HomeMy WebLinkAbout1729 . RESOLUTION NO. 1729 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, APPROVING CONDITIONAL USE PERMIT NO. 2005-07 FOR A 3,300 SQ. FT. TUTORING CENTER WITH 60 STUDENTS AT 19 E. LIVE OAK AVENUE UNITS A, C, & D WHEREAS, on March 25, 2005, a conditional use permit application was filed by Kate Kyungmi Ha, lessee, to permit a tutoring center; Development Services Department Case No. CUP 2005-07, at 19 E. Live Oak Avenue, units A, C, & D.; and WHEREAS, a public hearing was held by the Planning Commission on . May 10, 2005, at which time all interested persons were given full opportunity to be heard and to present evidence. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: SECTION 1. That the factual data submitted by the Development Services Department in the attached report dated May 10, 2005 is true and correct. SECTION 2. This Commission finds: 1. That the granting of such Conditional Use Permit will not be . detrimental to the public health or welfare, or injurious to the property or 1 . . . improvements in such zone or vicinity because the initial study did not disclose any substantial adverse effects to the area affected by the proposed project. 2. That the use applied for at the location indicated is a proper one for which a Conditional Use Permit is authorized. 3. That the site for the proposed use is adequate in size and shape to accommodate said use. AU yards, spaces, walls, fences, loading, landscaping and other features including the shared parking with the neighboring business, are adequate to adjust said use with the land and uses in the neighborhood. The proposed project complies with all related zoning requirements as set forth in the Arcadia Municipal Code. 4. That the site abuts streets and highways adequate in width and pavement type to cany the kind of traffic generated by the proposed use. 5. That the granting of such Conditional Use Permit will not adversely affect the comprehensive General Plan because the land use and current zoning are consistent with the General Plan. 6. That the use applied for will not have a substantial adverse impact on the environment, and that based upon the record as a whole there is no evidence that the proposed project will have any potential for an adverse effect on wildlife resources or the habitat upon which the wildlife depends. 2 . SECTION 3. That for the foregoing reasons this Commission grants Conditional Use Pennit No. CUP 2005-07, for a tutoring center at 19 E. Live Oak Avenue, units A, C, & D, upon the following conditions: 1. There shall be no more than sixty (60) students and nine (9) employees at anyone time. 2. The students shall be restricted to sixteen (16) years old and under on the weekdays, and no age restrictions on the weekends. . 3. The class hours in July and August shall be 9:30 a.rn. to 5:00 p.m., Monday through Friday, and 9:00 a.m. to 3:00 p.rn. on Saturdays. From September through June, the class hours shall be 3:00 p.m. to 6:00 p.m., Monday through Friday, and 9:00 a.m. to 3;00 p.rn. on Saturdays. 4. The use approved by CUP 2005-07 is limited to the tutoring center. The tutoring center shall be operated and maintained in a manner that is consistent with the proposal and plans submitted and approved for CUP 2005- 07. 5. A separate sign design review application shall be submitted for all new signs on the premises. 6. Any exterior alteration to the building requires the filing and approval of a design review application. . 3 . 7. All conditions of approval shall be complied with prior to opening the tutoring center. Noncompliance with the plans, provisions and conditions of . approval for CUP 2005-07 shall be grounds for immediate suspension or revocation of any approvals, which could result in the closing of the school. 8. All City code requirements regarding accessibility, fire protection, occupancy, and safety shall be complied with to the satisfaction of Building Services and the Fire Department. 9. Approval of CUP 2005-07 shall not take effect until the property owner(s), and applicants have executed and filed the Acceptance Form available from the Development Services Department to indicate awareness and acceptance of these conditions of approval. 10. The applicant shall defend, indemnify, and hold harmless the City of Arcadia and its officers, employees, and agents from and against any claim, action, or proceeding against the City of Arcadia, its officers, employees or agents to attack, set aside, void, or annul any approval or condition of approval of the City of Arcadia concerning this project and/or land use decision, including but not limited to any approval or condition of approval of the City Council, Planning Commission, or City Staff, which action is brought within the time period provided for in Government Code Section 66499.37 or other . provision of law applicable to this project or decision. The City shall promptly 4 . . . notify the applicant of any claim, action, or proceeding concerning the project and/or land use decision and the City shall cooperate fully in the defense of the matter. The City reserves the right, at its own option, to choose its own attorney to represent the City, its officers, employees, and agents in the defense of the matter. 1 I. A brief report will be presented to the Planning Commission in one year to provide an update on the operation of this business. SECTION 4. The decision, findings and conditions contained in this Resolution reflect the Commission's action of May 10,2005, by the following votes: AYES: Commissioners Hsu, Lucas, Wen NOES: Commissioners Baderian, Olson SECTION 5. Li, Associate Planner SUBJECT: Conditional Use Permit Application No. CUP 2005-07 for a tutoring center at 19 E. Live Oak Avenue, units A, C, & D. SUMMARY This Conditional Use Permit application was submitted by Kate Kyungmi Ha, lessee of the subject property, to operate a tutoring center with 60 students at 19 E. Live Oak Avenue, units A, C, & D. The Development Services Department is recommending denial of this application because the subject site is inadequate in size and shape to accommodate such use. GENERAL INFORMATION APPLICANT: Kate Kyungmi Ha (lessee) LOCATION: 19 E. Live Oak Avenue, units A, C, & D REQUEST: A Conditional Use Permit for a 3,300 sq.ft. tutoring center with 60 students in a 3,300 square foot unit within an existing 2 story commercial office building. SITE AREA: 19,055 sq. ft. (0.43 acres) FRONTAGE: Approx. 183 feet along Live Oak Avenue Approx. 61 feet along Louise Avenue . . . EXISTING LAND USE & ZONING: The site is developed with a 2-story, 9,000 sq.ft. commercial office building constructed in 1986, and is zoned CoO & 0, Professional Office with an Architectural Design overlay. SURROUNDING LAND USES & ZONING: No rt h : South: East: West: Single-family dwellings - zoned R-1 Commercial Retail units - zoned C-2 Bank - zoned CoO & 0 Restaurant - zoned C-1 & 0 GENERAL PLAN DESIGNATION: Commercial BACKGROUND This application is the result of a code enforcement citation. The subject use was originally pennitted in 1989 as a 2,000 sq.ft. art school with ten (10) students and four (4) teachers under Conditional Use Permit No. CUP 1989-010. Upon a recent inspection, staff discovered that the subject art school has expanded the use as well as the square footage of the school without pennits. PROPOSAL The proposal is to operate a 3,300 sq.ft. tutoring center that would occupy three units (A, C, & D) within the 9,000 sq.ft. office building at 19 E. Live Oak Avenue. Classes would be provided to students aged sixteen (16) and younger on weekdays. These classes would cover subjects such as Art, Speech, English, and Math. Piano lessons would also be provided. SAT ,preparation classes would be provided on Saturdays to high-school students. There would be one to two sessions a day, with a maximum of sixty (60) students at anyone time. The proposed class hours are as follows: Summer Class Hours (Julv and Auaust) Monday through Friday 9:30 a.m. - 5:00 p.m. Saturday 9:00 a.m. - 3:00 p.m. Winter Class Hours (September throuah June) Monday through Friday 3:00 p.m. - 6:00 p.m. Saturday 9:00 a.m. - 3:00 p.m. The applicant would typically be there from noon to 6:00 p.m. to handle administrative functions and teach class. In addition, there would be eight teachers CUP 05-07 May 10, 2005 Page 2 . . . who come in for a period of 2-4 hours each day; each teacher has 5-8 students. The teachers would typically come in a few hours before class for preparation, and stay an hour after to complete their tasks. A tutoring center is a permitted use in the COO zone with an approved conditional use permit. Parkina There are 32 on-site parking spaces. By Code, a tutoring center with students of non-driving age is required to provide 1 space per employee plus 1 space for every 5 students. Under this regulation, the proposed 3,300 sq.ft. tutoring center with sixty (60) students and nine (9) employees would require twenty-one (21) parking spaces. Together with the existing office uses, the proposed use would result in a parking deficiency of 12 spaces. The following is a break-down of the on-site parking requirements: Parking Requirements for Commercial Uses at 19 E. Ft. 5,700 3,300 Spaces Reauired 23 21 Parking Ratio 4/1,000 1/employee + 1/5 students Totals 9.000 On-site parking spaces provided 44 32 In response to a previous Conditional Use Permit application for a proposed job- training center at the subject location, a neighboring resident to the north of the site adVised staff that traffic near the intersection of Live Oak Avenue and Louise Avenue is heavy due to the site's existing art school, and the existing bank located across the street at Louise Avenue. ANALYSIS The Development Services Department received numerous calls from concemed parents, stating that the school serves a need in the city. Staff acknowledges the parents' concerns. However. in staff's opinion, the proposal is too intense for the subject property, and is inconsistent with the design of the building to accommodate general office uses. This is evident as the Building Official and Deputy Fire Marshal are requiring substantial upgrades to the building to accommodate this use (see attachments). Furthermore, the typical noise level associated with children may have a negative impact on the existing office uses, as well as adjoining residential uses. Although there will be a parking deficiency, staff observed that there is available on- site parking throughout most of the day. However, there is a substantial problem CUP 05-07 May 10,2005 Page 3 . . . with the site not providing an adequate on-site area to accommodate the loading and unloading of the students within a short period of time. The lack of proper on-site traffic circulation for the proposed use causes traffic to back out onto Louise Avenue and Live Oak Avenue especially when parents are dropping off and picking up their children at the same time. Staff is recommending denial of this application because the configuration of the parking areas are inadequate in size and shape to accommodate the expanded use. CODE REQUIREMENTS All City requirements regarding disabled access and facilities, occupancy limits. building safety, health code compliance, parking and site design shC!1I be complied with to the satisfaction of the Building Official, Community Development Administrator, Fire Marshall, and Public Works Services Director. Any exterior improvements, such as any new signs, sign face changes, and awnings shall be subject to architectural design review and approval by the Community Development Division. CEQA Pursuant to the provIsions of the California Environmental Quality Act, the Development Services Department has prepared an Initial Study for the proposed project. Said Initial Study did not disclose any substantial or potentially substantial adverse change in any of the physical conditions within the area affected by the , project including land, air, water, minerals. flora, fauna, ambient noise and objects of historical or aesthetic significance that could not be made less than significant with mitigation incorporation. When considering the record as a whole, there is no evidence that the proposed project will have any potential for adverse effect on wildlife resources or the habitat upon which the wildlife depends. However, this proposal would result in traffic impacts. Therefore, a Mitigated Negative Declaration has been prepared for this project; mitigation measures would be those that address the traffic issues., FINDINGS Section 9275.1.2 of the Arcadia Municipal Code requires that for a Conditional Use Permit to be granted, it must be found that all of the following prerequisite conditions can be satisfied: 1. That the granting of such Conditional Use Permit will not be detrimental to the public health or welfare or injurious to the property or improvements in such zone or vicinity. 2. That the use applied for at the location indicated is properly one for which a Conditional Use Permit is authorized. CUP 05-07 May 10, 2005 Page 4 . . . 3. That the site for the proposed use is adequate in size and shape to accommodate said use, and all yards, spaces, walls, fences, parking, loading, landscaping, and other features required to adjust said use with the land and uses in the neighborhood. 4. That the site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. 5. That the granting of such Conditional Use Permit will not adversely affect the comprehensive General Plan. RECOMMENDATION The Development Services Department recommends denial of Conditional Use Permit Application No. CUP 2005-07, because the subject site is Inadequate in size and shape to accommodate said use. If the Planning Commission determines that based on the evidence presented this is an appropriate use at this site and moves to approve Conditional Use Permit Application No. CUP 2005-07, staff recommends the following conditions of approval: 1. There shall be no more than twenty (20) students and nine (9) employees at anyone time. 2. PLANNING COMMISSION ACTION Denial The Planning Commission should move to deny Conditional Use Permit Application No. CUP 200S.Q7 because the proposal cannot satisfy all of the required prerequisite conditions for a Conditional Use Permit, and adopt Resolution No. 1729 to affirm the Commission's decisiOn and specific findings. Approval If the Planning Commission intends to approve Conditional Use Permit Application No. CUP 2005-07, the Commission should move to file the Negative Declaration, state the supporting findings, and direct staff to prepare a resolution incorporating the Commission's decision, specific finding~, and any conditions of approval. . This proposal would increase the intensity of the use and would increase the parking shortage. Also, the loading and unloading of students would cause a temporary congestion near an intersection. The congestion could be mitigated by limiting the number of students to where the provided spaces would be sufficient to serve as loading spaces.
