RESOLUTION 1419 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, GRANTING CONDmONAL USE PERMIT 89-013 TO OPERATE A CHURCH AT 422 WEST LEMON AVENUE (THE BALDWIN STOCKER ELEMENTARY SCHOOL). WHEREAS, on July 17, 1989 an application was filed by Christian Assembly Church, to utilize the multi-purpose room at the Baldwin Stocker Elementary School for church activities on Sundays between the hours of 9:00 a.m. and 12:00 noon, Planning Department Case No. c.u.P. 89-013 at 422 West Lemon Avenue (Baldwin Stocker Elementary School), more particularly described as follows: Lots 61-64 and the east 60', south 190 feet and north 194.33 feet of Lot 65, Tract 4869 in the City of Arcadia, County of Los Angeles, State of California as on file in Map Book 52, Page 13 in the County Recorder's Office. WHEREAS, a public hearing was held on August 22, 1989, at which time all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA . HEREBY RESOLVES AS FOLLOWS: Section 1. That the factual data submitted by the Planning Department in the attached report is true and correct. Section 2. This Commission finds: 1. That the granting of such Conditional Use Perniit will not be detrimental to the public health or welfare, or injurious to the property or improvements in such zone or vicinity. 2. That the use applied for at the location indicated is a proper use for which a Conditional Use Permit is authorized. 3. That the site for the proposed use is adequate in.size and shape to accom- modate said use. All yards, spaces, walls, fences, parking, loading, landscaping and other features are adequate to adjust said use with the land and uses in the neighborhood. Parking is located adjacent to the multi-purpose room and adjacent to Lemon Avenue. There is adequate on-site parking to accommodate the traffic generated by the church. 4. That the site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. 5. That the granting of such Conditional Use Permit will not adversely affect the . comprehensive General Plan. -1- 1419 . . . 6. That the use applied for will not have a substantial adverse impact on the environment. Section 3. That for the foregoing reasons this Commission approves a Conditional Use Permit to utilize the multi-purpose room at the school for church activities upon the following conditions: 1. That the maximum number of parishioners be restricted to 100 persons. 2. That the church activities shall be limited to the hours of 9:00 a.m. through 12:00 noon on Sundays only. 3. That there shall be no church-related outdoor activities conducted on the school premises. 4. That the church shall receive final approval from the Arcadia Unified School District Board of Education prior to operation of the church and a copy of said approval shall be forwarded to the Planning Department prior to commencing activities on the site. S. That C.U.P. 89-013 shall not take effect until the owner and applicant have executed a form available at the Planning Department indicating awareness and acceptance of the conditions of approval. 6. Noncompliance with the provisions and conditions of this Conditional Use permit shall constitute grounds for the immediate suspension or revocation of said Permit. Section 4. The decision, findings and conditions contained in this Resolution reflect the Commission's action of August 22, 1989 and the following vote: A YES: Commissioners Amato, Clark, Papay NOES: None ABSENT: Commissioners Hedlund, Szany Section S. The Secretary shall certify to the adoption of this Resolution and shall cause a copy to be forwarded to the City Council of the Oty of Arcadia. -2- 1419 . . . BUTLER, SENIOR PLANNER CASE NO.: c.u.P. 89-013 FROM: SUMMARY This application was filed by Christian Assembly Church requesting a conditional use permit to utilize the multi-purpose room at the Baldwin Stocker Elementary School for church activities on Sundays between the hours of 9:00 a.m. and 12:00 noon. The Planning Department is recommending approval subject to the conditions set forth in the staff report. GENERAL INFORMATION APPliCANT: Christian Assembly Church 422 West Lemon Avenue (Baldwin Stocker Elementary School) LOCATION: REQUEST: Conditional use permit to conduct church services on Sundays between the hours of 9:00 a.m. to 12:00 noon EXISTING LAND USE &: ZONING: The site is developed with the Baldwin Stocker Elementary School; zoned R-l SURROUNDING LAND USE &: ZONING: Properties to the north, south and east are developed with the single family residences, zoned R-l. Property to the west is developed with a parking; zoned R-1 c.u.P. 89-013 Page 1 August 22,1989 . . . . GENERAL PLAN DESIGNATION: Single-Family Residential D-6 du/ac PROPOSAL The applicant is proposing to utilize the multi-purpose room at Baldwin Stocker Elementary School for the purposes of conducting church services on Sunday between the hours of 9:00 a.m. and 12:00 noon. The portion of the multi-purpose room to be utilized contains a total of 3,712 square feet. The applicants have indicated that at present time they have a maximum of 70 persons attending services. Based upon occupancy requirements the room could accommodate 300 persons. As per the applicant's conversation with me they have indicated that they anticipate the use of the school on a short term basis only until they can find a permanent location for their church. The multi-purpose room is located mid-way on the school property. There is a total of 31 marked on-site parking spaces. Ten of these parking spaces are located adjacent to this building and an additional 21 spaces are at the front of the schOOl along Lemon A venue. Code requires 1 parking space for every 5 fixed seats or 1 space for every 35 sq. ft. of floor area. Based upon the floor area 106 parking spaces would be required. However, based upon the current number of parishioners, 14 spaces would be required (1 for every 5). Pursuant to the provisions of the California Environmental Quality Act, the Planning Department has prepared an initial study for the proposed project. Said initial study did not disclose any substantial or potentially substantial adverse change in any of the physical conditions within the area affected by the project including land, air, water, minerals, flora, fauna, ambient noise and objects of historical or aesthetic significance. Therefore, a Negative Declaration has been prepared for this project. SPECIAL INFORMATION On July 24, 1989, the Arcadia Unified School District Board of Education adopted Resolution 618 allowing the use of school facilities at Baldwin Stocker Elementary School Cafetorium and Restrooms for Church Services. The time frame identified in the Resolution was each Sunday from 9:00 a.m. to 12:00 p.m. The resolution notes that "the Arcadia Unified School District C.U.P. 89-013 Page 2 August 22,1989 . '. # . intends to lease such facility, renewal on an annual basis by mutual agreement, to the highest bidder..." This renewal can be for a maximum of 5 years without going out to bid again. Bids were opened on Wednesday, August 16th and the only bidder was the applicant; Christian Assembly Church. According to the school purchasing officer any applicant requesting to utilize school premises must have a plan to find a permanent location. Also, the acceptance of this bid will require final approval by the Board of Education. ANALYSIS A church is a permitted use in an R-l zone with an approved conditional use permit. It is staffs opinion that conducting church services at this location will have a minimal impact on the adjoining properties, if there are specific conditions which limit both the activities on the premises and the maximum number of persons attending the services. There is adequate on-site parking to accommodate said use and the location of the building minimizes the noise impact on adjoining properties. Staff recommends that the maximum number of parishioners be limited to 100 and that there be no church-related outdoor activities conducted on the school premises. RECOMMENDATION The Planning Department recommends approval of C.U.P.. 89-013 subject to the following conditions: 1. That the maximum number of parishioners be restricted to 100 persons. 2. That the church activities shall be limited to the hours of 9:00 a.m. through 12:00 noon on Sundays only. 3. That there shall be no church-related outdoor activities conducted on the school premises. 4. That the church shall receive final approval from the Arcadia Unified School District Board of Education prior to operation of the church and C.U.P. 89-013 Page 3 August 22,1989 - . . . a copy of said approval shall be forwarded to the Planning Department prior to commencing activities on the site. 4. That c.u.P. 89-013 shall not take effect until the owner and applicant have executed a form available at the Planning Department indicating awareness and acceptance of the conditions of approval. 5. Noncompliance with the provisions and conditions of this Conditional Use permit shall constitute grounds for the immediate suspension or revocation of said Permit. FINDINGS AND MOTIONS Approval If the Planning Commission intends to take action to approve this project, the Commission should move to approve and file the Negative Declaration and find that the project will not have a significant effect on the environment and direct staff to prepare the appropriate resolution incorporating the specific findings and conditions of approval set forth in the staff report (or as modified by the Commission). Denial If the Planning Commission intends to take action to deny this project, the Commission should move to deny and direct staff to prepare an appropriate resolution incorporating the Commission's decision and findings in support of that decision.
