RESOLUTION 1438
A RESOLUTION OF THE PLANNING COMMISSION GRANTING
CONDITIONAL USE PERMIT 90-007, FOR A MARfIAL ARTS
SCHOOL AT 149 EAST DUARfE ROAD.
WHEREAS, on May 15, 1990 an application was lied by Carey and Joy
Dooley for a martial arts school, Planning Department Case No. C.U.P. 90-007,
on property commonly known as 149 E. Duarte Rd., more particularly
described as follows:
Lot 17 and the westerly 23 feet of Lot 18. Block 62, a
part of Arcadia Santa Anita Tract, in the City of Arcadia,
County of Los Angeles, State of California, as per map
recorded in Book 16, Page 58 of Miscellaneous records,
in the office of said County Recorder.

WHEREAS, a public hearing was held on June 12, 1990, at which time all
interested persons were given full opportunity to be heard and to present
evidence;
NOW. THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
ARCADIA HEREBY RESOLVES AS FOLLOWS:
Section 1. That the factual data submitted by U1e Planning Department in
the attached report is true and correct.
Section 2. This Commission finds:
1. That the granting of such Conditional Use Permit will not be
detrimental to the public health or welfare. or injurious to the property or
improvements in such zone or vicinity.
2. That the use applied for at the location indicated is proper use for
which a Conditional Use Permit is authorized.
3. That the site for the proposed use is adequate in size and shape to
accommodate said use. All yards, spaces, walls. fences, parking, loading,
landscaping and other features are adequate to adjust said use with the land
and uses in the neighborhood.
4. That the site abuts streets and highways adequate in width and
pavement type to carry the kind of traffic generated by the proposed use.
5. That the granting of such Conditional Use Permit will not adversely
affect the comprehensive General Plan.

6. That the use applied for will not have a substantial adverse impact
on the environment.
Section 3. That for the foregoing reasons this Commission grants a
Conditional Use Permit for a martial arts school upon the follOwing conditions:
1. Fire protection shall be provided to the satisfaction of the Fire
Department which may include a central station fire alarm system per N.F.P.A.
standards #71 and 72E. Plans shall be submitted and approved prior to
installation.
2. Water service shall conform to the Uniform Plumbing Code and any
new water service shall be installed by the Arcadia Water Division upon the
request and payment of fees by the developer.
3. At anyone time the maximum occupancy of the school shall be
twenty students (20). Also, maximum occupancy shall comply with the
requirements of the Fire Department.
4. The school for martial arts shall only be open for instruction from
5:15 p.m. to 10:00 p.m. and at no time shall a martial arts class begin or end
within one-half hour (30 minutes) of any dance class.
5. Architectural Design Review applications will be required for all
signs.
6. The Planning Commission shall retain jurisdiction in so far as that if
there are parking and/or circulation problems resulting from this use which
are found by the Planning Department. at any time during the first twelve
months of business. a public hearing shall be scheduled for the purpose of
determining the extent of the parking and/or circulation problem(s), and for
the consideration of modifying the original conditions of approval, or imposing
additional conditions so as to mitigate the identified problem(s).
7. The subject site shall be maintained as per the plans on file in the
Planning Department.
8. That C.U.P. 90-007 shall not take effect until the owner and
applicant have executed a form available at the Planning Department indicating
awareness and acceptance of the conditions of approval.
9. Noncompliance with the provisions and conditions of this
Conditional Use Permit shall constitute grounds for the immediate suspension
or revocation of said permit.

Section 4. The decision. findings and conditions contained in this
Resolution reflect the Commission's action of June 12, 1990 and the following
vote:
AYES: Commissioners Amato. Clark, Hedlund. Szany. Papay
NOES: None
ABSENT: None
Section 5. The Secretary shall certify to the adoption of this Resolution
and shall cause a copy to be forwarded to the City Counell of the City of Arcadia.

GENERAL PLAN DESIGNATION:
Commercial
PROPOSAL AND ANALYSIS
The applicant is proposing to operate a school (martial arts) from a 1,980 square foot
commercial retail space which is part of a 4,380 square foot .commercial building at
149 East Live Oak Avenue. Presently a dance studio (Arcadia Dance Arts), which is a
permitted use in the C-2 zone without a conditional use permit, operates out of the
same 1,980 square foot space, A conditional use permit is required for any school.
At no time will the dance studio and martial arts school be open at the same time. The
first martial arts class will begin no earlier than 5:15 pm and will end by 9:45 pm. No
class will begin or end within one-half hour of any dance class. There will be a
maximum occupancy of twenty students at anyone time.
Surrounding the subject site are commercially zoned properties except to the north
where there are single-family and multiple-family dwellings. Separating the subject
site from the residentially zoned properties is a 20 foot wide alley.

There are 22 parking spaces on the subject site. The 4,380 square foot building which
was built in 1977 complies with the required number of parking spaces for a retail
building (5 spaces per 1,000 square feet), Besides the dance studio the other uses on the
site include a dry cleaners, nail salon and sandwich shop.
With limitations to the school's hours of operation and occupancy the Planning
Department believes a school can be accommodated on the site, Restricting the first
class of the day to 5:15 pm will allow the school to operate when other businesses have
closed or have past their peak business hours. Also, requiring a 30 minute gap
between between the martial arts class and a dance class will help eliminate overlap of
the two schools.
Any new signs or changes to th~ building's facade will need a Architectural Design
Review application.
The proposal would be consistent with the Zoning Ordinance and General Plan.
Pursuant to the provisions of the California Environmental Quality Act, the Planning
Department has prepared an initial study for the proposed project. Said initial study
did not disclose any substantial or potentially substantial adverse change in any of the
physical conditions within the area affected by the project including land, air, water,
minerals, flora, fauna, ambient noise and objects of historic,al or aesthetic significance,
Therefore, a Negative Declaration has been prepared for this project.

RECOMMENDATION
The Planning Department recommends approval of Conditional Use Permit 90-007
subject to the following conditions: .

1. Fire protection shall be provided to the satisfaction of the Fire
Department which may include a central station fire alarm system per
N,F,P.A. standards #71 and 72E. Plans shall be submitted and approved
prior to installation.
2, Water service shall conform to the Uniform Plumbing Code and any new
water service shall be installed by the Arcadia Water Division upon the
request and payment of fees by the developer.
3, At anyone time the maximum occupancy of the school shall be
twenty students (20). Also, maximum occupancy shall comply with the

FINDINGS AND MOTIONS
Approval
If the Planning Commission intends to take action to approve this project, the
Commission should move to approve and file the Negative Declaration and find that
the project will not have a significant effect on the environment and direct staff to
prepare the appropriate resolution incorporating the specific findings and conditions
of approval set forth in the staff report or as modified by the Commission.
Denial
If the Planning Commission intends to take action to deny this project, the
Commission should move to deny and direct staff to prepare an appropriate resolution
incorporating the Commission's decision and findings in support of that decision.
