RESOLUTION 1433 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, GRANTING ZONE VARIANCE 90-001 TO CONSTRUCT A SINGLE-FAMILY RESIDENCE ON A 4,465 SQUARE FOOT R-3 ZONED LOT AT 1031 SOUTIi GOLDEN WEST A VENUE. WHEREAS, on February 9, 1990 an application was filed by Bade Construction Company, Ine, to construct a single-family residence on a 4,465 square foot R-3 zoned lot Planning Department Case No, V-9o-001 at 1031 South Golden West Avenue, more particularly described as follows: North 47' of south 180' of east 95' of Lot 85, Tract 2731 in the City of Arcadia, County of Los Angeles as per map recorded in the office of said County Recorder WHEREAS, a public hearing was held on March 13, 1990, at which time all interested persons were given full opportunity to be heard and to present evidence; and WHEREAS, as part of the record of this hearing the Planning Commission reviewed and considered: a. The staff report and related attachments. b, Plans presented by the applicant. c. Written correspondence received from the public. d. All oral presentations and testimony made during the public hearing on March 13, 1990, NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOL YES AS FOLLOWS: Section 1, This Commission finds: 1. That this is an exceptional case because the size of the property is so small (4,465 square feet with only 47 feet of frontage that a conventional multiple-family development would not be possible and it is not possible to combine this lot with the lots to the north or south because each lot is developed and being developed with multiple-family units. 2. That the granting of such variance will upgrade the vacant property and enhance the appearance of the neighborhood and will not be materially detrimental -1- 1433 . . . to the public health or welfare or injurious to the property or improvements in such zone or vicinity in which the property is located. 3. That such variance is necessary for the preservation and enjoyment of a substantial property right of the applicant possessed by other property in the same zone and vicinity. The city has granted similar variances allowing the construction of a single-family home on an R-3 lot when the lot is substandard in size and width and when it is not possible to build a conventional R-3 development on the site. 4. That the granting of such variance will not adversely affect the comprehensive General Plan. Section 2, That for the foregoing reasons this Commission approves this Zone Variance to construct a single-family dwelling on an R-3 lot subject to the following conditions: 1, That the building shall be in compliance with the plans on file in the subject case. 2. That water service shall be provided to the satisfaction of the Water Division, 3, That a landscape and irrigation plan shall be provic~ed to the Planning Department for its review and approval, 4. That all off-site improvements shall comply with City standards and be completed to the satisfaction of the Director of Ptiblic Works, 5, That a modification shall be granted for a 26.5:t' rear yard setback for the second story in lieu of 35'-0" required. 6. That V-9o-001 shall not take effect until the owner and applicant have executed a form available at the Planning Department indicating awareness and acceptance of the conditions of approval, Section 3, The decision, findings and conditions contained in this Resolution reflect the Commission's action of March 13, 1990 and the following vote: A YES: Commissioners Amato, Clark, Hedlund, Szany, Papay NOES: None ABSENT: None Section 5. BUTLER, SENIOR PLANNER CASE NO.: V-90-001 FROM: SUMMARY Bade Construction Company, Inc. is requesting a zone variance to construct a single-family residence in an R-3 zone at 1031 South Golden West Avenue. The Planning Department is recommending approval subject to the conditions outlined in this report. GENERAL INFORMAnON APPLICANT: Bade Construction Company, !nc, . LOCATION: 1031 South Golden West Avenue REQUEST: Zone Variance to allow a two-story single-family dwelling on a R-3 zoned lot. LOT AREA: 4,465 square feet FRONTAGE: 47' on Golden West Avenue EXISTING LAND USE & ZONING: The site is vacant; zoned R-3 SURROUNDING LAND USE & ZONING: North: The property is being developed with a 10 unit condominium; zoned R-3 Developed with five units; zoned R-3 Developed with multiple-family units; zoned R-3 Developed with two units; zoned R-3 South: East: West: . V-90-001 March 13, 1990 Page 1 . GENERAL PLAN DESIGNATION: Multiple-Family 7+ du/ac PROPOSAL AND ANALYSIS The applicant is proposing to construct a 2,181 square foot dwelling with an attached two-car garage, Because of the size of the lot 47' by 95' (4,465 sq, ft.), an R-3 multiple-family development is not possible, In order to build on this property it is necessary for the applicant to obtain a zone variance because a single-family dwelling is only allowed in the R-3 zone in conjunction with multiple units, The applicant has designed the house in accordance with the R-l regulations. The proposed house meets those regulations with the exception of a second floor rear yard setback of 26.5:1:' in lieu of 35'-0" required, It is staff's opinion that the second floor setback modification for 26.5:1:' will not have a detrimental effect on the adjoining property. The required setback for an R-3 development is only 10'-0". . This is an exceptional case because the size of the property is so small that a conventional multiple-family development would not be possible. It is not possible to combine this lot with the lots to the north or south because they are developed and being developed with multiple family units, The proposed project would upgrade the property and entumce the appearance of the neighborhood. Approval of the zone variance will not: (1) be detrimental to the public health or welfare, nor injurious to the property and improvements in this zone or vicinity; or (2) adversely affect the comprehensive general plan. Pursuant to the provisions of the California Environmental Quality Act, the Planning Department has prepared an initial study for the proposed project, Said initial study did not disclose any substantial or potentially substantial adverse change in any of the physical conditions within the area affected by the project including land, air, water, minerals, flora, fauna, ambient noise and objects of historical or aesthetic significance, Therefore, a Negative Declaration has been prepared for this project. . V-90-001 March 13, 1990 Page 2 . RECOMMENDATION The Planning Department recommends approval of V-90-001 to subject to the following conditions: 1. The building shall be in compliance with the plans on file in the subject case, 2. That water service shall be provided to the satisfaction of the Water Division. 3. REOUIRED FINDINGS AND MOTIONS The Planning Commission should examine the information and make findings relevant to the prerequisite conditions as stated in Section 9291.1.2 of the Arcadia Municipal Code, which reads as follows: A. That there are exceptional or extraordinary circumstances or conditions applicable to the property involved, or to the intended use of the property, that do not apply generally to the property or class of use in the same zone or vicinity, B, That the granting of such variance will not be materially detrimental to the public health or welfare or injurious to the property or improvements in such zone or vicinity in which the property is located. C That such variance is necessary for the preservation and enjoyment of a substantial property right of the applicant possessed by other property in the same zone and vicinity. . Attached for your consideration are those pages of the application in which the applicants have stated their case regarding the aforementioned prerequisite conditions. Approval If the Planning Commission intends to take action to approve this project, the Commission should move to approve and file the Negative Declaration and find that the project will not have a significant effect on the environment and direct staff to prepare the appropriate resolution incorporating the specific findings and conditions of approval set forth in the staff report (or as modified by the Commission). Denial If the Planning Commission intends to take action to deny this project, the Commission should move to deny and direct staff to prepare an appropriate resolution incorporating the Commission's decision and findings in support of that decision. EXPLAIN IN DETAIL WHEREIN YOUR CASE CONFORMS TO THE FOLLOWING FIVE CONDITIONS: 1. That there are exceptBional or extraordinary circumstances or conditions applicable to the property involved, ir to the intended use of the property, that do not apply generally top the property or class of use in the same zone or vicinity. The lot is only 47x95 and therefore, onlv practical thina that will fit, is a sinqle familv dwellina. 2. That the granting of such variance will not be materially detrimental to the public health or welfare or injurious to the property or improvements in such zone or vicinity. Builing a single family home would only be an asset to community and area. 3. That such variance is necessary for the preservation and enjoyment of a substantial property right of the applicant possessed by other property in the same zone and vicinity. There is no other alternative to developina thi.. ornpF>rt-y than as a single family residence. All other properties in the same zone and vicinity are capable of being developed with greater density than this property is. 4. That the granting of such variance will not adversely affect the comprehensive General Plan. The granting of this variance will not adverselv affect the General Plan as this is the onlv lot in this area that is this small.
