RESOLUTION 1416 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, GRANTING CONDmONAL USE PERMIT 89-012 TO OPERATE A SCHOOL AT 36 EAST LIVE OAK A VENUE WHEREAS, on July 12,1989 an application was filed by Bonnie L Cho to operate a. math school, Planning Department Case No. c.u.P. 89-012, on property commonly known as 36 East Live Oak Avenue, more particularly described as follows: Lot 11, Tract No. 15628, in the City of Arcadia, County of Los Angeles, State of California, as per map recorded in Book 354, pages 24 and 25 of Maps, in the office of said County recorder. WHEREAS, a public hearing was held on August 8, 1989, at which time all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: Section 1. That the factual data submitted by the Planning Department in the attached report is true and correct. Section 2. This Commission finds: 1. That the granting of such Conditional Use Permit will not be detrimental to the public health or welfare, or injurious to the property or improvements in such zone or vicinity. 2. That the use applied for at the location indicated is a proper use for which a Conditional Use Permit is authorized. 3. That the site for the proposed use is adequate in size and shape to accommodate said use. All yards, spaces, walls, fences, parking, loading, landscaping and other features are adequate to adjust said use with the land and uses in the neighborhood. 4. That the site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. 5. That the granting of such Conditional Use Permit will not adversely affect the comprehensive General Plan. 6. That the use applied for will not have a substantial adverse impact on the environment. Section 3. That for the foregoing reasons this Commission grants a Conditional Use Permit for a school upon the following conditions: 1. Fire protection shall be provided to the satisfaction of the Fire Department which may include the following: A. Central station fire alarm system is required per N.F.P.A. standards #71 and 72E. Plans shall be submitted and approved prior to installation. B. One manual pull station shall be required. - I - 1416 ~ " . C T-19 and 24 requirements if any. D. E-2 occupancy E. Shall have one hour separation from adjacent B-2 occupancies. Above ceiling needs one hour separation. 2. Water service shall conform to the Uniform Plumbing Code and any new water service shall be installed by the Arcadia Water Division upon the request and payment of fees by the developer. 3. At anyone time the maximum occupancy of the school shall be forty (40) students and four employees (includes teachers). Also, maximum occupancy shall comply with the requirements of the Fire Department. 4. No more than twenty percent of the students at anyone time shall be sixteen years of age or older. 5. The school shall only be open for instruction from 2:30 pm to 6:30 pm. 6. The applicant or operator of the school shall be responsible for the storage of any bicycles and skateboards used by the school's students. Bicycles and skateboards shall be stored within the building or outside so that all walkways, driveways and parking spaces on the subject site remain clear and open. Bicycles racks may be placed outdoors subject to the approval of the Planning Department. A site plan shall be submitted showing the location of said bicycle racks. 7. Architectural Design Review applications will be required for all signs. 8. The Planning Commission shall retain jurisdiction in so far as that if there are parking and/or circulation problems resulting from this use which are found by the Planning Department, at any time during the first twelve months, a public hearing shall be scheduled for the purpose of determining the extent of the parking and/or circulation problem(s), and for the consideration of modifying the original conditions of approval, or imposing additional conditions so as to mitigate the identified problem(s). 9. The applicant or operator of the school shall be responsible to inform the students and their parents that all loading and unloading of students shall take place at the rear of the building and not along Live Oak Avenue. 10. The site shall be maintained as per the plans on file in the Planning Department. 11. That CUP 89-012 shall not take effect until the owner and applicant have executed a form available at the Planning DepartmeJ;\t indicating awareness and acceptance of the conditions of approval. 12. Noncompliance with the provisions and conditions of this Conditional Use Permit shall constitute grounds for the immediate suspension or revocation of said Permit. 13. The Planning Commission, at its first regularly scheduled meeting of August 1990, shall consider expansion of the maximum occupancy of the school which may revise condition number 3. -2- 1416 $ " . The decision, findings and conditions contained in this Resolution reflect the Commission's action of August 8, 1989 and the following vote: AYES: Commissioners Amato, Clark, Hedlund, Szany, Papay, NOES: None ABSENT: None Section S. The Secretary shall certify to the adoption of this Resolution and shall cause a copy to be forwarded to the City Council of the Oty of Arcadia. GENERAL PLAN DESIGNATION: Commercial PROPOSAL AND ANALYSIS The applicant is proposing to operate a school (math classes) from a 1,600 square foot commercial retail space which is part of a 4,000 square foot commercial building at 34-36 East Live Oak Avenue. School will be open from 2:30 pm to 6:30 pm with a maximum occupancy of sixty-nine students at anyone time. Maximum age of the students will 18 years old. A conditional use permit is required for any school. Surrounding the subject site are commercially zoned properties except to the south where there are single-family dwellings (L. A. County). Separating the subject site from the residentially zoned properties is a 20 foot wide alley. There are thirteen parking spaces on the subject site. From 30 to 62 East Live Oak the parking lots appear to flow as one. The applicant notes on her site plan that this area contains approximately one hundred parking spaces. Limiting the age of the students will lessen the number of students driving to the school. The parking lot should be able to handle the loading and unloading of students. Due to the proposed maximum occupancy of sixty-nine students, the Planning Department does have a concern with the proposed age (18) of the students. Since a drivers license can be obtained by a sixteen year old, staff feels that a limit should be placed on the number of students sixteen years of age and older. Staff will be CUP 89-012 August 8,1989 Page 2 " . . recommending that no more than twenty percent of the students at anyone time shall be sixteen years of age or older. Also, the maximum number of employees (including teachers) should be limited to four. This would help control the number of vehicles using the parking lot. Also, loading and unloading of students should take place at the rear of the building and not along Live Oak Avenue (condition #9). During the parking survey staff noticed that available parking spaces along Live Oak were few. Staff would like to avoid double parking along Live Oak which is a major thoroughfare. The applicant shall also be responsible for the storage of bicycles and skateboards so that all walkways, driveways and parking spaces remain clear and open. These items should be stored inside the building or bike racks should be placed at locations approved by the Planning Department (condition #6). The Planning Department will require review of the parking and circulation situation for the first twelve months of business (condition #8). Any new signs or changes to the building's facade will need a Architectural Design Review application. The proposal would be consistent with the Zoning Ordinance and General Plan. Pursuant to the provisions of the California Environmental Quality Act, the Planning Department has prepared an initial study for the proposed project. Said initial study did not disclose any substantial or potentially substantial adverse change in any of the physical conditions within the area affected by the project including land, air, water, minerals, flora, fauna, ambient noise and objects of historical or aesthetic significance. Therefore, a Negative Declaration has been prepared for this project. RECOMMENDATION The Planning Department recommends approval of Conditional Use Permit 89-012 subject to the following conditions: 1. FINDINGS AND MOTIONS Approval If the Planning Commission intends to take action to approve this project, the Commission should move to approve and file the Negative Declaration and find that the project will not have a significant effect on the environment and direct staff to prepare the appropriate resolution incorporating the specific findings and conditions of approval set forth in the staff report or as modified by the Commission.
