RESOLUTION NO. 1726 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, APPROVING CONDITIONAL USE PERMIT NO. 2005-05 AND ARCHITECTURAL DESIGN REVIEW NO. 2004-022 FOR AN AUTOMOBILE SERVICE STATION WITH LUBRICATION SERVICE AT 3 E. DUARTE ROAD WHEREAS, on February 25, 2005, a conditional use permit application was filed by Alex Gurski, project coordinator, to construct and operate an automobile service station, engaging in the sale of motor fuels with automobile lubrication service and a 210 sq. ft. convenience store (Development Services Department Case No. CUP 2005-05 and ADR 2004- 022) at property commonly known as 3 E. Duarte Road; and WHEREAS, a public hearing was held on April 12, 2005, at which time all interested persons were given full opportunity to be heard and to present evidence. NOW THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA RESOL YES AS FOLLOWS: SECTION 1. That the factual data submitted by the Development Services Department in the attached report is true and correct. SECTION 2. This Commission finds: . e 1. That the granting of such Conditional Use Permit will not be detrimental to the public health or welfare, or injurious to the property or improvements in such zone or vicinity because the initial study did not disclose any substantial adverse effects to the area affected by-the proposed project. 2. That the use applied for at the location indicated is a proper one for which a Conditional Use Permit is authorized. 3. That the site for the proposed use is adequate in size and shape to accommodate said use. All yards, spaces, walls, fences, loading, landscaping and other features including the shared parking with the neighboring business, are adequate to adjust said use with the land and uses in the neighborhood. The proposed project complies with all related zoning requirements as set forth in the Arcadia Municipal Code. 4. That the site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. 5. That the granting of such Conditional Use Permit will not adversely affect the comprehensive General Plan because the land use and current zoning are consistent with the General Plan. 6. That the use applied for will not have a substantial adverse impact . on the environment, and that based upon the record as a whole there is no 2 1726 . evidence that the proposed project will have any potential for an adverse effect on wildlife resources or the habitat upon which the wildlife depends. SECTION 3. That for the foregoing reasons this Commission grants Conditional Use Permit No. CUP 2005-05, for an automobile service station with at 3 E. Duarte Road, upon the following conditions: 1. The use approved by CUP 2005-05 and ADR 2004-022 is limited to the automobile service station. The service station shall be operated and maintained in a manner that is consistent with the proposal and plans e submitted and approved for CUP 2005-05 and ADR 2004-022. 2. All regulations on automobile service stations pursuant to Arcadia Municipal Code Section 9275.4 shall be complied with unless determined otherwise under CUP 2005-05 and ADR 2004-022. 3. A minimum of two (2) 36" box specimen trees shall be planted in the planter on the easterly portion of the property to screen the service bays, subject to the review and approval of the Community Development Administrator. 4. Switch the location between the trash enclosure and the parking spaces by the northwesterly comer of the property, subject to the review and approval of the Community Development Administrator. . 3 1726 . e 5. The monument sign shall be lowered to a maximum height of 8' - 0". 6. The wall sign on the northwest elevation shall be removed or relocated, location subject to the review and approval of the Community Development,Administrator. 7. The hours of operation shall be limited to Monday though Friday, 7:30 a.m. to 7:00 p.m., Saturday, 7:30 a.m. to 6:00 p.m., Sunday, 8:00 a.m. to 5:00 p.m. in the Summer (May 1st through Oct. 31st). And Monday tbrough Saturday, 7:30 a.m. to 6:00 p.m., Sunday, 8:00 a.m. to 5:00 p.m. in the Winter (Nov. 1st through April 30th). 8. The maximum number of employees at anyone time cannot exceed five (5). 9. All conditions of approval shall be complied with prior to opening of the automobile service station. Noncompliance with the plans, provisions and conditions of approval for CUP 2005-05 and ADR 2004-022 shall be grounds for immediate suspension or revocation of any approvals, which could result in the closing of the service station. 10.All City code requirements regarding accessibility, fire protection, occupancy, and safety shall be complied with to the satisfaction of Building . Services and the Fire Department. 4 1726 . e . II.Approval of CUP 2005-05 and ADR 2004-022 shall not take effect until the property owner(s), and applicants have executed and filed the Acceptance Form available from the Development Services Department to indicate awareness and acceptance of these conditions of approval. l2.The applicant shall defend, indemnify, and hold harmless the City of Arcadia and its officers, employees, and agents from and against any claim, action, or proceeding against the City of Arcadia, its officers, employees or agents to attack, set aside, void, or annul any approval or condition of approval of the City of Arcadia concerning this project and/or land use decision, including but not limited to any approval or condition of approval of the City Council, Planning Commission, or City Staff, which action is brought within the time period provided for in Government Code Section 66499.37 or other provision of law applicable to this project or decision. The City shall promptly notify the applicant of any claim, action, or proceeding concerning the project and/or land use decision and the City shall cooperate fully in the defense of the matter. The City reserves the right, at its own option, to choose its own attorney to represent the City, its officers, employees, and agents in the defense of the matter. 5 1726 . e . 13.That a "Right-turn only" sign shall be posted by each of the proposed driveways, subject to the review and approval of the Community Development Administrator. SECTION 4. The decision, findings and conditions contained in this Resolution reflect the Commission's action of April 12, 2005, by the following votes: AYES: NOES: Commissioners Baderian, Lucas, Olson, Wen Commissioner Hsu SECTION 5. Li, Associate Planner SUBJECT: Conditional Use Permit Application No. CUP 2005-05 and Architectural Design Review No. ADR 2004-022 for an automobile servic;e station at 3 E. Duarte Road. SUMMARY The subject Conditional Use Permit and Architectural Design Review applications were submitted by the project coordinator, Alex Gurski, to construct and operate an automobile service station at 3 E. Duarte Road. The Development Services Department is recommending denial of the applications because the proposed building is inconsistent with the goals set forth in the architectural design guidelines. GENERAL INFORMATION APPLICANT: Alex Gurski (project coordinator) LOCATION: 3 E. Duarte Road (also known as 916 S. Santa Anita Avenue) REQUEST: A Conditional Use Permit (CUP) and Architectural Design Review (ADR) to construct and operate an automobile service station, engaging in the sale of motor fuels with automobile lubrication service and a 210 sq.ft. convenience store. SITE AREA: 13,456 sq. ft. (0.31 acre) FRONTAGES: Approximately 152 feet along Duarte Road; 148 feet along Santa Anita Avenue . e . EXISTING LAND USE & ZONING: The site is currently undeveloped, and is zoned C-2 General Commercial. SURROUNDING LAND USES & ZONING: No rt h: Warehouse (non-conforming) - zoned C-2 South: Automobile SeNice Station - zoned C-2 E a s t: Tire SeNice Center (non-conforming) - zoned C-2 W est: Commercial Retail Center - zoned C-2 GENERAL PLAN DESIGNATION: Commercial BACKGROUND The subject property was an automobileseNice station '(Shell seNice station) until it closed in May of 2003. This former station had two seNice bays for minor seNicing of vehicles and an automatic key-operated carwash bay. The structures, including the fuel tanks, were removed and demolished by July 2003. The property has remained vacant since that time. PROPOSAL AND ANALYSIS The proposal is to construct a.nd operate an automobile seNice station with four fuel pumps, three seNice bays for automobile lubrication seNice, and an incidental 210 sq.ft. convenience store at the subject property. There will be five employees at the peak employment period. The proposed hours vary slightly between the summer and winter season; they are as follows: Summer Hours Monday through Friday Saturday Sunday 7:30 a.m. - 7:00 p.m. 7:30 a.m. - 6:00 p.m. 8:00 a.m. - 5:00 p.m. Winter Hours Monday through Saturday 7:30 a.m. - 6:00 p.m. Sunday 8:00a.m. - 5:00 p.m. The applicant estimates about 43 trips per day for the lubrication seNice use, based on current operations. The proposed use provides an equal number of fuel pumps and islands as the previous use, therefore not increasing the number of trips generated for the refueling of vehicles. The applicant estimates 122 trips per day for the previous car wash, in addition to trips generated by the two seNice bays. In CUP 2005-05 & ADR 2004-022 April 12, 2005 Page 2 . e . staff's opinion, the proposed use would not generate more traffic than the previous automobile service station. An automobile service station is a permitted use in the C-2 zone with an approved conditional use permit. Parkinq The proposed service station has six (6) on-site parking spaces. By Code, one parking space is required for each employee in the peak employment period, plus one additional for the convenience store; therefore, a maximum of five (5) employees shall be permitted at anyone time. The Code also requires that the backup area shall not occur in the first 20 feet from the street right-of-way and a parking lot entrance or exit. However, this was a recent change to the code and was not considered during the Architectural Design Review process. If this project is approved, staff suggests a condition to switch the location between the trash enclosure and the parking spaces by the northwesterly comer of the property to comply with such a requirement. Architectural Desiqn Review The applicant describes the architectural design as a blend of Art Deco and Traditional Red Brick styles, with lighting and decorative wrought iron work that is representative of the Art Nouveau styles. The predominant materials used will be aged red brick, wrought iron, glass mullions, red roof tile and light tile wainscoting. In staffs opinion, the proposed style is reminiscent of an old firehouse, which is of high aesthetic quality and would complement the red brick commercial retail building to the west of the subject property, across Santa Anita Avenue. The Arcadia Architectural Design Guidelines requires the design of the buildings to show proper consideration for the visual effect of the development from view of the public rights-of-way. With the udrive-thru" design of the service bays, the door panels will remain open during the hours of operation; the open bays will remain visible from Santa Anita Avenue and Duarte Road and would detract from the overall aesthetic quality of the building. The more traditional layout of service bays where there are only doors on one side of the building would be more desirable because screening could be better achieved. It could also eliminate the open bays from facing the street, resulting in a more appealing fa9ade than open service bays. Siqns The applicant is proposing one freestanding monument sign, two directional signs, and three wall signs for the project. CUP 2005-05 & ADR 2004-022 April 12, 2005 Page 3 . The monument sign is a 10'-0" high intemally-iIluminated sign with push-through lettering and an opaque background. Based on recently approved monument signs approved on similar size sites and type of uses, the height should be reduced to 8'-0" because it would satisfy the same advertising need while attaining a more pedestrian-friendly scale. The directional signs are consistent with the monument sign in their design and are proposed at 3'-0", which meet the city's visibility standards. The three wall signs proposed are intemally-iIluminated channel letters with a halo effect. The two wall signs on the southwest and southeast elevation appear integrated with the building. However, the one on the northwest elevation appears to be wedged into a narrow area between the cornice and the roof of the adjacent portion of the building. In staff's opinion, this wall sign should be removed or relocated. CODE REQUIREMENTS All City requirements regarding disabled access and facilities, occupancy limits, building safety, health code compliance, parking and site design shall be complied with to the satisfaction of the Building Official, Community Development Administrator, Fire Marshall, and Public Works Services Director. e CEQA Pursuant to the provIsions of the California Environmental Quality Act, the Development Services Department has prepared an Initial Study for the proposed project. Said Initial Study did not disclose any substantial or potentially substantial adverse change in any of the physical conditions within the area affected by the project including land, air, water, minerals, flora, fauna, ambient noise and objects of historical or aesthetic significance that could not be made less than significant with mitigation incorporation. When considering the record as a whole, there is no evidence that the proposed project will have any potential for adverse effect on wildlife resources or the habitat upon which the wildlife depends. Therefore, a Negative Declaration has been prepared for this project. FINDINGS Section 9275.1.2 of the Arcadia Municipal Code requires that for a Conditional Use Permit to be granted, it must be found that all of the following prerequisite conditions can be satisfied: . 1. That the granting of such Conditional Use Permit will not be detrimental to the public health or welfare or injurious to the property or improvements in such zone or vicinity. CUP 2005-05 & ADR 2004-022 April 12, 2005 Page 4 . e . 2. That the use applied for at the location indicated is properly one for which a Conditional Use Permit is authorized. 3. That the site for the proposed use is adequate in size and shape to accommodate said use, and all yards, spaces, walls, fences, parking, loading, landscaping, and other features required to adjust said use with the land and uses in the neighborhood. 4. That the site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. 5. That the granting of such Conditional Use Permit will not adversely affect the comprehensive General Plan. Section 9275.4.2 of the Arcadia Municipal Code also states that the Planning Commission shall not grant any Conditional Use Permit for a drive-in business such as a service station unless it makes the following findings: 1. The proposed use complies with all requirements set forth for the issuance of a Conditional Use Permit; 2. The proposed use will not substantially increase vehicular traffic on any street in a residentially zoned district; 3. The proposed use will not lessen the suitability of any nearby commercially zoned property for commercial use by interfering with pedestrian traffic; 4. The proposed use will not create increased traffic hazards to pedestrian when located near a school, church, auditorium, theater or other place of assembly. RECOMMENDATION The Development Services Department recommends denial of Conditional Use Permit Application No. CUP 2005-05 and Architectural Design Review Application No. ADR 2004-022, based on the reason that this proposal does not fully comply with the Architectural Design Guidelines. If the Commission decides to approve the proposal, staff recommends the following conditions: 1. The use approved by CUP 2005-05 and ADR 2004-022 is limited to the automobile service station. The service station shall be operated and maintained in a manner that is consistent with the proposal and plans subm~ed and approved for CUP 2005-05 and ADR 2004-022. Denial The Planning Commission should move to deny Conditional Use Permit Application No. CUP 200S.QS and Architectural Design Review No. ADR 2004- 022, and direct staff to prepare a resolution to deny CUP 2005-003 for an automobile service station at 3 E. Duarte Road. Approval If the Planning Commission intends to approve these applications, the Commission should state the specific reasons for approval and direct staff to prepare the appropriate resolution incorporating the Commission's decision and specific findings.
