RESOLUTION NO. 1743
A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF ARCADIA, CALIFORNIA, APPROVING
CONDITIONAL USE PERMIT NO. 2006-02 AND
ARCHITECTURAL DESIGN REVIEW NO. ADR 2005-41
FOR A YOUTH FACILITY ADDITION TO AN EXISTING
CHURCH AT 512 W. DUARTE ROAD
WHEREAS, on February 6, 2006, a conditional use permit
application was filed by Chien- Ting Wan of WLC Architects, Inc., on
behalf of Our Savior Lutheran Church, for a youth facility addition to an
existing church (Development Services Department Case No. CUP 2006-
02) at property commonly known as 512 W. Duarte Road; and
WHEREAS, a public hearing was held by the Planning Commission
on March 28, 2006, at which time all interested persons were given full
opportunity to be heard and to present evidence.
NOW THEREFORE, THE PLANNING COMMISSION OF THE
CITY OF ARCADIA RESOL YES AS FOLLOWS:
SECTION 1.
That the factual data submitted by the
Development Services Department in the attached report is true and correct.
SECTION 2.
This Commission finds:
1. That the granting of such Conditional Use Permit will not be
.. detrimental to the public health or welfare, or injurious to the property or
improvements in such zone or vicinity because the initial study did not
disclose any substantial adverse effects to the area affected by the proposed
project.
2. That the use applied for at the location indicated is a proper one
for which a Conditional Use Permit is authorized.
3, That the site for the proposed use is adequate in size and shape to
accommodate said use. All yards, spaces, walls, fences, loading,
landscaping and other features including the shared parking with the
neighboring business, are adequate to adjust said use with the land and uses
in the neighborhood. The proposed project complies with all related zoning
requirements as set forth in the Arcadia Municipal Code.
4. That the site abuts streets and highways adequate in width and
pavement type to carry the kind of traffic generated by the proposed use.
5. That the granting of such Conditional Use Permit will not
adversely affect the comprehensive General Plan because the land use and

current zoning are consistent with the General Plan.
6. That the use applied for will not have a substantial adverse impact
on the environment, and that based upon the record as a whole there is no

evidence that the proposed project will have any potential for an adverse
. effect on wildlife resources or the habitat upon which the wildlife depends.
SECTION 3. That for the foregoing reasons this Commission
grants Conditional Use Permit No. CUP 2006-02 and Architectural Design
Review No. ADR 2005-41, for a youth facility addition to an existing
church at 512 W. Duarte Road, upon the following conditions:
1. The maximum number of students for the youth program, at
anyone time, shall not exceed thirty (30).
2. The class hours of the proposed use shall be limited to Monday,
8:00 p.m. to 10:00 p.m., Tuesday to Friday, 7:00 p.rn. to 10:00 p.rn., and
Sunday, 2:00 p.m. to 8:00 p.m.
3. That any special events at the proposed facility shall be limited
to indoor events only and within the hours of 8:00 a.m. to 10:00 p.rn., and
shall also be limited to times when no other church activity is taking place.
4. The parking lot shall be striped and landscaped per the Arcadia
Municipal Code, subject to the approval of the Development Services
Department.

5. The use approved by CUP 2006-02 and ADR 2005-41 is
limited to the youth facility. The facility shall be operated and maintained

in a manner that is consistent with the proposal and plans submitted and
. approved for CUP 2006-02 and ADR 2005-41.
6. A separate sign design review application shall be submitted
for all new signs on the premises.
7. All conditions of approval shall be complied with prior to the
issuance of permits. Noncompliance with the plans, provisions and
conditions of approval for CUP 2006-02 and ADR 2005-41 shall be
grounds for immediate suspension or revocation of any approvals, which
could result in the closing of the youth facility.
8. All City code requirements regarding accessibility, fire
protection, occupancy, and safety shall be complied with to the satisfaction
of Building Services and the Fire Department.

9. Approval of CUP 2006-02 and ADR 2005-41 shall not take
effect until the property owner(s), and applicants have executed and filed
the Acceptance Form available from the Development Services Department
to indicate awareness and acceptance of these conditions of approval.
10. The applicant shall defend, indemnify, and hold harmless the
City of Arcadia and its officers, employees, and agents from and against any
claim, action, or proceeding against the City of Arcadia, its officers,
employees or agents to attack, set aside, void, or annul any approval or

condition of approval of the City of Arcadia concerning this project and/or
. land use decision, including but not limited to any approval or condition of
approval of the City Coimcil, Planning Commission, or City Staff, which
action is brought within the time period provided for in Government Code
Section 66499.37 or other provision of law applicable to this project or
decision. The City shall promptly notify the applicant of any claim, action,
or proceeding concerning the project and/or land use decision and the City
shall cooperate fully in the defense of the .matter, The City reserves the
right, at its own option, to choose its own attorney to represent the City, its
officers, employees, and agents in the defense of the matter.

11. That staff shall work with the church to ensure that adequate
on-site parking will be available for any special events within the new youth
facility addition.
SECTION 4,
The decision, findings and conditions contained in
this Resolution reflect the Commission's action of March 28, 2006, by the

SUBJECT: Conditional Use Permit Application No. CUP 2006-02 and Architectural
Design Review No, ADR 2005-41 for a youth facility addition to an
existing church at 512 W, Duarte Road .
SUMMARY
This Conditional Use Permit and Architectural Design Review application was
submitted by the architect, Chien- Ting Wan of WLC Architects, Inc., on behalf of the
applicant, Our Savior Lutheran Church, for a youth facility addition to the church
facility at 512 W. Duarte Road, The Development Services Department is
recommending approval of the applications subject to the conditions in this staff
report,
GENERAL INFORMATION
APPLICANT: Chien-Ting Wan of WLG Architects, Inc. (on behalf of Our Savior
Lutheran Church)

REQUEST: A Conditional Use Permit and Architectural Design Review for a
2,770 sq.ft. youth facility addition to an existing church

EXISTING LAND USE & ZONING:
The site is. developed with a church, constructed in 1957; a
fellowship hall, constructed in 1966; and a residence ("Quint"
house), original construction date unknown, that was converted to
Sunday school use in 1961, These buildings have a combined
square footage of 16,750 sq.ft., and the property is zoned R-3,

GENERAL PLAN DESIGNATION:
Multiple-Family Residential (24 DUlAC Maximum)
BACKGROUND
The church was initially permitted by Variance No: V 56-8, which became effective
on October 2, 1956. Subsequently, the Arcadia Municipal Code was amended to
allow churches in any zone with a Conditional Use Permit. Since then, three
Conditional Use Permits have been granted for various expansions of the church.
This property is currently developed with a church, a fellowship hall, and a quint
house, with a combined square footage of 16,750 sq,ft, Besides church service on
Sundays, they also operate a Sunday school for up to 85 kindergarten to sixth grade
students. On Weeknights and Sundays, there is a youth group program for up to 30
high school students, An additional youth facility is being proposed to better
accommodate the existing uses attheir current capacity,
PROPOSAL AND ANALYSIS
The proposal is to add a 2,770 sq,ft, youth facility building to the subject church site,
It will provide five classrooms, two bathrooms, and a basement storage area.
The primary function of this addition is to accommodate an existing youth group
program with up to 30 high-school aged students, There is a minister who
supervises the classes, The classes are held on Monday, 8:00 p,m. to 10:00 p,tn"
Tuesday to Friday, 7:00 p,m. to 10:00 p.m., and Sunday, 2:00 p,m, to 8:00 p,m,
The new facility is also going to be available for occasional special events in the
community, These events will not coincide with church service or other programs. In
staff's opinion, permitting such events within a 2,770 sq.ft. building would be an
appropriate use for this property, provided that the hours are limited to 8:00 a,m, to

10:00 p.m" and the events are held indoors to mitigate any potential impact upon the
neighboring residential properties.
A church facility is a permitted use in the R-3 zone with an approved conditional use
permit.
Parking
The proposed building will be situated within an existing parking area, requiring the
removal of 16 on-site parking spaces, With 128 existing spaces, this would reduce
the on-site parking to 112 spaces. The City's parking requirements for the various
uses on the subject property are as follows:

By Code, the proposed use would require 242 on-site parking spaces. With 112 on-
site spaces available, there will be a parking deficiency of 130 spaces, Although
there is a noticeable parking deficiency per code requirements, staff feels that the
proposed on-site parking would be sufficient since the uses are not simultaneous,
Le" the fellowship hall will not be used at the same time as the sanctuary; Sunday
school and the youth program will not begin until after the church service, which the
students and teachers generally attend prior to participating in the youth activities,
Upon recent site inspections, staff observed that the parking area is underutilized,
and in staff's opinion such parking would be adequate to accommodate the new
youth facility.
Architectural Desian Review
Concurrent with the consideration of the Conditional Use Permit, the Planning
Commission may approve, conditionally approve, or disapprove the applicant's
architectural design concept plans,
The property consists of buildings of various architectural styles; however, the
proposed youth facility will incorporate many of the design features of the existing
church, Le" stone veneer, accent bands, a high-pitched roof tower, exterior colors,
and window treatments would be compatible with the church building. Therefore, it is

staffs opinion that the applicant's proposal meets the intent ofthe City's architectural
design criteria.
. CODE REQUIREMENTS
All City requirements regarding disabled access and facilities, occupancy limits,
building safety, health code compliance, parking and site design shall be complied
with to the satisfaction of the Building Official, Community Development
Administrator, Fire Marshall, and Public Works Services Director.
CEQA
Pursuant to the prOVIsions of the California Environmental Quality Act, the
Development Services Department has prepared an Initial Study for the proposed
project. Said Initial Study did not disclose any substantial or potentially substantial
adverse change in any of the physical conditions within the area affected by the
project including land, air, water, minerals, flora, fauna, ambient noise and objects of
historical or aesthetic significance that could not be made less than significant with
mitigation incorporation, When considering the record as a whole, there is no
evidenCe that the proposed project will have any potential for adverse effect on
wildlife resources or the habitat upon which the wildlife depends, Therefore, a
Mitigated Negative Declaration has been prepared for this project. The mitigation
measures would be those that address the potential parking and traffic impacts,

FINDINGS
Section 9275.1.2 of the Arcadia Municipal Code requires that for a Conditional Use
Permit to be granted, it must be found that all of the following prerequisite conditions
can be satisfied:
1. That the granting of such Conditional Use Permit will not be detrimental to the
public health orwelfare or injurious to the property or improvements in such zone
or vicinity.
2. That the use applied for at the location indicated is properly one for which a
Conditional Use Permit is authorized,
3. That the site for the proposed use is adequate in size and shape to
accommodate said use, and all yards, spaces, walls, fences, parking, loading,
landscaping,. and other features required to adjust said use with the land and
uses in the neighborhood.

RECOMMENDATION

The Development Services Department recommends approval of Conditional Use
Permit Application No, CUP 2006-02 and Architectural Design Review No. ADR
2005-41, subject to the following conditions:

PLANNING COMMISSION ACTION
Approval
The Planning Commission should move to approve Conditional Use Permit No.
CUP 2006-02 and Architectural Design Review No. ADR 2005-41, file the
Negative Declaration, and direct staff to prepare a resolution to approve CUP
2006-02 for a 2,770 sq.ft. youth facility addition to the existing church at 512 W.
Duarte Road.
Denial
If the Planning Commission intends to deny this CondItional Use Permit application,
the Commission should state the specific reasons for denial and direct staff to
prepare the appropriate resolution incorporating the Commission's decision and
specific findings.
