APPROVING CONDITIONAL USE PERMIT NO. 05-04 TO OPERATE A RENTAL GAR AGENCY UTILIZING A MAXIMUM NUMBER OF 14 PARKING SPACES AT 120 LAS TUNAS DRIVE. WHEREAS, on February 7, 2005. a conditional use permit application was filed by Enterprise Rent A Car to establish a rental car agency (Development Services Department Case No. C.U.P. 05-04) at property commonly known as 120 Las Tunas Drive; and WHEREAS, a public hearing was held on March 22, 2005, at which time all interested persons were given full opportunity to be heard and to present evidence. NOW THEREFORE. THE PLANNING COMMISSION OF THE CITY OF ARCADIA RESOLVES AS FOLLOWS: SECTION 1. That the factual data submitted by the Development Services Department in the attached report is true and correct. SECTION 2. This Commission finds: 1. That the granting of such Conditional Use Permit will not be detrimental to the public health or welfare, or injurious to the property or improvements in such zone or vicinity because the initial stUdy did not disclose any substantial adverse effects to the area affected by the proposed project. 2. That the use applied for at the location indicated is a proper one for which a Conditional Use Permit Is authorized. 3. That the site for the proposed use is adequate in size and shape to accommodate said use. All yards. spaces. walls, fences, loading, landscaping and other features including the shared parking with the neighboring business. are adequate to . e I adjust said use with the land and uses in the neighborhood. The proposed project complies with all related zoning requirements as set forth in the Arcadia Municipal Code. 4. That the site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. 5. That the granting of such Conditional Use Permit will not adversely affect the comprehensive General Plan because the land use and current zoning are consistent with the General Plan. 6. That the use applied for will not have a substantial adverse impact on the environment, and that based upon the record as a whole there is no evidence that the proposed project will have any potential for an adverse effect on wildlife resources or the habitat upon which the wildlife depends. SECTION 3. That for the foregoing reasons this Commission grants Conditional Use Permit No. CUP 05-04, to operate a rental car agency utilizing a maximum number of 14 parking spaces. upon the following conditions: 1. The use approved by CUP 05-04 is limited to a rental car agency that shall not utilize more than 14 onsite parking spaces. There shall be one parking space available for each employee and for each vehicle that is being stored at anyone time. For example, no more than 10 cars shall be "stored. and no more than four employees shall be onsite at anyone time. If the applicant has 8 employees working at one time, no more than 6 cars shall be stored at that time. Any expansion upon the use approved shall require approval of a separate conditional use permit. 2. That the applicant shall upgrade the existing parking lot by resurfacing, re-striping. and re-Iandscaping. The applicant shall install a 5-foot wide landscape buffer between the street side northerly property line and the parking lot. This work shall 2 \708 . e I be completed to the satisfaction of the Community Development Administrator or his/her designee before occupancy of the subject unit and/or prior to issuance of a business license. 3. A separate sign design review application shall be submitted for all new signs on the premises. 4. The applicant shall defend, indemnify, and hold harmless the City of Arcadia and its officers, employees, and agents from and against any claim, action, or proceeding against the City of Arcadia, its officers, employees or agents to attack, set aside, void, or annul any approval or condition of approval of the City of Arcadia conceming this project and/or land use decision, including but not limited to any approval or condition of approval of the City Council, Planning Commission, or City Staff. which action is brought within the time period provided for in Government Code Section 66499.37 or other provision of law applicable to this project or decision. The City shall promptly notify the applicant of any claim, action, or proceeding concerning the project and/or land use. decision and the City shall cooperate fully in the defense of the matter. The City reserves the right, at its own option, to choose its own attomey to represent the City, its officers, employees, and agents in the defense 01 the matter. 5. Approval of CUP 05-04 shall not take effect until the property owner(s), and applicants have executed and filed the Acceptance Form available from the Development Services Department to indicate awareness and acceptance of these conditions of approval. 3 1708 . e , SECTION 4. The decision, findings and conditions contained in this Resolution reflect the Commission's action of March 22, 2005, and the following votes: AYES: NOES: SECTION 5. Memo Enterprise Rent-A-Car To: Arcadia Planning Commissioners F_ Dave Baker, Area Manager, Enterprise Rent-A-Car Date: 1/2512005 He: Request For an Administrative Interpretation of "Automobile Storage" (9275.1.39.1) e Enterprise has been serving the Arcadia community for over 20 years. Currently, we service the area With several locations, namely our offices in East Pasadena, Duarte, EI Monte, and San Gabriel. Having a location in Arcadia will allow us to improve our service to the residents and businesses of Arcadia. We are requesting an Administrative Interpretation, in reference to Ordinance 1350, section 9275.1.39.2 for "Automobile Storage", so that we can commence our lease agreement and service the Arcadia community as soon as possible. We are committed in making Arcadia a more desirable place to live and work. We have employed and promoted a number of local residents in our management development program lI1.roughout lI1e years. Enterprise Rent-A-Car is a "local" company. Unlike our competitors, we have a presence in thousands of neighborhoods, placing us on a first-name basis With the people who call those neighborhoods home. We purchase millions of dollars in vehicles locally, generate tax dollars through sales and employment, create meaningful jobs lI1at generate significant income and benefits for employees and their families, and much more. We realize we owe our success to lI1e support and good will of the people who live in those communities and who do business With us. That's why we are committed to involving ourselves in the support of worthwhile endeavors in the home towns and cities where we operate our business. We have successfully negotiated terms of a lease agreement that would have Enterprise Rent-A-Car operate In Arcadia. contingent upon Planning Commission's approval of 11115 Administrative Interpretation. The proposed location at 120 Las Tunas Blvd, formally the Tattoo parlor, next door to the Pet Jungle, In doing so, we will propose several upgrades to the property including landscaping, painting, and re-striping lI1e parking lot, creating 30 parking spots. including two ADA handicap parking spots. All upgrades and plans subject to design review. All parking spaces have been measured and would comply with current Arcadia parking codes. (See Parking Diagram) Enterprise Rent-A-Car Business Plan for Servicing the Arcadia Community We would have a staff of 4 employees, Branch Manager, Assistant Manager, Management Trainee. and Car Prep. Our hours of operation would be 7:30 am - 6:00 pm, Monday thru Friday, 9:00 am - 12:00 pm on Saturday, and closed on Sunday. We would pursue contracts With local Arcadia businesses to service our vehicles off-site. I Enterprise would offer free pick-up service to residents, repair shops, and local businesses in Arcadia, Temple City, Sierra Madre, and parts of Monrovia. Enterprise currently facilitates replacement rentals to Rusnak Mercedes With a "satellite location" where vehicles are parked and rented at lI1e dealership. 1 . e I Based on our current relationships and national insurance agreements, we estimate a fleet size of approximately 40 cars on average over the next 12 months, with growth forecasted to peak at an average of roughly 100 cars by year 5. Nationally and locally our strongest performing stores in customer service and sales, maintain an average fleet size of 90-100 cars. Nationally, Enterprise locations utilize an average of 91 % of their fleet This means that approximately 91 % of a branch's fleet is consistently rented. Locally, branches with a similar business/residential mix utilize an average of 91.3%. (Information based on results from similar locations in Azusa, Alhambra, Rosemead, Baldwin Park, and Walnut) Roughly 3% of our fleet is getting serviced or repaired, ultimately leaving our branches with 5%-7% of our vehicles available to use for rentals, and customer I employee transportation. Enterprise Rent-A-Car locations are not franchised. This enables Enterprise to move cars to and from locations to meet the needs of our customers. Enterprise currently operates 30 locations within the San Gabriel Valley. Arcadia would be the 31". Locally, Enterprise also employs a team of 30 drivers to move cars between these locations daily. In the first year of operation, we forecast the Arcadia location will have on average 3 cars parked for available rental, with 2 additional spaces to be used for employee parking. The Branch Manager will have access to drive a rental vehicle to and from work. One employee will operate a 'Satelltte" location servicing Rusnak, thus parking their car at the dealership, leaving 2 additional parking spaces for the remaining ~mployees. The lease agreement grants Enterprise permission to use no more than 15 of the 30 parking spaces. The 15 parking spaces would be utilized for accessible customer parking and only in the event of an unforeseen spike in demand. We would not park cars on the street, under any. circumstances. Offices running approximately 150+ cars typically utilize an average of 15 parking spaces. We do not forecast enough demand in this area to substantiate a fleet this size. Enterprise's success in the local markets is the resutt of running efficient and customer friendly operations. We have a business model in place that tells us, we can manage an extremely efficient operation in Arcadia with the use of minimal parking. We do not feel . Automobile Storage" would be an applicable description of our service, needs, or requirements. Our vehicles are constantly being utilized in the local markets to meet the demands of San Gabriel Valley residents. It would not be a profitable venture for Enterprise or the City of Arcadia, if we were to anticipate storing vehicles for any length of time. Thank you for your time and consideration.
