RESOLUTION 1431 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, GRANTING CONDInONAL USE PERMIT 89-019 TO OPERATE A RESTAURANT AT 921 SOUTH BALDWIN AVENUE WHEREAS, on November 20, 1989 an application was filed by Shizuo and Akiko Seshimo, Planning Department Case No, c.u.p, 89-019 at 921 South Baldwin Avenue, more particularly described in attached Exhibit A: WHEREAS, a public hearing was held on January 23,1990, at which time all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: Section 1. That the factual data submitted by the Planning Department in the attached report is true and correct. Section 2. This Commission finds: 1. That the granting of such Conditional Use Permit will not be detrimental to the public health or welfare, or injurious to the property or improvements in such zone or vicinity. 2, That the use applied for at the location indicated is a proper use for which a Conditional Use Permit is authorized. 3, That the sitefor the proposed use is adequate in size and shape to accom-modate said use. All yards, spaces, walls, fences, parking, loading, landscaping and other features are adequate to adjust said use with the land and uses in the neighborhood. Parking is located adjacent to the multi-purpose room and adjacent to Lemon Avenue, There is adequate on-site parking to accommodate the traffic generated by the church. 4, That the site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. 5. That the granting of such Conditional Use Permit will not adversely affect the comprehensive General Plan. 6. That the use applied for will not have a substantial adverse impact on the environment, Section 3, That for the foregoing reasons this Commission approves a Conditional Use Permit to operate a restaurant upon the following conditions: 1, That pursuant to Section 7490 of the Arcadia Municipal Code, connection to the existing sanitary sewer shall be made through an approved grease interceptor, -1- 1431 . . . 2. That an automatic hood and duct fire extinguishing system shall be installed to the satisfaction of the Fire Department, 3, That the serving and sale of liquor shall be restricted to beer and wine only. 4. That there shall be no cocktail lounge or bar area, The floor area shall comply with the plans submitted in this application. 5, Dinners shall not be served after 10:00 p.m, 6. Deliveries to the site shall not be earlier than 7:00 a,m. or later than 9:00 p.m, 7. That a modification shall be granted for 50 spaces, in Jieu of 57 spaces required. This approval shall not constitute an approval for a reduction in parking for the entire retail center. Rather than parking modification shall only be for the restaurant approved by C.U,P. 89-019. 8. That c.u.P, 89-019 shall not take effect until the owner and applicant have executed a form available at the Planning Department indicating awareness and acceptance of the conditions of approval, 9, Noncompliance with the provisions and conditions of this Conditional Use permit shall constitute grounds for the immediate suspension or revocation of said Permit. Section 4. The decision, findings and conditions contained in this Resolution reflect the Commission's action of January 23,1990 and the following vote: AYES: Commissioners Amato, Hedlund, Szany, Papay NOES: None ABSENT: Commissioner Clark Section 5, The Secretary shall certify to the adoption of this Resolution and shall cause a copy to be forwarded to the City Council of the City of Arcadia. BUTLER, SENIOR PLANNER CASE NO,: C,U.P, 89-019 TO: FROM: SUMMARY Shizuo and Akiko Seshimo have requested a conditional use permit and related parking modifications to operate a Japanese Restaurant with seating for 38 persons at 921 South Baldwin Avenue, The Planning Department is recommending approval subject to the conditions outlined in the staff report. GENERAL INFORMAnON APPLICANT: Shizuo and Akiko Seshimo LOCATION: 921 South Baldwin Avenue REQUEST: Conditional use permit and related modifications to operate a restaurant with seating for 38 persons. LOT AREA: 31,140 square feet 168f:' on Baldwin Avenue and 10Q:f:' on Fairview Avenue FRONTAGE: EXISTING LAND USE &: ZONING: The site is developed with a retail center which includes a flower shop, carpet store, ultra life therapy center, a pizza establishment and 3 vacant units (including the proposed unit); zoned C-2 SURROUNDING LAND USE &: ZONING: North: South: East: West: Developed with retail and a restaurant; zoned C-2 H Developed with a 7-11 store; zoned C-2 Developed with residential uses; zoned C-2 Developed with mixed commercial uses; zoned R-3 c.u.p, 89-019 January 23, 1990 Page 1 tt GENERAL PLAN DESIGNAnON: Commercial PROPOSAL The applicant is proposing' to operate a 1,400 :I: square foot Japanese restaurant with seating for 38 persons in the existing 9,981 square foot retail center. The restaurant will operate Tuesday through Sunday. The hours of operation will be Tuesday through Friday 11:00 a,m. to 2:00 p.m. Ounch hours) and 5:00 p,m, to 10:00 p.m. (dinner hours) and Saturdays and Sundays from 5:00 p.m. to 10:00 p.m. The applicants are proposing to serve beer and wine only to accompany the dinners. There will be no cocktail lounge or "bar" area. Parking . When the retail center was developed parking was provided at the ratio of 5 spaces per 1,000 sq, ft. of gross floor area for a total of 50 spaces. There is an existing eating establishment in the corner unit (Antonio's Flying Pizza - c.u.p, 87-19) which has seating for 12 persons. This eating establishment increased the required parking an additional 15 parking spaces for a total of 6S spaces required. However, because a condition of approval was to limit the seating to 12 persons, it was felt by the Planning Department that a modification to 50 spaces was appropriate. Based upon the parking requirements for restaurants (10 per 1,000 sq, ft. gfa), the proposed restaurant requires 14 parking spaces (or a net increase of 7 spaces for the site). The proposed restaurant increases the required parking for the center by 7 spaces (57 spaces in lieu of 50 spaces required; taking into the consideration the modification that was granted for the Pizza establishment), The applicants conducted the attached week long parking survey during the hours of 11:30 a.m. to 2:00 p.m. and during the hours of 5:30 p,m. to 9:00 p.m. During the afternoon hours there was a maximum of 9 vehicles in the lot at anyone time, During the evening hours there was a maximum of 12 vehicles in the lot at anyone time, Staffs drive-by inspection of the site is consistent with the numbers provided by the applicant during the day. We have not verified the number of cars during the evening hours, -. . ~ . . C.U.P. 89-019 January 23, 1990 Page 2 . Currently there are three vacant units; one unit containing 1,40Of sq, ft, is proposed to be occupied by the restaurant; the remaining two units total 2,536 sq. ft. Based upon the parking requirements for general retail activities, these two units would require 15 parking spaces, ANALYSIS A restaurant is a permitted use in the C-2 zone with an approved conditional use permit. It is staffs opinion that based upon the parking study and on staffs observations, parking will not be a problem, Because of the design of the project, the parking is self-contained and not utilized by other properties. Staff would recommend that the hours of operation be restricted to the times set forth in the application and that the sale of liquor be limited to beer and wine, Pursuant to the provisions of the California Environmental Quality Act, the Planning Department has prepared an initial study for the proposed project, Said initial study did not disclose any substantial or potentially substantial adverse change in any of the physical conditions within the area affected by the project including land, air, water, minerals, flora, fauna, ambient noise and objects of historical or aesthetic significance, Therefore, a Negative Declaration has been prepared for this project. . RECOMMENDAnON The Planning Department recommends approval of c.u.p, 89-019 to operate a restaurant subject to the following conditions: 1. That pursuant to Section 7490 of the Arcadia Municipal Code, connection to the existing sanitary sewer shall be made through an approved grease interceptor. 2, That an automatic hood and duct fire extinguishing system shall be installed to the satisfaction of the Fire Department, 3. That the serving and sale of liquor shall be restricted to beer and wine only. 4, That there shall be no cocktail lounge or bar area. FINDINGS AND MOnONS Approval . If the Planning Commission intends to take action to approve this project, the Commission should move to approve and file the Negative Declaration and find that the project will not have a significant effect on the environment and adopt Resolution 1431 incorporating the specific findings and conditions of approval set forth in the staff report (or as modified by the Commission).
