RESOLUTION 1418 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, AMENDING CONDmON NO.1 OF RESOLUTION 1333 (CONDmONAL USE PERMIT 87-6) TO PERMIT 10 ADDmONAL SEATING STOOLS WITHIN THE VONS PAVILIONS STORE AT 745 NAOMI AVENUE. WHEREAS, on July 21, 1989, a request was filed by The Vons Company Inc., to revise Conditional Use Permit 87-6 in order to permit 10 additional seating stools to be used in conjunction with the existing food counter and seating area within the Vons Pavilions store, Planning Department Case No. C.U.P. 87~6, at 745 Naomi Avenue, more particularly described as follows: SEE EXHIBIT "A" WHEREAS, a public hearing was held on August 22, 1989, at which time all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: Section 1. That the factual data submitted by the Planning Department in the attached report is true and correct. Section 2. This Commission finds: 1. That the granting of such a revision to c.u.P. 87-6 will not be detrimental to the public health or welfare, or injurious to the property or improvements in such zone or vicinity. 2. That the use applied for at the location indicated is a proper use for which a Conditional Use Permit is authorized. 3. That the site for the proposed use is adequate in size and shape to accommodate said use. All yards, spaces, walls, fences, parking, loading, landscaping and other features are adequate to adjust said use with the land and uses in the neighborhood. 4. That the site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. 5. That the granting of such a revision will not adversely affect the comprehensive General Plan. 1418 1 - . . 6. That the use applied for will not have a substantial adverse impact on the environment. Section 3. That for the foregoing reasons this Commission grants the applicant's request to revise Cu.P. 87-6 in order to permit 10 additional seating stools to be used in conjunction with the existing food counter and seating area within the Vons Pavilions store upon the following conditions: 1. Seating shall be limited to a maximum of thirty (30) persons. 2 Fire safety shall be provided to the satisfaction of the Fire Department. 3. That the proposed seating shall be maintained per the review and approval of the Planning Department. 4. That revised Cu.P. 87-6 shall not take effect until the owner and applicant have executed a form available at the Planning Department indicating awareness and acceptance of the conditions of approval. 5. Noncompliance with the provisions and conditions of this revised Conditional Use Permit shall constitute grounds for the immediate suspension or revocation of said permit. 6. That the food counter shall remain clear of all debris, at reasonable intervals, during the hours of operation. Section 4. The decision, findings and conditions contained in this Resolution reflect the Commission~s action of August 22, 1989 and the following vote: A YES: Commissioners Papay, Clark, Amato NOES: None ABSENT: Commissioners Hedlund, Szany Section 5. The Secretary shall certify to the adoption of this Resolution and shall cause a copy to be forwarded to the City Council of the Oty of Arcadia. 1418 -2- - . . NICHOLSON, ASSOCIATE PLANNER CONDmONAL USE PERMIT 87-6 CASE NO.: SUMMARY The Vons Companies, Inc., is seeking to revise c.u.P. 87-6 in order to permit 10 additional seating stools to be used in conjunction with the existing food counter and seating area within the Vons Pavilions store at 745 Naomi Avenue. Currently there are 20 seating"stools being used in conjunction with the food counter, as a convenience for the customers, which is in accordance with C.U.P. 87-6. The Planning Department is recommending approval of the applicant's proposal for a maximum of 30 seats subject to the conditions ou~ed in this report. QENERAL INFORMATION APPUCANT: The Vons Companies, Inc. (tenants) LOCATION: 745 Naomi Avenue REQUEST: To permit 10 additional seating stools to be used in conjunction with the existing food counter and seating area within the Vons Pavilions store. LOT AREA: FRONTAGE: 286,764 square feet (6.58 acres) Approximately 496 feet on Naomi Avenue Approximately 359 feet on Duarte Road EXISTING LAND USE &: ZONING: The subject site is developed with the Vons Pavilions store (64,872 square feet) and retail shops (19,881 square feet); zoned C-2 (General Commercial). .. . , . Multiple-family dwellings; zoned R-3 Hinshaws department store and retail shops; zoned C-2 Multiple-family units and a shopping center; zoned C-l &: D South: East: West: GENERAL PLAN DESIGNATION: Commercial SPECIAL INFORMATION On May 12, 1987, the Planning Commission adopted Resolution 1333 (copy attached) granting Conditional Use Permit 87-6 to permit a maximum of 20 seating stools to be used in conjunction with the existing food counters within the Vons Pavilions store. At the the present time only one food counter with 20 seats remains, as illustrated on the attached Seating Area Plan and submitted floor plan. PROPOSAL AND ANALYSIS It is staffs opinion that to allow a limited number of seating in market facilities only provides a convenience for customers. The aforementioned food counter and its existing seating is a convenient and incidental use to the Vons Pavilions store. Staff believes that the applicant's proposal for theoadditional seating would not create a situation that would be detrimental to the site or neighboring properties. Pursuant to the provisions of the California Environmental Quality Act, the Planning Department has prepared an initial study for the proposed project. Said initial study did not disclose any substantial or potentially substantial adverse change in any of the physical conditions within the area affected by the project including land, air, water, minerals, flora, fauna, ambient noise, and objects of historical or aesthetic significance. Therefore, a Negative Declaration has been prepared for the project. RECOMMENDATION The Planning Department recommends approval of applicant's proposal subject to the following conditions: c.u.P. 87-6 August 22, 1989 Page 2 -. . - . 1. Seating shall be limited to a maximum of thirty (30) persons. 2. Fire safety shall be provided to the satisfaction of the Fire Department. 3. That the proposed seating shall be maintained per the review and approval of the Planning Department. 4. FINDINGS AND MOTIONS Approval If the Planning Commission intends to take action to approve this proposal, the Commission should move to approve and file the Negative Declaration and fmd that the proposal will not have a significant effect on the environment and direct staff to prepare the appropriate resolution incorporating the specific findings and conditions of approval set forth in the staff report (or as modified by the Commission). Denial If the Planning Commission intends to take action to deny this proposal, the Commission should move to deny and direct staff to prepare an appropriate resolution incorporating the Commission's decision and fmdings in support of that decision.
