HomeMy WebLinkAbout1412 RESOLUTION 1412 . A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, GRANTING CONDmONAL USE PERMIT 89-008 TO CONSTRUCT AND OPERATE A 7,000 SQ. FT. JAPANESE STEAK HOUSE RESTAURANT AT 333 E. HUNTINGTON DRIVE. WHEREAS, on May 9, 1989 an application was filed by Tokyo Wako, to construct and operate a 7,000 sq. ft. Japanese steak house restaurant, Planning Department Case No. c.u.P. 89-008, on property commonly known as 333 E. Huntington Drive, more particularly described as follows: SEE ATTACHMENT "A" . WHEREAS, a public hearing was held on June 13, 1989, at which time all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: Section 1. That the factual data submitted by the Planning Department in the attached report is true and correct. Section 2. This Commission finds: 1. That the granting of such Conditional Use Permit will not be detrimental to the public health or welfare, or injurious to the property or improvements in such zone or vicinity. 2. That the use applied for at the location indicated is a proper use for which a Conditional Use Permit is authorized. 3. That the site for the proposed use is adequate in size and shape to accommodate said use. All yards, spaces, walls, fences, parking, loading, landscaping and other features are adequate to adjust said use with the land and uses in the neighborhood. 4. That the site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. 5. That the granting of such Conditional Use Permit will not adversely affect the comprehensive General Plan. 6. That the use applied for will not have a substantial adverse impact on the environment. Section 3. That for the foregoing reasons this Commission grants a Conditional Use Permit to construct and operate a 7,000 sq. ft. Japanese steak house restaurant, upon the following conditions: 1. The following conditions from the Department of Public Works shall be complied with to the satisfaction of the Director of Public Works. A. Submit grading and drainage plan prepared by a registered civil engineer subject to the approval of the Director of Public Works. Site drainage must be in conformance to L.A. County Flood Control District's tributary area hydrology. All storm water drainage must . -1 - 1412 be collected on-site and piped underground to the Santa Anita . Wash. Provide hydrology and hydraulic calculations. B. Dedicate six (6) ft. strip of property for street purposes along the westerly boundary of the subject property within the limits of public access way, to provide for a thirty-five (35) ft. right of way from the centerline of Gateway Drive. C. Dedicate a fifteen (15) ft. radius comer cut-off for street purposes. D. Install two six-inch VCP sewer laterals to property line on Huntington Drive to service proposed restaurants. E. Plant parkway trees at locations determined by the Director of Public Works per City of Arcadia Standard 5-13. F. New driveways on Huntington Drive shall be located so as to avoid conflict with existing catch basins and local depressions. G. Close existing driveways not to be Used and reconstruct curb, gutter and sidewalk to match existing. H. Remove and replace deficient or damaged curb, gutter or sidewalk. I. Construct commercial type driveways per City Standard Drawing No. 5-11. J. Arrange for all utility companies to provide underground services to the subject property from Huntington Drive only. All undergrounding of utilities must be completed before April 1, 1990, as after this date no street cuts in Huntington Drive will be . permitted. K. Relocate one (1) City-owned street light on Huntington Drive. Exact location of street light requires approval of the Director of Public Works. L. Disconnect irrigation system that serves the east parkway landscape area on Gateway Drive and reconnect to the developer's irrigation system. After reconnection is completed, the maintenance of the existing landscape area becomes the responsibility of the developer. M. Construct five (5) ft. P.c.c. sidewalk adjacent to existing parkway landscape on the east side of Gateway Drive. N. Remove and reconstruct full width concrete sidewalk on Huntington Drive, as directed per City Engineer. O. Relocate the northerly Derby directional sign from its existing location (where it interferes with proposed driveway) to a location approved by City Engineer. A new legal description covering the new sign relocation shall be submitted for City's approval. P. Plug and abandon the existing 6" VCP sewer crossing the subject property at the sewer manhole intersecting the existing main line which runs east on the north parkway of Huntington Drive. Sewer easement descriptions shall be submitted to the Department of Public Works for quitclaim processing. Q. Comply with all the provisions required by L.A. County . Department of Public Works and/or Army Corps of Engineers for -2- 1412 . any storm drain connections. A copy of permit shall be sent to the Public Works Department. Developer must pay a share of the cost as computed by the City for the public access way improvement before the City will allow access. Submit an improvement plan for the reconstruction of the median nose on Gateway Drive to provide sufficient turning radius. All survey monuments, centerline ties and survey reference points shall be protected in place or re-established where disturbed. 2. That seating shall comply with the requirements set froth by the Fire Departmen t. 3. That the proposed plans shall be submitted to the Redevelopment Agency for Agency design Review. 4. That c.u.P. 89-008 shall not take effect until the owner and applicant have executed a form available at the Planning Department indicated awareness and acceptance of the conditions of approval. 5. Noncompliance with the provisions and conditions of this Conditional Use Permit shall constitute grounds for the immediate suspension or revocation of said Permit. Section 4. The decision, findings and conditions contained in this Resolution reflect the Commission's action of June 13, 1989 and the following vote: A YES: Commissioners Amato, Clark, Szany, Papay NOES: None ABSENT: Commissioner Hedlund Section 5. The Secretary shall certify to the adoption of this Resolution and shall cause a copy to be forwarded to the City Council of the City of Arcadia. Japanese steak house restaurant with seating for 150 persons 163,561 square feet (3.75 acres) LOT AREA: EXISTING LAND USE & ZONING The site is currently vacant. Plans have been approved by the Redevelopment Agency for a mixed use commercial project with two restaurants. The subject site is zoned CPD-1. SURROUNDING LAND USE & ZONING North: South: Developed with the Residence Inn; zoned CPD-1 Developed with California State Bank and Arcadia Gateway Center; zoned CPD-1 Developed with the Santa Anita Wash Developed with the Souplantation and Embassy Suites; zoned CPD-1 and CPD.l & H East: West: C.U.P. 89-008 June 13, 1989 Page 1 . . . GENERAL PLAN DESIGNATION Planned Development - 1 SITE INFORMATION On January 6, 1989 the Redevelopment Agency approved the design for the proposed mixed-use project (Arcadia 118ndmArk Development) consisting of retail and office space. They also approved the concept of two restaurants, totaling 12,000 sq. it. on the site. Based upon the plans in plan check, the project will contain approximately 70,700 sq. ft. of office and retail space and 12,000 sq. ft. of restaurant space. A parking structure will be located along the north property line. There will be 433+ parking spaces; 437 spaces are required based upon the above uses. The Ilpplicant has indicated that the plans will be modified to provide parking which complies with code. There are 190 surface parking spaces and 343 spaces within the parking structure. In January, 1989, a parking study was prepared by Barton-AsehmAn Associates, Inc. for the proposed project. The report noted that: "the impact of the Arcadia Landmark development project on the area roadway system, with the exception of race-day conditions at the intersection of Huntington Drive and Second Avenue, will not exceed level- of-service standards put forth by the City of Arcadia. Although race-day conditions at the intersection of Huntington Drive and Second Avenue will not satisfy City standards, police control of this intersection will improve operational conditions to meet the city's requirements." PROPOSAT~ AND ANALYSIS The applicant is requesting a conditional use permit to construct a 7,000 square foot restaurant. The restaurant will be located in the middle of the property east of the proposed Tony Roma's restaurant. The applicant is proposing seating for 150 persons. Based upon the Fire Department's requirements, a mAnmum seating of 205 persons is allowed; 163 in the dining area and 42 in the lounge area. Entrance to the restaurant will be from the west side of the building. On-site parking for the center, including the proposed two restaurants will comply with code. Pursuant to the provisions of the California Environmental Quality Act, the plAnning Department has prepared an initial study for the proposed project. Said initial study did not disclose any substantial or potentially substantial adverse C.U.P.89-008 June 13, 1989 Page 2 . .. . change in any of the physical conditions within the area affected by the project including land, air, water, minerals, flora, fau,na, ambient noise and objects of historical or aesthetic significance. Therefore, a Negative Declaration has been prepared for this project. ARCHITECTURAL DESIGN REVIEW Concurrent with the consideration of this conditional use permit, the Planning Commission may approve, conditionally approve or deny the applicant's design concept. The proposed restaurant has been designed with an oriental theme. The building will be painted silver grey with darker grey accent bands with bronze glazed windows. A natural wood shading device will be located over the upper portion of each window. On the north and east elevation there will be a grey glazed tile band. Glass block will also be incorporated in the waIl design. Imported glazed royal blue clay tile is proposed for the roofing material. Earthtone marble will highlight the building entrance walls. Entry to the building will be over an Oriental-style bridge. White cement planter boxes will be located along the south, .east and west building elevation. Although the design of the building is unique, it is in keeping with the Japanese theme of the restaurant. The blue/grey colors of the building are colors which have been used on other buildings within the CPD-1 zone, i.e., the California State Bank Building and the Cigna building. If the Oriental restaurant were to change owners and another type of use proposed, staff believes that exterior modifications could be made to the building to make it adaptable to other types of uses. It is staffs opinion that the proposed design complies with the intent of the design criteria set forth in the City's Architectural Design Review Regulations. The proposed restaurant is located within the Redevelopment Area. Agency Design Review will be required. RECOMMENDATION The Planning Department recommends approval of C.U.P. 89-008 subject to the. following conditions: C.U.P. 89-008 June 13, 1989 Page 3 . 1. Conditions as outlined in the attached report from the Department of Public Works shall be complied with to the satisfaction of the Director of Public Works. 2. The.t seating shall comply with the requirements set forth by the Fire Department. 3. That the proposed plans shall be submitted to the Redevelopment Agency for Agency Design Review. 4. That C.U.P. 89-008 shall not take effect until the owner and applicant have executed a fonn available at the PlAnning Department indicating awareness and acceptance of the conditions of approval. 5. Noncompliance with the provisions and conditions of this Conditional Use permit shall constitute grounds for the immediate suspension or revocation of said Permit. FINDTNr.s AND MOTIONS Annroval . If the PlllJ'ln;ng Commission intends to take action to approve this project, the Commission should move to approve and file'the Negative Declaration and find that the project will not have a significant effect on the environment and direct staff to prepare the appropriate resolution incorporating the specific findings and conditions of approval set forth in the staff report (or as modified by the Commission). Denial If the PIllJ'ln;ng Commission intends to take action to deny Conditional Use Permit 89-008, the Commission should move to deny and direct staff to prepare an appropriate resolution incorporating the Commission's decision and supporting findings. The Planning Commission may wish to consider the following motions and findings which should be expanded upon with specific reasons for denial: D.1 Find that the granting of this conditional use permit will be detrimental to the public health or welfare or injurious to the property or improvements in such zone or vicinity. D.2 Find that the use applied for at the location indicated is not properly one for which a conditional use permit is authorized. Find that the site for the proposed use is not adequate in size and shape to accommodate said use, and all yards, spaces, walls, fences, parking, loading, landscaping, and other features required to acljust said use with the land and uses in the neighborhood. D.3 . C.U.P.89-008 June 13, 1989 Page 4 D.4 Find that the site abuts streets and highways inadequate in width and pavement . type to carry the kind of traffic generated by the proposed use. 0.5 Find that the granting of this conditional use permit will adversely affect the comprehensive general plan. D.6 Find that the location and configuration of the structures are not visually harmonious with their sites and with surrounding sites and structures, and that the structures dominate their surroundings to an extent inappropriate to their use. D.7 Find that the architectural design of the structures and their materials and colors are not visually harmonious with surrounding development. D.8 Find that the plans for the landscaping of open spaces do not conform to the requirements set forth in the code, and that they do not provide visually pleasing settings for structures on the site and on adjoining and nearby sites and conflict with the natural landscape. D.9 Find that the design and location of signs and their materials and colors are not consistent with the character and scale of the buildings to which they are attached or which are located on the same site, and that the signs are not visually harmonious with surrounding development. . D.10 Find that the architectural design does not enhance the visual environment of the city, preserve and protect property values and mitigate against degradation and depreciation. . D.ll Find that the proposal does not promote and protect the health, safety, comfort and general welfare of the community and does not promote the standards of appearance in the community or encourages the appropriate use of land within the City. Find that the project contains expanses of flat building walls which needs additional architectural indentations and/or projections so as to provide opportunity for shade, shadow, and visual relief. The existing parkway widths are fifteen (15) feet on Huntington Drive and four (4) feet on Gateway Drive. . 2. Traffic volume will be increased. but there will be no major impact. 3. The subject property is served by a sewer line that is tributary to a deficient City trunk sewer line. However, based on past charges paid by the property owner and considering the future charves that will be paid. in time these payments wi 11 provide the property s share of the costs necessary for taking care of downstream sewer line' deficiencies. Submit grading and drainage plan prepared by a registered civil engineer subject to the approval of the Director of Public' Works. Site drainage must be in conformance to L. A. Provide hydrology and hydraulic calculations. Z. Plant parkway trees at locations determined by the Director of Public Works per City of Arcadia Standard 5-13. 6. New driveways on Huntington Drive shall be located so as to avoid conflict with existing catch basins and local depressions. 7. Close existing driveways not to be used and reconstruct curb. gutter and sidewalk to match existing. 8. Remove and' replace deficient or damaged curb, gutter or sidewalk. ~ 9. Construct commercial type driveways per City Standard Drawing No. S-11. 10. Arrange for all utility companies to provide underground services to the subject property from Huntington Drive only. All undergrounding of utilitfes must be completed before April 1, 1990, as after this date no street cuts in Huntington Drive will be permitted. 11. Relocate one (1) City-owned street light on Huntington Drive. Exact location of street light requires approval of the Director of Public Works. 12. Disconnect frrigat'on system that serves the east parkway landscape area on Gateway Drive and reconnect to the developer's irrigation system. After reconnect ion is completed, the maintenance of the existing landscape area becomes the responsibility of the developer. 13. Construct five (5) ft. P.C.C. sidewalk adjacent to existing parkway landscape on the east side of Gateway Drive. 14. Remove and reconstruct full width concrete sidewalk on Huntington Drive, as directed per City Engineer. 15. Relocate the northerly Derby directional sign from its existing location (where it interferes with proposed driveway) to a location approved by City Engineer. A new legal description covering the new sign relocation shall be submitted for City's approval. . . 16. Plug and abandon the existing 6" V.C.P. sewer crossing the subject property at the sewer manhole intersecting the existing main line which. runs east on the north parkway of Huntington Drive. Sewer easement descrfptions shall be submitted to the Department of Public Works for quitclafm processfng. 17. Comply with all the provisions required by L. A. County Department of Public Works and/or Army Corps of Engineers for any storm drain connections. A copy of permit shall be sent to the Public Works Department. 18. Developer IllUst pay a share of the cost as computed by the City for the public access way improvement before the City will anow access. 19. Submit as improvement plan for the reconstruction of the median nose on Gateway Drive to provide sufficient turning radius., 20. All survey monuments, centerline ties and survey reference points shall be protected in place or re-estab1ished where disturbed. This work will be the responSibility of the permittee and shall be at the permittee's expense.
