CUP. 06-12 AND APPROVING ARCHITECTURAL DESIGN REVIEW NO. ADR 06--27 TO ENCLOSE AN EXISTING COVERED PATIO TO EXPAND THE SERVICE BUILDING OF THE EXISTING OUTDOOR DINING AREA BUT DENYING THE REQUEST TO AMEND CONDITIONAL USE PERMIT NO. CUP 97-3 TO ELIMINATE THE VALET PARKING SERVICE AT THE EXISTING RESTAURANT AT 850 SOUTH BALDWIN AVENUE. WHEREAS, following the processing of Architectural Design Review No. ADR 06-27, a Conditional Use Permit application was filed by Mr. Bruce Fung on October 31, 2006 to enclose an existing covered patio to expand the service building of the existing outdoor dining area and amend Conditional Use Permit No. CUP 97-3 to eliminate the valet parking service and re-stripe the parking lot at the existing restaurant at 850 South Baldwin Avenue; WHEREAS, pursuant to the provisions of the California Environmental Quality Act, Public Resources Code Section 21000 et seq. ("CEQAj, and the State's CEQA Guidelines, the City of Arcadia prepared a Preliminary Exemption Assessment and determined that the proposed project qualifies as a Class 3 Categorical Exemption under Section 15303(c) of the CEQA Guidelines as a conversion of an existing small structure from one use to another where only minor modifications are made to the exterior of the structure; and WHEREAS, a public hearing was held by the Planning Commission on December 12, 2006, at which time all interested persons were given full opportunity to be heard and to present evidence. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: -1- 1752 . . . SECTION 1. That the factual data submitted by the Development Services Department in the attached report are true and correct. SECTION 2. This Commission finds: 1. That the approval of Conditional Use Permit Application No. CUP 06-12 and Architectural Design Review No. ADR 06-27 to enclose the existing covered patio to expand the service building of the existing outdoor dining area will not be detrimental to the public health or welfare, or injurious to the property or improvements in the zone or vicinity. 2. That the enclosing of the existing covered patio to expand the service building of the existing outdoor dining area at the location indicated is properly one for which a Conditional Use Permit is authorized based on the specific conditions of approval stated herein relating to the proposed use and design. 3. That the site for the proposed enclosing of the existing covered patio to expand the service building of the existing outdoor dining area is adequate in size and shape to accommodate said use, and all yards, spaces, walls, fences, parking, loading, landscaping and other features required to adjust said use with the land and uses in the neighborhood. 4. That the site for the proposed enclosing of the existing covered patio to expand the service building of the existing outdoor dining area abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. 5. That the SUbject property is designated for commercial use in the General Plan, that the proposed enclosing of the existing covered patio to expand the service building of the existing outdoor dining area is consistent with that designation, and that -2- 1752 . . . the granting of the Conditional Use Permit will not adversely affect the comprehensive general plan. 6. That the determination that the proposed project qualifies as a Class 3 Categorical Exemption is appropriate and that based upon the record as a whole, there is no evidence that the proposed project will have any potentially adverse effect on wildlife resources or the habitat upon which wildlife depends. SECTION 3. That for the foregoing reasons this Commission grants Conditional Use Permit No. CUP 06-12 and approves Architectural Design Review No. ADR 06-27 to enclose the existing covered patio to expand the service building of the existing outdoor dining area at the existing restaurant at 850 South Baldwin Avenue, subject to the following conditions: 1. The restaurant, the service building and the outdoor dining area shall be improved, operated and maintained in a manner that is consistent with the proposal and plans submitted and conditionally approved for Conditional Use Permit No. CUP 06-12 and Architectural Design Review No. ADR 06-27, subject to the satisfaction of the Community Development Administrator. 2. All financial transactions shall be handled in the existing restaurant building and not at the outdoor dining area. The outdoor dining area and any employees serving the outdoor dining area shall not be equipped with cash registers, credit/debit card machines, change dispensers, or any other equipment that would facilitate monetary transactions. 3. Valet parking shall be provided during the lunch and dinner hours and the parking lot shall be designed to provide a minimum of 57 parking spaces. The valet -3- 1752 . . . parking service and the parking lot layout are subject to approval by the Community Development Administrator. 4. A new a-foot by 20-foot trash enclosure is to be provided at the rear of the restaurant building as shown on the plans submitted for Conditional Use Permit Application No. CUP 06-12, and is to be built in accordance with City standards. 5. The bottom 42 inches of the service building, both the expanded portion and the existing portion are to be made of brick or brick veneered to match the brick used for the north and west sides of the outdoor dining area enclosure and the existing landscaping is to be maintained to the satisfaction of the Community Development Administrator. 6. The fireplace is to retain the brick motif used on the Baa, and the final design shall be subject to approval by the Community Development Administrator. 7. The allowed hours of operation for the restaurant and outdoor dining area shall not exceed a maximum of 16 hours per day and are to be between 6:00 a.m. and 12:00 midnight. B. Deliveries and property maintenance are to be conducted from 7:00 a.m. to 9:00 p.m., and are prohibited on Sundays and Holidays. 9. All cooking equipment at the outdoor dining area producing grease laden vapors shall be protected by an automatic fire extinguishing system and shall be covered by a Class I hood; both subject'to the satisfaction of the Fire Marshal. 10. Knox boxes with keys shall be provided for access to all restricted areas, subject to the satisfaction of the Fire Marshal. -4- 1752 . . . 11. The street trees in the Baldwin Avenue right-of-way adjacent to the subject property shall be retained and maintained to the satisfaction of the Public Works Services Director. 12. The applicant shall defend, indemnify, and hold harmless the City of Arcadia and its officers, employees, and agents from and against any claim, action, or proceeding against the City of Arcadia, its officers, employees or agents to attack, set aside, void, or annul any approval or condition of approval of the City of Arcadia conceming this project anellor land use decision, including but not limited to any approval or condition of approval of the City Council, Planning Commission, or City Staff. which action is brought within the time period provided for in Govemment Code Section 66499.37 or other provision of law applicable to this project or decision. The City shall' promptly notify the applicant of any claim, action, or proceeding conceming the project and/or land use decision and the City shall cooperate fully in the defense of the matter. The City reserves the right, at its own option, to choose its own attomey to represent the City, its officers, employees, and agents in the defense of the matter. 13. Noncompliance with the plans, provisions and conditions of approval for CUP 06-12 and/or ADR 06-27 shall be grounds for immediate suspension and/or revocation of any approvals, which shall result in suspension of construction and/or the suspension of the operation of the restaurant and the use of the outdoor dining area. 14. Approval of CUP 06-12 and/or ADR 06-27 shall not take effect until the property owner and applicant have executed and filed the Acceptance Form from the Development Services Department to indicate awareness and acceptance of the conditions of approval, and that all conditions of approval shall be satisfied prior to final -5- 1752 . . . inspection and issuance of a Certificate of Occupancy for the expanded service building. SECTION. 4. The decision, findings, and conditions of approval contained in this Resolution reflect the Planning Commission's action of December 12, 2006, by the following vote: AYES: NOES: Commissioners Baderian, Parrille and Olson Commissioners Beranek and Hsu SECTION 5. Baldwin Avenue SUMMARY Conditional Use Permit Application No. CUP 06-12 and Architectural Design Review No. ADR 06-27 are a request to enclose a trellis covered patio to enlarge the food preparation and service area of an outdoor dining area at the restaurant at 850 S. Baldwin Avenue. The CUP application is also requesting to amend the conditions of approval of CUP 97-3, which allowed the outdoor dining area. The Development Services Department is recommending approval of Conditional Use Permit Application No. CUP 06-12 and Architectural Design Review No. ADR 06-27, subject to the conditions listed in ,this report. GENERAL INFORMATION APPLICANT: Mr. Bruce.Fung - Arcadia Garden Cafe LOCATION: 850 S. Baldwin Avenue REQUESTS: A Conditional Use Permit and Architectural Design Review to enclose an existing covered patio portion of an existing outdoor dining area to enlarge the food preparation and service area, and to amend the conditions of approval of Conditional Use Permit No. CUP 97-3 that allowed the outdoor dining area. . SITE AREA: Approximately 28,830 square feet (0.55 acre) . FRONTAGE: 132.74 feet along S. Baldwin Avenue EXISTING LAND USE: The site is developed with a 5,114 square foot restaurant, a 1,660 square foot outdoor dining area, and 51 nonconforming on-site parking spaces. GENERAL PLAN DESIGNATION: Commercial with a maximum floor-area-ratio (FAR) of 50 percent ZONING DESIGNATION: C-2 - General Commercial SURROUNDING LAND USES AND ZONING: North: Multi-tenant commercial building and a single-family residence - zoned C~2 South: Commercial buildings - zoned C-2 East: Parking for a commerCial building (proposed 76-unit senior housing project) - zoned C-O . West FaSt~food with drive-thru and a restaurant-zoned C-2 BACKGROUND The building permit file indicates that the subject property was initially improved with an automobile dealership in 1954. The building was expanded, remodeled and approved for a 4,590 square foot restaurant in 1975 (CUP 75-7 - PC Reso. 890). The 1,660 square foot outdoor dining area with seating for 40 people, a 400 square foot trellis patio cover, built-in BBQ, and 120 square foot service building was added in 1997 through CUP 97-3 (PC Reses. 1546 & 1553) SUbject to the following conditions: 1. Fire safety shall be provided to the satisfaction of the Fire Department. 2. Water service shall be provided to the satisfaction of the Water Division. 3. All work done within the public right-of-way shall be done to the satisfaction of the Engineering Division. 4. That the restaurant shall proVide valet parking during the lunch and dinner hours. . That the owner have the option of installiflg wrought-iron in lieu of wood lattice, subject to the review and approval of the Development Services . Department (wrought-iron was installed) 6. That the owner shall re-stripe the parking lot per the approved plans. The Chez Sateau Restaurant closed at the end of October 2004, and became Cafe Deco in February 2005. Cafe Deco closed in August 2005 and became the Arcadia Garden Cafe in February 2006. PROPOSAL AND ANALYSIS Conditional Use Permit Application No. CUP 06-12 and Architectural Design Review No. ADR 06-27 propose to enlarge the service building in the outdoor dining area by enclosing the covered patio portion (reducing the seating from the 40 that was approved by CUP 97-3 to seating for 28 persons) convert the built-in BBQ to a fireplace, provide a new trash enclosure, and amend CUP 97-3 to eliminate the valet parking requirement and rearrange the parking layout to improve traffic flow. The new parking plan is designed in accordance with the City of Arcadia's parking design regulations, but is 14 spaces deficient. Expanded Food Service Buildina . A larger food preparation and service building will enable the restaurant to provide a more extensive menu for the outdoor dining area. Because the outdoor dining area is not immediately adjacent to the restaurant building, the health department will not allow the delivery of food and beverages from the restaurant to the outdoor dining area, unless the food and beverages are in. closed containers. Staff is not opposed to a larger service building for the outdoor dining area, but is concemed that the outdoor dining area remains a part of the restaurant and not become a separate operation. To help assure that the outdoor dining area does not become a separate operation, staff recommends that financial transactions be required to occur inside the restaurant building, and that cash registers, credit/debit card machines, or any other means of monetary transactions not be allowed to be located within the outdoor dining area. Parkina The original restaurant, approved by CUP 75-7 provided 49 parking spaces. See the site plan from CUP 7&-7. Under CUP 97-3, valet parking service was required for the outdoor dining area because the only way to fit the required number of parking spaces on-site was to use tandem parking spaces. See the site plan from CUP 97-3. Since the Chez Sateau Restaurant was already providing valet parking prior to the addition of the outdoor dining area, this condition of approval was not a burden. . CUP 06-12 and ADR 06-27 December 12, 2006 Page 3 of 8 . . . " The current restaurant, the Arcadia Garden Cafe has not been required to provide valet parking service because they are not utilizing the outdoor dining area. The applicant does not want to provide valet parking and has reconfigured the parking lot to facilitate seff-parking by the customers. The current parking layout provides 51 spaces, however; the layout was not approved by the City and does not comply with City parking regulations. A total of 57 parking spaces are required for the combined total square footage of 5,690 square feet (4,590 square feet of restaurant building plus 1,100 square feet of outdoor dining area) at a ratio of 10 parking spaces per 1,000 gross square feet. The parking lot layout that is being proposed by CUP 06-12 provides 43 parking spaces and is designed in accordance with the City of Arcadia's parking regulations, but is 14 spaces deficient. Staff worked with the applicant to prepare this layout, and staff feels that a deficiency in the number of parking spaces is preferable to having deficient stall sizes and aisle widths. Staff's opinion is that the proposed deficiency of 14 spaces is acceptable because this restaurant is a stand alone business on an enclosed site so that any shortage of parking should not adversely affect any other businesses. Staff recommends that if CUP 06-12 is to be approved, that the approval includes a Modification for 43 parking spaces in lieu of the 57 required for the 4,590 square foot restaurant and 1,100 square foot outdoor dining area. Trash Enclosure A new B-foot by 20-foot trash enclosure is to be provided at the rear of the restaurant building. This new enclosure is to be built in accordance with City standards, and will house two (2) trash bins that are presently located in an enclosure that does not meet City standards, and interferes with the backout area of several parking spaces. Architectural Desion Review Concurrent with the consideration of t/:le Conditional Use Permit, the Planning Commission may approve, conditionally approve, or disapprove the applicant's architectural design concept plans. This Architectural Design Review proposes changes to the outdoor dining area. The service building will be expanded by enclosing a trellis covered patio, and a built-in SSQ will be converted into a fireplace. The proposed design for the expanded service building is stucco finished walls painted to match the existing service building and metal framed glass storefront windows and doors. Staff recommends that the bottom 42 inches of the service building, both the new portion and the existing portion be made of brick or brick veneered to match the brick used for the north and west sides of the outdoor dining area enclosure, and that CUP 06-12 and ADR 06-27 December 12,2006 Page 4 of 8 . . . the existing landscaping is maintained. The fireplace should retain the brick motif used on the BBQ, and the final design should be subject to approval by the Community Development Administrator. With these as conditions of approval, staff's opinion is that the design of the proposed outdoor dining service building and fireplace will be visually harmonious with surrounding developments, and finds that the architectural design concept will be in compliance with the City's Architectural Design Review Regulations. Other Code Reauirements Except for the number of parking spaces, all other City Code requirements will be complied with to the satisfaction of the various department heads. In addition, the outdoor dining area will have to comply with the County Environmental Health Department's regulations for restaurants, and the City's requirements for the posting of Health Department inspection grades and results. Compliance with these requirements will be determined by having fully detailed construction and tenant improvement plans submitted for plan check review and approval. FINDINGS Section 9275.1.2 of the Arcadia Municipal Code requires that for a Conditional Use Permit to be granted, it must be found that all of the following prerequisite conditions can be satisfied: 1. That the granting of such Conditional Use Permit will not be detrimental to the public health or welfare or injurious to the property or improvements in such zone or vicinity. 2. That the use applied for at the location indicated is properly one for which a Conditional Use Permit is authorized. 3. That the site for the proposed use is adequate in size and shape to accommodate said use, and all yards, spaces, Walls, fences, parking, loading, landscaping, and other features required to adjust said use with the land and uses in the neighborhood. 4. That the site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. 5. That the granting of such Conditional Use Permit will not adversely affect the comprehensive General Plan. CEQA Pursuant to the provisions of the Califomia Environmental Quality Act (CEQA) the Development Services Department has prepared a Preliminary Exemption Assessment CUP 06-12 and ADR 06-27 December 12, 2006 Page 5 of 8 finding that the proposed project is a Class 3 Categorical Exemption under Section 15303( c) as a conversion of an existing small structure from one use to another where . only minor modifications are made to the exterior of the structure. A Notice of Exemption is not required to be filed and has not been prepared for this project. The Development Services Department will not be filing a Notice of Determination. RECOMMENDATION The Development Services Department recommends approval of Conditional Use Permit Application No. CUP 06-12 and Architectural Design Review No. ADR 06-27 subject to the following conditions: 1. The restaurant, the outdoor dining area, and the site shall be improved, operated and maintained in a manner that is consistent with the proposal and plans submitted and conditionally approved for CUP 06-12 and ADR 06-27, subject to the satisfaction of the Community Development Administrator. 2. All financial transactions shall be handled in the existing restaurant building and not at the outdoor dining area. The outdoor dining area. and any employees serving the outdoor dining area shall not be equipped with cash registers, credit/debit card machines, change dispensers, or any other equipment that would facilitate monetary transactions. . 3. The approval of CUP 06-12 includes a Modification for 43 parking spaces in lieu of the 57 required for the 4,590 square foot restaurant and 1,100 square foot outdoor dining area. The Modification is only for the number of spaces and does not allow for deficient parking stall sizes or deficient aisle widths, and is only for this specific use approved by CUP 06-12 and not for the buildings and/or site in general, nor for any other use on this site. 4. A new 8-foot by 20-foot trash enclosure is to be provided at the rear of the restaurant building as shown on the plans submitted for CUP 06-12, and is to be built in accordance with City standards. 5. The bottom 42 inches of the service building, both the new portion and the existing portion are to be made of brick or brick veneered to match the brick used for the north and west sides of the outdoor dining area enclosure and the existing landscaping is to be maintained to the satisfaction of the Community Development Administrator. 6. ADDroval The Planning Commission should move to approve the proposed project, state the supporting findings, and direct staff to prepare a resolution incorporating the Commission's decision, specific findings and conditions of approval. Denial If the Planning Commission intends to deny this project, the Commission should move for denial and direct staff to prepare a resolution incorporating the Commission's decision and specific findings. A denial would mean that the restaurant must operate in accordance with one of the prior approved Conditional Use Permits; CUP 75-7 or CUP 97-3.
