RESOLUTION 1417
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF ARCADIA, CALIFORNIA GRANTING CONDmONAL USE
PERMIT 89-011 TO EXPAND THE EXISTING RESTAURANT/BAR
AND RELATED MODIFICATIONS FOR THE SATELLITE DISH,
PARKING AND LANDSCAPING AT 29-31 EAST HUNTINGTON
DRIVE.
WHEREAS, on June 27, 1989 an application was filed by Lyle W. Patterson, to
expand the existing restaurant/bar (Steerburger), Planning Department Case No. c.u.P. 89-
011 at 29-31 East Huntington Drive, more particularly described as follows:
Lot 8 of Block 74, Santa Anita Tract in the Oty of Arcadia, County of Los Angeles,
State of California.
WHEREAS, a public hearing was held on August 8,1989, at which time all
interested persons were given full opportunity to be heard and to present evidence;
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA
HEREBY RESOLVES AS FOLLOWS:
Section 1. That the factual data submitted by the Planning Department in the
attached report is true and correct.
Section 2. This Commission finds:
1. That the granting of such Conditional Use Permit will not be detrimental to
the public health or welfare, or injurious to the property or improvements in such zone or
vicinity.
2. That the use applied for at the location indicated is a proper use for which a
Conditional Use Permit is authorized.
3. That although the site is not adequate in size to accommodate all the required
parking, Parking District 2 located to the north of the property is available for parking and
the property owner pays into the parking district. Also the peak hours of business are in
the evening when most of the other uses in the area are dosed.
4. That the site abuts streets and highways adequate in width and pavement type
to carry the kind of traffic generated by the proposed use.
5. That the granting of such Conditional Use Permit will not adversely affect the
comprehensive General Plan.
6. That the use applied for will not have a substantial adverse impact on the
environment.

Section 3. That for the foregoing reasons this Commission approves a Conditional
Use Permit to expand the existing restaurant/bar upon the following conditions:
1. That the following conditions shall be complied with to the satisfaction of
the Director of Public Works:
a. Any changes to the existing parking lot will require a grading and drainage
plan prepared by a registered civil engineer to be submitted to the Public
Works Department for their review and approval/
b. Any damages to existing off-site improvements as a result of construction
shall be repaired to the satisfaction of the Department of Public Works.
2. The following conditions shall be complied with to the satisfaction of the
Fire Department.
a. Lighted exit signs shall be provided over the three exits.
b. Panic hardware shall be required on both rear exits.
c Occupancy shall be limited to 85 persons.
d. An automatic hood and duct fire extinguishing system is required.
3. That the east and north sides of the building shall be stuccoed to match the
front building elevation.
4. That the canopy and metal frame over the building at 31 East Huntington
Drive shall be removed.
5. The asphalt in the parking area shall be replaced and the parking lot
redesigned to meet all code requirements, including but not limited to 90 degree
parking stalls, 25 foot back-out area, 5'-0" wide landscape buffer along the east or
west property line. The revised landscape and parking plans shall be submitted to
the Planning Department for its review and approval.
6. The mechanical equipment on the back of the building shall be screened or
painted to match the building. The plans shall be submitted to the Planning
Department for its review and approval.
7. The antenna shall be relocated to the back portion of the middle one-third
of the building. The specific location shall be approved by the Planning Department.
8. All signs shall comply with code. The applicant shall have one year in
which to replace the nonconforming signs with signs which comply with code. Said
signs shall be subject to the review and approval of the Redevelopment Agency and
Architectural Design Review.
9. That c.u.P. 89-011 shall not take effect until the owner and applicant have
executed a form available at the Planning Department indicating awareness and
acceptance of the conditions of approval.

10. Noncompliance with the provisions and conditions of this Conditional
Use permit shall constitute grounds for the immediate suspension or revocation of
said Permit.
11. That the proposed plans shall be submitted to the Redevelopment Agency
for its review and approval.
Section 4. The decision, findings and conditions contained in this Resolution reflect
the Commission's action of August 8, 1989 and the following vote:
A YES: Commissioners Amato, Clark, Hedlund, Szany, Papay
NOES: None
Section 5. The Secretary shall certify to the adoption of this Resolution and shall
cause a copy to be forwarded to the City Council of the Oty of Arcadia.

GENERAL PLAN DESIGNATION:
Commercial
HISTORY
Prior to 1956 the building at 29 East Huntington Drive was a liquor store; in 1956 the
building changed use to a restaurant and has been a restaurant/bar since that time.
The vacant building (31 East Huntington Drive) has been used as a walk-up eating
establishment since 1956. This building was recently vacated when Pineda's moved
from the building. Both buildings are located on the same lot.
There are no conditional use permits for either use.
PROPOSAL
Building
The applicant is proposing to expand the existing 2,800 sq. ft. Steerburger's bar and
seating area into the vacated 400 sq. ft. building to the east. A new restroom (161 sq.
ft.) is proposed at the rear of the vacant building to comply with handicap
requirements. The two existing restrooms in the Steerburger will be converted into
one handicap restroom.
The floor plan shows seating for 103 persons.
The existing openings and glass block in the 400 sq. ft. building will be filled and
stucco textured to match the front facade of the Steerburger. The canopy will be
painted to match the stucco. A brick landscape planter to match the planter at the
Steerburger will be constructed in the front of the building.
Parking and Landscaping
Based upon the parking requirements for bars and restaurants 32 parking spaces are
required (10 spaces per 1,000 sq. ft. of gross floor area and fraction thereof). There are
four marked parking spaces on the site and 4.3 spaces allocated within Parking
District 2. There is no landscaping within the subject site's parking area.
The applicant is proposing to redesign and restripe the parking lot to accommodate
eight cars and provide landscaping adjacent to the building.

Miscellaneous Items
An eleven foot high satellite dish anterma is located 14'-0" back from the front of
the building. The Arcadia Municipal Code allows roof mounted dish antennas only
if they are located within the middle one-third of the roof of the building and not
exceeding 10'-0" in height.
The existing dish antenna was installed without permits and does not meet code
requirements.
The existing signs on the building (front and back) do not comply with the
Downtown design overlay and were installed without permits.
The property is located within the RedevelopmentArea and will require Agency
Design Review. The Agency staff "suggests increasing the height of the Huntington
Drive facade (false front) on the vacant building to match the height of the
Steerburger building as well as incorporating more of the Steerburger design
features into the proposed construction. Additionally applicant may want to
consider removing the overhead canopy on Huntington and rur1ning the length of
the building."
ANALYSIS
Restaurant/bars are permitted uses in the C-2 zone with an approved conditional
use permit. It is staffs opinion that the expansion of the Steerburger into the
existing vacant building will not create a significant impact on the area. The
expansion does not increase the number of required parking spaces and it is staffs
opinion that it would not create a significant increase in traffic. Because of the type
of use, most of the business is during evening hours when other businesses within
the area are closed.
Staff would recommend, however, that approval be subject to the folloWing
improvements:
1. The applicant is proposing to stucco the vacant building and the new addition
to the building. It is staffs opinion that the east and west walls of the
building should be stuccoed (it is now painted brick) to bring the entire
building into a more urWorm appearance.
2. In regards to the parking area, the proposed aisle width and parking stall sizes
do not comply with code. Also, the design requires the cars to back out onto
the alley. The parking area could be redesigned to provide five 90 degree
parking spaces which comply with code requirements. Also this would
increase the landscaping on the site by providing a 5'-0" landscape buffer

along either the east or west property line. The parking area is in total
disrepair and the asphalt needs to be replaced.
3. The mechanical equipment on the back of the building is visible from the
parking district. This equipment should be screened or painted to match the
building.
4. The dish antenna is very visible from Huntington Drive. Although the
height exceeds code by 1'-0", staff does not believe that this is a significant
modification. However, staff recommends that the antenna be relocated to
the back portion of the middle one-third of the building. The specific location
to be approved by the Planning Department.
S. The existing signing which was installed sometime after October, 1987 does
not comply with the Downtown Design Overlay Regulations (Resolution
5293) adopted in 1986. The signs were not approved by the Redevelopment
Agency or go through the Architectural Design Review process and there are
no permits for the signs. The regulations specifically state: "Internally
illuminated signs shall not be permitted." It is staff's opinion that the signs
should be replaced with signing which complies with code.
Pursuant to the provisions of the California Environmental Quality Act, the
Planning Department has prepared an initial study for the proposed project. Said
initial study did not disclose any substantial or potentially substantial adverse
change in any of the physical conditions within the area affected by the project
including land, air, water, minerals, flora, fauna, ambient noise and objects of
historical or aesthetic significance. Therefore, a Negative Declaration has been
prepared for this project.
RECOMMENDATION
The Planning Department recommends approval of C.U.P. 89-11 to expand the
Steerbutger Bar/Restaurants subject to the following conditions:
1. That the following conditions shall be complied with to the satisfaction of the
Director of Public Works:
a. Any changes to the existing parking lot will require a grading and drainage
plan prepared by a registered civil engineer to be submitted to the Public
Works Department for their review and approval/

FINDINGS AND MOTIONS
Approval
If the Planning Commission intends to take action to approve this project, the
Commission should move to approve and file the Negative Declaration and find
that the project will not have a significant effect on the environment and direct staff
to prepare the appropriate resolution incorporating the specific findings and
conditions of approval set forth in the staff report (or as modified by the
Commission).
Denial
If the Planning Commission intends to take action to deny this project, the
Commission should move to deny and direct staff to prepare an appropriate
resolution incorporating the Commission's decision and findings in support of that
decision.
