RESOLUTION 1430 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, GRANTING CONDmONAL USE PERMIT 90-001 FOR THE SALE OF liQUOR FOR OFF-PREMISE CONSUMPrION AT 600 EAST LIVE OAK AVENUE WHICH IS WITHIN 150 FEET OF RESIDENTIALLY ZONED PROPERTY, WHEREAS, on December 17, 1989, an application was filed by Steve and Denise Riggio fot' the sale of liquor for off-premise consumption, which would be within 150 of residentially zoned property. The applicants propose to operate a deli shop which will include the sale of beer, wine and champagne, Planning Department Case No, c.u.P. 90-001, on property commonly known as 600 East Live Oak A venue, more particularly described as follows: Lots 3, 4, 5 and 6 of Tract 15233 in the City of Arcadia, County of Los Angeles, State of California, as per Map recorded in Book 332, Pages 29 and 30 of Maps, in the office of said County Recorder. . WHEREAS, a public hearing was held on January 9, 1990, at which time all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSIGN OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: Section 1. That the factual data submitted by the Planning Department in the attached report is true and correct. Section 2. This Commission finds: 1. That the granting of such Conditional Use Permit will not be detrimental to the public health or welfare, or injurious to the property or improvements in such zone or vicinity. 2. That the use applied for at'the location indicated is a proper use for which a Conditional Use Permit is authorized, 3. That the site for the proposed use is adequate in size and shape to accommodate said use. All yards, spaces, walls, fences, parking, loading, landscaping and other features are adequate to adjust said use with the land and uses in the neighborhood. 4. That the site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use, . 1430 1 . 5. That the granting of such Conditional Use Permit will not adversely affect the comprehensive General Plan, 6. That the use applied for will not have a substantial adverse impact on the environment, Section 3, That for the foregoing reasons this Commission grants a Conditional Use Permit for the sale of liquor for off-premise consumption upon the following conditions: 1. That fire protection shall be provided to the satisfaction of the Arcadia Fire Department. 2. For the purpose of this conditional use permit liquor shall be defined and limited to beer, wine and champagne, 3, The sale of liquor shall be limited to 20% of the floor area used for retail sales and display. This shall be subject to the approval of the Planning Department. 4, That c.u.p, 90-001 shall not take effect until the owner and applicant have executed a form available at the Planning Department indicating awareness and acceptance of the conditions of approval. 5, Noncompliance with the provisions and conditions of this Conditional Use Permit shall constitute grounds for its immediate suspension or revocation. Section 4, The decision, findings and conditions contained in this Resolution reflect the Commission's action of January 9,1990 and the following vote: A YES: Commissioners Amato, Hedlund, Szany, Papay NOES: Clark ABSENT: None Section 5. The Secretary shall certify to the adoption of this Resolution and shall cause a copy to be forwarded to the City Council of the Oty of Arcadia. . . 2 1430 . Staff said that the applicants are proposing to open a dell shop which will Include the selling 01 liquor packed In gilt baskets, However, due to a misunderstanding 01 the applicants' request staff would like to add that they wish to display various liquors lor purchase and to sell the displayed liquor without having the containers gilt wrapped or packaged, as required by condition No. 2 In the staff report. Staff does not have a problem with this request, as long as the sale 01 liquor Is limited to 20% of the floor area which Is used lor retail sales and display, This Is stated In condition No, 3 01 the staff report to ensure that the sale of liquor remains as an Incidental use to the primary dell Items. In order to permit the sale 01 unwrapped liquor for off-premise consumption, condition No.2 In the staff report must be deleted. The public hearing was opened, Denise Riggio, 2218 Sixth, said that she Is In agreement with all 01 the conditions In the staff report. She stated that the primary business will be to make gourmet dinners which the customers will pick up , and she would like to have beer and wine available for the customer to take home, The sale of liquor will be approximately 10% of the business, She explained that her store Is 1175 sq. It" 500 ot which Is for display area and the remainder Is tor kitchen space. She remarked that she doesn't Intend to store liquor In the rear since the kitchen spaes might already'be too small. She remarked that It would not be a good Idea to have the liquor In gift baskets slnca the customer may not want the particular combination of liquor and It would be much more expensive to have It In gift baskets. Her business will be similar to Claro's market on Huntington Drive, She Qssured the Commission and the neighbors that this would not be like a liquor store. Since the liquor will not be a cooler In the store, she didn't think that she would get customers to come In Just to buy warm beer or wine. She stated that there are several stores In the area who sell cold beer and wine and thought anybody who Just wanted liquor would go there to purchase It. The sale of liquor In the store would be only as a convenience for the customers who purchase dinners, Barbara Stowe, 622 e, Sandra, objected to the sale of liquor and said that there are enough stores In the area who sale liquor. . . Harold Wilt, 2523 Loulse, said that he welcomed the facility but objected to the sale of liquor lor off. premise consumption, He remarked that the area Is being flooded with the sale of liquor. He said that If the alcohol Is not chilled and there seems to be a problem with It, why have It If It Is not needed. In rebuttal, Ms. Riggio, said that gift wrapped baskets are expensive and she would make them when a customer ordered It. To have ready gift baskets would not be a good Idea since the customer may not want the specific Items that are In the gilt basket..' ' .' Arcadia City Planning Commlsslor 1/9/9( Page ~ " . MOTlON It was moved by Commissioner Szany, seconded by Commissioner Amato to close the public hearing, The motion passed by voice vote with none dissenting. Commissioner Clark stated that this Is a desirable use and since the liquor will not be chilled he didn't think that people would come In just to buy liquor. Chairman Papay said that he shares the neighbors' concern but felt that with so many other liquor stores In the area, a customer would not go Into Ms. Riggio's dell just to purchase liquor, He suggested adding a condition to the staff report that all beer and wine not be refrigerated, ' Commissioner Hedlund said that as long as the liquor Is restricted to beer and wine there Is no need to restrict the use of a refrigerator, He didn't think that people would go Into this store to purchase warm . liquor when they can go to a liquor store ~earby to buy II chilled. Mr. Miller said that a condition can be added that If anybody drinks on the premises the applicant may be cited and since. the applicant would have a vested Interest she would enforce that condition. The Commission did not feel this condition was necessary. MOTlON .. .. The applicants are proposing to open a deli shop which will include the selling of liquor packed in gift baskets, The Planning Department is recommending approval subject to the conditions outlined in this report. GENERAL INFORMAnON . APPLICANTS: Steve and Denise Riggio LOCATION: 600 East Live Oak Avenue REQUEST: A Conditional Use Permit to sell liquor for off-premise consumption, which will be within 150 feet of residentially zoned property. The applicants are proposing to open a deli shop which will include the selling of liquor packed in gift baskets, LOT AREA: 30,730 square feet (0.71 acres) FRONTAGE: Approximately 204 feet on Live Oak Avenue Approximately 132 feet on Hempstead Avenue EXISTING LAND USE & ZONING: The site is developed with a retail shopping center, and is zoned C-2, SURROUNDING LAND USE & ZONING: . North: A church and mixed commercial uses: zoned C-2 South: Singly-family residences which are located within the Los Angeles County area. . East: West: Arcadia Mounted Police facility; unzoned area Restaurants; zoned C-2 GENERAL PLAN DESIGNAnON: Commercial PROPOSAL AND ANALYSIS The applicants are proposing to open an 1/175 square foot deli shop which will include the sale of liquor (champagne, wines, beer/ etc,) packed in gift baskets, The deli shop would be within a 9/539 square foot retail shopping center, as shown on the submitted site and parking plan. A 20 foot wide alley separates the site from the only neighboring residential properties. Said properties are south of the site. A conditional use permit is required for any retail business that sells liquor for off- premise consumption and is located less than 150 feet from residentially zoned property, . The City adopted the requirement for a conditional use permit due to the potential problems that could be caused by the sale of liquor for off-premise consumption adjacent to residential properties, Some of the detrimental aspects considered were noise, littering, loitering and criminal activity which would not be consistent with a residential community. The Planning Department feels that the sale of liquor packed in gift baskets would not create the detrimental aspects usually associated with liquor sales, It is unlikely that the liquor purchased at the gift shop would be consumed on or near the site. The applicants' proposal would be consistent with the Zoning Ordinance and General Plan, Pursuant to the provisions of the California Environmental Quality Act, the Planning Department has prepared an initial study for the proposed project. Said initial study did not disclose any substantial or potentially substantial adverse change in any of the physical conditions within the area ~fected by the project including land, air/ water, minerals, flora, fauna, ambient noise, and objects of historical or aesthetic significance. Therefore, a Negative Declaration has been prepared for the project, . C.U,P, 90-001 1/9/90 Page 2 . RECOMMENDAnON The Planning Department recommends approval of Conditional Use Permit 90-001 subject to the following conditions: 1. That fire protection shall be provided to the satisfaction of the Arcadia Fire Department. 2. All liquor sold shall be gift wrapped or packaged. 3. The sale of liquor shall be limited to 20% of the floor area used for retail sales and display, This shall be subject to the approval of the Planning Department. 4, That C.U,P, 90-001 shall not take effect until the owner and applicant have executed a form available at the Planning Department indicating awareness and acceptance of the conditions of approval. 5. Noncompliance with the provisions and conditions of this Conditional Use Permit shall constitute grounds for its immediate suspension or revocation. . FINDINGS AND MOTIONS Approval If the Planning Commission intends to take action to approve this project, the Commission should move to approve and file the Negative Declaration and find that the project will not have a significant effect on the environment and direct staff to prepare the appropriate resolution incorporating the specific findings and conditions of approval set forth in the staff report, or as modified by the Commission, Denial If the Planning Commission intends to take action to deny this project, the Commission should move to deny and direct staff to prepare an appropriate resolution incorporating the Commission's decision and findings in support of that decision. .
