A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF ARCADIA, CALIFORNIA, GRANTING CONDmONAL
USE PERMIT 89-009 FOR A TRUCK DRIVING SCHOOL AND
OUTDOOR REPAIR AND MAINTENANCE OF DRIVING SCHOOL
VEHICLES AT 11629 CLARK STREET
WHEREAS, on May 26, 1989 an application was filed by Richard F. Dootson for
the continuation of a truck driving school and outdoor repair and maintenance of
driving school vehicles, Planning Department Case No. C.U.P. 89-009, on property
commonly known as 11629 Oark Street, more particularly described as follows:

WHEREAS, a public hearing was held on June 27, 1989, at which time all
interested persons were given full opportunity to be heard and to present evidence;
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
ARCADIA HEREBY RESOLVES AS FOLLOWS:
Section 1. That the factual data submitted by the Planning Department in the
attached report is true and correct.
Section 2. This Commission finds:
1. That the granting of such Conditional Use Permit will not be detrimental
to the public health or welfare, or injurious to the property or improvements in such
zone or vicinity.
2. That the use applied for at the location indicated is a proper use for which
a Conditional Use Permit is authorized.
3. That the site for the proposed use is adequate in size and shape to
accommodate said use. All yards, spaces, walls, fences, parking, loading, landscaping
and other features are adequate to adjust said use with the land and uses in the
neighborhood.
4. That the site abuts streets and highways adequate in width and pavement
type to carry the kind of traffic generated by the proposed use.
5. That the granting of such Conditional Use Permit will not adversely affect
the comprehensive General Plan.
6. That the use applied for will not have a substantial adverse impact on the
environment.
Section 3. That for the foregoing reasons this Commission grants a Conditional
Use Permit for a truck driving school and outdoor repair and maintenance of driving
school vehicles upon the following conditions:
1. Provide a paved area for all maintenance work with drains to a separator
for accidental spills of hazardous material and any water. This shall be completed to
the satisfaction of the Fire Department by July 28, 1989.
2. The following conditions from the Department of Public Works shall be
complied with to the satisfaction of the Director of Public Works:

A. Submit grading and drainage plan prepared by a registered civil
engineer subject to the approval of the Director of Public Works. Provide calculations
for drainage system. Computation should show hydrology, hydraulics and elevations.
B. Plant two (2) parkway trees at locations determined by the Director
of Public Works per City of Arcadia Standard S-13.
C. Construct full parkway width P.C.C. sidewalk, as per City Standard.
D. All public works improvements shall be completed to the
satisfaction of Director of Public Works prior to final acceptance by Building and Safety
Department and prior to occupancy.
E. All survey monuments, centerline ties and survey reference points
shall be protected in place or re-established where disturbed. This work will be the
responsibility of the permittee and shall be at the permittee's expense.
3. Water service shall conform to the Uniform Plumbing Code and any new
water service shall be installed by the Arcadia Water Division upon the request and
payment of fees by the developer.
4. All on-site parking spaces shall be used first by the school's students before
parking on any public street. "On-site parking spaces" shall pertain to the 57 new
parking spaces and the existing 19 parking spaces along Clark Street east of building #4
as shown on the site plan on file with the Planning Department. It shall be the
responsibility of the school to inform and enforce this requirement with its students.
5. School trucks and vehicles not actively being used for instruction shall not
be parked in the street, but shall be parked on the subject property.
6. A five foot wide landscaped buffer shall be provided along Clark Street
between the public right-of-way and the parking lot. A landscape plan shall be
submitted to the Planning Department for review and approval. Landscaping shall be
similar to the existing materials used along Clark Street. This landscaping shall be
completed by July 28, 1989
7. All parking spaces shall be double striped per code.
8. The school shall be responsible for the daily cleaning up of debris and
trash caused by their students on the subject site, public right-of-ways and on adjacent
properties. Trash receptacles shall be conveniently placed on the site for use by the
students.
9. The outdoor repair and maintenance area shall only be used as long as
on-site truck instruction exists on the subject property. If on-site truck instruction is
discontinued, the repair area shall be eliminated and any buildings used for repair
purposes removed within 30 days. Any buildings or structures proposed for the repair
area shall first be submitted for Architectural Design Review to determine if a
conditional use permit is required.
10. Maintenance and repair work shall be limited to driving school vehicles
only. Said vehicles shall be registered to Dootson.
11. Maintenance and repair work shall not include overhauling of engines,
transmission work, body work or painting.
12. Wrecked, damaged or inoperative vehicles shall not be stored on the
property.

13. Outdoor storage shall be prohibited. This shall include engine parts, tires,
wares, merchandise, crates and any item related to the repair and maintenance of
driving school vehicles.
14. No vehicles shall be parked on the premises which are offered for sale,
lease or rent.
15. The office building (#1) shall be used only for the driving school operation
or for other permitted uses in the M-l zone.
16. The operation of the driving school which includes the repair and
maintenance of driving school vehicles shall comply with all statutory requirements.
17. By July 28, 1989 the subject property shall be totally paved per code with a
concrete or asphaltic surface to specifications and standards of the Department of Public
Works and Planning Department.
18. At anyone time the. maximum number of students for the school shall be
seventy-six (76).
19. The subject property shall be used exclusively by the Dootson Driving
School, its students, employees and tenants.
20. The site shall be maintained as per the plans on file in the Planning
Department.
21. That CUP 89-009 shall not take effect until the owner and applicant have
executed a form available at the Planning Department indicating awareness and
acceptance of the conditions of approval.
22. Noncompliance with the provisions and conditions of this Conditional
Use Permit shall constitute grounds for the immediate suspension or revocation of said
Permit.
Section 4. The decision, findings and conditions contained in this Resolution
reflect the Commission's action of June 27, 1989 and the following vote:

Section 5. The Secretary shall certify to the adoption of this Resolution and shall
cause a copy to be forwarded to the City Council of the City of Arcadia.

SUMMARY
This application was filed by Richard F. Dootson (Dootson Driving Schools) to
continue truck instruction and outdoor repair and maintenance of driving school
vehicles at 11629 Clark Street.
The Planning Department is recommending approval subject to the conditions
outlined in the report.

HISTORY
On March 11, 1986 the Planning Commission voted 7 to 0 to approve CUP 85-21, a
request to operate the offices for an automobile and truck driving school at the subject
site. Driving school vehicles were allowed to park on the site. At that time on-site
truck instruction and repair work was not proposed.

On July 28, 1987 the Planning Commission voted 5 to 0 to approve CUP 87-13
(Resolution 1341 attached) for outdoor repair and maintenance of driving school
vehicles, and truck instruction upon areas covered with gravel in lieu of being paved.
Termination of said repair work and the use of the graveled area was required by July
28, 1989. By August 28, 1989 all structures related to the repair work were required to be
removed from the site.
PROPOSAL AND ANALYSIS
The applicant is requesting a conditional use permit for the continuation of on-site
truck instruction and outdoor repair and maintenance of driving school vehicles. A
description of the training and repair work is given by the applicant:

We are training Class I drivers in the safe operation of Class I vehicles.
Namely, how to safely hook and unhook a trailer from a tractor, how
to "pre trip" the vehicle before going on the road, how to back a
semitruck and trailer, and how to dock a trailer. We also do
preventive maintenance work and repairing of the vehicles on the
northwest portion of the property. We do not do any major heavy
duty mechanical work such as transmission work, engine overhauling,
body work, painting or the like. We do minor work including
replacing windshield wipers, replacing tires, maintaining and repairing
brakes, oil and filter changes, electrical trouble shooting, clutches, air
systems and similar preventive maintenance work. We do minor
tune-up work however today's ignition systems are almost too
sophisticated for us to even try.

All unpaved areas will now be paved to accommodate truck instruction and to
provide additional parking spaces for the students. The areas used for truck
instruction and repair work will basically be the same areas as approved by CUP 87-13.
The areas not previously approved to be used for the school will be paved to provide
for 57 additional parking spaces.
It is the Planning Department's opinion that the continuation of the outdoor repair
area in conjunction with the truck driving school would be appropriate. Work shall
be restricted to driving school vehicles only and the type of work shall be limited. If
on-site truck instruction is discontinued the outdoor repair area should be eliminated.
In the past there have been complaints about the operation Of the school. Complaints
have been about dust, dirt on the streets, trash from students and students using most
of the street parking. The paving of the lot should solve the dust and dirt problem.
Adding 57 parking spaces and requiring the school to use the on-site spaces first should
help to make more street parking available. Also, staff is recommending that school
trucks and vehicles not being used for instruction shall not be parked on the streets,
but shall be parked on-site. A condition of approval has also been added making the
school responsible for the cleaning of trash created by its students.
One letter and a petition in opposition to the request has been received.
A five foot wide landscaped buffer will be required between Clark Street and the
parking lot.
The proposal would be consistent with the Zoning Ordinance and General Plan.
Pursuant to the provisions of the California Environmental Quality Act, the Planning
Department has prepared an initial study for the proposed project. Said initial study
did not disclose any substantial or potentially substantial adverse change in any of the
physical conditions within the area affected by the project including land, air, water,
minerals, flora, fauna, ambient noise and objects of historical or aesthetic significance.
Therefore, a Negative Declaration has been prepared for this project.
RECOMMENDATION
The Planning Department recommends approval of Conditional Use Permit 89-010
subject to the following conditions:
1.

Approval
If the Planning Commission intends to take action to approve this project, the
Commission should move to approve and file the Negative Declaration and find that
the project will not have a significant effect on the environment and direct staff to
prepare the appropriate resolution incorporating the specific findings and conditions
of approval set forth in the staff report or as modified by the Commission.

In response to your memorandum, the item(s) which this department has concern
or special knowledge of are listed below:
1. The existing parkway width is eight (8) feet on Clark Street.
2. Traffic volume will be increased, but there will be no major impact.
3. The subject property is served by a sewer line that has the capacity to
transport sewage flows generated in accordance with land use reflected in
the City's current general plan to CSD's system.
