CUP 08-11 FOR A 3,505 SQUARE-FOOT LEARNING CENTER WITH A MAXIMUM ENROLLMENT OF 60 STUDENTS AT 1201 S. BALDWIN AVENUE. WHEREAS, on August 26, 2008, a Conditional Use PenIrit application was filed by BaoKim Coleman for a3,505 square-foot learning center with a maximum enrollment of 60 students; Development Services Department Case No. CUP 08-11, at property commonly known as 1201 S. Baldwin Avenue; and WHEREAS, a public hearing was held by the Planning Commission on November 25, 2008, at which time all interested persons were given full opportunity to be heard and to present evidence. NOW THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA RESOLVES AS FOLLOWS: SECTION 1. That the factual data provided by the Development Services Department in the staff report dated November 25, 2008 is true and correct. SECTION 2. This Commission finds: 1. That the granting of such Conditional Use PenIrit will not be detrimental to the public health or welfare, or injurious to the property or improvements in such zone or vicinity because the proposed use will be compatible with the surrounding.uses and is an appropriate use for the subject site. 2. That the use applied for at the location indicated is a proper one for which a Conditional Use Permit is authorized. . 3. That the site for the proposed use is adequate 'in size and shape to accommodate said use. All yards, spaces, walls, fences, loading, landscaping and other features including the shared parking with the neighboring business, are adequate to adjust said use with the land and uses in the neighborhood. The proposed project complies with all related zoning requirements as setforth in the Arcadia Municipal Code. 4. That the site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. 5. That the granting of such Conditional Use Permit will not adversely affect the comprehensive General Plan because the land use .and current zoning are consistent with the General Plan. 6. That the proposed project'will create an educational or training program which . involves no physical alterations to the site except in the interior of the structure, and is therefore exempt from the California Environmental Quality Act (Class 22 Categorical Exemption, Section No. 15322). SECTION 3. That for the foregoing reasons this Commission grants Conditional Use Permit No. CUP 08-11, for a learning center at 1201 S. Baldwin Avenue, subject to the following conditions: I. Enrollment at the learning center shall not exceed 60 students at any given time. 2. No more than 15 students and 13 staff members shall be present at the learning center atany one time. . 2 Resolution No. 1785 . 3. The hours of operation of the learning center shall not exceed 9:00 a.m. to 9:00 p.m., Monday through Friday, and 9:00 a.m. to 2:00 p,m. on Saturdays. The facility shall be closed on Sundays. 4. The learning center shall create and enforce a traffic and parking management plan, wherein all staff and patrons shall be required to load, unload, and park in the upper-level parking lotto the west of the subject unit. 5. The learning center shall post and distribute notices to all parents, students, and staff, informing them of the traffic and parking management plan. A draft of the notice shall be submitted to the City for review and approval by the Development Services Director or designee prior to issuance of an occupancy permit. 6. After a period of six (6) months following the learning center's opening, the . Development Services Department shall provide a report to the Planning Commission concerning the day-to-day parking and traffic situation at the site, at which time the Planning Commission shall have the right to revoke Conditional Use Permit No. CUP 08- II ifthere is reasonable evidence ofa parking shortage or circulation problem at the,site. 7. The use approved by CUP 08-11 is limited to the learning center as described in the business plan dated November 18, 2008. The facility shall be operated and maintained in a manner that is consistent with the proposal arid plans submitted and approved for CUP 08-11. 8. Noncompliance with the plans, provisions and conditions of approval for CUP 08-11 shall be grounds for immediate suspension or revocation of any approvals, which could result in the closing of the learning center. . 3 Resolution No. 1785 e . . 9. All City code requirements regarding accessibility, fire protection, occupancy, and safety shall be complied with to the satisfaction of Building Services and the Fire Department. 10. Approval of CUP 08-11 shall not take effect until the property owner(s), and applicant have executed and filed the Acceptance Form available from the Development Services Department to indicate awareness and acceptance of these conditions of approval. 11. The applicant shall defend, indemnify, and hold hannless the City of Arcadia and its officers, employees, and agents from and against any claim, action, or proceeding against the City of Arcadia, its officers, employees or agents to attack, set aside, void, or aIillul any approval or condition of approval of the City of Arcadia concerning this project aIld/or land use decision, including but not limited to any approval or condition of approval of the City Council, Planning Commission, or City' Staff, which action is brought within the time period provided for in Government Code Section 66499.37 or other provision of law applicable to this project or decision. The City shall promptly notify the appJicantof any claim, action, or proceeding concerning the project and/or land use decision and the CityshaII cooperate fully in the defense of the matter. The City reserves the right, at its own option, to choose its own attorney to represent the City, its officers, employees, and agents in the defense of the matter. SECTION 4. Based on the results of these tests, an individualized comprehensive program of instruction is designed and prepared for that student. Baldwin Avenue. SUMMARY Conditional Use Permit Application No. CUP 08-11 proposes to convert a 3,505 square-foot retail unit within an existing commercial center into a leaming center (d.b.a. Huntington Leaming Center) with a maximum enrollment of 60 students per school year. The proposed use is expected to generate the same number of vehicle trips and parking demand as would a general retail use. The Development Services Department is recommending approval of Conditional Use Permit Application No. CUP 08-11, subject to the conditions in this report. GENERAL INFORMATION APPLICANT: BaoKim Coleman (on behalf of Huntington Leaming Center) LOCATION: 1201 S. Baldwin Avenue (Arcadia Hub Shopping Center) REQUEST: A Conditional Use Permit to allow a 3,505 sqiJare-foot leaming center with a maximum enrollment of 60 students (1 sl through 12t1l grade) SITE AREA: Approximately n2,134 square feet (17.73 acres) FRONTAGES: 679 feet along Baldwin Avenue 1,064 feet along Duarte Road . ",. - 1,047 feet along Naomi Avenue EXISTING LAND USE & ZONING: The site is developed with a large commercial center (Arcadia Hub Shopping Center) containing a Vons Pavilions, Burlington Coat Factory/Baby Depot, JoAnn Fabrics, future LA Fitness (formerly Ross Dress for Less), and three ml.llti"tenant strip commercial buildings. The entire center is zoned C-2, General Commercial. GENERAL PLAN DESIGNATION: Commercial SURROUNDING LAND USES & ZONING: North: General office uses, a post office, and a retirement hotel zoned C-2; and multiple-family residences zoned R-3 South: A commercial center with a CVS Pharmacy and other retail stores and restaurants zoned C-2, and multiple- family residences zoned R-3 Mixed commercial uses zoned C-2 A nonconforming apartment complex zoned C-2, and a retail center containing a 99 Ranch Market and other retail stores and restaurants zoned C-1 East: West: BACKGROUND The majority of the buildings that comprise the Hub were constructed in 1957. Although the shopping center consists of numerous distinct parcels, the center is joined together through a recorded reciprocal parking and driveway easement to allow for shared parking. A total of 1,151 parking spaces are provided on-site. Since the center's opening, several parking modifications have been approved for the shopping center for uses such as, Starbucks Coffee,Subway, Osaka Ya Restaurant, Kids Island, Vons Pavilions, China Trust Bank, and as recently as September of this year, for a dental office. A significant parking modification was approved in September 2007 when the City Council approved a Conditional Use Permit for a 43,544 square-foot LA Fitness health club at the southeast comer of the center in the former Ross Dress for Less space. PROPOSAL AND ANALYSIS The applicent is proposing to convert an existing 3,505 square-foot retail space adjacent to Burlington Coat FactorylBaby Depot into a Huntington Learning Center franchise. The proposed use is considered a "school" and requires a Conditional CUP 08-11 1201 S. Baldwin Ave. ...... .__"-__""1: ....^^n ____ '" Ie ,--. - Use Permit. According to Arcadia Municipal Code Section 9275.1.35.1, schools, including learning and tutorial centers, are permitted in any zone with an approved Conditional Use Permit. The Huntington Learning Center franchise offers personalized academic tutoring and testing preparation services to 161 through 12th grade students based on individual need. The applicant anticipates a maximum enrollment of 60 students during each school cycle; however, due to the center's emphasis on individualized instruction, fewer than half of the students are expected to utilize the facilities on any given day. Programs offered by the center include beginning reading, academic reading, math, algebra, writing, study skills, and examination preparation services for the PSAT, SAT, and ACT. Instruction is typically offered at a student-to-instructor ratio of 1:1 for third grade students or younger and at 4:1 for fourth grade students or older. Math is usually at a 2:1 ratio and exam preparation is at 1:1. Students typically attend two to three two-hour sessions par week. The proposed hours of operation for the leaming center are Monday through Friday, 9:00 a.m. to 9:00 p.m. and Saturdays from 9:00 a.m. to 2:00 p.m. The facility will be closed on Sundays. A summary of the center's proposed business plan is attached to this report. Parkina The subject unit is a challenging location for a new learning center. The unit is located at one of the busiest sections of the shopping center where parking is scarce due to the COnfiguration of the center and the concentration of popular retail businesses. Furthermore, there is no convenient drop-off or pick-up area directly in front of the unit. In order to address these concerns, the applicant hired Hirsch/Green Transportation Consulting - the same firm that prepared the parking and traffic analysis for the Mure LA Fitness health club - to prepare a parking evaluation (see attachment). The study concluded, after extensive analysis, that the learning center would not increase traffic or parking demand within the shopping center any mOre than would a retail use. Retail uses are permitted by right at the center. Pursuant to Arcadia Municipal Code Section 9269.5, schools; including learning and tutoring centers must provide off-street parking at the following rates: One parking space per employee plus one (1) space for every five (5) students (for children under high school age) and one (1) space for every three (3) students (for high-school age students or older). The proposed learning center is anticipated to have 10 staff members on-site on weekdays and 13 on weekends, and at anyone time, approXimately 14 students on weekdays and 15 students on weekends. It is estimated that 25% of the students would be of high school age. Using these figures, the parking requirement for the proposed learning center would be 16 spaces. By comparison, a general retail use that has a parking requirement of five (5) spaces per 1,000 square feet would require 18 spaces, or two (2) more than is CUP 08-11 1201 S. Therefore, staff does not an,icipate that the parking demand will be higher for the learning center than if the space was leased to a retail business, and a parking mOdification is not necessary for the learning center. Circulation With respect to traffic circulation, the study found that because Huntington Learning Center operates on a staggered schedule - meaning students arrive and depart the facility at varying times throughout the day - the volume of vehicle trips occurring at one time would be much lower than would be expected at a typical tutorial canter. In the worst case scenario, the learning center would result in about four (4) vehicles arriving and three (3) vehicles leaving during a peak 1D-minute period, or approximately one (1) vehicle every minute and a half. This would leave ample time for students to enter or exit the vehicles, and for the vehicles to leave the parking area without creating a queue of vehicles waiting to drop-off or pick-up students. Additionally, the study indicates that during peak hours (between the hours of 6:00 p.m. and 7:00 p.m.) the learning center would generate a maximum of 13 vehicle trips per hour. A retail use of the same size, by comparison, would also generate approximately 13 trips per hour during peak PM hours according to the Institute of Transportation Engineers' CITE} Trip Generation manual. As such, it is unlikely that the proposed learning center would prOduce a greater number of vehicle trips than a typical retail use. Although the learning center IS not expected to significantly affect traffic circulation and parking within the canter, the transportation consultant r~mmends the creation of a traffic and parking management plan to minimize a~ivity within the highly- utilized parking area directly in front of the subject location (the consultant refers to this atea as Subarea 3). The plan would encourage students, parents, and staff to load, unload, and park in the upper parking area next to JoAJ:In Fabrics (Subarea 1). Staff supports this concept since Subarea 1 is an underutilized parking area and is only 150 feet away from the main entrance of the proposed learning center. Therefore, staff recommends a condition of approval stating that all staff, parents, and students shan load, unload, and park in the upper-level "remote" parking area. The applicant must post and distribute notices explaining this to all staff and patrons, and provide a copy to the City prior to issuance of an occupancy permit. Staff believes that this condition will help mitigate, if not entirely avoid, unexpected increases in vehicle traffic. COD~ REQUIREMENTS All City requirements regarding disabled access and facilities, occupancy limits, building safety, parking and site design shall be complied with to the satisfaction of the Building Official, Community Development Administrator, Fire Marshall, and Public Works Services Director. This section exempts projects for educational or training programs involving no physical changes. The Development Services Department has prepared a Preliminary Exemption Assessment to document this determination. fiNDINGS Section 9275: 1.2 of the Arcadia Municipal Code requires that for a Conditional Use Permit to be granted, it must be found that all of the following prerequisite conditions can be satisfied: 1. That the granting of such Conditional Use Permit will not be detrimental to the public health or welfare or injurious to the property or improvements in such zone or vicinity. 2. That the use applied for at the location indicated is properly one for which a Conditional Use Permit is authorized. 3. Baldwin Ave, Arcadia CA 91007, and is currently in contract (lease agreement) with the Arcadia Shopping Hub LP asa tenant. Projected center opening is either in November/December 2008 pending approvals from the city for the CUP and various Building permits and the timing of the build-out. I . The current space of 3,505 .sqft surpasses Huntington's franchisee space requirements of 2,000-2,500 sqft. . The space can accommodate up to 40 students at any given time; however, the reality would probably be on the average of 5 to 10 students per hour. .
