RESOLUTION NO. 1724
A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF ARCADIA, CALIFORNIA, DENYING
CONDITIONAL USE PERMIT APPLICATION NO. CUP
2005-02 FOR A JOB TRAINING CENTER WITH 6
STUDENTS AND ONE EMPLOYEE WITHIN AN
EXISTING COMMERCIAL OFFICE BUILDING AT 19 E.
LIVE OAK AVENUE, UNIT E.
WHEREAS, on January 4, 2005, an application was filed by David Yuan
Xie for a job training center with 6 students and one employee within an
existing commercial office building; Development Services Department Case
No. CUP 2005-02, at 19 E. Live Oak Avenue, Unit E; and
e WHEREAS, a public hearing was held on March 8, 2005, at which time
all interested persons were given full opportunity to be heard and to present
evidence.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY
OF ARCADIA HEREBY RESOLVES AS FOLLOWS:
SECTION 1. That the factual data submitted by the Development
Services Department in the attached report dated January 11,2005 is true and
correct.
SECTION 2. This Commission fmds:

. A. That the granting of this Conditional Use Permit would be
detrimental to the public health and welfare and injurious to the property and
improvements in such zone or vicinity because the existing parking facilities are
inadequate and there is not sufficient onsite parking for the proposed job
training center. By code, the subject building would require 35 on-site parking
spaces; however, there are only 32 spaces provided.
B. That the use applied for at the location indicated is properly one for
which a Conditional Use Permit is authorized, however, the proposed use, as
evident by its current illegal operation, does not satisfy the parking

requirements for the requested conditional use as specified in Sections 9269.5
Et Seq. of the Arcadia Municipal Code.
C. That the site for the proposed use is not adequate in size and shape to
accommodate the proposed use, and that there is not sufficient onsite parking to
accommodate the proposed use.
D. That the site abuts a street that is adequate in width to carry the kind
of traffic that would be generated by the proposed use; however, there is not
sufficient onsite parking to accommodate the use.
E. That the granting of such Conditional Use Permit will adversely
affect the comprehensive General Plan because although the land use and

. cUrrent zoning are consistent with the General Plan, there is not sufficient onsite
parking to accommodate the use.
F. That the evaluation of the environmental impacts as set forth in the
initial study is appropriate and that the project could have less than a significant
effect upon the environment within the meaning of the California
Environmental Quality Act of 1970, but the project was not approved, and
therefore, a Negative Dec1aration could not be approved.
SECTION 3. That for the foregoing reasons this Commission denies
Conditional Use Permit Application No. CUP 2005-02 for a job-training center

with 6 students within an existing commercial office building at 19 E. Live Oak
Avenue, Unit E.
SECTION 4. The decision and findings contained in this Resolution
reflect the Planning Commission's action of March 8, 2005 to deny Conditional
Use Permit Application No. CUP 2005-02, by the following votes:

Commissioners Baderian, Lucas, Olson and Wen
NOES:
None
SECTION 5. The Secretary shall certify to the adoption of this
Resolution and shall cause a copy to be forwarded to the City Council of the
City of Arcadia.

SUBJECT: Conditional Use Permit Application No. CUP 2005-02 for a job-training
center at 19 E. Live Oak Avenue, unit E.
SUMMARY
This Conditional Use Permit application was submitted by the business owner, David
Xie, to operate a job-training center for up to 6 students at 19 E. Live Oak Avenue,
unit E. The Development Services Department is recommending approval of this
application subject to the conditions in this staff report.
GENERAL INFORMATION
APPLICANT: David Yuan Xie (business owner)
LOCATION: 19 E. Live Oak Avenue, unit E
REQUEST: A Conditional Use Permit for a job-training center with up to 6
students in a 650 square foot unit within an existing commercial
building.
SITE AREA: 19,055 sq. ft.. (0.43 acres)
FRONTAGE: Approx. 183 feet along Live Oak Avenue
Approx. 61 feet along Louise Avenue
EXISTING LAND USE & ZONING:
The site is developed with a 2-story, 9,000 sq.ft. commercial office
building constructed in 1986, and is zoned CoO & 0, Professional
0fficewith an Architectural Design overlay.

GENERAL PLAN DESIGNATION:

PROPOSAL AND ANALYSIS
The proposal is to operate a job-training center that would occupy a 650 sq.ft. unit on
the ground floor of the existing commercial office building at 19 E. Live Oak Avenue,
unit E. There will be a maximum of six (6) students per session and one instructor.
The students will be adults who are pursuing a career in card dealing. The proposed
class hours are from noon (12:00 p.m.) to 6:00 p.m., Monday through Saturday.
The subject unit would be remodeled into one open classroom. Restroom facilities
are not required per Building Code as there are shared restrooms in the subject
building.
A job-training center is considered as a school use, and is a permitted use in the CoO
zone with an approved conditional use permit.
Parkino
There are 32 on-site parking spaces. By Code, a job-training center is required to
provide 1 space per employee plus 1 space for every 3 students. Under this
regulation, the proposed 650 sq.ft. job-training center with six (6) adult students and
one (1) employee would require three (3) parking spaces. This is equivalent to the
three (3) spaces required for the original office use of the subject unit (4 spaces per
1,000 sq.ft. of gross floor area). Currently, the subject site has a parking deficiency
of three (3) spaces; however, the proposed use would not increase that number.

A neighboring resident to the north of the subject property has commented that traffic
'near the intersection of Live Oak Avenue and Louise Avenue is heavy due to the
site's existing art school, and the existing bank on the east of Louise Avenue.
However, it is staffs opinion that the proposed job-training center would not generate
any additional traffic beyond that of the original office use. Furthermore, the subject
unit is located in the westerly portion of the building, where there is a separate
parking area away from the intersection, as shown on the submitted site plan.
CODE REQUIREMENTS
All City requirements regarding disabled access and facilities, occupancy limits,
building safety, health code compliance, parking and site design shall be complied
with to the satisfaction of the Building Official, Community Development
Administrator, Fire Marshall, and Public Works Services Director.
Any exterior improvements, such as new signs, sign face changes, and awnings
shall be subject to architectural design review and approval by the Community
Development Division.
CEQA
Pursuant to the provIsions of the California Environmental Quality Act, the
Development Services Department has prepared an Initial Study for the proposed
project. Said Initial Study did not disclose any substantial or potentially substantial
adverse change in any of the physical conditions within the area affected by the
project including land, air, water, minerals, flora, fauna, ambient noise and objects of
historical or aesthetic significance that could not be made less than significant with
mitigation incorporation. When considering the record as a whole, there is no
evidence that the proposed project will have any potential for adverse effect on
wildlife resources or the habitat upon which the wildlife depends. Therefore, a
Negative Declaration has been prepared for this project.

FINDINGS
Section 9275.1.2 of the Arcadia Municipal Code requires that for a Conditional Use
Permit to be granted, it must be found that all of the following prerequisite conditions
can be satisfied:
1. That the granting of such Conditional Use Permit will not be detrimental to the
public health or welfare or injurious to the property or improvements in such
zone or vicinity.
2. That the use applied for at the location indicated is properly one for which a
Conditional Use Permit is authorized.
3. That the site for the proposed use is adequate in size and shape to
accommodate said use, and all yards, spaces, walls, fences, parking, loading,
landscaping, and other features required to adjust said use with the land and
uses in the neighborhood.
4. That the site abuts streets and highways adequate in width and pavement
type to carry the kind of traffic generated by the proposed use.
5. That the granting of such Conditional Use Permit will not adversely affect the
comprehensive General Plan.
RECOMMENDATION
The Development Services Department recommends approval of Conditional Use
Permit Application No. CUP 2005-02, subject to the following conditions:
1. The maximum number of students at anyone time shall not exceed six (6).
2. The students shall be of at least high school age (16 years and older).
3. The hours of operation shall be limited to 12:00 p.m. to 6:00 p.m., Monday
through Saturday.
4. There shall be no gambling permitted.
5. All City code requirements regarding accessibility, fire protection, occupancy,
and safety shall be complied with to the satisfaction of Building Services and
the Fire Department.
6. Non-compliance with the provisions and conditions of this Conditional Use
Permit shall constitute grounds for the immediate suspension and revocation
of said permit.
7. Approval of CUP 2005-02 shall not take effect until the property owner(s), and
applicants have executed and filed the Acceptance Form available from the
CUP 2005-02

Development Services Department to indicate awareness and acceptance of
these conditions of approval.
8. The applicant shall defend, indemnify, and hold harmless the City of Arcadia
and its officers, employees, and agents from and against any claim, action, or
proceeding against the City of Arcadia, its officers, employees or agents to
attack, set aside, void, or annul any approval or condition of approval of the
City of Arcadia conceming this project and/or land use decision, including but
not limited to any approval or condition of approval of the City Council,
Planning Commission, or City Staff, which action is brought within the time
period provided for in Government Code Section 66499.37 or other provision
of law applicable to this project or decision. The City shall promptly notify the
applicant of any claim, action, or proceeding concerning the project andlor
land use decision and the City shali cooperate fully in the defense of the
matter. The City reserves the right, at its own option, to choose its own
attorney to represent the City, its officers, employees, and agents in the
defense of the matter.
PLANNING COMMISSION ACTION
Approval
The Planning Commission should move to approve Conditional Use Permit
Application No, CUP 2005-02, file the Negative Declaration, and direct staff to
prepare a resolution to approve CUP 2005-02 for a job-training center at 19 E.
Live Oak Avenue. unit E. .
Denial
If the Planning Commission intends to deny this Conditional Use Permit application,
the Commission should state the specific reasons for denial and direct staff to
prepare the appropriate resolution incorporating the Commission's decision and
specific findings.

The City Building Services, Engineering Division, Fire Marshall, Public Works
Services, and Water Services will review the construction plans for the tenant
improvements for compliance with all applicable construction and safety codes
and will oversee construction and installation of any necessary infrastructure or
improvements on-site and/or within and along the pUblic right-of-way. The tenant
improvements for the coffee shop will also be reviewed by the Los Angeles
County Health Department for compliance with local health codes.
