MC 89-089 FOR A 37'-0" FRONT YARD SETBACK IN LmU OF THE 62'-6" AVERAGE OF THE TWO NEAREST RESIDENCES FOR A PROPOSED NEW TWO STORY HOUSE AT 1020 SINGING WOOD DRIVE. WHEREAS, on October 9,1989, an application was filed by Mr. Chia Hsiung Lin for a new two story house, Planning Department Case No. MC 89-089, on property commonly known as 1020 Singing Wood Drive, more particularly described as follows: The easterly 110.0 feet of Lot 24 of Tract No. 12803 in the City of Arcadia, County of Los Angeles, State of California as per Map recorded in Book 262, Pages 11 and 12 of Maps in the records of said County. WHEREAS, a public hearing was held on October 24, 1989 by the Modification Committee at which time all interested persons were given full opportunity to be heard and to present evidence; and WHEREAS, the Committee found that the Architectural Review Board of the Rancho Santa Anita Property Owner's Association had approved the proposed design on June 8, 1989, and that the Public Works Department has no objections to the requested Modification; and WHEREAS, the Committee determined that the request is too extensive and referred MC 89-089 to the Planning Commission; and WHEREAS, on November 14, 1989 the Planning Commission held a public hearing on MC 89-089, and all interested persons were given full opportunity to be heard and to present evidence; and WHEREAS, the Commission determined that the subject property is large enough to accommodate a house without a Modification, and that the forty foot front setback of the previously existing house was an exception in the neighborhood, and that the proposed house is significantly larger and higher than the previous house; and WHEREAS, based upon their determinations, the Commission denied Planning Department Case No. MC 89-089. NOW, TIIEREFORE, THE PLANNING COMMISSION OF TIIE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: SECTION 1. That the factual data submitted by the Planning Department in the . . . attached report is true and correct. SECTION 2. This Commission finds: A. That the granting of Planning Department Case No. MC 89-089 would be injurious to the property or improvements in such zone or vicinity. B, That the requested modification would have an adverse impact on the adjoining properties to the east and west, as well as upon those across the street. C. That approval of MC 89-089 would not secure an appropriate improvement, nor relieve a hardship, nor promote uniformity of development. SECTION 3, That for the foregoing reasons this Commission denies Planning Department Case No. MC 89-089. SECTION 4. The decision and findings contained in this Resolution reflect the Commission's action of November 14, 1989 and the following vote: A YES: Amato, Clark, Hedlund, Papay and Szany NOES: None ABSENT: None SECTION 5. The Secretary shall certify to the adoption of this Resolution and shall cause a copy to be forwarded to the City Council of the Oty of Arcadia. Kasama, Assistant Planner CASE NO.: MC 89-089: Referral by Modification Committee SUMMARY This Modification application was filed by Chia Hsiung Un for a 37'-0" front yard set- back in lieu of the 62'-6" average of the two nearest developed lots for a new 6,624 square foot, two story residence and attached three-car garage at 1020 Singing Wood Drive. The Modification Committee felt this is an extensive request and referred it to the Planning Commission. GENERAL INFORMATION APPLICANT: Chia Hsiung Lin ADDRESS: 1020 Singing Wood Drive REQUEST: A 37'-0" front yard setback in lieu of the 62'-6" average of the two nearest developed lots (1004 & 1032 Singing Wood Dr.) for a new two story residence (9251.2.8) LOT AREA: LOT WIDTH: Approximately 30,364 square feet (0.697 acre) 110.0 feet EXISTING LAND USE & ZONING: The subject site has been cleared with the exception of several trees and a tennis court; the zoning is R-0/30,000. GENERAL PLAN DESIGNATION: SF-2, Single-family residential (2 d.u./acre). SURROUNDING LAND USE & ZONING: The surrounding properties are all developed with single family residences. The area is zoned R-0/30,000. . . . BACKGROUND The Modification Committee (Clark, Feinberg and Butler) considered application MC 89-089 at a public hearing on October 24, 1989. The Committee's opinion is that this request is too extensive. However, because the Architectural Review Board of the Rancho Santa Anita Property Owner's Association had approved the proposal, a denial by the Committee would result in conflicting determinations. Therefore, the Committee decided to refer this application to the Planning Commission. Findings Of Public Hearin~ MC 89-089 The subject property is the easterly portion of what was a double lot. The proposal is for a new 6,624 sq, ft., two story residence with an attached three car garage. The applicant is requesting a front setback equivalent to that of the former house. The new structure will be at 40'-0" and the 37'-0" is to accommodate a porch overhang. The proposal has been approved by the Architectural Review Board of the Rancho Santa Anita Property Owners Association (ARB) and the Public Works Department has no objections to this request. A letter of opposition had been received from Mr. Michael J. Mangana of 1025 Hampton Road. The applicant explained that the requested setback would enable the saving of a 36" diameter oak tree, as well as, provide a more useful space between the new house and an existing tennis court. The former house was at a 40'-0" front setback. The new house has been designed so that it is lower in height towards the front to lessen its visual impact upon the street. The Committee felt that a 25'-6" Modification is rather extreme. While the former house was at 40'-0", it was the exception on that street. Also, the saving of the oak is commendable, however, the only benefit is to the subject property while the reduced setback impacts the neighborhood. Because the ARB had approved the proposal, a denial by the Committee would result in conflicting determinations. Therefore, the Committee decided to refer application MC 89-089 to the Planning Commission for consideration at the Novem- ber 14, 1989 meeting. Additional Information A total of three letters of opposition have been received. Mr. Mangana's was intro- duced at the Modification hearing. Phil and Mary Catania own the adjacent lot to the west at 1026 Singing Wood Drive, and, Mr. George R. Meeker's residence is at 1025 Singing Wood Drive. Me 89.ol9 November 14, 1989 Page 2 . . . No. 432171 October 19, 1989 city of Arcadia 240 West Huntington Drive Arcadia, CA 91006 Re: MC 89-089 please accept this letter as a Letter of Opposition to a 37'-0" front yard setback in lieu of the 62'-6" average of the two nearest residences for a proposed new two story residence (9251.2.2.) I would like to know why they are requesting such an extreme difference to the required front yard setback. I was at Ann Cooper's home when they submitted their design for their home and it was approved. At that meeting they were going to transplant their oak trees that were in the way. Now they come in requesting this variance and I wonder if their plans would have been approved with this knowledge that they intended to move the house within 37 feet of the front property line and not transplant the oak tree(s). Huntington Drive Arcadia, Ca. 91006 Re: Application MC 89-089 To Whom it May Concern: Let this letter serve as our written Letter of Opposition in regards to the above mentioned application regarding a 37' front yard setback for a new proposed residence at 1020 Singing Wood Drive. We attended the Homeowners Metting at Ann Cooper's home regarding this residence, and this was not presented to us in this way. Their plans passed at the meeting without our knowledge of this setback. If it had been presented that evening, we would not have voted our approval. We are in definate opposition. With our home being built next door at 1026 Singing Wood Drive, and our setback at approximately 70' which conforms to the neighborhood, we feel this residence should conform also. Box 60 Arcadia, CA 91006 Re: Application No. MC 89-089 Dear Mr. Kasama, I'm sorry I was unable to attend the October 24, 1989 Public Hearing regarding the setback variance at 1020 Singing Wood Drive because of health conditions. I strenuously oppose the setback variance that has been asked for. I believe the city code on this matter should be upheld 100% and the setback should be the 62'6". . We face this property and feel that the valuse of all the residences are at stake in this matter. We wish to maintain the beauty and excellence of this residential neighborhood.
