RESOLUTION NO. 1728
A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF ARCADIA, CALIFORNIA, APPROVING
CONDITIONAL USE PERMIT NO. 05-009 WITH A
MODIFICATION TO ALLOW 6 FUELING POSITIONS IN
LIEU OF 8 REQUIRED, AND ARCHITECTURAL DESIGN
REVIEW NO. 04-028 TO ALLOW A NEW AUTOMOBILE
FUELING STATION AT 625 W. LAS TUNAS DRIVE.
WHEREAS, the City of Arcadia on November 4, 2004, received an
Architectural Design Review application followed by a Conditional Use Permit
application on March 31, 2005 by Mr. David Sabin, a representative for the Arco
Company to allow a new automobile fueling station at 625 W. Las Tunas Drive;
. and,

WHEREAS, pursuant to the provisions of the California Environmental Quality
Act, Public Resources Code, Section 21000 et seq. ("CEQA"), and the State's
CEQA Guidelines, the City of Arcadia prepared an Initial Study and determined,
there is no substantial evidence that the approval of Conditional Use Permit No.
05-009 and Architectural Design Review No. 04-028 would result in a significant
adverse effect on the environment. Accordingly, a Negative Declaration has been
prepared and notice of that fact was given in the manner required by law; and,

. WHEREAS, a public hearing was held by the Planning Commission on June
14, 2005, at which time all interested persons were given full opportunity to be
heard and present evidence.
NOW, TIIEREFORE, TIIE PLANNING COMMISSION OF THE CITY OF
ARCADIA RESOLVES AS FOLLOWS:
SECTION 1. That the factual data submitted by the Development Services
Department in the attached report is true and correct.
SECTION 2. This Commission finds:
i. That the granting of such Conditional Use Permit will riot be detrimental to the
public health or welfare, or injurious to the property or improvements in such zone

or vicinity because the proposed use will be compatible with the surrounding uses,
and it will be appropriate for the subject site since it will be a continuation of the
existing use, which is a fueling station, and the proposed project will provide
adequate parking and queing to the automated self-service car wash.
2. That the use applied for at the location indicated is a proper one for which a
Conditional Use Pennit is authorized.
3. That the site for the proposed use is adequate in size and shape to accommodate
said use. All yards, spaces, loading, landscaping, parking, and other features are
adequate to adjust said use with the land and uses in the neighborhood. The

e proposed project complies with all related zoning requirements as set forth in the
Arcadia Municipal Code.
4. That the site abuts two major streets that are adequate in width and pavement
type to carry the kind of traffic generated by the proposed use.
5. That the granting of such Conditional Use Permit will not adversely affect the
comprehensive General Plan because the land use and current zoning are consistent
with the General Plan.
6. That the use applied for will not have a substantial adverse impact on the
environment, and that based upon the record as a whole there is no evidence that
. the proposed projeqt wilJ have any potential for an adverse effect on wildlife
resources or the habitat upon '!Vhich the wildlife depends.
SECTION 3.
That for the foregoing reasons this Commission grants
Conditional Use Permit No. CUP 05-009 with a modification to allow 6 fueling
positions in lieu of 8 required, and Architectural Design Review No. 04-028 to
allow a new automobile fueling station at 625 W. Las Tunas Drive, upon the
following conditions:

__ 1. Prior to issuance of a demolition permit, a Lot Line Adjustment must be
approved and recorded by Los Angeles County Recorder's Office to adjust the
property lines of three lots into one parcel.
2. The fueling station and AM/PM convenience store may be permitted to open
24-hours a day with an attendant on-site at all times.
3. The business hours for the automated self-service car wash shall be limited to
7:00 a.m. to 8:00 p.m., everyday.
4. The retail sales area within the convenience store shall not exceed 1,625 square
feet in area.
e 5. The sales of beer and wine shall be contained within the refrigerator coolers
inside the convenience store and is limited to only off-site consumption.
6. The vacuum units shall be skirted with a mechanical equipment blanket to
reduce the noise by approximately forty percent (40%).
7. The monument sign shall not exceed 10'-0" in height, and the second price sign
shall not be more than 2 1h ' x 5' per face and 8' -0" in height.
8. The proposed'light fixtures along Baldwin Avenue and Las Tunas Drive shall
not exceed 20'.0" in height, and 15'-0" in height if located within 100'-0" of

e residential zoned property. The height of the light posts shall be measured from
the elevation of the adjacent pavement of the parking lot.
9. All the light fixtures shall be hooded and arranged to reflect away from the
adjoining properties and streets. A blank metal shall also be inserted behind the
lenses to block-off any lights that shall glare ont~ the adjacentproperties.
to. A minimum of9 parking spaces shall be provided on site.
11. The proposed signage, including the window signs, shall comply with all
applicable Municipal Code requirements.
12. All on-site parking spaces shall be double striped in accordance with Municipal

Code Section 9269.8.1.
13. A landscape and irrigation plan shall be submitted for review and approved by
the Community Development Administrator, or his/her designee prior to issuance
of a building pennit.
14. The proposed project shall comply with the conditions of approval set forth by
the Public Works Services Department in their memorandum, dated November 4,
2004.

e 15. The proposed project shall comply with the National Pollutant Discharge
Elimination System (NPDES) requirements required by the Public Works Services
Department, dated November 11, 2004.
16. The proposed project shall comply with the conditions of approval set forth by
Building Services in their memorandum, dated November 4, 2004.
17. The proposed project shall comply with the conditions of approval set forth by
Fire Department set forth in their memorandum. dated November 15, 2004.
18. The proposed project shall comply with the conditions of approval set forth by
Engineering Division in their memorandum, dated May 3, 2005.
e '19. Approval of CUP 05-009 and ADR No. 04-028 shall not take effect until the
property owner(s) and applicants have executed and filed the Acceptance Form
available from the Development Services Department to indicate awareness and
acceptance of these conditions of approval.
20. The applicant shall defend, indemnify, and hold harmless th~ City of Arcadia
and its officers, employees, and agents from and against any claim, action, or
proceeding against the City of Arcadia, its officers, employees or agents to attack,
set aside, void, or annul any approval or condition of approval of the City of
Arcadia concerning this project and/or land use decision, including but not limited

e to any approval or condition of approval of the City Council, Planning
Commission, or City Staff, which action is brought within the time period provided
for in Government Code Section 66499.37 or other provision of law applicable to
this project or decision. The City shall promptly notify the applicant of any claim,
action, or proceeding concerning the project and/or land use decision and the City
shall cooperate fully in the defense of the matter. The City reserves the right, at its
own, option, to choose its own attorney to represent the City, its officers,
employees,and agents in the defense of the matter.

The decision, findings and conditions contained in this

Conditional Use Permit No, 2005-009 and Architectural Design

e SUMMARY
The subject applications were filed by Mr. David Sabin, on behalf of the Arco
Company. to allow a new automobile fueling station at 625 W. Las Tunas Drive.
The Development Services Department is recommending approval of the
applications, and adoption of Resolution No. 1728, subject to the conditions of
'approval outlined in this staff report.
GENERAL INFORMATION
APPLICANT: David Sabin on Behalf of Arco Company
LOCATION: 625 W. Las Tunas Drive
REQUEST: A Conditional Use Permit and Architectural Design Review to
allow a new automobile fueling station, and the sales of beer and
winewithin the convenience store. The applicant's proposal also

BACKGROUND
On November 2, 2004, the City Council adopted Ordinance No. 2201, approving
Text Amendment No. 2004-003 that was initiated by the applicant, to allow an
automated self-service car wash in conjunction with an automobile fueling station
and convenience store. At that time the Arcadia Municipal Code did not have a
provision to allow such a facility.
PROPOSAL
The subject site currently has an existing Arco Service Station that has been in
operation since 1968. The service station consists of a 1,694 square foot AM/PM
24"haur convenience store with 3 service lube bays at the rear of the building,
and 6 fueling positions: The fueling station and convenience store currently

operates 24-hours a day with an attendant on-site at all times. The service lube
bays operate from 8:30 a.m. to 6:00 p.m., Monday through Saturday.
The applicant proposes to demolish all of the existing structures and construct a
larger convenience store that will be approximately 3,058 square feet, a 958
square foot automated self-service car wash at the rear of the building, permit the
sale of beer and wine within the convenience store that will be located less than
, 50' from residentially zoned property, and a canopy with 6 fueling positions in
lieu of 8 required by Code. The site will no longer have any service lube bays.
The fueling station and convenience store will continue to operate 24-hours a day
with at least 3 attendants on-site at all times, and the automated self-service car
wash will operate everyday from 7:00 a.m. to 8:00 p.m. There will be three 8-
hour shifts each day with three employees on-site at.all time.
ParkinQ
The Arcadia Municipal Code requires three (3) parking spaces for every 1,000
square feet of retail sales area in addition to the fueling positions. The actual
retail sales area within the convenience store is 1,625 square feet, which
requires a total of 9 parking spaces. A total of 10 parking spaces will be provided
in front of the convenience store, which exceeds the minimum on-site parking
requirements.
The existing driveway approach on Baldwin Avenue will be widen from 34'-0" to
40'-0" to provide adequate queing into the car wash area, and the driveway on
Las Tunas Drive that is located furthest east will remain at the same location.
The driveway closest to the intersection will be removed.
Interlocking pavers will also be placed behind several parking stalls as a
pedestrian walkway to the convenience store.
Architectural Desion Review
After working with staff and the City's consultant on the architectural design of
the building, the applicant re-designed the building from an initial contemporary
style that was similar to the Area Service Station at 5 W. Foothill Boulevard to a
Craftsman style building. Some of the defining elements of the Craftsman style
building include deep roof eaves with exposed cornices, and wide front porches
with tapered wood columns and river rock veneer at the base. Further
enhancements include half-sided gable roofs on all sides of the building with a

trellis at the front and rear side of the car wash, and over the trash enclosure.
Also, the river rock veneer will be used on all of the support columns for the
canopy and monument sign to create uniformity.
The proposed signs, with the exception of the window signs would comply with
all applicable codes. The window signs exceed the allowable area requirement,
as noted in the following analysis.
ANALYSIS
Section 9275.4.7(4) of the Arcadia Municipal Code requires that an automobile
fueling station must provide at least 8 fueling positions as the primary use. There
will be no change in the number of fueling positions since 6 fuel dispensers are
more than adequate for this site.
As for the sale of beer and wine within the convenience store, it is staff's opinion
that although the convenience store will be located less than 150' from
residentially zoned property it would not have an adverse impact since they will
be contained inside the refrigerator coolers and there will be no on-site
consumption.
In regards to signage, the applicant is requesting that the two end windows in
front of the convenience store be fully covered by window signs. According to
Arcadia Municipal Code Section 9262.4.8, the total area of a window sign in any
one (1) wall shall not exceed twenty-five (25%) of the window area provided that
the total area of directly lighted window signs does not exceed ten percent (10%)
of said window area. It is staff's opinion that there is no hardship or unique
situation to warrant this request since 25% of window signs are sufficient for the
size of this store's frontage.
It is staff's opinion that the proposed use and signage, with the exception of the
full 'window signs, are appropriate for the site, provided that the operation of such
use remains consistent with this application.
CODE REQUIREMENTS
All City requirements regarding disabled access and facilities, occupancy limits,
building safety, health code compliance, parking and site design shall be
complied with to the satisfaction of the Building Official, Community Development
Administrator, Fire Marshall, and Public Works Services Director.

Pursuant to the provIsions of the Califomla Environmental Quality Act, the
Development Services Department has prepared an initial study for the proposed
project. Said initial study did not disclose any substantial or potentially substantial
adverse change that cannot be mitigated to a level that is less than significant in
any of the physical conditions within the area affected by the project inclUding
land, air, water, minerals, flora, fauna, ambient noise and objects of historical or
aesthetic significance. When considering the record as a whole, there is no
evidence that the proposed project will have any potential for an adverse effect
on wildlife resources or the habitat upon which the wildlife depends. Therefore, a
Negative Declaration has been prepared for this project.
ADDITIONAL INFORMATION
Staff received one letter of concern from the adjacent neighbor at 525 W.
Woodruff Avenue opposing the proposed project because ofthe potential noise
impacts the car wash would generate (refer to the attachment).

The noise levels are not anticipated to be substantially higher than what currently
exists on the auto service station site and the car wash will be located
approximately 64'-0" from the side property line of the residentially zoned
property. However to ensure that the noise will be mitigated, a condition of
approval has been imposed that the vacuum units shall be skirted with a
mechanical equipment blanket to reduce the noise by approximately forty percent
(40%).
FINDINGS
Section 9275.1.2. of the Arcadia Municipal Code requires that for a Conditional
Use Permit to be granted, it must be found that all of the following prerequisite
conditions can be satisfied:
1. That the granting of such Conditional Use Permit will not be
detrimental to the public health or welfare or injurious to the property or
improvements in such zone or vicinity.
2. That the use applied for at the location indicated is properly one for
which a Conditional Use Permit is authorized.

That the site for the proposed use is adequate in size and shape to
accommodate said use, and all yards, spaces. walls. fences, parking,
loading, landscaping, and other features required to adjust said use

use.
5. That the granting of such Conditional Use Permit will not adversely

PLANNING COMMISSION ACTION
Approval
The Planning Commission should move to adopt the Negative Declaration,
approve Conditional Use Permit Application No. 05-009 with a modification to
allow 6 fueling positions in lieu of 8 required, Architectural Design Review No. 04-
028, and adopt Resolution No. 1728 approving a new automobile fueling station
at 625 W. Las Tunas Drive.
Denial
If the Planning Commission intends to deny this Conditional Use Permit, the
Commissior:1 should state the specific reasons for denial and direct staff to
prepare the appropriate resolution incorporating the Commission's decision and
specific findings.

EVALUATION OF ENVIRONMENTAL IMPACTS:
1.
A brief explanation is required for all answers except "No Impacr answers that are
adequately supported by the information sources a lead agency cites in the parentheses
following each question. A "No Impact" answer is adequately supported if the referenced
information sources show that the impact Simply does not apply to projects such as the one
involved (e.g., tile project is not within a fault rupture zone). A "No Impacr answer should
be explained where it is based on project~specific factors as well as general standards
(e.g" the project will not expose sensitive receptors to pollutants, based on a project-
specific screening analysis).

All answers must take account of the whole action involved, including off-site as well as on-

mitigation measures has reduced an effect from "Potentially Significant Impacr to a "Less
Than Significant Impact." The lead agency must describe the mitigation measures, and
briefly explain how they reduce the effect to a less than significant level (mitigation

A Phase I Report was prepared by Secor Inc., dated February 1, 2005. A review of a previous
environmental investigation report Indicates that numerous environmental investigations has been

1, Fire protection requirements, including fire hydrants, shall be as stipulated by the Arcadia
Fire Department.
2, If a fire sprinkler system is required, backflow protecllon on the fire sprinkler system shall
be by an approved Double Check Detector Assembly installed aboveground and
screened as required by the Planning Department. The bypass meter shall read in cubic
feet (ct).
3. The existing water"servlce lateral and water meter are both 1 inch, A Water Meter
Clearance Application, filed with the Arcadia Water Section, shall be required prior to
permit issuance to ensure adequate water meter/service size for domestic use, irrigation,
and the car wash.
4. New water service installation shall be by the Developer. Installation shall be according
to'the specificallons of the Public Works Services Department, Engineering Section,
Demolition of existing water services, if necessary, shall be by the Developer,according
to Public Works Services Department, Engineering Section specifications.
5. No water service lateral, meter, flush-out, backflow prevention device or fire hydrant may
be located in any driveway nor may be closer than 3 feet from the top of "x. of any
driveway or other utility,
6. Backflow protection on the Irrigation system shall be as stipulated by the Arcadia Water
Section. Any existing irrigallon system shall be brought up to current code requirements.
7. All pipe, valves, hydrants, meters, fittings and appurtenances, including disinfection and
flushing, shall meet the specifications of the Arcadia Public Works Services Department,
Engineering and Water Sections.
8. The car wash make up water shall be separated from the domestic water by installation
of, an approved reduced pressure backflow preventer.
9. A reduced pressure backflow preventer shall also be Installed at or near the domestic
water meter.
