RESOLUTION 1442 A RESOLUTION OF lHE PLANNING COMMISSION OF lHE CITY OF ARCADIA, CALIFORNIA, GRANTING CONDmONAL USE PERMIT 90-011 TO OPERATE AN AUTOMOTNE GARAGE AT 152-154 EAST ST. JOSEPH STREET WHEREAS, on July 19, 1990 an application was filed by Michael Toshima and Greg Garcia to operate an automotive garage, Planning Department Case No, C.U.P, 90-011, on property commonly known as 152-154 East St. Joseph Street, more particularly described as follows: Lot 1 of Parcel Map 8942, in the City of Arcadia, County of Los Angeles, State of California, as per map recorded in Book 109, Page 58 of Parcel Maps, in the office of the County Recorder of said County. WHEREAS, a public hearing was held on August 28, 1990 at which time all interested persons were given full opportunity to be heard and to present evidence; NOW, lHEREFORE, lHE PLANNING COMMISSION OF lHE CITY OF ARCADIA HEREBY RESOL YES AS FOLLOWS: Section 1. That the factual data submitted by the Planning Department in the attached report is true and correct. Section 2. This Commission finds: 1. That the granting of such Conditional Use Permit will not be detrimental to the public health or welfare, or injurious to the property or improvements in such zone or vicinity. 2. That the use applied for at the location indicated is a proper use for which a Conditional Use Permit is authorized. 3. That the site for the proposed use is adequate in size and shape to accommodate said use. All yards, spaces, walls, fences, parking, loading, landscaping and other features are adequate to adjust said use with the land and uses in the neighborhood. 4. That the site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. -1- 1442 . . '- 5. That the granting of such Conditional Use Permit will not adversely affect the comprehensive General Plan. 6. That the use applied for will not have a substantial adverse impact on the en vironment, Section 3. That for the foregoing reasons this Commission grants a Conditional Use Permit for a to construct a new American Legion Hall upon the following conditions: 1. An oil separator shall be required subject to the approval of the City Engineer, Building Department and Planning Department. 2. Fire protection shall be provided to the satisfaction of the Fire Department. This is an H-4 occupancy and shall meet all requirements for a H-4 occupancy in Chapter 9 of the Uniform Building Code, especially ventilation and drainage. Flammables shall be stored in accordance with Uniform Fire Code. Also, a fire alarm to the central station is required. 3. Following shall be complied with to the satisfaction of the Arcadia Water Division: A. Any change in water service shall conform to the Uniform Plumbing Code and shall be installed be the Arcadia Water Division upon the request and payment of fees by the developer. B. If any water service exists in the alley, it shall be relocated to the front of the building on St. Joseph Street. C. No water service lateral, meter or flush out shall be permitted in any driveway. Nor shall they be located less than 3 feet from the top of "X" of any driveway or other utility installation. D. All landscape, irrigation and fire sprinkler systems subject to Water Division approval for backflow protection. E. Water requirements for fire protection shall be determined by the Arcadia Fire Department. 4. Following shall be complied with to the satisfaction of the Planning and Redevelopment Departments: A. Plant new landscaping materials (i.e. flowers, shrubs and trees) in circular planter formally occupied by oak tree along Second Avenue. B. Replace dead landscaping for the whole site and repair sprinkler system to assure coverage. -2- 1442 . C Trim and prune neglected landscaping. 5. All work shall be conducted inside the building. 6. At all times of the day and night vehicles being worked on or waiting to have work done shall be stored inside the building. 7. A maximum of six (6) employees for the automotive garage shall be permitted on the site at anyone time. 8. A separate Architectural Design Review application will be required for all signs. 9. The following businesses are specifically prohibited: auto painting and spray booths, auto body work, auto dismantling, towing services, auto sales, auto leasing and outdoor vehicle storage. 10. The site shall be maintained per the plans on file in the Planning Department. 11. All trash, garbage and debris shall be kept within an approved trash enclosure. 12. Outdoor storage of wares, merchandise, crates, bottles and similar items shall be prohibited. 13. All driveways shall remain open during business hours. 14. That CUP 90-011 shall not take effect until the owner and applicant have executed a form available at the Planning Department indicating awareness and acceptance of the conditions of approval. 15. Noncompliance with the provisions and conditions of this Conditional Use Permit shall constitute grounds for the immediate suspension or revocation of said Permit. Section 4. The decision, findings and conditions contained in this Resolution reflect the Commission's action of August 28, 1990 and the following vote: AYES: Commissioners Amato, Hedlund, Szany, Papay NOES: None ABSENT: Commissioner Clark ABSTAIN: None Section 5. WONG, ASSOCIATE PLANNER CONDmONAL USE PERMIT 90-011 This application was filed by Michael Toshima and Greg Garcia for the operation of a 5,950 square foot automotive garage at 152-154 East St. Joseph Street. The Planning Department is recommending approval subject to the conditions outlined in this report. ZONING: The site is developed with an industrial building; zoned M-l CUP 90-011 8/'l13/90 Page 1 . . ~ SURROUNDING LAND USE & ZONING: North: South: East: West: Industrial and Edison Station; zoned M-1 Industrial; zoned M-1 City of Arcadia water facility; zoned CPD-1 Automotive garage and industrial; zoned M-1 GENERAL PLAN DESIGNATION: Industrial BACKGROUND INFORMATION On February 28,1979 the Modification Committee granted a modification for 66 parking spaces in lieu of 72 spaces (M-79-2S) for the construction of a 35,900 square fool industrial building at the subject site. One of the considerations for the modification was the saving of the tree along Second Avenue. The building was completed on October 7, 1980. PROPOSAL AND ANALYSIS The applicants are proposing to operate a 5,950 square foot automotive garage within an existing 35,900 square foot industrial building. No exterio~ changes are proposed. A conditional use permit is required for an automotive garage. The applicants state (see Exhibit "A") that 'The purpose of our business is to offer maintenance and repair services to owners of collector and specialty vehicles. These services include all mechanical and electrical work, but exclude all paint and body work. . . . Customer's cars will always be parked in the building to prevent exposure to sun and other outdoor hazards. This will not be a high volume business, as compared to the usual auto repair shop. A concern of the Planning Department is parking. and storage of customers vehicles, The applicants are proposing to park customer's cars inside the building at all times. This restriction would limit the size of the business and the number of vehicles that could be worked on. All work will be required to be done inside the building. The Planning Department recommends that the maximum number of employees at anyone time shall be six. This would theoretically leave six parking spaces for potential customers. The parking requirement for an industrial building is 2 spaces per 1,000 square feet. CUP 90-011 8/'213/90 Page 2 . . , It is the Planning Department's opinion that the business should not include auto body painting or auto body work. These activities require vehicles to be stored on the premises for longer periods of time, which could increase the pressure to use on-site parking spaces for employees and patrons. A garage that does auto body painting or auto body work shoul.;!. have a separate parking lot used exclusively for the storage of vehicles, The subject site is not large enough to accommodate painting or body work. Staff has no objection to the dispensing of tires, batteries, oil and accessories; tuning of motors, wheel and brake adjustment and other repairs and services. Staff feels that an additional trash enclosure should be provided behind the building. This would eliminate one parking space. Access to the site will be from two 16'-8" wide driveways along the alley. One letter in opposition has been received (copy attached). A garage is a permitted use in the M-l zone with an approved conditional use permit, The proposal would be consistent with the Zoning Ordinance and General Plan. , " Pursuant to the provisions of the California Environmental Quality Act, the Planning Department has prepared an iriitial study for the proposed project. Said initial study did not disclose any substantial or potentially substantial adverse change in any of the physical conditions within the area affected by the project including land, air, water, minerals, flora, fauna, ambient noise and objects of historical or aesthetic significance, Therefore, a Negative Declaration has been prepared for this' project. RECOMMENDATION The Planning Department recommends approval of Conditional Use Permit 90-011 subject to the following conditions: 1. An oil separator shall be required subject to the approval of the City Engineer, Building Department and Planning Department. 2. Fire protection shall be provided to the satisfaction of the Fire Department. This is an H-4 occupancy and shall meet all requirements for a H-4 occupancy in Chapter 9 of the Uniform Building Code, especially ventilation and drainage. ' FINDINGS AND MOTIONS Approval If the Planning Commission intends to take action to approve Conditional Use Permit 90-011, the Commission should move to approve and f1le the Negative Declaration and find that the project will not have a significant effect on the environment and direct staff to prepare the appropriate resolution incorporating the specific findings and conditions of approval set forth in the staff report, or as modified by the Commission. Denial If the Planning Commission intends to take action to deny this project, the Commission should move to deny and direct staff to prepare an appropriate resolution incorporating the Commission's decision and findings in support of that decision.a CUP 90-011 8/'2J3/9O Page 5 . THESE SERVICES INCLUDE ALL MECHANICAL AND ELECTRICAL WORK, BUT EXCLUDE ALL PAINT AND BODY WORK. OUR CLIENTELE WILL BE OWNERS OF VINTAGE, ANTIQUE, CLASSIC, SPECIAL INTEREST, AND EXOTIC VEHICLES. GENERALLY, THESE VEHICLES ARE MORE THAN TWENTY-FIVE YEARS OLD. THEY REQUIRE SPECIAL CARE BECAUSE OF THEIR HIGH VALUE AND OWNER'S EXTRAORDINARY LEVEL OF CARE. CUSTOMER'S CARS ACCEPTED FOR SERVICE WILL ALWAYS BE PARKED IN THE BUILDING TO PREVENT ~XPOSURE TO SUN AND OTHER OUTDOOR HAZZARDS.
