RESOLUTION 1439
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF ARCADIA, CALIFORNIA, GRANTING CONDmONAL USE
PERMIT 90-008 FOR AN AUTOMOTIVE GARAGE WITH RETAIL
STORES AT 10-16 WEST LIVE OAK AVENUE.
WHEREAS, on May 25, 1990 an application was filed by Arcadia Live Oak
Partners, Ltd. for an automotive garage with retail stores, Planning Department
Case No. c.u.P. 90-008, on property commonly known as 10-16 W. Live Oak
Ave" more particularly described as follows:
Lots 5 & 6, in Block "A" of Tract No. 10898, in the City of Arcadia,
County of Los Angeles, State of California, as per map recorded
in Book 189, Pages 42 and 43 of Maps in the office of said
County Recorder.
WHEREAS, a public hearing was held on June 26, 1990, at which time all
interested persons were given full opportunity to be heard and to present
evidence;
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
ARCADIA HEREBY RESOLVES AS FOLLOWS:
Section 1. That the factual data submitted by the Planning Department in
the attached report is true and correct,
Section 2. This Commission finds:
1. That the granting of such Conditional Use Permit will not be
detrimental to the public health or welfare, or injurious to the property or
improvements in such zone or vicinity.
2. That the use applied for at the location indicated is a proper use for
which a Conditional Use Permit is authorized.
3. That the site for the proposed use is adequate in size and shape to
accommodate said use. All yards, spaces, walls, fences, parking, loading,
landscaping and other features are adequate to adjust said use with the land and
uses in the neighborhood.
4, That the site abuts streets and highways adequate in width and
pavement type to carry the kind of traffic generated by the proposed use,
5, That the granting of such Conditional Use Permit will not adversely
affect the comprehensive General Plan.

5. That the granting of such Conditional Use Permit will not adversely
affect the comprehensive General Plan.
6. That the use applied for will not have a substantial adverse impact
on the environment.
Section 3. That for the foregoing reasons this Commission grants a
Conditional Use Permit for an automotive garage with retail stores, upon the
following conditions:
1. The following conditions shall be complied with to the satisfaction
of the Public Works Director.
A. Submit grading and drainage plan prepared by a registered
civil engineer subject to the approval of the Director of Public
Works. Provide calculations for gravity drainage system and
the pump drainage system. Computations should show
hydrology, hydraulics, elevations and all the details requested
on the City's "Pump Drainage" sheet.
NOTE: Show all existing and proposed parkway trees, pull
boxes, meters, power poles, street lights, driveways,
sidewalks and handicapped ramps on
grading/ drainage plan.
B. Driveway on live Oak Avenue will be located so as not to
conflict with mature parkway trees. ,
C, Close existing driveways not to be used and reconstruct curb,
gutter and sidewalk to match existing.
D. Obtain approval from the Department of Public Works prior
to removal of the portion of the existing gutter.
E. Construct P.c.c. commercial type driveway apron according
to the Arcadia Standard Drawing No. 5-11. No driveway
shall be constructed closer than three (3) feet from any fire
hydrant, omamentallight standard, telephone or electrical
pole, meter box or underground vault or manhole.
F. Install six (6) inch VCP sewer lateral to property line to
service proposed Automotive Garage. However, no sewer
lateral shall be required if a service line is presently ~xisting
to handle sewage flow.

G. Submit oil-separator plans prepared by a Registered
Mechanical Engineer in accordance with Uniform Plumbing
Code latest edition.
H. Arrange for underground utility service and dedicate
easements to utility companies.
I. All public works improvements shall be completed to the
satisfaction of the Director of Public Works prior to final
acceptance by Building and Safety Department and prior to
occupancy.
J. All survey monuments, centerline ties and survey reference
points shall be protected in place or re-established where
disturbed. This work will be the responsibility of the
permittee and shall be at the permittee's expense.
2. Fire protection, shall be provided to the satisfaction of the Arcadia
Fire Department.
3. A maximum of 5,000 square feet of retail space shall be permitted.
4. The existing billboard shall be removed from the site.
5. A landscape and irrigation plan shall be submitted to the Planning
Department for review and approval prior to issuance of building permits,
There shall be a minimum of one fifteen gallon tree for every five parking
spaces.
6. A covenant holding the lots a~ one parcel shall be recorded prior to
the issuance of building permits. Said covenant shall be subject to the approval
of the City Attorney and Planning Department.
7, A separate Architectural Design Review application will be required
for all signs not covered by the conditional use permit. Individual channel
letters will be required for all wall signs and any free-standing sign shall be
required to have a decorative pole COVPl. This shall be subject to the approval of
the Planning Department.
8. The following businesses are specifically prohibited: auto painting
and spray booths, auto body work, auto dismantling, towing services, auto sales
and vehicle storage.
9, Deliveries of wares, merchandise, crates, bottles and similar items to
the site occupied by the garage and retail building shall be prohibited between the
hours of 8:00 p.m. and 7:00 a.m.

10. Entrance and driveway of the parking lot shaIi be enhanced by
colored and textured paving materials (stamped concreted, brick pavers, etc.).
This shall be subject to the approval of the Planning Department.
11. CUP 90-008 remains subject to the imposition of business hour
requirements if reports and complaints warrant the consideration of such a
condition, No such condition shall be applied until a noticed public hearing has
been conducted. The Planning Commission retains continuing jurisdiction
concerning business hours. If a public hearing is required, the applicant shall
provide site plans and floor plans of the site in adequate numbers for the
hearing,
12. The subject site shall be maintained as per the plans on file in the
Planning Department.
13. An additional trash enclosure shall be provided. Location, size and
material shall be subject to the approval of the Planning Department.
14, Outdoor storage of wares, merchandise, crates, bottles and similar
items shall be prohibited.
15. That C.U,P. 90-008 shall not take effect until the owner and
applicant have executed a form available at the Planning Department indicating
awareness and acceptance of the conditions of approval.
16. Noncompliance with the provisions and conditions of this
Conditional Use Permit shall constitute grounds for the immediate suspension
or revoca tion of said permit.
Section 4. The decision, findings and conditions contained in this
Resolution reflect the Commission's action of June 26, 1990 and the following
vote:

SUMMARY
This application was filed by Arcadia live Oak Partners, LTD. for the construction of a
15,000 square foot automotive garage with retail stores at 10-16 West Live Oak Avenue,
The Planning Department is recommending approval subject to the conditions
outlined in this report.

GENERAL PLAN DESIGNATION:

BACKGROUND INFORMATION
The Planning Commission at its May 9, 1989 meeting voted 5 to 0 approving
CUP 89-005 for a resident manager's apartment within a self storage facility and to
construct a building containing more than 20,000 square feet within 100 feet of
residentially zoned property at 10-16 West Uve Oak Avenul!, The total square footage
of all the buildings on the site would have been 47,378 square feet.
. Then on March 27,1990 the Commission voted 5 to 0 approving CUP 90-003 for a 6,000
square foot restaurant and 4,900 square feet of retail/ office space. A modification was
also granted for 81 parking spaces in lieu of 85.
At this time the applicant does not plan to pursue any of these projects.
PROPOSAL AND ANALYSIS
. The applicant is proposing to clear the site and const:I:uct two single-story buildings
totaling 15,000 square feet for automotive garage uses. Approximately 2,500 square feet
in each building may be occupied by retail uses. A conditional use permit is required
for any garage, The users of the site have not been determined, but the applicant is
hoping to attract a retail automotive parts store and auto related businesses.
The applicant would like to have ,the flexibility to lease all 15,000 square for garage uses
or have 10,000 square feet for garage and a maximum of 5,000 square feet of retail area.
There will be 65 parking spaces on the site which was determined as follows:
5,000 square feet of retail area at 5 spaces per 1,000 sq. ft. ..,...... 25 spaces
10,000 square feet of garage area at 4 spaces per 1,000 sq. it.. . , . . . . . 40 spaces
Total spaces. . . . . . . .65 spaces
Initially, a major concern of the Planning Department was parking for the garage uses,
After conducting a survey of other Cities and visiting similar places of business, staff,
believes that the proposal provides for more than adequate parking, All of the
Planning Departments contacted said that there were no problems with parking.
Following is a list of the Cities contacted, their requirements and the number of spaces
that they would have required for the proposed 10,000 and 15,000 square foot garage:

and tire installation allowed, however showroom area will be
considered as retail. 21 spaces for 10,000 sq. ft. and 33 spaces for

ROSEMEAD
4 parking spaces per 1,000 sq. ft. Bay area'not included. Auto body
and tire installation allowed, l).owever showroom area will be
considered as retail, No spray booth within 200 feet of residential.
21 spaces for 10,000 sq. ft. and 33 spaces for 15,000 sq. ft.
EL MONTE
4 parking spaces per 1,000 sq. ft. Bay area not included. Auto body
and tire installation allowed, however showroom area will be
considered as retail. 21 spaces for 10,000 sq, ft. and 33 spaces for

SAN GABRIEL
1 parking space per auto bay and 4 spaces per building. Average bay
measures 10' x 35'. Auto body and tire installation allowed. 30
spaces for 10,000 sq, ft. and 38 spaces for 15,000 sq. ft.
2 parking spaces per 1,000 sq. ft. or 1 spaces per every 2 employees,
whichever is greater. Bay area is included. Auto body and tire
installation allowed. 20 spaces for 10,000 sq. ft. and 30 spaces for
15,000 sq. ft.
PASADENA

1 parking spaces per 1,000 sq. ft, for building area 10,000 sq. ft. or less,
Area over 10,000 sq. ft. 1 space per 2,500 sq, ft. Bay area not
included. Auto body and tire installation allowed, however
showroom area will be considered as retail. 6 spaces for 10,000 sq. ft.
and 9 spaces for 15,000 sq. ft.
Due to the proximity of residential property and past experience with garages the
Planning Department will be recommending that the following businesses be
prohibited: auto painting and spray booths, auto body work, auto dismantling, towing
services, auto sales and vehicle storage. Also, staff is recommending restrictions to the
hours of deliveries made to the site (condition #9).
Plus the Planning Commission shall retain continuing jurisdiction concerning the
business hours of the garage (condition #11), Note that the Zoning Ordinance does
require a conditional use permit for a retail business selling liquor for off-premise
consumption and a retail business which is open more than 16 hours per day or which
is open any time between midnight and 6:00 a.m., and located less than 150 feet from
residentially zoned property.

Staff feels that an additional trash enclosure should be provided behind the building
along the east property line. This would eliminate one parking space.
Both buildings will be of the same architectural style. Exterior treatment will consist of
tan and brown 8" x 16" single score concrete block placed in a pattern and a tan 4" x 16"
concrete block used as an accent stripe around the building. A standing seam turquoise
metal roof will be located in the front portion of each building. Aluminum turquoise
storefront windows and doors will also be used in the front part of each building. This
is being done to accent the retail stores. Silver roll-up doors will used for the garage
tenants.
The buildings will have a landscaped front yard setback of 5'-0" to 7'-0" (none
required). A rear yard setback of 53'-0" will be maintained (20'-0" min.). An 8'-0" to
10'-0" landscape buffer will separate the parking lot from Live Oak Avenue (5'-0"
min.). Eleven tree wells will be used in place of wheel stops:
Access to the site will be from two 25'-0" wide driveways on Live Oak Avenue. A 5'-0"
wide landscaped buffer and 6'-0" high block wall will be located along the rear property
line since the subject lot. abuts residentially zoned property (Temple City).
The Planning Department believes that the 3'-0" high wall sign facing Live oak
Avenue would be appropriate. The letters will be raised channel letters with polished
stainless steel faces, Any other signs will need a separate Architectural Design Review
application.
A garage is a permitted use in the CoM zone with an approved conditional use permit.
The proposal either meets or exceeds all code requirements. The proposal would be
consistent with the Zoning Ordinance and General Plan.
ARCHITECTURAL DESIGN REVIEW
Concurrent with the consideration of this conditional use permit, the Planning
Commission may approve, conditionally approve or deny the applicant's design
concept plans.
Staff believes that the applicant's proposal complies with the intent of the design
criteria set forth in the City's Architectural Design Review Regulations.
Pursuant to the provisions of the California Environmental Quality Act, the Planning
Department has prepared an initial study for the proposed project. Said initial study
did not disclose any substantial or potentially substantial adverse change in any of the
physical conditions within the area affected by the project including land, air, water,
minerals, flora, fauna, ambient noise and objects of historical or aesthetic significance.
Therefore, a Negative Declaration lull! been prepared for this project. . .

. RECOMMENDATION
The Planning Department recommends approval of Conditional Use Permit 90-008
subject to the following conditions:

1. Conditions as outlined in the attached report from the Department of

Public Works.

FINDINGS AND MOTIONS
Approval
If the Planning Commission intends to take action to approve Conditional Use Permit
89-017, the Commission should move to approve and file the Negative Declaration
and find that the project will not have a significant effect on the environment and
direct staff to prepare the appropriate resolution incorporating the specific findings and
conditions of approval set forth in the staff report, or as modified by the Commission.
Denial
If the Planning Commission intends to take action to deny this project, the
Commission should move to deny and direct staff to prepare an appropriate resolution
incorporating the Commission's decision and findings in support of that decision.

In response to your memorandum, the items which this department has concern or
special knowledge of are listed below:
1. The existing parkway width is twelve (12) feet on Live Oak Avenue.
2. Traffic volume will be increased, but there will be no major impact.
3. The subject property is served by a sewer line that has the capacity to
transport sewage flows generated in accordance with land use reflected in
the City's current general plan to CSD's system.
This department has reviewed the subject CUP and recommends the following
conditions of approval:
1.
Submit grading and drainage plan prepared by a registered civil engineer
subject to the approval of the Director of Plibl ic Works. Provide
calculations for both the gravity drainage system and the pump drainage
system. Computations should show hydrology, hydraulics, elevations, and
all the details requested on the City's "Pump Drainage" sheet.
NOTE: Show all existing and proposed parkway trees, pull boxes, meters,
power poles, street lights, driveways, sidewalks and handicapped ramps on
