RESOLUTION 1414
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF ARCADIA, CALIFORNIA, GRANTING CONDmONAL
USE PERMIT 89-010 TO OPERATE AN ART SCHOOL AT 19 EAST
LIVE OAK AVENUE
WHEREAS, on June 5,1989 an application wasfiIed by Kyungmi K. Ha to operate
an art school, Planning Department Case No. Cu.P. 89-010, on property commonly
known as 19 East Live Oak Avenue, more particularly described as follows:
Lot 8, Tract No. 11438, in the City of Arcadia, County of Los Angeles,
State of California, as per map recorded in Book 234, page 22 of Maps, in
the office of said County recorder.

WHEREAS, a public hearing was held on June 27, 1989, at which time all
interested persons were given full opportunity to be heard and to present evidence;
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
ARCADIA HEREBY RESOLVES AS FOLLOWS:
Section 1. That the factual data submitted by the Planning Department in the
attached report is true and correct.
Section 2. This Commission fmds:
1. That the granting of such Conditional Use Permit will not be detrimental
to the public health or welfare, or injurious to the property or improvements in such
zone or vicinity.
2. That the use applied for at the location indicated is a proper use for which
a Conditional Use Permit is authorized.
3. That the site for the proposed use is adequate in size and shape to
accommodate said use. All yards, spaces, walls, fences, parking, loading, landscaping
and other features are adequate to adjust said use with the land and uses in the
neighborhood.
4. That the site abuts streets and highways adequate in width and pavement
type to carry the kind of traffic generated by the proposed use.
5. That the granting of such Conditional Use Permit will not adversely affect
the comprehensive General Plan.
6. That the use applied for will not have a substantial adverse impact on the
environment.
Section 3. That for the foregoing reasons this Commission grants a Conditional
Use Permit for an art school upon the following conditions:

1. Fire protection shall be provided to the satisfaction of the Fire
Department which includes the following:
A. Storage room and corridor shall be one hour construction.
B. Exit doors shall swing in the direction of exit travel and have panic
hardware at lobby and corridor end.
2. Water service shall conform to the Uniform Plumbing Code and any new
water service shall be installed by the Arcadia Water Division upon the request and
payment of fees by the developer.
3. At any time the maximum occupancy of the school shall be ten students
and four teachers.
4. Maximum age of the students shall be fifteen (15) years old.
5. The school shall only be open from 2:00 pm to 6:00 pm Monday through
Friday.
6. The applicant or operator of the school shall be responsible for the storage
of any bicycles and skateboards used by the school's students. Bicycles and skateboards
shall be stored within the building so that all walkways and parking spaces on the
subject site remain clear and open. Bicycles racks may be placed outdoors subject to the
approval of the Planning Department. A site plan shall be submitted showing the
location of said bicycle racks.
7. Architectural Design Review applications will be required for all signs.
8. The Planning Commission shall retain jurisdiction in so far as that if
there are parking and/or circulation problems resulting from this use which are found
by the Planning Department, at any time during the first twelve months, a public
hearing shall be scheduled for the purpose of determining the extent of the parking
and/or circulation problem(s), and for the consideration of modifying the original
conditions of approval, or imposing additional conditions so as to mitigate the
identified problem(s).
9. The site shall be maintained as per the plans on file in the Planning
Department.
10. That CUP 89-010 shall not take effect until the owner and applicant have
executed a form available at the Planning Department indicating awareness and
acceptance of the conditions of approval.
11. Noncompliance with the provisions and conditions of this Conditional
Use Permit shall constitute grounds for the immediate suspension or revocation of said
Permit.
Section 4. The decision, findings and conditions contained in this Resolution
reflect the Commission's action of June 27, 1989 and the following vote:
A YES: Commissioners Amato, Clark, Hedlund, Szany, Papay,

Section 5. The Secretary shall certify to the adoption of this Resolution and shall
cause a copy to be forwarded to the City Council of the City of Arcadia.

SUMMARY

The Planning Department is recommending approval subject to the conditions

. GENERAL PLAN DESIGNATION:
Commercial
PROPOSAL AND ANALYSIS
The applicant is proposing to operate a 2,000 square foot art school which is part of a
7,948 square foot office building (plans attached). School will be open from 2:00 pm to
6:00 pm Monday through Friday with a maximum occupancy of ten students and four
teachers. Maximum age of the students will 15 years old. Oasses wiI1last for one to
two hours. A conditional use permit is required for any school.
The parking lot contains 32 parking spaces which is the required number of spaces for
the office building calculated at 4 spaces per 1,000 square feet, Eight parking spaces
would be available for the 2,000 square foot school.
Surrounding the subject site are commercially zoned properties except to the north
where the lots are zoned R-l and PR-1. The building has a 25'-0" setback from the
north property line.

With limitations to the school's hours and days of operation, occupancy and age of the
students the Planning Department believes a school can be accommodated on the site.
Limiting the age of the students will lessen the number of students driving to the
school. The parking lot and adjacent street parking should be able to handle the
loading and unloading of students.
The Planning Department does have a concern about the placement of bicycles and
skateboards used by students. The Planning Department is recommending that the
applicant be responsible for the storage of these items within the building or the
placement of bicycle racks outdoors so that all walkways and parking spaces remain
clear and open.
Any new signs or changes to the building's facade will need a Architectural Design
Review application.
The proposal would be consistent with the Zoning Ordinance and General Plan.
Pursuant to the provisions of the California Environmental Quality Act, the Planning
Department has prepared an initial study for the proposed project. Said initial study
did not disclose any substantial or potentially substantial adverse change in any of the
physical conditions within the area affected by the project including land, air, water,
minerals, flora, fauna, ambient noise and objects of historical or aesthetic significance.
Therefore, a Negative Declaration has been prepared for this project.

. RECOMMENDATION
The Planning Department recommends approval of Conditional Use Permit 89-010
subject to the following conditions:

Approval

the project will not have a significant effect on the environment and direct staff to
prepare the appropriate resolution incorporating the specific findings and conditions
of approval set forth in the staff report or as modified by the Commission.

Commission should move to deny and direct staff to prepare an appropriate resolution
incorporating the Commission's decision and findings in support of that decision.
