RESOLUTION NO. 1742 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, APPROVING CONDITIONAL USE PERMIT NO. 2006-01 AND ARCHITECTURAL DESIGN REVIEW NO. 2005-36 FOR A 506 SQ.FT. WIRELESS COMMUNlCA TrONS EQillPMENT ENCLOSURE AND A FIFTY-FOOT (50') TALL MONOPOLE ANTENNA STRUCTURE CAMOUFLAGED AS A TREE AT 20 E. FOOTlllLL BOULEVARD. WHEREAS, on December 28, 2005, a conditional use permit application was filed by Omnipoint Communications, Inc., for a 506 sq.ft. wireless communications equipment enclosure and a fifty-foot (50') tall monopole antenna structure camouflaged as a tree (Development Services Department Case No. CUP 2006-01 and ADR 2005-36) at property commonly known as 20 E, Foothill Boulevard; and WHEREAS, a public hearing was held by the Planning Commission on March 28, 2006, at which time all interested persons were given full opportunity to be heard and to present evidence. NOW THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA RESOL YES AS FOLLOWS: SECTION 1. That the factual data submitted by the . Development Services Department in the attached report is true and correct. SECTION 2. This Commission finds: 1. That the granting of such Conditional Use Permit will not be detrimental to the public health or welfare, or injurious to the property or improvements in such Zone or vicinity because the initial study did not disclose any substantial adverse effects to the area affected by the proposed project. 2. That the use applied for at the location indicated is a proper one for which a Conditional Use Permit is authorized. . 3. That the site for the proposed use is adequate in size and shape to accommodate said use. All yards, spaces, walls, fences, loading, landscaping and other features including the shared parking with the neighboring business, are adequate to adjust said use with the land and uses in the neighborhood. The proposed project complies with all related zoning requirements as set forth in the Arcadia Municipal Code. 4. That the site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. . 2 1742 5. That the granting of such Conditional Use Permit will not . adversely affect the comprehensive General Plan because the land use and current zoning are consistent with the General Plan. 6. That the use applied for will not have a substantial adverse impact on the environment, and that based upon the record as a whole there is no evidence that the proposed project will have any potential for an adverse effect on wildlife resources or the habitat upon which the wildlife depends. . SECTION 3. That for the foregoing reasons this Commission grants Conditional Use Permit No. CUP 2006-01 and Architectural Design Review No. ADR 2005-36, for a 506 sq,ft. wireless communications equipment enclosure and a fifty-foot (50') tall monopole antenna structure camouflaged as a tree at 20 E. Foothill Boulevard, upon the following conditions: 1. That two live trees (i.e., pine) to match the antenna shall be planted, subject to the approval of Planning Services, and shall be maintained at all times in a first-class condition. 2. The concrete masonry wall and landscaping around the facility shall match the existing trash enclosure and landscaping adjacent to the site. . 3 1742 3. All City code requirements regarding accessibility, fire protection, . occupancy, and safety shall be complied with to the satisfaction of Building Services, Public Works Services, Development Services, and the Fire Department. 4. The proposed wireless communications facility including its colors and materials shall be maintained ina manner that is consistent with the plans and materials submitted and approved for CUP 2006-01 and ADR 2005-36. . 5. Noncompliance with the plans, provISIons and conditions of approval for CUP 2006-01 shall be grounds for immediate suspension or revocation of any approvals. 6. Approval of CUP 2006-01 and ADR 2005-36 shall not take effect until the property owner(s), and applicants have executed and filed the Acceptance Form available from the Development Services Department to indicate awareness and acceptance of these conditions of approval. . 7. The applicant shall defend, indemnify, and hold harmless the City of Arcadia and its officers, employees, and agents from and against any claim, action, or proceeding against the City of Arcadia, its officers, employees or agents to attack, set aside, void, or annul any approval or 4 1742 condition of approval of the City of Arcadia concerning this project and/or . land use decision, including but not limited to any approval or condition of approval of the City Council, Planning Commission, or City Staff, which action is brought within the time period provided for in Government Code Section 66499.37 or other provision of law applicable to this project or decision. The City shall promptly notify the applicant of any claim, action, or proceeding concerning the project and/or land use decision and the City shall cooperate fully in the defense of the matter. The City reserves the right, at its own option, to choose its own attorney to represent the City, its officers, employees, and agents in the defense of the matter. . 8. That the design shall be revised to a different type of tree camouflage (i.e., monopine), subject to the approval of Planning Services. SECTION 4. Foothill Boulevard, SUMMARY Conditional Use Permit No. CUP 2006-01 and Architectural Design Review No. ADR 2005-36 were submitted by Sequoia Deployment Services, Inc" representing Omnipoint Communications, Inc., to construct a wireless communications facility, consisting of a 506 sq.ft. wireless communications equipment enclosure and a fifty-foot (50') tall monopole antenna structure camouflaged as a palm tree (monopalm) at 20 E. Foothill Boulevard. The Development Services Department is recommending approval of the. applications subject to the conditions in this staff report. GENERAL INFORMATION APPLICANT: Sequoia Deployment Services (Representing Omnipoint Communications, Inc., a subsidiary of T-Mobile, USA, Inc,) LOCATION: REQUEST: 20 E. Foothill Boulevard A Conditional Use Permit and Architectural Design Review for a 506 sq,ft, wireless communications equipment enclosure and a fifty-foot (50') tall monopole antenna structure camouflaged as a palm tree (monopalm). 59,978 sq.ft. (1,38 acre) LOT AREA: . FRONTAGE: 148 feet along Foothill BoUlevard . EXISTING LAND USE & ZONING: The subject property is improved with a 25,000 sq,ft. office building constructed in 1980, and is zoned C-2. SURROUNDING LAND USES & ZONING: North: Commercial retail center; zoned C-2 South: Single-family dwellings; zoned R-1 East: Escrow office; zoned C-2 West: Laundry service; zoned C-2 GENERAL PLAN DESIGNATION: Commercial BACKGROUND On April 27, 2004, the Arcadia Planning Commission adopted Resolution No. 1705 to approve Conditional Use Permit No, CUP 2004-003 and Architectural Design Review No. 2003-044 for a near-identical communications facility proposal. The approval was based on the finding that the proposal met all the prerequisite conditions for a CUP and the design was in conformance with the architectural design guidelines. A new application is being sought by the applicant because the previous permit expired on . May 6, 2005. PROPOSAL Communications equipment facilities are permitted in any zone with a Conditional Use Permit (AMC Sec. 9275.1.11), The proposed location for the monopalm antenna and its equipment is a 506 sq.ft, area located near the center of the subject property, The proposed antennas will be mounted on a fifty-foot (50') tall mono palm located within the subject area with block wall screening of the ground mounted equipment. The proposed screening will match the colors and materials of the existing trash enclosure adjacent to the subject area. The applicant is also requesting a height modification of 50'-0" in lieu of the 40'-0" maximum building height permitted in the C.2 zone. The additional height is requested because it is necessary to provide the best level of service, and would be consistent with the allowable height for roof mounted communications equipment upon commercial buildings, I.e., per current code mechanical equipment and its screening may extend 10'-0" above the 40'-0" maximum height limitation for such buildings, . CUP 2006-01 & ADR 2005-36 March 28, 2006 Page 2 ANALYSIS . Uses such as this wireless communications equipment facility are permitted in any zone with an approved Conditional Use Permit (AMC Sec. 9275,1,11). The new equipment enclosure and the 50' tall monopalm will not decrease the number of parking spaces for the site's commercial office building, Based upon the applicant's proposal, it is staffs opinion that the proposed monopalm installation will be a compatible use upon the site, Architectural Desian Review . Concurrent with the consideration of the Conditional Use Permit, the Planning Commission may approve, conditionally approve, or disapprove the applicant's architectural design concept plans, The 50-foot tall monopole antenna structure is proposed to be camouflaged as a palm tree, also referred to as monopalm. To further camouflage the monopalm, the applicant is also proposing to plant two (2) forty-foot (40') tall live palm trees by the structure, Also, the proposed masonry wall enclosure and landscaping will be consistent with the existing trash enclosure and landscaping adjacent to the subject site, In staffs opinion, the proposed structure will be visually harmonious with existing buildings and structures, and surrounding development, and will enhance the appearance of the area; staff finds the proposed architectural design concept to be in compliance with the City's Architectural Design Review Regulations, Code Reauirements The proposed project is required to comply with all Code requirements and policies as determined to be necessary by the Building Official, Fire Marshall, City Engineer, Community Development Administrator, and Public Works Services Director, and are to be determined by having fully detailed construction plans submitted for plan check review and approval. CEQA Pursuant to the provisions of the California Environmental Quality Act, the Development Services Department has prepared an Initial Study for the proposed project. Said Initial Study did not disclose any substantial or potentially substantial adverse change in any of the physical conditions within the area affected by the project including land, air, water, minerals, flora, fauna, ambient noise and objects of historical or aesthetic significance, When considering the record as a whole, there is no evidence that the proposed project will have any potential for adverse effect on wildlife resources or the habitat upon which the wildlife depends. Therefore, a Negative Declaration has been prepared for this project. . CUP 2006-01 & ADR 2005-36 March 28, 2006 Page 3 . . . FINDINGS Section 9275.1.2 of the Arcadia Municipal Code requires that for a Conditional Use Permit to be granted, it must be found that all of the following prerequisite conditions can be satisfied: 1, That the granting of such Conditional Use Permit will not be detrimental to the public health or welfare or injurious to the property or improvements in such zone or vicinity, 2, That the use applied for at the location indicated is properly one for which a Conditional Use Permit is authorized, . 3, That the site for the proposed use is adequate in size and shape to accommodate said use, and all yards, spaces, walls, fences, parking, loading, landscaping, and other features required to adjust said use with the land and uses in the neighborhood. 4, That the site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. 5, That the granting of such Conditional Use Permit will not adversely affect the comprehensive General Plan. RECOMMENDATION The Development Services Department recommends approval of Conditional Use Permit Application No, CUP 2006-01 and Architectural Design Review No. ADR 2005- 36, subject to the following conditions: 1, Two (2) forty-foot (40') tall live palm trees shall be planted by the monopalm. 2, The color and material of the wall and landscaping around the facility shall match the existing trash enclosure and landscaping adjacent to the site. 3, All City code requirements regarding accessibility, fire protection, occupancy, and safety shall be complied with to the satisfaction of Building Services, Public Works Services, Development Services, and the Fire Department. 4, The proposed wireless communications facility including its colors and materials shall be maintained in a manner that is consistent with the plans and materials submitted and approved for CUP 2006,01 and ADR 2005-36, 5. PLANNING COMMISSION ACTION Approval The Planning Commission should move to approve Conditional Use Permit No. CUP 2006-01 and Architectural Design Review No. ADR 2005-36, file the Negative Declaration, and direct staff to prepare a resolution to approve CUP 2006-01 for a 506 sq.ft. wireless communications equipment enclosure and a fifty-foot (50') tall monopole antenna structure camouflaged as a palm tree (monopalm) at 20 E. Foothill Boulevard. Denial If the Planning Commission intends to deny this Conditional Use Permit application, the Commission should state the specific reasons for denial and direct staff to prepare the appropriate resolution incorporating the Commission's decision and specific findings. Butler, Community Development Administrator By: Pete Kinnahan, Economic Development Administrator Prepared by: Brian Saeki, Management Analyst SUBJECT: Finding of Consistency with the Arcadia General Plan for the AcqUisition and Disposition of Land for the Proposed Morlan Place Project SUMMARY Rusnak Arcadia, has proposed an expansion of their new and used Mercedes Benz dealership at 55 W, Huntington Drive. Staff is currently negotiating with Rusnak Arcadia for this expansion which would include the potential acquisition and disposition by the Arcadia Redevelopment Agency of approximately 3,6 aaes (5 separate parcels) adjacent to the existing Mercedes Benz site for ultimate use of the property as an auto dealership, if certain conditions are met or findings are made, Section 65402 of the California Government Code requires that the Planning Commission find that any acquisition and disposition of land by the City or Agency confonn to the City's General Plan. Because the proposed expansion area is currently designated Commercial in the City's General Plan and new and used automobile sales are considered commercial uses, staff recommends that the Planning Commission find that the potential land acquisition and disposition for the proposed Morlan Place project is consistent with the City's General Plan. DISCUSSION Rusnak Motors purchased the Fonner Foulger Ford site in August 2001 where they immediately began selling pre-owned certified Mercedes Benz automobiles with no assistance from the Redevelopment Agency, They moved their entire Mercedes Benz operation to Arcadia in November 2002 again without Redevelopment Agency assistance. This included the sales of new and used Mercedes Benz, service and parts facilities. . Rusnak Arcadia has now approached the Redevelopment Agency with a proposed . . . Arcadia Planning Commission June 22, 2004 Page 2 of 2 project to expand their current facility by approximately 3,6 acres, Staff is currently negotiating with Rusnak Arcadia to develop a Disposition and Deveiopment Agreement (DDA) which will specify all development parameters and will include all financial obligations, a development timeline, architectural design of the buildings, etc. Additionally, this agreement would allow the Redevelopment Agency to acquire and dispose of the 3.6 acres adjacent to the existing site to Rusnak Arcadia for the auto dealership expansion project, if certain conditions are met or findings are made. Section 65402 of the California Government Code requires that a finding be made by the Planning Commission of conformity with the General Plan before any property may be acquired and disposed by the Agency. This proposed project is consistent with the General Plan designation for this site (Commercial), The project proposes to expand the existing dealership to include the sale of new and used automobiles, automobile service, parts sales, etc, These are considered commercial uses and are also allowed by the Arcadia Zoning Code with a conditional use permit. Also as part of the proposed project, Mo~an Place would be partially vacated after a public hearing is conducted and findings are made. Section 65402 also requires that the Planning Commission find that the vacation is consistent with the General Plan, Due to the uncertainty of the project at this time, staff, based upon the recommendation of the City Attorney, will schedule this finding to appear before the Planning Commission at a future meeting. ENVIRONMENTAL IMPACT Staff has completed an initial study for the proposed project. Based upon the findings of the initial study, a traffic study was prepared and the mitigation measures will be incorporated into the project, A negative declaration or mitigated negative declaration will be presented to the Redevelopment Agency at the time the DDA is adopted by the Agency, RECOMMENDATION Staff recommends that 'the Planning Commission find that the proposed acquisition and disposition, and proposed use, of the 3,6 acres as proposed in the proposed DDA with Rusnak Arcadia, are consistent with the General Plan, Approved by: Donna L.
