RESOLUTION 1425 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA, STATE OF CALIFORNIA., GRANTING CONDmONAL USE PERMIT 89-017 TO EXPAND THE EXISTING SERVICE STATION AT 4 WEST FOOTHILL BOULEVARD. WHEREAS, on October 2, 1989 an application was filed by Fred Fiedler and Associates on behalf of Union Oil Company of California to expand the existing service station, Planning Department Case No. c.u.P. 89-017, on property commonly known as 4 W. Foothill Boulevard, more particularly described as follows: SEE EXHIBIT "A" WHEREAS, a public hearing was held on October 24, 1989, at which time all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: Section 1. That the factual data submitted by the Planning Department in the attached report is true and correct. Section 2. This Commission finds: 1. That the granting of such Conditional Use Permit will not be detrimental to the public health or welfare, or injurious to the property or improvements in such zone or vicinity. 2. That the use applied for at the location indicated is a proper use for which a Conditional Use Permit is authorized. 3. That the site for the proposed use is adequate in size and shape to accommodate said use. All yards, spaces, walls, fences, parking, loading, landscaping and other features are adequate to adjust said use with the land and uses in the neighborhood. 4. That the site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. 5. That the granting of such Conditional Use Permit will not adversely affect the comprehensive General Plan. 6. That the use applied for will not have a substantial adverse impact on the environment. 1425 -1- . Section 3. That for the foregoing reasons this Commission grants a Conditional Use Permit to expand the existing service station, upon the following conditions: 1. The following conditions shall be complied with to the satisfaction of the Public Works Director. A. Submit grading and drainage plan prepared by a registered civil engineer subject to the approval of the Director of Public Works. Provide calculations for gravity drainage system. Computations should show hydrology, hydraulics and elevations. NOTE: Show all existing and proposed parkway trees, pull boxes, meters, power poles, street lights, driveways, sidewalks and handicapped ramps on grading/drainage plan. B. Plant eight (8) parkway trees at locations determined by the Director of Public Works per Arcadia City Standard Drawing 5-13. C Close existing driveways not to be used and reconstruct curb, gutter and sidewalk to match existing. D. Remove and replace deficient or dama~ed curb, gutter, sidewalk or pavement. E. Construct P.c.c. ramp for the handicapped per Arcadia City Standard Drawing No. S-22. F. All survey monuments, centerline ties and survey reference points shall be protected in place or re-established where disturbed. This work will be the responsibility of the permittee and shall be at the permittee's expense. G. The above. items are to be complied with to the satisfaction of the Director of Public Works in accordance with the applicable provisions of the Arcadia Municipal Code. 2. Fire protection, building occupancy and water requirements shall be maintained to the satisfaction of the Arcadia Fire Department which shall include the following: A. Central station fire alarm system is required per N.F.P.A. standards #71 and 72E. Plans shall be submitted and approved prior to installation. B. Fire hydrant required on Santa Anita Wash. C V.F.C. Section 29.104(b) drains in garage floor required and Section 79.907 grade in service station. . . 1425 -2- . . . 3. That the Certificate of Compliance and Covenant for a common driveway for Tentative parcel Map 88-006 shall be executed and recorded prior to issuance of building permits. 4. Any change in water service shall be installed by the Arcadia Water Division at the applicant's expense. 5. All work on vehicles shall be done inside the building. The only exception shall be work customarily done at the gasoline dispensers. 6. Auto body painting and auto body work shall be prohibited. 7. No vehicles shall be parked on the premises which are offered for sale, lease or rent. 8. No vehicles shall be parked on the premises other than those of persons attending to business on the site, vehicles being serviced for customers, vehicles of employees and tow trucks and other service vehicles. No. vehicles belonging to employees or customers shall be parked on streets, alleys, sidewalks or required landscaped strips. 9. All merchandise, wares and crates, in the form of temporary and permanent storage or displays shall be within the building. 10. Service station shall comply with all other applicable regulations found int he Zoning Ordinance, Division 5, Title 4. 11. A landscape and irrigation plan shall be submitted to the Planning Department for review and approval prior to issuance of building permits. A substantial buffer shall be required along Tindalo Road. 12. The subject site shall be maintained as per th,e plans on file in the Planning Department. 13. ThatC.U.P. 89-017 shall not take effect until the owner and applicant have executed a form available at the Planning Department indicating awareness and acceptance of the conditions of approval. 14. Noncompliance with the provisions and conditions of this Conditional Use Permit shall constitute grounds for the immediate suspension or revocation of said permit. Section 4. The decision, findings and conditions contained in this Resolution reflect the Commission's action of October 24, 1989 and the following vote: A YES: Commissioners Amato, Clark, Hedlund, Szany, Papay NOES: None ABSENT: None 1425 -3- . Section 5. The Secretary shall certify to the adoption of this Resolution and shall cause a copy to be forwarded to the City Council of the City of Arcadia. WONG, ASSOCIATE PLANNER c.u.P. 89-017 This Conditional Use Permit application was filed by Fred Fiedler & Associates for the expansion of an existing automobile service station at 4 West Foothill Blvd. The Planning Department is recommending approval. North: Automobile service station and church; zoned C-2 Vacant lot; zoned C-2 Mixed commercial; zoned C-"2 Single-family dwellings; zoned R-l South: East: West: GENERAL PLAN DESIGNATION: Commercial HISTORY On November 12, 1968 the Planning Commission approved CUP 68-19 (Resolution 666) for the construction of a new service station at the southwest corner of Foothill Blvd. and Santa Anita Avenue. The size of the lot was 18,000 square feet (125' x 147'). On June 7,1988 the City Council approved a lot line adjustment creating two rectangular shaped lots (TPM 88-006). The subject lot with the service station being 143.49 feet in width and 218.66 feet in depth (31,108 sq. ft.) while the vacant lot to the south having 76.50 feet in width and 218,66 feet in depth (16,538 sq. ft.). As of October 20, 1989 the Certificate of Compliance for the lot line adjustment and Covenant for a common driveway have not been recorded. The Planning Department will be requiring that said Certificate and Covenant shall be recorded prior to issuance of building permits for the expansion of the service station. PROPOSAL AND ANALYSIS The applicant is proposing to enlarge the existing service station by adding a lube bay, storage room, locker room, customer room and 2 product dispensers (gas pumps). A new 2~-6" x 47'-0" canopy will be placed along Foothill Blvd. The vacant area to the west will be paved to accommodate 22 parking spaces and a trash enclosure. Additional landscaping will be provided along Foothill Blvd, Tindalo Road and along the south property line. No driveways will be added. All new building materials will match the existing structures. A automobile service station is a permitted use in the C-2 zone with an approved conditional use permit. CUP 89-017 10/24/89 Page 2 . . . Pursuant to the provisions of the California Environmental Quality Act, the Plan- ning Department has prepared an initial study for the proposed project, Said initial study did not disclose any substantial or potentially substantial adverse change in any of the physical conditions within the area affected by the project including land, air, water, minerals, flora, fauna, ambient noise and objects of historical or aesthetic significance. Therefore, a Negative Declaration has been prepared for this project. ARCHITECTURAL DESIGN REVIEW Concurrent with the consideration of this conditional use permit, the Planning Commission may approve, conditionally approve or deny the applicant's design concept plans. Staff believes that the applicant's proposal complies with the intent of the design criteria set forth in the City's Architectural Design Review Regulations. RECOMMENDATION The Planning Department recommends approval of Conditional Use Permit 89-017 subject to the following conditions: 1. Conditions as outlined in the attached report from the Department of Public Works shall be complied with to the satisfaction of the Director of Public Works. 2. Fire protection, building occupancy and water requirements shall be maintained to the satisfaction of the Arcadia Fire Department which shall include the following: A. Central station fire alarm system is required per N.F.P.A. standards #71 and 72E. Plans shall be submitted and approved prior to installation. B. Fire hydrant required on Santa Anita Avenue. C U.F.C. Section 29.104 (b) drains in garage floor required and Section 79.907 grade in service station. 3. FINDINGS AND MOTIONS . . Approval If the Planning Commission intends to take action to approve Conditional Use Permit 89-017, the Commission should move to approve and file the Negative Declaration and fmd that the project will not have a significant effect on the environment and direct staff to prepare the appropriate resolution incorporating the specific findings and conditions of approval set forth in the staff report, or as modified by the Commission. Denial If the Planning Commission intends to take action to deny Conditional Use Permit 89-017, the Commission should move to deny and direct staff .to prepare an appropriate resolution incorporating the Commission's decision and supporting findings. The Planning Commission may wish to consider the following motions and findings which should be expanded upon with specific reasons for denial: D.l Find that the granting of this conditional use permit will be detrimental to the public health or welfare or injurious to the property or improvements in such zone or vicinity. D.2 Find that the use applied for at the location indicated is not properly one for which a conditional use permit is authorized. D.3 Find that the site for the proposed use is not adequate in size and shape to accommodate said use, and all yards, spaces, walls, fences, parkin& loading, landscaping, and other features required to adjust said use with the land and uses in the neighborhood. D.4 Find that the site abuts streets and highways inadequate in width and pavement type to carry the kind of traffic generated by the proposed use. Find that the granting of this conditional use permit will adversely affect the comprehensive general plan. Find that the location and configuration of the structures are not visually harmonious with their sites and with surrounding sites and structures, and that the structures dominate their surroundings to an extent inappropriate to their use. CUP 89-017 10/24/89 Page S . . . 0.8 Find that the plans for the landscaping of open spaces do not conform to the requirements set forth in the code, and that they do not provide visually pleasing settings for structures on the site and on adjoining and nearby sites and conflict with the natural landscape. D.9 Find that the design and location of signs and their materials and colors are not consistent with the character and scale of the buildings to which they are attached or which are located on the same site, and that the signs are not visually harmonious with surrounding development. Foothill - Service station In response to your memorandum, the items which this department has concern or special knowledge of are listed below: 1. The existing parkway widths are ten (10) feet on Foothill Boulevard, ten (10) feet on Santa Anita Avenue and twelve (12) feet on Tindalo Road. 2. Traffic volume will be increased, but there will be no major impact. 3. The subject property is served by a sewer line that has the capacity to transport sewage flows generated in accordance with land use reflected in the city's current general plan to CSD's system. This department has reviewed the subject CUP and recommends the following conditions of approval: 1.
