RESOLUTION NO. 1427 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF .ARCADIA, CALIFORNIA, APPROVING MC 89-096 TO GRANT A MODIFICATION FOR A 28'-9" HEIGHT IN LIEU OF 16'-0" FOR A 1,309 SQUARE FOOT, DETACHED GARAGE AT 1026 SINGING WOOD DRIVE. WHEREAS, on November 6, 1989, an application was filed by Phil and Mary Catania for a 28'-9" high, detached garage, Planning Department Case No. MC 89- 096, on property commonly known as 1026 Singing Wood Drive, more particularly described as follows: In the City of Arcadia, County of Los Angeles, State of California, Parcel No.1 of Parcel Map No. 19809, as per map recorded in Book 209, Page 91 of Parcel Maps, in the Records of Said County. WHEREAS, a public hearing was held on November 28, 1989 by the Modification Committee at which time all interested persons were given full . opportunity to be heard and to present evidence; and WHEREAS, the Committee felt that a 13'-9" height modification is rather significant, referred MC 89-096 to the full Planning Commission; and WHEREAS, on December 12, 1989 the Planning Commission held a public hearing at which time all interested persons were given full opportunity to be heard and to present evidence; and WHEREAS, the Commission found that the specific design and location of the proposed garage mitigated the potential impacts upon the neighboring properties. NOW, THEREFORE, THE PLi\NNING COMMISSION OF THE CITY OF .ARCADIA HEREBY RESOL YES AS FOLLOWS: SECTION 1. That the factual data submitted by the Planning Department in the attached report is true and correct. SECTION 2. This Commission finds: A. That the granting of MC 89-096, subject to the condition that a covenant be executed and recorded by the applicants in a form acceptable to the City Attorney, that will limit the proposed accessory building to one floor, that it shall not be used . as accessory living quarters, nor as a separate dwelling unit, shall not be rented, and . . . shall not be equipped with any kitchen facilities, will not be detrimental to the public health or welfare, or injurious to the property or improvements in such zone or vicinity. B. That the requested modification, subject to the condition, will not have an adverse impact on any neighboring properties. C. That the conditional approval of MC 89-096 will secure an appropriate improvement and promote uniformity of development. SECTION 3. That for the foregoing reasons this Commission conditionally approves Planning Department Case No. MC 89-096. SECTION 4. The decision and findings contained in this Resolution reflect the Commission's action of December 12, 1989 and the following vote: A YES: Amato, Clark, Hedlund, Szany and Papay NOES: None ABSENT: None SECTION 5. The Secretary shall certify to the adoption of this Resolution and shall cause a copy to be forwarded to the City Council of the City of Arcadia. Kasama, Assistant Planner CASE NO.: MC 89-096: Referred to the Planning Commission by the Modification Committee SUMMARY This Modification application was filed by Phil and Mary Catania and requests approval of a detached garage which would be 28'-9" in height in lieu of 16'-0" allowed by Code, at 1026 Singing Wood Drive. The Modification Committ~ felt this was a significant request and referred it to the Planning Commission. GENERAL INFORMATION APPLICANTS: Phil and Mary Catania 1026 Singing Wood Drive A 28'-9" height in lieu of 16'-0" for a 1,309 sq. ft., detached garage (with bathrooms) (9251.2.8) ADDRESS: REQUEST: LOT AREA: Approximately 32,299 square feet (0.741 acre) 110.0 feet LOT WIDTII: EXISTING LAND USE & ZONING: The subject site has been cleared of structures; the zoning is R-o/30,000. GENERAL PLAN DESIGNATION: SF-2, Single-family residential (2 d.u./acre). SURROUNDING LAND USE & ZONING: The surrounding properties are all developed with single family residences. The area is zoned R-0/30,000. . . . BACKGROUND The Modification Committee (Amato, McIntyre and Woolard) considered applica- tion MC 89-096 at a public hearing on November 28, 1989. The applicant was requesting the height Modification so that the garage would'be harmonious with the proposed 35'-0" high house. The proposal had been approved by the Architectural Review Board of the Rancho Santa Anita Property Owners Association. Ms. Renee Shevell, the adjacent westerly neighbor at 1032 Singing Wood Drive, attended the hearing to express her concerns, but, did not oppose the proposal. No one else presented any opposition. The Committee's opinion was that this request was significant and may establish a precedent. Therefore, the Committee decided to refer this application to th~ Planning Commission. ANALYSIS Section 9251.2.8 sets forth regulations for accessory buildings. It reads as follows: Accessory buildings shall not occupy more than 25% of a required rear yard and shall not be located within three feet of a rear lot line, nor within ten feet of another building. An accessory building shall not have more than one story and shall not exceed sixteen feet in height. The total floor area of accessory buildings shall not exceed 50% of the ground floor area of the main building; if required parking space is detached from the main building, said total area may be increased by 200 square feet. These regulations assure that accessory buildings will be appropriately sized and located. In the case of this Modification request, however, the proposed accessory building will be completely clear of the required 35 foot rear yard, will be approxi- mately 67 feet from the rear lot line, 45 feet behind the main building, and has only 31.6% of the ground floor area of the main building. In addition, it will be setback 15 feet from the westerly side lot line and the roof will slope down towards it. The design and location, of the proposed garage, mitigate the impacts the requested 28'-9" height might otherwise present. The Code would allow a 16 foot high, flat roofed, 2,071 square foot accessory building to be located three feet from the rear lot line and ten feet from the side lot line. The proposed garage, with its greater set- backs and gabled roof, will have a lesser affect upon the neighbors as well as being more aesthetically appealing. It should be noted that if this proposed garage were connected to the main building, by a fully enclosed and roofed area, it would be part of the main building and not an accessory building, and it would fully comply with all zoning requirements. PLANNING COMMISSION'S FINDINGS Approval If the Planning Commission intends to take action to approve this request, the Commission should find that approval of MC 89-096 would secure an appropriate improvement, prevent an unreasonable hardship, or promote uniformity of devel- opment, and move to approve this request and direct Staff to prepare an appropriate resolution. Staff recommends that as a condition of approval, it be required that a covenant be executed and recorded by the applicant, in a form acceptable to the City Attorney, that will limit the proposed accessory building to one floor, that it shall not be used as accessory living quarters, nor as a separate dwelling unit, shall not be rented, and shall not be equipped with any kitchen facilities. This covenant it to assure that any subsequent owners will be aware of the status of this garage. The covenant is to be recorded prior to a final i~pection of the acces- sory building. Denial If the Planning Commission intends to take action to deny this request, the Com- mission should find that approval of MC 89-096 would not secure an appropriate improvement, nor prevent an unreasonable hardship, nor promote uniformity of development, and move to deny this request and direct Staff to prepare an appropri- ate resolution. The request is for a 28'-9" height for a 1,309 sq. ft. detached garage which is part of a proposed new residential project. The applicant is requesting the height Modification so that the garage will be harmonious with the proposed 35'-0" high house. The proposal has been approved by the Architectural Review Board of the Rancho Santa Anita Property Owners Association.
