RESOLUTION 1436 A RESOLUTION OF THE PLANNING COMMISSION GRANTING CONDmONAL USE PERMIT 90-004, FOR THE SALE OF ALCOHOUC BEVERAGES WITHIN A GROCERY STORE FOR OFF-PREMISE CONSUMPTION WITHIN 150 FEET OF RESIDENTIALLY ZONED PROPERTY AND FOR AN EATING ESTABUSHMENT WITHIN 1HE GROCERY STORE WITH SEATING FOR 12 PERSONS AT 1300 SOUTH GOLDEN WEST AVENUE. WHEREAS, on April 9, 1990 an application was filed by Tawa Supermarket, Inc, for the sale of alcoholic beverages within a grocery store for off-premise consumption within 150 feet of residentially zoned property and for an eating establishment within the grocery store with seating for 12 persons, Planning Department Case No, c.u.P. 90- 004, on property commonly known as 1300 South Golden: West Avenue, more particularly described as follows: SEE EXffiBIT "A" . WHEREAS, a public hearing was held on May 8,1990, at which time all interested persons were given full opportunity to be heard and to present evidence; NOW, TIiEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOL YES AS FOLLOWS: Section 1, That the factual data submitted by the Planning Department in the attached report is true and correct. Section 2. This Commission finds: 1. That the granting of such Conditional Use Permit will not be detrimental to the public health or welfare, or injurious to the property or improvements in such zone or vicinity. 2. That the use applied for at the location indicated is proper use for which a Conditional Use Permit is authorized. 3. That the site for the proposed use is adequate in size and shape to accommodate said use. All yards, spaces, walls, fences, parking, loading, landscaping and other features are adequate to adjust said use with the land and uses in the neighborhood, 4. That the site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. ei 1436 -1- . 5. That the granting of such Conditional Use Permit will not adversely affect the comprehensive General Plan. 6. That the use applied for will not have a substantial adverse impact on the environment. Section 3. That for the foregoing reasons this Commission grants a Conditional Use Permit for the sale of alcoholic beverages within a grocery store for off-premise consumption within 150 feet of residentially zoned property and for an eating establishment within the grocery store with seating for 12 persons upon the following conditions: 1. Fire protection shall be provided to the satisfaction of the Fire Department, 2. A grease interceptor shall be installed. This shall be completed to the satisfaction of the Director of Public Works. 3. Deliveries of wares, merchandise, crates, bottles and similar items to the site for the grocery store and any use within said grocery store shall be prohibited between the hours of 9:00 p.m. and 7:00 a.m. Also, all deliveries shall be made at the rear (adjacent to east property line) of the building. 4. Wall signs shall be individual channel letters. All signs shall be subject to a separate Architectural Design Review application. 5. The site and areas designated for the sale of alcoholic beverages and seating for the eating establishment shall be maintained per the plans on file in the Planning Department. 6. Seating shall be limited to a maximum of twelve (12) persons. 7. If legally feasible, the cleaning, maintenance, gardening and landscaping of the property at 1220-1300 South Golden West Avenue and 838-852 West Duarte Road shall be prohibited between the hours of 9:00 p.m. and 7:00 a,m. 8. The eleven (11) parking spaces along the east property line shall be eliminated and the striping removed to facilitate access for delivery trucks, 9. That c.u.p, 90-004 shall not take effect until the owner and applicant have executed a form available at the Planning Department indicating awareness and acceptance of the conditions of approval. 10. Noncompliance with the provisions and conditions of this Conditional Use Permit shall constitute grounds for the immediate suspension or revocation of said permit. . . 1436 -2- Section 4. The decision, findings and conditions contained in this Resolution reflect the Commission's action of May 8, 1990 and the following vote: AYES: Commissioners Amato, Clark, Hedlund, Szany, Papay NOES: None ABSENT: None Section 5. The Secretary shall certify to the adoption of this Resolution and shall cause a copy to be forwarded to the City Council of the City of Arcadia. I I SURROUNDING LAND USE & ZONING: North: South: East: Multiple-family residential; zoned R-3 Multiple-family residential; zoned R-3 Commercial retail center and nonconforming apartment building; zoned C"2 Multiple-family residential and automobile service station; zoned R-3 and C-2 West: GENERAL PLAN DESIGNATION: Neighborhood Commercial BACKGROUND On July 26, 1988 the Planning Commission approved a proposal to remodel the exterior of the existing buildings at 1220-1300 South Golden West Avenue (ADR 88-78). Modifications were approved for the height of architectural features and the location of two signs. On January 17, 1989 the City Council approved CUP 88-029 for a 4,800 square foot restaurant within the existing shopping center. PROPOSAL AND ANALYSIS The applicant proposes to reopen the presently vacant grocery store at 1300 South Golden West Avenue (formerly Pantry Market). A conditional use permit is required due to the sale of alcoholic beverages for off-premise consumption within 150 feet of residentially zoned property and for an eating establishment within the grocery store with seating for 12 persons. Prior to the requirement of a conditional use permit the former grocery store sold alcoholic beverages and had an eating area with seating for 12 persons. Since the grocery store has been closed for more than 90 days, any new store could not conduct business as previously done without complying with current zoning requirements, The location of both the alcoholic beverages and the 12 seats will be at the front of the store (see attached floor plan). Alcohol will be sold in a 9' x 36' area, while the 12 seats will be within a 9' x 26' space adjacent to a take-out food counter, CUP 90-004 May 8, 1990 Page 2 . The Planning Department believes that the 324 square foot area for the sale of alcohol would be incidental to the other products being sold in the store. The store contains 29,604 square feet and the 324 square foot area would occupy only 1.10% of the total floor area. At this time the grocery store will be open 7 days a week from 9 a.m. to 9 p.m. A conditional use permit would be required if the store desired to be open more than 16 hours in a day or were to be open anytime between 12 midnight and 6:00 a,m, A take-out food business is permitted without a conditional use permit. By adding tables with chairs the business changes from a retail activity to an eating establishment which requires a conditional use permit The seating area will contain 234 square feet. It is staffs opinion that by limiting the seating, this eating establishment would not be detrimental to the site or the surrounding properties. The site presently has 318 parking spaces in lieu of 338 spaces. . Since 1982 there have been numerous conditional use permits approved for eating establishment with limited seating. In most cases the Planning Department has recommended that the maximum seating be limited to 12 persons. By restricting the seating within these eating establishments the Planning Department feels the parking requirement for a retail business of 5 spaces per 1,000 square feet is adequate. Due to the close proximity to residential properties, the Planning Department will be recommending limitations to the hours of deliveries to the grocery store. Any new signs or changes to the building's facade will need a Architectural Design Review application. The proposal would be consistent with the Zoning Ordinance and General Plan, Pursuant to the provisions of the California Environmental Quality Act, the Planning Department has prepared an initial study for the proposed project. Said initial study did not disclose any substantial or potentially substantial adverse change in any of the physical conditions within the area affected by the project including land, air, water, minerals, flora, fauna, ambient noise and objects of historical or aesthetic significance. Therefore, a Negative Declaration has been prepared for this project. RECOMMENDATION The Planning Department recommends approval of Conditional Use Permit 90-004 subject to the following conditions: . CUP 90-004 May 8,1990 Page 3 . . . 1. FINDINGS AND MOTIONS Approval If the Planning Commission intends to take action to approve this project, the Commission should move to approve and file the Negative Declaration and find that the project will not have a significant effect on the environment and direct staff to prepare the appropriate resolution incorporating the specific findings and conditions of approval set forth in the staff report or as modified by the. Commission, Denial If the Planning Commission intends to take action to deny this project, the Commission should move to deny and direct staff to prepare an appropriate resolution incorporating the Commission's decision and findings in support of that decision.
