RESOLUTION 1429 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, GRANTING CONDmONAL USE PERMIT 89-020 TO CONSTRUCT A NEW AMERICAN LEGION HALL AT 615-619 EAST UVE OAK AVENUE WHEREAS, on December 8, 1989 an application was filed by the, Arcadia American Legion Post No. 247 and The Plount Company, Inc. to construct a new American Legion Hall, Planning Department Case No. C.U.P. 89-020, on property commonly known as 615-619 East live Oak Avenue, more particularly described as follows: SEE ATTACHMENT "A" WHEREAS, a public hearing was held on January 9, 1990 at which time all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: Section 1. That the factual data submitted by the PI~ing Department in the attached report is true and correct. Section 2, This Commission finds: 1. That the granting of such Conditional Use Permit will not be detrimental to the public health or welfare, or injurious to the property or improvements in such zone or vicinity. 2. That the use applied for at the location indicated is a proper use for which a Conditional Use Permit is authorized, 3. That the site for the proposed use is adequate in size and shape to accommodate said use, All yards, spaces, walls, fences, parking, loading, landscaping and other features are adequate to adjust said use with the land and uses in the neighborhood. 4, That the site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. 5. That the granting of such Conditional Use Permit will not adversely affect the comprehensive General Plan. -1- 1429 . . . 6, That the use applied for will not have a substantial adverse impact on the environment. Section 3, That for the foregoing reasons this Commission grants a Conditional Use Permit for a to construct a new American Legion Hall upon the following conditions: 1. Conditions as outlined in the attached report from the Department of Public Works shall be complied with to the satisfaction of the Director of Public Works, 2. Fire protection shall be provided to the satisfaction of the Fire Department which includes the following: A. Central station fire alarm system is required per N.F.P,A. standards #71 and 72E. Plans shall be submitted and approved prior to installation. B, Hydrant required with a minimum 2,000 GPM, C. Exit doors from meeting room shall swing out. 3. Maximum occupancy shall comply with the requirements of the Fire and Building Departments. 4. The bar shall remain private and shall not be open to the public. 5. A landscape and irrigation plan shall be submitted to the Planning Department for review and approval prior to issuance of building permits. There shall be a minimum of one fifteen gallon tree for every five parking spaces. 6, Functions that are not part of the American Legion Post, shall be restricted to the meeting room/main hall. The bar should only be used to service the meeting room/main hall. 7. A separate Architectural Design Review application will be required for all signs. 8. Entrances to the parking lot shall be enhanced by colored and textured paving materials (stamped concreted, brick pavers, etc.). This shall be subject to the approval of the Planning Department. 9. The site shall be maintained per the plans on file in the Planning Department. 10. That CUP 89-020 shall not take effect until the owner and applicant have executed a form available at the Planning Department indicating awareness and acceptance of the conditions of approval. -2- 1429 . . . 11. Noncompliance with the provisions and conditions of this Conditional Use Permit shall constitute grounds for the immediate suspension or revocation of said Permit. 12, A six foot high decorative masonry wall shall be built along the north property line subject to the approval of the Planning Department. 13. The use of the building shall be restricted to American Legion members and their immediate family members. 14. The trash enclosure shall be relocated to the southwest corner of the lot (parking space #1 on site plan). Location, materials and landscaping shall be subject to the approval of the Planning Department. 15, The use of the meeting room, bar, game room' and pool room shall be restricted to the following hours: Monday through Saturday: 12 noon to 11:00 p,m. Sunday: 12 noon to 8:00 p.m, 16, The Planning Commission shall retain jurisdiction in so far as that if there are parking, circulation and/or noise problem(s) resulting from this use which are found by the Planning Department, at any time during the first twelve months that the American Legion building is open, a public hearing shall be scheduled for the purpose of determining the extent of the parking, circulation and/or noise problem(s), and for the consideration of modifying the original conditions of approval, or imposing additional conditions so as to mitigate the identified problem(s). Section 4. The decision, findings and conditions contained in this Resolution reflect the Commission's action of January 9, 1990 and the following vote: A YES: Commissioners Amato, Clark, Hedlund, Papay NOES: None ABSENT: None ABSTAIN: Commissioner Szany -3- 1429 . . . The Planning Department is recommending approval subject to the conditions outlined in the report. Facility will be used for American Legion activities, American Legion members and their families and rental of the hall to other organizations and groups. 16,300 square feet (.37 acre) 163 feet on live Oak Avenue EXISTING LAND USE & ZONING: Commercial building and a vacant lot; zoned C-2 SURROUNDING LAND USE & ZONING: North: Nonconforming single-family dwellings and unimproved 25'-0" wide public right-of-way; zoned C-2 CUP 89-020 1/9/90 Page 1 . . . South: East: West: Mixed commercial; zoned C-2 Restaurant; zoned C-2 Church; zoned C-2 GENERAL PLAN DESIGNAnON: Commercial PROPOSAL AND ANALYSIS The applicants are proposing to construct a new 3,300 square foot American Legion Hall at 615 and 619 East Live Oak Avenue, They will be moving from their present location at 720 N. First Avenue, The building will contain a meeting room/main hall, private bar, game room, pool room, kitchen, offices and storage rooms, A conditional use permit is required for any private dub, lodge and community service organization. Meetings are presently held twice each month from 8:00 pm to 9:00 pm. The private bar and game room will be open to members Monday through Saturday from 12 noon to 11:00 pm and on Sundays 12 noon to 8:00 pm, Other American Legion activities include sit-down breakfasts or dinners and entertaining other Legion Posts. The meeting room/ main hall will be made available to veterans and their families, orgaIli.1;ations and other groups. A letter from the American Legion dated November 22, 1989 is attached explaining the proposed use of the building. The Planning Department feels that there is adequate parking for American Legion activities. There is some concern about parking when the facility is used by veterans and their families, orgaIli.1;ations and other groups, It is staffs opinion that when other functions are held that are not part of the American Legion Post, they should be restricted to the meeting room/main hall, The bar should only be used to service the meeting room/main hall. Surrounding the subject site are commercially zoned properties, To the north are nonconforming single-family dwellings on C-2 zoned property, Separating the site along the north property line will be a 6" high concrete curb and a 6'-0" high chain link fence, There will be 35 parking spaces: 26 standard spaces, 8 compact and 1 handicapped, Two 20'-0" wide driveways will be located along Live Oak Avenue, Any new signs will need a Architectural Design Review application. The proposal would be consistent with the Zoning Ordinance and General Plan. CUP 89-020 1/9/90 Page 2 " . ARCHITECTURAL DESIGN REVIEW Concurrent with the consideration of this conditional use permit, the Planning Commission may approve, conditionally approve or deny the applicant's design concept plans. Staff believes that the applicant's proposal complies with the intent of the design criteria set forth in the City's Architectural Design Review Regulations. Pursuant to the provisions of the California Environmental Quality Act, the Planning Department has prepared an initial study for the proposed project. Said initial study did not disclose any substantial or potentially substantial adverse change in any of the physical conditions within the area affected by the project including land, air, water, minerals, flora, fauna, ambient noise and objects of historical or aesthetic significance. Therefore, a Negative Declaration has been prepared for this project, RECOMMENDAnON The Planning Department recommends approval of Conditional Use Permit 89-020 subject to the following conditions: . 1. FINDINGS AND MOTIONS Approval If the Planning Commission intends to take action to approve this project, the Commission should move to approve and file the Negative Declaration and find that the project will not have a significant effect on the environment and approve CUP 89-020 subject to the conditions of approval set forth in the staff report or as modi- fied by the Commission. Denial If the Planning Commission intends to take action to deny this project, the Commission should move to deny and direct staff to prepare an appropriate resolution incorporating the Commission's decision and findings in support of that decision, . CALI F OR N I A November 22, 1989 TO WHOM IT MAY CONCERN REFERENCE: Arcadia American Legion - Post #247 Proposed use of new Legion Post Building to be built at: 615 - 619 East Live Oak, Arcadia. . The building will contain a main hall or meeting room, private bar, game room, post room and kitchen. This is a Veterans Key Club and the liquor license is being transferred from our present Arcadia location at 620 N. First Avenue, Arcadia. We are not applying for a ABC Catering license. Post regular meetings are held the second and forth Tuesday of each month from 8 P.M. - 9 P.M. with an average attendance of approximately 25 members. Private bar and game rooms will be open to members Monday thru Saturday from 12 noon to 11 P.M. We may close on Sunday, however, if open, hours will be 12 noon to 8 P.M. From past history, very seldom are there more than 15 - 20 members at the Bar-Lounge or Game Room at one time. Our social functions are very limited, however, on occasion we do have sit-down breakfast or dinners for members and their familys or we may entertain other Legion Posts. Normally these functions are limited to' the Main Hall. In the past years, we have rented out our meeting hall to several outside groups, such as wedding parties, etc. We do not intend to continue with this at our new building. We would however, like to make the Main Hall available to Veterans and their families for specified activities. Any of these functions have to be approved by the nine member Building Committee. We do not let any group rent the complete building for these functions. The Bar-Lounge area is operated separate from the Main Hall, al- though it may service the Hall. Being a civic minded organization, we certainly would cooperate in renting the Meeting Hall to a recognized organization, if their attendance would be 60 or less persons. Live Oak Avenue In response to your memorandum, the items which this department has concern or special knowledge of are listed below: 1. The existing parkway width is twelve (12) feet on Live Oak Avenue, 2. Traffic volume will be increased, but there will be no major impact. 3. The sUbject property is served by the Los Angeles County Sanitation District. Therefore, a CSD and a City permit will be required, Thi s department has reviewed the subject CUP and recommends the foll owi ng conditions of approval: 1. Submit grading and drainage plan prepared by a registered civil engineer subject to the approval of the Director of Public Works, NOTE: Show all existing and proposed parkway trees, pull boxes, meters, power poles, street lights, driveways, sidewalks and handicapped ramps on grading/drainage plan, Parcel No.1 will be served by the County Sanitation District sewer line in Live Oak Avenue and will require a CSD permit. Install six-inch VCP sewer lateral to serve the property, The sewer connection will require a gas trap. Plant four (4) parkway trees at locations determined by the Director of Public Works per Arcadia City Standard Drawing S-13. Close existing driveways not to be used and reconstruct curb, gutter and sidewalk to match existing. Remove and replace deficient or damaged curb, gutter, sidewalk or pavement. Arrange with the Public Works Department for inspection prior to removal of existing gutter.
