the subject CUP and recommends the fo 11 owi ng conditions of approval: 1. Install six-inch VCP sewer lateral to property line on Welland Avenue to service proposed development. The sewer connection will require a gas trap. 2. Plant four (4) parkway trees at locations determined by the Director of Public Works per Arcadia City Standard Drawing S-13-1. Contact Public Works Department for type and size. 3. Remove and replace deficient or damaged curb,' gutter, sidewalk and/or pavement to satisfaction of the City Engineer. Contact Public Works Department for exact locations of removal and replacement, 4. Construct curb, gutter and sidewalk on Welland Avenue in accordance with details shown on City approved improvement plans and as per Arcadia City Standards, 5. Construct P. C. C. driveway aprons according to the Arcadia Standard Drawing No. S-II.
