A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, GRANTING CONDITIONAL USE PERMIT 90-003 TO CONSTRUCT A RESTAURANT AT 10-16 W, DVE OAK AVENUE. WHEREAS, on February 26, 1990 an application was filed by Arcadia Live Oak Partners, Ltd., to construct a restaurant, Planning Department Case No. c.u.P. 90-003, on property commonly known as 10-16 W, Live Oak Avenue, more particularly described as follows: Lots 5 and 6, BlockA, Tract No. 10898, in the City of Arcadia, County of of Los Angeles, State of California, as per Map recorded in Book 189, Pages 42-43 of Maps, in the office of said County Recorder, WHEREAS, a public hearing was held on March 27, 1990, at which time all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: Section 1, That the factual data submitted by the Planning Department in the attached report is true and correct, Section 2. This Commission finds: 1, That the granting of such Conditional Use Permit will not be detrimental to the public health or welfare, or injurious to the property or improvements in such zone or vicinity, 2. That the use applied for at the location indicated is a proper use for which a . Conditional Use Permit is authorized, . 3. That the site for the proposed use is adequate in size and shape to accommodate said use. All yards, spaces~ walls, fences, parking, loading, landscaping and other features are adequate to adjust said use with the land and uses in the neighborhood, 4. That the site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. 5, That the granting of such Conditional Use Permit Will not adversely affect the comprehensive General Plan. 6, That the use applied for will not have a substantial adverse impact on the environment. Section 3. That for the foregoing reasons this Commission grants a Conditional Use Permit to construct a restaurant, upon the following conditions: 1. The following conditions from the Department of P\l-blic Works shall be complied with to the satisfaction of the Director of Public Works. A. Submit grading and drainage plan prepared by a registered civil engineer subject to the approval of the Director of Public Works, Provide calculations for both the gravity drainage system and the pump drainage system, computations should show hydrology, hydraulics, elevations, and all the details requested on the City's "Pump Drainage" sheet. NOTE: Show all existing and proposed parkway trees, pull boxes, meters, power poles, street lights, driveways, sidewalks and handicapped ramps on grading/ drainage plan'- . -1- 1434 Existing parkway trees in good condition shall remain and sidewalk will be constructed around them to the satisfaction the Department of Public Works. Driveway on Live Oak Avenue shall be located so as not to conflict with mature parkway trees. Close existing driveways not to be used and reconstruct curb, gutter and sidewalk to match existing. Remove and replace deficient or damaged curb, gutter, sidewalk or pavement. Obtain approval from the Department of Public Works prior to removal of the portion of the existing gutter. Gravity drainage outlets, and commercial driveway aprons shall be constructed to conform to Arcadia City Standard Drawing No, S-l1. Arrange for underground utility service and dedicate easements to utility companies. All public works improvements shall be completed to the satisfaction of the Director of Public Works prior to final acceptance by Building and Safety Department and prior to occupancy. All survey monuments,centerline ties and survey reference points shall be protected in place or re-established where disturbed. This work will be the responsibility of the permittee and shall be at the permittee's expense. Install grease interceptor as per City Code. Submit calculation for grease interceptors designed by a registered engineer subject to approval of Director of Public Works and Building Department. . 2, Fire protection shall be provided to the satisfaction of the Fire Department which . includes the following: . A. Sprinkler system with over 20 heads require central station supervision per N.F,P.A. 71, Fire sprinklers required per N,EP.A. 13 standards. Plans shall be submitted and approved prior to installation. C. Fire hydrant required with a minimum 2,000 GPM min. Fire flow 3710, 3. Maximum occupancy shall comply with the requirements of the Fire and Building Departments, 4. The existing billboard shall be removed from the site. 5. A landscape and irrigation plan shall be submitted to the Planning Department for review and approval prior to issuance of building permits. There shall be a minimum of one fifteen gallon tree for every five parking spaces. 6. A covenant holding the lots as one parcel shall be recorded prior to the issuance of building permits. Said covenant shall be subject to the approval oHhe City Attorney and Planning Department. 7. A separate Architectural Design Review application will be required for all signs, Individual channel letters will be required for all wall signs and any free-standing shall be required to have a decorative pole cover. This shall be subject to the approval of the Planning Department. 8, A modification shall be granted for 81 parking spaces in lieu of 85 spaces. 9, Deliveries of wares,-merchandise, crates, bottles and similar items to the site occupied by the restaurant and commercial retail/office building shall be prohibited between . the hours of 7:00 p.m. and 7:00 a.m. . -2- B. . c. D, E. F. G, H. I. J. K. B, 1434 . 10, Entrance and driveway of the parking lot shall be enhanced by colored and textured paving materials (stamped concrete, brick pavers, etc.). This shall be subject to the . approval of the Planning Department. 11. CUP 90-003 remains subject to the imposition of business hour requirements if reports and complaints warrant the consideration of such a condition. No such condition shall be applied until a noticed public hearing has been conducted. the Planning Commission retains continuing jurisdiction concerning business hours, If a public hearing is required, the applicant shall provide site plans and floor plans of the restaurant in adequate numbers for the hearing. 12, The site shall be maintained per the plans on file in the Planning Department. 13. That c.u.P. 90-003 shall not take effect until the owner and applicant have executed a form available at the Planning Department indicate awareness and acceptance of the conditions of approval. 14. Noncompliance with the provisions and conditions of this Conditional Use Permit shall constitute grounds for the immediate suspension or revocation of said Permit, Section 4. The decision, findings and conditions contained in this Resolution reflect the Commission's action of March 27, 1990 and the following vote: A YES: Commissioners Amato, Clark, Hedlund, Szany, Papay NOES: None ABSENT: None Section 5. The Secretary shall certify to the adoption of this Resolution and shall cause a copy to be forwarded to the City Council of the City of Arcadia. GENERAL INFORMATION APPLICANTS: Arcadia Live Oak Partners, LTD. LOCATION: 10-16 West Live Oak Avenue REQUEST: Conditional use permit for the construction of a 6,000 square foot restaurant which may be divided into two restaurants, The site will also contain 4,900 square feet of retail/office space, A modification is being requested for 81 parking spaces in lieu of 8S spaces. LOT AREA: Approximately 43,875 square feet (1.01 acre) 167.27 feet on Live Oak Avenue FRONTAGE: EXISTING LAND USE & ZONING: The site is developed with a bar, restaurant and a singl~family dwelling; zoned C-M CUP 90-003 3/27/90 Page 1 . . . SURROUNDING LAND USE &: ZONING: North: Automobile service station and commercial retail center; zoned C-2 Multiple-family dwellings; zoned R-2 (Temple City) Commercial retail; zoned C-2 (Temple City) Mixed commercial; zoned CoM South: East: West: GENERAL PLAN DESIGNATION: Commercial BACKGROUND INFORMATION The Planning Commission at its May 9, 1989 meeting voted 5 to 0, approving CUP 89-005 for a resident manager's apartment within a self storage facility and to construct a building containing more than 20,000 square feet within. 100 feet of residentially zoned property at 10-16 West live Oak Avenue. The total square footage of all the buildings on the site would have been 47,378 square feet. At this time the applicant does not feel a self storage facility would be economically feasible. PROPOSAL AND ANALYSIS The applicant is proposing to clear the site and construct a 6,000 square foot restaurant which may be divided into two restaurants of 3,000 square feet. In addition to the restaurant, a 4,900 square foot retail/office building will be built. A conditional use permit is required for any restaurant. The user of the restaurant has not been determined at this time. Both buildings will be of the same architecturaL style. Exterior treatment will consist of off white and light beige stucco with a standing seam metal roof (deep red or marine green). A canopy will be located in front of the buildings and over the interior walkways. Posts for the canopy will be stuccoed off white. The east and west elevations (back of buildings) will consist of split face and precision (smooth) face block painted light beige. The Planning Department will be recommending that the color for the standing seam metal roof be marine green, which is the alternate color found in the colors and materials legend, The buildings will have a minimum front yard setback of 9'.,0" and 10'-0" (none required). A rear yard setback of 125'-0" to 133'-0" will be maintained. Each building will have a trash enclosure and a loading space will be located behind the restaurant. CUP 90-003 3/27/90 Page 2 . . . Access to the site will be from a 22'-0" wide driveway on Live Oak Avenue. 81 parking spaces will be provided in lieu of 85. It is the Planning Departments opinion that the parking deficiency of 4 spaces would not be detrimental in this area. The Planning Department has no objection to the restaurant being divided into two since the required parking is based on the gross square footage of the building 00 spaces per 1,000 sq. ft.). A 5'-0" wide landscaped buffer and 6'-0" high block wall will be located along the rear property line since the subject lot abuts residentially zoned property (Temple City). Due to the proximity of residential property, the Planning Department is recommending restrictions to the hours of deliveries made to the site (condition #9). Also, the Planning Commission shall retain continuing jurisdiction concerning the business hours of the restaurant (condition #11). Note that the Zoning Ordinance does require a conditional use permit for a retail business selling liquor for off-premise consumption and a retail business which is open more than 16 hours per day or which is open any time between midnight and 6:00 a.m., and located less than 150 feet from residentially zoned property, Any new signs will need a Architectural. Design Review application. A restaurant is a permitted use in the CoM zone with an approved conditional use permit. The proposal either meets or exceeds all code requirements except for the parking modification. The proposal would be consistent with the Zoning Ordinance and General Plan. ARCHITECTURAL DESIGN REVIEW Concurrent with the consideration of this conditional use permit, the Planning Commission may approve, conditionally approve or deny the applicant's design concept plans. Staff believes that the applicant's proposal complies with the intent of the design criteria set forth in the City's Architectural Design Review Regulations. Pursuant to the provisions of the California Environmental Quality Act, the Planning Department has prepared an initial study for the proposed project. Said initial study did not disclose any substantial or potentially substantial adverse change in any of the physical conditions within the area affected by the project including land, air, water, minerals, flora, fauna, ambient noise and objects of historical or aesthetic significance. Therefore, a Negative Declaration has been prepared for this project. CUP 90-003 3/27/90 Page 3 . . . . RECOMMENDATION The Planning Department. recommends approval of Conditional Use Permit 90-003 subject to the following conditions: 1. Conditions as outlined in the attached report from the Department of Public Works shall be complied with to the satisfaction of the Director of Public Works. 2. FlNDINGS AND MOTIONS Approval If the Planning Commission intends to take action to approve this project, the Commission should move to approve and file the Negative Declaration and find that the project will not have a significant effect on the environment and approve CUP 89-D20 subject to the conditions of approval set forth in the staff report or as modi- fied by the Commission. Denial If the Planning Commission intends to take action to deny this project, the Commission should move to deny and direct staff to prepare an appropriate resolution incorporating the Commission's decision and findings in support of that decision. . Live Oak Avenue, CUP 90-003, Restaurants in a Commercial Center In response to your memorandum, the items which this department has concern or special knowledge of are listed below: 1. The existing parkway width is twelve (12) feet on Live Oak Avenue. 2. Traffic volume will be increased, but there will be no major impact. 3. The subject property is served by a sewer line that has the capacity to transport sewage flows generated in accordance with land use reflected in the City's current general plan to CSD's system. This department has reviewed the subject CUP and recommends the following conditions of approval: Submit grading and drainage plan prepared by a registered civil engineer subject to the approval of the Di rector of Pub 1 i c Works.
