RESOLUTION NO, 1445 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, GRANTING CONDmONAL USE PERMIT 90-014 TO OPERATE A DOUGHNUT SHOP EATING ESTABLISHMENT AT 104 EAST FOOTHILL BOULEVARD. WHEREAS, on August 30,1990, an application was filed by Mr. Tony Yoong to operate a doughnut shop eating establishment, Planning Department Case No, CUP 90-014, on property commonly known as 104 East Foothill Boulevard, more particularly described as follows: A portion of Lot 12, Block 89 of the Santa Anita Tract, in the City of Arcadia, County of Los Angeles, State of California as per map recorded in Book 34, Pages 41 and 42 of Miscellaneous Records in the Office of the County Recorder of said County, WHEREAS, a public hearing was held on October 9, 1990, at which time all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOL YES AS FOLLOWS: SECTION 1. Thatthe factual data submitted by the Planning Department in the attached report is true and correct, SECTION 2. This Commission finds: 1. That the granting of such Conditional Use Permit will not be detrimental to the public health or welfare, or injurious to the property or improvements in such zone or vicinity. 2. That the use applied for at the location indicated is properly one for which a Conditional Use Permit is authorized. 3, That the site for the proposed use is adequate in size and shape to accommodate said use, and all yards, spaces, walls, fences, parking, loading, landscaping and other features are adequate to adjust said use with the land and uses in the neighborhood. 4, That the site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use, 5. That the granting of such Conditional Use Permit will not adversely affect the comprehensive General Plan, -1- 1445 le . ~ 6, That the use applied for will not have a substantial adverse impact on the environment, SECTION 3. That for the foregoing reasons this Commission grants a Conditional Use Permit to operate a doughnut shop eating establishment upon the following conditions: 1, That CUP 90-014 be limited to a doughnut shop in order to avoid the parking problems that may arise from overlapping peak operation times, 2. That a parking modification be granted for 27 parking spaces in lieu of 67 spaces, This shall only be for the use approved by CUP 90-014, and does not constitute a general reduction in parking for the total site. 3. That a landscaping modification shall be granted for the existing 385 sq. ft. on-site planter and 3 trees in lieu of 440 sq. ft, and 6 trees, This shall only be for the use approved by CUP 90-014, and does not constitute a general reduction in landscaping for the total site. 4, That solid metal doors be installed on the existing trash enclosure, 5, That any new signs for this business shall be subject to Architectural Design Review and installed with the appropriate permits. 6. That fire protection and building occupancy shall be provided and main- tained to the satisfaction of the Fire Department, Such shall include, but not be limited to, an automatic hood and duct fire extinguishing system, and a central fire alarm system, Plans for these and any other installations shall be submitted to the City for approval prior to installation, 7, That the subject site be maintained according to the plans filed with the Planning Department for CUP 90-014, and that all of the conditions of approval shall be complied with prior to the installation of the requested tables and seats, 8, That CUP 90-0l4shall not take effect until the property owner and applicant have executed the Acceptance Form available at the Planning Department to indicate their awareness and acceptance of the conditions of approval. 9, That noncompliance with the provisions and conditions of this Condi- tional Use Permit, CUP 90-014, shall constitute grounds for its immediate suspension or :revocation, -2- 1445 e SECTION 4, The decision, findings and conditions contained in this Resolution reflect the Commission's action of October 9, 1990 and the following vote: A YES: Commissioners Amato, Clark, Hedlund, Papay and Szany NOES: None ABSENT: None SECTION 5. Kasama, Assistant Planner SUBJECT: Conditional Use Permit No. 90-014 SUMMARY This application was filed to operate a doughnut shop with limited table seating at 104 E, Foothill Boulevard, The Planning Department is recommending approval subject to the conditions listed in this report, GENERAL INFORMATION APPLICANT: Tony Yoong LOCATION: 104 E, Foothill BOulevard REQUEST: A Conditional Use Permit with parking and landscaping modifications for a 750 sq, ft, doughnut shop with two tables and eight seats. Approximately 16,960 square feet (0,389 acre) 159,27 feet along Foothill Boulevard 105.92 feet along First Avenue SITE AREA: FRONT AGES: EXISTING LAND USE & ZONING: 5,400 sq, ft. retail building with 27 parking spaces (c. 1978) The zoning is C-2 (General Commercial) SURROUNDING LAND USES & ZONING: North: Savings and Loan Office, zoned C-2 South: Multiple family residential, zoned R-2 East: Santa Anita Wash West: Auto Service and a General Office, zoned C-2 GENERAL PLAN DESIGNATION: C - Commercial . . . PROPOSAL AND ANALYSIS The applicant is proposing a 750 sq, ft. doughnut shop with 2 tables with 4 seats each, The hours of operation are stated as 6:00 a,m. to 8:00 p.m, 7 days a week, A take out food shop is considered a retail use for which special permits are not needed, The inclusion of on-site eating facilities however, makes this use an eating establishment for which a Conditional Use Permit (CUP) is required. Also, because this proposal needs a CUP it can be required. that the property be brought into compliance with all current parking, landscaping and other site improvement standards. The subject property was formerly used as part of the adjacent Cheese Box Deli- catessen's sales area. The delicatessen has a CUP to operate with 3 tables and seat- ing for 6, and, there is also an ice cream parlour in this center (Baskin Robbins) which has a CUP for 6 seats with attached tables, The proposed doughnut shop will occupy 750 square feet and is part of a 5,400 square foot retail building. This center is located on a comer lot which has street frontages along East Foothill Boulevard and First Avenue. The uses in this retail center are as follows: T~ of Use Insurance Office Photography Studio Proposed Doughnut Shop Delicatessen Ice Cream Parlour Beauty Supplies Shop Total 5'1, Foota&e 750 750 750 750 1,200 1.200 5,400 Req'd, Pkg. 3 4 15 15 24 6 67 There are presently 27 off street parking spaces (26 standard ok 1 handicapped) which is adequatefor retail uses (5 spaces per 1,000 sq, ft.). However, strictly according to the Code, the proposed combination of uses requires 67 parking spaces because of the 3 eating establishments which technically require 20 spaces per 1,000 sq. ft. Therefore, a parking modification is necessary for 27 spaces in lieu of 67, The 3 eating establishments in this center are not typical fast food businesses which would usually necessitate an increase in the available parking. Rather, these 3 uses do not generate the intense parking demand normally associated with fast food establishments, and, because of their particularly distinct special- izations (i,e, doughnuts for breakfast, delicatessen for lunch or dinner, and ice cream as a snack or dessert) their peak business times do not coincide and should not significantly overlap. Conditional Use Permit No. 9()'()14 October 9, 1990 Page 2 . Staff has not observed, nor have any complaints been received of parking prob- lems at this center. And, because the proposed use is a doughnut shop which is distinctly different from the other 2 eating establishments, it is not anticipated that this proposal will generate an excessive increase in parking demand, There is presently a landscape planter of approximately 385 sq. it, at the southeast comer of the parking area and the 5 foot wide perimeter buffers contain 3 trees, The Code requires that 5 percent of the parking area (approx. 440 sq, ft.) be land- scaped and that 1 tree be provided for every 5 parking spaces (6 trees). The land- scaping modification is for the existing 385 sq, it, on-site planter in lieu of 440 sq, it, and for 3 trees in lieu of 6, . The present layout of the parking lot is such that it will not readily accommodate additional landscaping, and, there are already 5 street trees around this site, It is staff's opinion that additional landscaping would not necessarily be an improvement. It would probably alter the parking situation (e.g. inclusion of compact spaces) and, the perimeter of the site is already adequately landscaped, There is a masonry trash enclosure without doors located behind the landscape planter at the southeast corner of the parking lot. While the enclosure is adequate and is screened by the planter, it is currently the department's policy to require solid metal doors on trash enclosures. Also, the new sign face for this business was installed without a sign permit from the Building Division and without Architectural Design Review. The applicant has been informed of the required processes and has submitted the necessary applications. Pursuant to the provisions of the California Environmental Quality Act, the Planning Department has prepared an initial study for the proposed project, Said initial study did not disclose any substantial or potentially substantial adverse change in any of the physical conditions within the area affected by the project, including land, air, water, minerals, flora, fauna, ambient noise and objects of historical or aesthetic significance. Therefore, a Negative Declaration has been prepared for this project. RECOMMENDATION The Planning Department recommends approval of Conditional Use Permit No, 90-014 subject to the following conditions: 1, That CUP 90-014 be limted to a doughnut shop in order to avoid the parking problems that may arise from overlapping peak operation times. That a parking modification be granted for 27 parking spaces in lieu of 67 spaces. This shall only be for the use approved by CUP 90-014, and does not constitute a general reduction in parking for the total site. 2. . Denial If the Planning Commission intends to take action to deny this project, the Commission should move to deny and direct staff to prepare an appropriate resolution incorporating the Commission's decision and supporting findings.
