RESOLUTION 1446
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF ARCADIA, CALIFORNIA, GRANTING CONDmONAL USE
PERMIT 90-015 TO OPERATE A SANDWICH/DEUCATESSEN
EATING ESTABUSHMENT AT 411 EAST HUNTINGTON DRIVE
WHEREAS, on September 21, 1990 an application was filed by Stuart Heller, to
operate a sandwich/delicatessen eating establishment, Planning Department Case No.
c.u.p, 90-015 at 411 East Huntington Drive, more particularly described in attached Exhibit
A,
WHEREAS, a public hearing was held on October 23, 1990, at which time all
interested persons were given full opportunity to be heard and to present evidence;
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA
HEREBY RESOLVES AS FOLLOWS:
Section 1. That the factual data submitted by the Planning Department in the
attached report is true and correct
Section 2. This Commission fmds:
1. That the granting of such Conditional Use Permit will not be detrimental to the
public health or welfare, or injurious to the property or improvements in such zone or
vicinity,
2. That the use applied for at the location indicated is a proper use for which a
Conditional Use Permit is authoriZed,
3, That the site for the proposed use is adequate in size and shape to accommodate
said use, All yards, spaces, walls, fences, parking, loading, landscaping and other features
are adequate to adjust said use with the land and uses in the neighborhood, There is
adequate on-site parking to accommodate the proposed use.
4, That the site abuts streets and highways adequate in width and pavement type to
carry the kind of traffic generated by the proposed use,
5. That the granting of such Conditional Use Permit will not adversely affect the
comprehensive General Plan.
6. That the use applied for will not have a substantial adverse impact on the
environment,
Section 3, That for the foregoing reasons this Commission approves a Conditional
Use Permit to operate an eating establishment upon the following conditions:
1. That the gross floor area of the restaurant shall not exceed 1,100 sq, ft.
2. That the use be limited to a delicatessen/sandwich shop only.

3, That seating shall be limited to 12 persons.
3, That fire safety shall be provided to the satisfaction of the Fire
Department. including posting of the seating plan in plan view for the fire
inspector at all times.
4, That no alcoholic beverages shall be served in the sandwich shop,
5, That c.u.p, 90-015 shall not take effect until the owner and applicant have
executed a form available at the Planning Department indicating awareness and
acceptance of the conditions of approval.
6, Noncompliance with the provisions and conditions of this Conditional
Use permit shall constitute grounds for the immediate suspension or revocation of
said Permit.
Section 4, The decision, findings and conditions contained in this Resolution reflect
the Commission's action of October 23, 1990 and the following vote:
A YES: Commissioners Amato, Hedlund, Szany, Papay
NOES: None
ABSENT: Commissioner Clark
Section 5. The Secretary shall certify to the adoption of this Resolution and shall
cause a copy to be forwarded to the City Council of the City of Arcadia.

of the Planning Commission held on the 13 day of November, 1990 by the following vote:

SUMMARY
An application was filed by Stuart Heller to operate a sandwich shop/delicatessen
at 411 East Huntington Drive. The Planning Department is recommending
approval subject to conditions outlined in this report.

BACKGROUND
On June 27, 1989 the Planning Commission adopted Resolutions 1411 and 1412
granting Conditional Use Permits 89-007 and 89-008 to operate two restaurants on
the site (Tony Rama's and Tokyo Wako).
On October 9, 1990 the PlAnning Commission adopted Resolution 1444 granting a
conditional use permit for a Thai buffet style fast food restaurant with seating for
16 persons. The Thai restaurant would be located in the retail area.
PROPOSAL AND ANALYSIS
The applicant is proposing to operate a sandwich shop/delicatessen with seating
for 12 persons. The total square footage of the sandwich shop is 993 square feet.
The sandwich shop will operate Sunday through Thursday from 10:00 a.m, to
12:00 midnight and Friday and Saturday from 10:00 a.m. to 2:00 a.m, No alcoholic
beverages will be served.

There are 428 parking spaces on the site (244 spaces within the parking structure
and 184 on-grade spaces).
Based upon code requirements for eating establishments fifteen additional
parking spaces are required for the sandwich shop (eating estaplishment). This
results in a net deficiency of eighteen parking spaces (446 spaces required and 428
existing).
One of the main concerns that staff has with eating establishments is that they
may generate more traffic and a greater demand for parking than a retail use.
The City has, in the past, granted conditional use permits to eating
establishments in retail centers with limitations on the seating.
In many retail centers small eating establishments are an integral part of a retail
center. "

Staff has not observed any parking problems with other approved similar eating
establishments in retail centers.
Generally, a sandwich shop/delicatessen generates less traffic than a fast food
hamburger eating establishment, It is staffs opinion that a sandwich
shop/delicatessen would be an appropriate use on the site and would not have a
significant impact on the parking or the on-site circulation and would be an
appropriate use on the site,
There have been no further proposals filed for eating establishments at this
location, If any further proposals for eating establishments or restaurants are
filed with the City, staff would recommend that a parking study be prepared to
evaluate the potential impact on parking.
MISCELLANEOUS INFORMATION
The Redevelopment Agency has reviewed the proposal and made the following
comments:
"As the second CUP request for an eating establishment within the Arcadia
Landmark Development, the Agency is concerned with limiting the total
number of eating establishments as well as the number of seats due to the
potential impact on the overall parking at the development."
Pursuant to the provisions of the California Environmental Quality Act, the
Planning Department has prepared an initial study for the proposed project. Said
initial study did not disclose any substantial or potentially substantial adverse
change in any of the physical conditions within the area affected by the project
including land, air, water, minerals, flora, fauna, ambient noise and objects of
historical or aesthetic significance, Therefore, a Negative Declaration has been
prepared for this project.
RECOMMENDATION
The Planning Department recommends approval ofC.U.P. 90-015 subject to the
following conditions,
1. That the gross floor area of the restaurant shall not exceed 1,000 sq. ft.
2, That the use be limited to a delicatessen/sandwich shop only.
3. That seating shall be limited to 12 persons.
4, That fire safety shall be provided to the satisfaction of the Fire Department.
5, That no alcoholic beverages shall be served in the sandwich shop.

6. That C.U;P. 90-015 shall not take effect until the owner and applicant have
executed a form available at the Planning Department indicating awareness
and acceptance of the conditions of approval,
7, Noncompliance with the provisions and conditions of this Conditional Use
permit shall constitute grounds for the immediate suspension or revocation
of said Permit,
FINDINGS AND MOTIONS
Approval
H the Planning Commission intends to take action to approve this project, the
Commission should move to approve and file the Negative Declaration and find
that the project will not have a significant effect on the environment and direct staff
to prepare the appropriate resolution incorporating the specific findings and
conditions of approval set forth in the staff report (or as modified by the
Commission).
Denial
H the Planning Commission intends to take action to deny this project, the
Commission should move to deny and direct staff to prepare an appropriate
resolution incorporating the Commission's decision and findings in support of that
decision.
