RESOLUTION 1443
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF ARCADIA, CALIFORNIA, GRANTING CONDmONAL USE
PERMIT 90-012 FOR AN AUTOMOTIVE GARAGE AT 125 WEST
LIVE OAK AVENUE.
WHEREAS, on August 13, 1990 an application was filed by Tony
Mangusin, for an automotive garage, Planning Department Case No. Cu.P. 90-
012, on property commonly known as 125 W. Live Oak Ave., more particularly
described as follows:
That portion of Lot 68 of the Santa Anita Colony, in the City of
Arcadia, County of Los Angeles, State of California, as per map
recorded in Book 42 Page 87 of Miscellaneous Records in the
office of the County Recorder of said County, lying within the
following described boundaries:
Commencing at the intersection of the Easterly sideline of that
strip of land, 80 feet wide described as Parcel No. 123 in a final
judgment had in Superior Court Case No. 519554, recorded in
Book 25990 Page 156 of Official Records in the office of the
County Recorder of the County of Los Angeles with the
Northerly line of Live Oak Avenue, 100 feet wide, as shown on
the map of Tract No. 13935 recorded in Book 285 Pages 13 and 14
of Maps, in the office of the County Recorder of said County;
then along said Northerly line Easterly 85.56 feet to the point of
beginning; then North 289.57 feet to the Southerly line of Las
Tunas Drive, 100 feet wide; then East along said Southerly line
147.52 feet; then South 266.27 feet to the Northerly line of said
Live Oak Avenue; then Westerly 149.35 feet along said
Northerly line to the point of beginning.
WHEREAS, a public hearing was held on September 25, 1990, at which
time all interested persons were given full opportunity to be heard and to
,present evidence;
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
ARCADIA HEREBY RESOLVES AS FOLLOWS:
Section 1. That the factual data submitted by the Planning Department in
the attached report is true and correct.
Section 2 This Commission finds:

1, That the granting of such Conditional Use Permit will not be
detrimental to the public health or welfare, or injurious to the property or
improvements in such zone or vicinity.
2. That the use applied for at the location indicated is a proper use for
which a Conditional Use Permit is authorized.
3. That the site for the proposed use is adequate in size and shape to
accommodate said use. All yards, spaces, walls, fences, parking, loading,
landscaping and other features are adequate to adjust said use with the land and
uses in the neighborhood.
4. That the site abuts streets and highways adequate in width and
pavement type to carry the kind of traffic generated by the proposed use.
5. That the'granting of such Conditional Use Permit will not adversely
affect the comprehensive General Plan.
6. That the use applied for will not have a substantial adverse impact
on the environment.
Section 3. That for the foregoing reasons this Commission grants a
Conditional Use Permit for an automotive garage, upon the following
conditions:
1. A grading and drainage plan shall be prepared by a registered civil
engineer if there are any changes in the existing grade and/or drainage of the lot.
This plan shall be subject to the approval of the Director of Public Works.
2. Fire protection, shall be provided to the satisfaction of the Arcadia
Fire Department. All buildings shall be fire sprinklered per NFP A 13 standards.
3. Following shall be complied with to the satisfaction of the Arcadia
Water Division:

Any change in water service shall conform to the Uniform
Plumbing Code and shall be installed by the Arcadia Water
Division upon the request and payment of fees by the
developer.
No water service lateral, meter or flush out shall be
permitted in any driveway. Nor shall they be.located less
than 3 feet from the top of "X" of any driveway or other
utility installation.
All landscape, irrigation and fire sprinkler systems subject to
Water Division approval for backflowprotection.

D. Water requirements for fire protection shall be determined by
the Arcadia Fire Department.
4. The wall which is located approximately 75 feet from the north
property line shall be maintained as long as the garage is in business. H a new
wall is built it shall consist of decorative block or masonry with stucco finish at a
minimum height of 6 feet. Any fence or gate shall be solid metal. Design,
location and materials shall be subject to the approval of the Planning
Department.
5. All work for the garage shall be conducted inside or at the rear of
the building. No work shall be conducted in front of the garage building along
Live Oak Avenue or in front of the existing wall along Las Tunas Drive. Said
wall is setback approximately 75 feet from the north property line.
6. The work area behind the existing garage shall remain screened
from public view. H any portion of the existing buildings on the site are
removed which causes this work area to be visible from the street, a new
decorative block wall or masonry wall with stucco finish shall be built at a
minimum height of 6 feet. Any fence or gate shall be solid metal. Design,
location and materials shall be subject to the approval of the Planning
Department.
7. Auto sales and auto leasing shall be prohibited unless a conditional
use permit is granted for such use.
8. A trash enclosure shall be provided if the area used to store the
trash bin is visible to the public. Location, size and material shall be subject to
the approval of the Planning Department.
9. Outdoor storage of wares, merchandise, crates, and similar items
shall be permitted only at the rear of the building out of public view.
10. The site shall be maintained per the plans on file in the Planning
Department.
11. The automotive garage shall only be open between the hours of 7:00
a.m. and 7:00 p.m., Monday through Saturday. Said garage shall be closed on
Sunday.
12. That C.U.P. 90-012 shalL not take effect until the owner and
applicant have executed a form available at the Planning Department indicating
awareness and acceptance of the conditions of approval.

13, Noncompliance with the provisions and conditions of this
Conditional Use Permit shall constitute grounds for the immediate suspension
or revocation of said permit.
Section 4. The decision, findings and conditions contained in this
Resolution reflect the Commission's action of September 25,1990 and the
following vote:
AYES: Commissioners Amato, Clark, Hedlund, Szany, Papay
NOES: None
ABSENT: None
Section 5. The Secretary shall certify to the adoption of this Resolution
and shall cause a copy to be forwarded to the City Council of the City of Arcadia.

SUMMARY
This application was filed by Tony Magusin for the construction of a 4,341 square foot
metal shed at the rear of an existing legal nonconforming automotive garage at 125
West Live Oak Avenue.
The Planning Department is recommending approval subject to the conditions
outlined in this report.

GENERAL PLAN DESIGNATION:

PROPOSAL AND ANALYSIS
On April 11, 1990 the applicant was notified that structural bUilding additions (metal
shed) were erected without first submitting drawings for approval and obtaining the
proper permits. Plans were submitted to the Building Department for plan check on
May 29, 1990 and it was determined by the Planning Department that a conditional use
permit was required. A conditional use permit was filed for on August 13,1990.
The applicant is proposing to construct a 4,341 square foot metal shed at the rear of an
existing 3,930 square foot automotive garage located at 125 West Live Oak Avenue.
Also developed on the site are two commercial retail buildings built in 1948 and 1949
totaling 4,824 square feet. The automotive garage was built in 1954 prior to the
requirement of a conditional use permit. A conditional use permit is required for any
expansion of the automotive garage.
The parking lot used by the commercial buildings is separate from the garage and
contains 36 parking spaces. 25 spaces are needed for the commercial buildings.
One concern the Planning Department has with garages is the parking and storage of
customers vehicles. In this case the applicant has a large enough area behind the
building to accommodate vehicles (see attached aerial). This area is approximately
15,000 square feet and is screened from public view by buildings or walls. All work will
be required to be done inside this area or inside the building.
Staff is recommending that all work be conducted inside or at rear of the building
(condition #5). Also, the work area behind the garage shall remain screened from
public view (conditions #4 and 6).
A trash enclosure may be required if the area used to store the trash bin is visible to the
public.
A garage is a permitted use in the C-M zone with an approved conditional use permit.
The proposal would be consistent with the Zoning Ordinance and General Plan.

Pursuant to the provisions of the California Environmental Quality Act, the Planning
Department has prepared an initial study for the proposed project. Said initial study
did not disclose any substantial or potentially substantial adverse change in any of the
physical conditions within the area affected by the project including land, air, water,
minerals, flora, fauna, ambient noise and objects of historical or aesthetic significance,
Therefore, a Negative Declaration has been prepared for this project.
RECOMMENDATION
The Planning Department recommends approval of Conditional Use Permit 90-012
subject to the following conditions:
1. A grading and drainage plan shall be prepared by a registered civil engineer if
there are any changes in the existing grade and/or drainage of the lot. This plan
shall be subject to the approval of the Director of Public Works.
2. Fire protection shall be provided to the satisfaction of ~he Fire Department. All
buildings shall be fire sprinklered per NFP A 13 standai'ds.
3. Following shall be complied with to the satisfaction of the Arcadia Water
Division:
Any change in water service shall conform to the Uniform Plumbing
Code and shall be installed be the Arcadia Water Division upon the

FINDINGS AND MOTIONS
Approval
If the Planning Commission intends to take action to approve Conditional Use Permit
90-011, the Commission should move to approve and file the Negative Declaration
and find that the project will not have a significant effect on the environment and
direct staff to prepare the appropriate resolution incorporating the specific findings and
conditions of approval set forth in the staff report, or as modified by the Commission.
