RESOLUTION 1421 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, GRANTING CONDmONAL USE PERMIT 89-014 TO OPERATE AN EATING ESTABLISHMENT WITH SEATING FOR 12 PERSONS AT 10 EAST HUNTINGTON DRIVE. WHEREAS, on August 21,1989 an application was filed by n S. Yu, to operate an eating establishment with seating for 12 persons, Planning Department Case No. C.U.P. 89-014, on property commonly know as 10 E. Huntington Drive, more particularly described as follows: Lots 31, 32, 33 and 34 of Block 73 of Arcadia Santa Anita Tract, as per Map recorded in Book 15, Pages 89 and 90 of Miscellaneous Records in the office of the Los Angeles County Recorder. WHEREAS, a public hearing was held on September 12, 1989, at which time all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: Section 1. That the factual data submitted by the Planning Department in the attached report is true and correct. Section 2. This Commission finds: 1. That the granting of such conditional use permit will not be detrimental to the public health or welfare, or injurious to the property or improvements in such zone or vicinity. 2. That the use applied for at the location indicated is a proper use for which a conditional use permit is authorized. 3. That the site for the proposed use is adequate in size and shape to accommodate said use. All yards, spaces, walls, fences, parking, loading, landscaping and other features are adequate to adjust said use with the land and uses in the neighborhood. 4. That the site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. S. That the granting of such conditional use permit will not adversely affect the comprehensive General Plan. 1421 -1 - '( . . . . 6. That the use applied for will not have a substantial adverse impact on the environment. Section 3. That for the foregoing reasons this Commission grants a Conditional Use Permit 0 operate an eating establishment with seating for 12 persons, upon the following conditions: 1. Seating shall be limited to a maximum of twelve (12) persons. 2. A modification shall be granted for 49 parking spaces in lieu of 66 parking spaces. This approval shall not constitute an approval for a reduction in parking for the entire commercial retail center. Rather, this parking modification shall only be for the eating establishment approved by CUP 89-014. 3. Fire protection and building occupancy shall be maintained to the satisfaction of the Arcadia Fire Department. 4. Any changes in water service shall be installed by the Arcadia Water Division at the applicant's expense. Also, backflow protection may be required, subject to field inspection by the Water Division. S. The Public Works Department notes that the grease interceptor capacity and size shall comply with provisions of Uniform Plumbing Code and shall be subject to the approval of the Building and Safety Department. 6. The subject site shall be maintained as per the plans on file in the Planning Department. 7. That C.U.P. 89-014 shall not take effect until t~e owner and applicant have executed a form available at the Planning Department indicating awareness and acceptance of the conditions of approval. 8. Noncompliance with the provisions and conditions of this Conditional Use Permit shall constitute grounds for the immediate suspension or revocation of said Permit. Section 4. The decision, findings and conditions contained in this Resolution reflect the Commission's action of September 12, 1989 and the following vote: A YES: Commissioners Amato, Oark, Szany, Papay NOES: None ABSTAIN: Commissioner Hedlund . . 1421 -2- . . WONG, ASSOCIATE PLANNER c.u.P. 89-014 CASE NO.: SUMMARY This Conditional Use Permit application was filed by n S. Yu for an eating establishment with seating for sixteen people at 10 East Huntington Drive. The Planning Department is recommending approval for an eating establishment with seating for twelve persons. GENERAL INFORMATION APPLICANT: ns. Yu LOCATION: 10 East Huntington Drive REQUEST: Conditional Use Permit for an eating establishment with seating for sixteen people. Parking modification required. LOT AREA: Approximately 29,433 square feet (.68 acre) 146.00 feet along Santa Anita Avenue 201.60 feet along Huntington Drive FRONTAGE: EXISTING LAND USE &: ZONING: 9,428 square foot commercial retail building; zoned C-2H SURROUNDING LAND USE &: ZONING: North: South: East: West: Restaurant and mixed commercial; zoned C-2H Multiple-family residential; zoned R-3H and PR-3H Restaurant and mixed commercial; zoned C-2H County Park; zoned 5-2 . . . . . . GENERAL PLAN DESIGNATION: Commercial PROPOSAL AND ANALYSIS The applicant is requesting a conditional use permit so that seating for 16 people could be added to the existing take-out only food business (Burrito Flats). The business occupies 1,227 square feet (13%) of the 9,428 square foot retail building. A take-out food business is permitted without a conditional use permit. By adding tables with chairs the business changes from a retail activity to an eating establishment which requires a conditional use permit. Code requires 48 parking spaces for the 9,428 square foot retail building, 49 parking spaces have been provided. A retail business requires 5 parking spaces per 1,000 square feet of gross floor area, but an eating establishment needs 20 spaces per 1,000 square feet. Due to the difference in required parking, the proposed eating establishment increases the required parking for the entire center to 66 spaces. It is staff's opinion that by limiting the seating, this eating establishment would not be detrimental to the site or the surrounding properties. The parking impacts from this one eating establishment with seats within this shopping center is by itself not significant. Since 1982 there have been numerous conditional use permits approved for eating establishment with limited seating. In most cases the Planning Department has recommended that the maximum seating be limited to 12 persons. By restricting the seating within these eating establishments the Planning Department feels the parking requirement for a retail business of 5 spaces per 1,000 square feet is adequate. The Planning Department is concerned with the potential increase in traffic when the subject site is fully utilized. The site has had only one tenant until recently. Uses such as eating establishments and restaurants require conditional use permits and traffic issues can be addressed as part of the consideration of such applications. Other uses such as convenience stores do not require conditional use permits and would be permitted even though they generally are associated with increased vehicular traffic. While the Planning Department is recommending approval of this particular conditional use permit, we believe that the seating at this time should should be limited to twelve (12) persons. Pursuant to the provisions of the California Environmental Quality Act, the Planning Department has prepared an initial study for the proposed project. Said initial study c.u.P. 89-014 9/12/89 Page 2 . . . . . . did not disclose any substantial or potentially substantial adverse change in any of the physical conditions within the area affected by the project including land, air, water, minerals, flora, fauna, ambient noise and objects of historical or aesthetic significance. Therefore, a Negative Declaration has been prepared for this project. RECOMMENDATION The Planning Department recommends approval of Conditional Use Permit 89-014 subject to the following conditions: 1. Seating shall be limited to a maximum of twelve (12) persons. 2. A modification shall be granted for 49 parking spaces in lieu of 66 parking spaces. This approval shall not constitute an approval for a reduction in parking for the entire commercial retail center. Rather, this parking modification shall only be for the eating establishment approved by CUP 89-014. 3. FINDINGS AND MOTIONS Approval If the Planning Commission intends to take action to approve Conditional Use Permit 89-014, the Commission should move to approve and file the Negative Declaration and find that the project will not have a significant effect on the environment and direct staff to prepare the appropriate resolution incorporating the specific findings and conditions of approval set forth in the staff report, or as modified by the Commission.
