EXPANSION TO AN EXISTING 1,000 SQ. Fr. RESTAURANT WITH PARKING AND LANDSCAPING MODIFICATIONS AT 506 EAST UVE OAK A VENUE. WHEREAS, on May 25, 1990 an application was filed by Yasuo !ida, for a 528 sq. ft. expansion to an existing 1,000 sq. ft. restaurant with parking and landscaping modifications, Planning Department Case No. c.u.P. 90-009, on property commonly known as 506 E. Live Oak Avenue, more particularly described as follows; SEE EXffiBIT "A" WHEREAS, a public hearing was held on June 26, 1990, at which time all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOL YES AS FOLLOWS: Section 1. That the factual data submitted by the Planning Department in the attached report is true and correct. Section 2. This Commission finds; 1. That the granting of such Conditional Use Permit will not be detrimental to the public health or welfare, or injurious to the property or improvements in such zone or vicinity. 2. That the use applied for at the location indicated ,is a proper use for which a Conditional Use Permit is authorized. 3. That the site for the proposed use is adequate in size and shape to accommodate said use. All yards, spaces, walls, fences, parking, loading, landscaping and other features are adequate to adjust said use with the land and uses in the neighborhood. 4. That the site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. 5. That the granting of such Conditional Use Permit will not adversely affect the comprehensive General Plan. 6. That the uSe applied for will not have a substantial adverse impact on the environment. 1440 -1- . . , Section 3. That for the foregoing reasons this Commission grants a Conditional Use Permit for the expansion of an existing restaurant, upon the following conditions: 1. That a parking modification shall be granted for 21 parking spaces in lieu of 52 spaces. This shall only be for the use approved by CUP 90"009, and does not constitute a general reduction in parking for the total site. Such parking spaces shall be striped in accordance with AMC Sec. 9269.8.1. 2. That a covenant, drafted by the City Attorney's Office, be executed an recorded by the applicant, to assure that the parking on the parcels at the rear of the subject site shall be maintained, kept, and useed exclusively for vehicular parking for the benefit of the subject retail center. 3. That a landscaping modification shall be granted for the existing 225 sq. ft. on-site planter in lieu of the 5'-0" wide planters, the 5% parking area landscaping, and 11 trees. This modification shall only be for the use approved by CUP 90-009, and not for other new uses on the site. 4. That the sign cabinet on the requested expansion area be removed, and that any new signs and exterior alterations for the subject. property shall be subject tot Architectural Design Review. 5. That a trash enclosure be built, in accordance with City standards, in the rear parking area, in the location indicated on the site plan. 6. That two street trees be planted per City Standard 5-13-1 at locations to be determined by the Director of Public Works. 7. That fire protection and building occupancy shall be provided and maintained to the satisfaction of the Arcadia Fire Department. 8. That the site shall be maintained per the plans on file in the Planning Department, and all the conditions of approval of CUP 90-009 shall be complied with prior to the utilizing the new seating area. 9. That C.U.P. 90-009 shall not take effect until the owner and applicant have executed a form available at the Planning Department indicate awareness and acceptance of the conditions of approval. 10. Noncompliance with the provisions and conditions of this Conditional Use Permit shall constitute grounds for the immediate suspension or revocation of said Permit. 1440 -2- . . --. Section 4. Kasama, Assistant Planner Conditional Use Permit No. 90-009 This application was filed to expand an existing restaurant at 506 East live Oak Avenue. The Planning Department is recommending approval subject to the conditions listed in this report. GENERAL INFORMATION APPLICANT: LOCATION: REQUEST: . Approximately 17,780 square feet (0.40 acre) 100.00 feet along live Oak Avenue 150.00 feet along Lenore.Avenue EXISTING LAND USE & ZONING: 8,478 sq. ft. retail building with parking. The zoning Is C-2 (General Commercial) SURROUNDING LAND USES & ZONING: North: M-Presidences & mixed commercial, zoned R-3 & C-2 South: Church parking and LA Co. 5-P residential, zoned PR-2 E a s t: Mixed commercial, zoned C-2 West: M-P residential, zoned R-3 GENERAL PLAN DESIGNATION: C - Commer~al ~ . . --. PROPOSAL AND ANALYSIS The applicant is proposing a 528 sq. ft. expansion to an existing 1,000 sq. ft. restau- rant. The subject property has been used as a restaurant since before the City began requiring Conditional Use Permits for them. The proposed expansion, however, requires a CUP and also requires that parking and landscaping be brought into compliance with current standards. The expanded restaurant will total 1,528 square feet and is part of an 8,478 square foot retail building. This center is located on a comer lot which fronts East Live Oak Avenue and Lenore Avenue. The uses in this retail center are as follows: Type of Use Clothing Store Barber Shop Dry Cleaner /Laundry Liquor Store Take Out Sandwich Shop Proposed Restaurant Expansion Restaurant Total Req'd. Pkg. 6 6 11 11 2 6 10 52 Sq. Footage 1,150 1,050 2,200 2,200 350 528 1.000 8,478 There are presently 25 off street parking spaces (not striped according to Code). Fourteen are in front of the center, and 11 are on a separate parcel to the rear of the site. A covenant will hold the parking on the separate parcel for the exclu- sive use of the subject property. If the parking spaces are striped according to Code, the front parking area would accommodate 11 spaces (10 standard and 1 handicapped). The rear parking area will provide 10 standard spaces and a trash enclosure. The parking modification is for 21 spaces in lieu of 52. Staff has not observed, nor have any complaints been received of parking prob- lems at this center. It is not anticipated that the proposed expansion will gener- ate an excessive increase in parking demand. There is presently a landscape planter of approximately 225 sq. ft. at the comer of the site. The Code requires 5'-0" wide planters between a parking area and adja- cent street side property lines, landscaping of 5% of parking areas and one tree for every 5 parking spaces. It is Staffs opinion that requiring the installation of such extensive new landscaping would be an overly burdensome condition of approval for the 528 sq. ft. expansion requested by the applicant. The landscaping modification is for the existing 225 sq. ft. on-site planter in lieu of the 5'-0" wide planters, the 5% parking area landscaping, and 11 trees. P\U'suant to the provisions of the California Environmental Quality Act, the Planning Department has prepared an initial study for the proposed project. Said initial study did not disclose any substantial or potentially substantial adverse change in any of the physical conditions within the area affected by the project, including land, air, water, minerals, flora, fauna, ambient noise and objects of historical or aesthetic significance. Therefore, a Negative Declaration has been prepared for this project. RECOMMENDATION The Planning Department recommends approval of Conditional Use Permit No. 90-009 subject to the following conditions; 1. That a parking modification shall be granted for 21 parking spaces in lieu of 52 spaces. This shall only be for the use approved by CUP 9D-009,and does not constitute a general reduction in parking for the total site. Such parking spaces shall be striped in accordance with AMC Sec. 9269.8.1. 2. That CUP 90-009 shall not take effect until the property owner and appli- cant have executed the form available at the Planning Department indicat- ing awareness and acceptance of the Conditions of approval. 10. That noncompliance with the provisions and conditions of this Condi- tional Use Permit shall constitute grounds for its immediate suspension Or revocation. FINDINGS AND MOTIONS Approval If the Planning Commission intends to take action to approve this project, the Commission should move to approve and file the Negative Declaration and find that the project will not have a significant effect on the environment and direct staff to prepare the appropriate resolution incorporating the specific findings and conditions of approval set forth in the staff report, or as modified by the Commission. Denial If the Planning Commission intends to take action to deny this project, the Commission should move to deny and direct staff to prepare an appropriate resolution incorporating the Commission's decision and supporting findings.
