A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF ARCADIA,. CALIFORNIA, APPROVING
CONDITIONAL USE PERMIT NO. 2006-06 AND
ARCHITECTURAL DESIGN REVIEW NO. 2006-08 FOR A
FIFTY-FOOT (50') TALL MONOPOLE ANTENNA
STRUCTURE CAMOUFLAGED AS A TREE AT 5630 PECK
ROAD.

WHEREAS, on July II, 2006, a conditional use permit application
was filed by OmnipQint Communications, Inc., fora fifty-foot (50') tall
monopole antenna structure camouflaged as a tree (Development Services
. Department Case No. CUP 2006-06 and ADR 2006-08) at property
commonly known as 5630 Peck Road; and
WHEREAS, a public hearing was held by the Planning Commission
on July II, 2006, at which time all interested persons were given full
opportunity to be heard and to present evidence.
NOW THEREFORE, THE PLANNING COMMISSION OF THE
CITY OF ARCADIA RESOLVES AS FOLLOWS:
SECTION I.
That the factual data submitted by the

SECTION 2.
This Commission finds:
I. That the granting of such Conditional Use Permit will not be
detrimental to the public health or welfare, or injurious to the property or
improvements in such zone or vicinity because the initial study did not
disclose any substantial adverse effects to the area affected by the proposed
proj ect.
2. That the use applied for at the location indicated is a proper one
for which a Conditional Use Permit is authorized.
3. That the site for the proposed use is adequate in size and shape to
accommodate said use. All yards, spaces, walls, fences, loading,
landscaping and other features including the shared parking with the
neighboring business, are adequate to adjust said use with the land and uses
in the neighborhood. The proposed project complies with all related zoning
'requirements as set forth in the Arcadia Municipal Code.
4. That the site abuts streets and highways adequate in width and
pavement type to carry the kind of traffic generated by the proposed use.

5. That the granting of such Conditional Use Permit will not
adversely affect the comprehensive General Plan because the land use and
current zoning.are consistent with the General Plan.
6. That the use applied for will not have a substantial adverse impact
on the environment, and that based upon the record as a whole there is no
evidence that the proposed project will have any potential for an adverse
effect on wildlife resources or the habitat upon which the wildlife depends.
SECTION 3. That for the foregoing reasons this Commission
grants Conditional Use Permit No. CUP 2006-06 and Architectural Design
. Review No. ADR 2006-08, for a fifty-foot (50') tall monopole antenna
structure camouflaged as a tree at 5630 Peck Road, upon the following
conditions:
I. The concrete masonry wall around the proposed trash enclosure
shall be painted to match the color of the adjoining buildings found on the
subject site.

2. All City code requirements regarding accessibility, fire protection,
occupancy, and safety shall be complied with to the satisfaction of Building
Services, Public Works Services, Development Services, and the Fire
Department.

3. The proposed wireless communications facility including its
colors and materials shall be maintained in a manner that is consistent with
the plans and materials submitted and approved for CUP 2006-06 and ADR
2006-08.
4. Noncompliance with the plans, proVISIOns and conditions of
approval for CUP 2006-06 shall be grounds for immediate suspension or
revocation of any approvals.
5. Approval of CUP 2006-06 and ADR 2006-08 shall not take effect
until the property owner(s), and applicants have executed and filed the
. Acceptance Form available from the Development Services Department to
indicate awareness and acceptance of these conditions of approval.
6. The applicant shall defend, indemnify, and hold harmless the City'
of Arcadia and its officers, employees, and agents from and against any
claim, action, or proceeding against the City of Arcadia, its officers,
employees or agents to attack, set aside, void, or annul any approval or
condition of approval of the City of Arcadia concerning this project and/or
land use decision, including but not limited to any approval or condition of
approval of the City Council, Planning Commission, or City Staff, which
. action is brought within the time period provided for in Government Code

t Section 66499.37 or other provision of law applicable to this project or
decision. The City shall promptly notify the applicant of any claim, action,
or proceeding concerning the project and/or land use decision and the City
shall cooperate fully in the defense of the matter. The City reserves the
right, at its own option, to choose its own attorney to represent the City, its
officers, employees, and agents in the defense of the matter.
SECTION 4.
The decision, findings and conditions contained in
this Resolution reflect the Commission's action of July 11, 2006, by the

SUMMARY
The Conditional Use Permit application "'{as submitted by Avila Inc., representing
Omnipoint Communications Inc., to construct a wireless communica~ions facility
consisting of twelve (12) antennas and four (4) indoor equipment cabinets. The
antennas will be installed on a 50'-0" high monopole antenna camouflaged as a
palm tree at 5630 Peck Road.
The Development.Services Department is recommending approval of CUP 06-06
a!ld ADR 06-08 SUbject to the conditions set forth in the staff report and adoption
of Resolution 1747 granting Conditional Use Permit No. 06-06 for a 50'-0" high
unmanned wireless communications facility at 5630 Peck Road.

SITE AREA:
EXISTING LAND USE & ZONING:
The site is developed with a 154,000 sq.ft. storage facility
(Storamerica); zoned M-1 & D.
SURROUNDING LAND USES & ZONING DE~IGNATIONS:
Property to the north is in the City of Irwindale and is developed
with the Foothill Transit facility and properties to the east, west,
and south are developed with industrial uses, zoned M-1 & D.
GENERAL PLAN DESIGNATION:
The subject site is designated as Industrial.
BACKGROUND
On November 13, 2001 the Arcadia Planning Commission adopted Resolution
No. 1664 to approve Conditional Use Permit No. CUP 2001-27 for a similar
communications facility located approximately 139 feet from the proposed
monopalm antenna at the subject site. The approval was based on the finding
that the proposal met all the prerequisite conditions for a CUP and the design
was in conformance with the architectural design guidelines. The monopalm
antenna is 45'-0" high with equipment cabinets placed within one of the storage
units.
PROPOSAL
Communication equipment facilities are permitted in any zone with a Conditional
Use Permit (A.M.C. Sec. 9275.1.11). The proposed location is 285.3 sq.ft. in
area located between a proposed trash enclosure and a storage building along
the easterly property line adjacent to 11261 Clark Street. The proposed antennas
will be mounted on a 50' -0" high monopalm. The equipment cabinets will be
placed within an adjoining building.
The application is also requesting a height modification of 50'-0" in lieu of the 35'-
0" maximum aUowedin the M-1 zone. The additional height is requested to
provide the best level of service, and to create greater realism as a palm tree by

projecting the palm fronds 5'-0" above the 45'-0" high monopole antenna
structure.
ANALYSIS
Uses such as this wireless communications equipment facility are permitted in
any zone with an approved Conditional Use Permit (AMC Sec. 9275.1.11). The
50'-0" high monopalm will not decrease the number of parking spaces for the use
of the site. Based upon the applicant's proposal, it is staff's opinion that the
proposed monopalm installation will be a compatible use upon the site.
Architectural Desian Review
Concurrent with the consideration of the Conditional Use Permit, the Planning
Commission may approve, conditionally approve, or disapprove the applicant's
architectural design concept plans.
The 50'-0" tall monopole antenna structure is proposed to be camouflaged as a
palm tree. also referred to as a monopalm. Staff explored other options for
camouflaging the antennas, such as a roof mounted antenna, but the height of
the existing buildings .on-site are too low for the antennas to provide an adequate
signal quality. It is the opinion of staff that due to the existing mono palm in the
area and sparsely landscaped environment, in addition to the developmental
constraints of the proposed location, the monopalm is the most desirable
alternative for the project site. Staff finds the proposed architectural design
concept to be in compliance with the City's Architectural Design Review
Regulations.
Code Reauirements
The proposed project is required to comply with aU Code requirements and
policies as determined to be necessary by the Building Official, Fire Marshall,
City Engineer, Community Development Administrator, and Public Works
Services Director, and are to be determined by having fully detailed construction
plans submitted for plan check reView and approval.
CEQA
Pursuant to the provIsions of the Califomia Environmental Quality Act, the
Development Services Department has prepared an Initial Study for the
proposed project. Said Initial Study did not disclose any substantial or potentially
substantial adverse change in any of the physical conditions within the area
affected by the project including land, air, water, minerals, flora, fauna, ambient

noise and objects of historical or aesthetic significance. When considering the
record as a whole, there is no evidence that the proposed project will have any
potential for adverse effect on wildlife resources or the habitat upon which the
wildlife depends. Therefore, a Negative Declaration has been prepared for this
project.
FINDINGS
Section 9275.1.2 of the Arcadia Municipal Code requires that for a Conditional
Use Permit to be granted, it must be found that all of the following prerequisite
conditions can be satisfied:
1. That the granting of such Conditional Use Permit will not be detrimental to
the public health or welfare or injurious to the property or improvements in
such zone or vicinity.
2. That the use applied for at the location indicated is properly one for which
a Conditional Use Permit is authorized.
3. That the site for the proposed use is adequate in size and shape to
accommodate said use, and all yards, spaces, walls, fences, parking,
loading, landscaping, and other features required to adjust said use with
the land and uses in the neighborhood.
4. That the site abuts streets and highways adequate in width and pavement
type to carry the kind of traffic generated by the proposed use.
5. That the granting of such Conditional Use Permit will not adversely affect
the comprehensive General Plan.
RECOMMENDATION
The Development Services Department recommends approval of Conditional
Use Permit Application No. CUP 2006-06 and Architectural Design Review No.
ADR 2006-08, subject to the following conditions:
1. The concrete masonry wall around the proposed trash enclosure shall be
painted to match the color of the adjoining buildings found on the subject
site.
2. All City code requirements regarding accessibility, fire protection,

PLANNING COMMISSION ACTION
ADDroval
The Planning Commission should move to adopt the Negative Declaration
and approve Architectural Design Review No. ADR 2006-08 and Conditional
Use Permit No. CUP 2006-06 by adopting Resolution 1747: A Resolution of
the Planning Commission of the City of Arcadia, California granting
Conditional Use Permit No. 06-06 for a 50'-0 unmanned wireless
communication facility at 5630 Peck Road.

Dear Andrew,
The existing buildings in the immediate area of the proposed T-Mobile IE24752 StorAmerica
site, at 5630 Peck Road, are not of sufficient height to provide the desired wireless coverage
objective, and therefore a rooftop option was not found which could meet the required
objectives. Thus, T -Mobile is requesting approval of the CUP 2006-06, for a stand alone
MonoPalm, to match an existing MonoPalm on the property, to be able to meet the required
radio coverage quality objective for the area.
