RESOLUTION NO. 1723
A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF ARCADIA, CALIFORNIA, APPROVING
CONDITIONAL USE PERMIT NO. 2004-015 FOR A 1,200
SQ.FT. TUTORING CENTER WITH UP TO 30 STUDENTS
AT 1012 S. BALDWIN AVENUE, UNITB
WHEREAS, on October 18, 2004, a conditional use permit
application was filed by Cheyenne Chen, business .owner, for a tutoring
center for up to 30 students (Development Services Department Case No.
CUP 2004-015) at property commonly known as 1012 S. Baldwin Avenue,
Unit B; and
WHEREAs, a public hearing was held on March 8, 2005, at which
time all interested persons were given full opportunity to be heard and to
present evidence,
NOW THEREFORE, THE PLANNING COMMISSION OF THE
CITY OF ARCADIA RESOL YES AS FOLLOWS:
SECTION 1.
That the factual data submitted by the
Development Services Department in the attached report is true and correct.
SECTION 2.
This Commission finds:
I. That the granting of such Conditional Use Permit will not be
detrimental to the public health or welfare, or injurious to the property or
improvements in such zone or vicinity because the initial study did not

disclose any substantial adverse effects to the area affected by the proposed
project.
2. That the use applied for at the location indicated is a proper one
for which a Conditional Use Permit is authorized.
3. That the site for the proposed use is adequate in size and shape to
accommodate said use. All yards, spaces, walls, fences, loading,
landscaping and other features including the shared parking with the
neighboring business, are adequate to adjust said use with the land and uses
in the neighborhood. The proposed project complies with all related zoning
requirements as set forth in the Arcadia Municipal Code.
4. That the site abuts streets and highways adequate in width and
pavement type to carry the kind of traffic generated by the proposed use.
5. That the granting of such Conditional Use Permit will not
adversely affect the comprehensive General Plan because the land use and
current zoning are consistent with the General Plan.
6. That the use applied for will not have a substantial adverse impact
on the environment, and that based upon the record as a whole there is no
evidence that .the proposed project will have any potential for an adverse
effect on wildlife resources or the habitat upon which the wildlife depends.

SECTION 3. That for the foregoing reasons this Commission
grants Conditional Use Permit No. CUP 2004-015, for a tutoring center with
up to 30 students at 1012 S. Baldwin Avenue, Unit B, upon the following
conditions:
1. There shall be no more than thirty (30) students and two (2)
employees at anyone time.

2. The hours of operation shall be 10:30 a.m. to 8:00 p.m., Monday
through Friday, 10:30 a.m. to 4:30 p,m. on Saturdays, and 10:30 a.m. to
3:00 p.m. on Sundays.
3. The parking lot shall be restriped and landscaped per the Arcadia
Municipal Code, subject to the approval of the Development Services
Department.
4. The use approved by CUP 2004-015 is limited to the tutoring
center. The tutoring center shall be operated and maintained in a manner
that is consistent with the proposal and plans submitted and approved for
CUP 2004-015.
5. A separate sign design review application shall be submitted for
all new signs on the premises.
6. Any exterior alteration to the building requires the filing and
. approval of a design review application.

7. All conditions of approval shall be complied with prior to opening
the tutoring center. Noncompliance with the plans, provisions and
conditions of approval for CUP 2004-015 shall be grounds for immediate
suspension or revocation of any approvals, which could result in the closing
of the school and office.

8. All City code requirements regarding accessibility, fire protection,
occupancy, and safety shall be complied with to the satisfaction of Building
Services and the Fire Department.
9. Approval of CUP 2004-015 shall not take effect until the property
owner(s), and applicants have executed and filed the Acceptance Form
available from the Development Services Department to indicate awareness
and acceptance of these conditions of approval.
10. The applicant shall defend, indemnify, and hold harmless the City
of Arcadia and its officers, employees, and agents from and against any
claim, action, or proceeding against the City of Arcadia, its officers,
employees or agents to attack, set aside, void, or annul any approval or
condition of approval of the City of Arcadia concerning this project and/or
land use decision, including but not limited to any approval or condition of
approval of the City Council, Planning Commission, or City Staff, which
I action is brought within the time period provided for in Government Code

Section 66499.37 or other provision of law applicable to this project or
decision. The City shall promptly notify the applicant of any claim, action,
or proceeding concerning the project and/or land use decision and the City
shall cooperate fully in the defense of the matter. The City reserves the
right, at its own option, to choose its own attorney to represent the City, its
officers, employees, and agents in the defense of the matter.
SECTION 4. The decision, findings and conditions contained in
this Resolution reflect the Commission's action of March 8, 2005, by the
following votes:
A YES: Commissioners Hsu, Lucas, Wen
NOES: Commissioners Baderian, Olson
SECTION 5. The Secretary shall certify to the adoption of this
Resolution and shall cause a copy to be forwarded to the City Council of the
City of Arcadia.

SUBJECT: Conditional Use Permit Application No. CUP 04-015 for a tutoring
center at 1012 S. Baldwin Avenue, Unit B.
SUMMARY
This Conditional Use Permit application was submitted by Cheyenne Chen,
representing L.A. Institute, to operate a tutoring center for up to 30 students at 1012
S. Baldwin Avenue, Unit B. The Development Services Department is
recommending denial of this application because it does not comply with the Building
Code.
GENERAL INFORMATION
APPLICANT: Cheyenne Chen (representative of L.A. Institute)
LOCATION: 1012 S. Baldwin Avenue, Unit B
REQUEST: A Conditional Use Permit for a 1,200 square foot tutoring center
with up to 30 students within an existing commercial building.
SITE AREA: 21.427 sq. ft. (0.49 acres)
. FRONTAGE: Approximately 68' feet along Huntington Drive
EXISTING LAND USE & ZONING:
The site is developed with a 2-story, 6,600 sq.ft. commercial office
and retail building constructed in 1959, and is zoned C-2 in the front
144' of the property, and PR-3 in the rear 170' of the property.

GENERAL PLAN DESIGNATION:
Commercial
PROPOSAL AND ANALYSIS
The proposal is to operate a tutoring center that would occupy a 1,200 square foot
unit on the second floor of an existing commercial office and retail building at 1012 S.
Baldwin Avenue. Tutoring would be provided to students from age six (6) to eighteen
(18). The number of students will be limited to a maximum of 30 students per
session. The proposed class hours would be from 10:00 a.m. to 6:00 p.m., Monday
through Friday, and 11 :00 a.m. to 3:00 p.m. on Sundays.
A tutoring center is a permitted use in the C-2 zone with an approved conditional use
permit; however, the Development Services Department is recommending denial of
the applicant's proposal because of its non-compliances with the age classification of
students under the Building Code. Specifically, the code restricts education
occupancy located on a second floor to students who are of at least high school age.
Therefore, if approved, this center must limit the age of the students to high school
and over.
ParkinQ
There are 37 on-site parking spaces. By Code, a tutoring center is required to
provide 1 space per employee plus 1 space for every 3 students. Under this
regulation, the proposed 1,200 sq.ft. tutoring center with 30 students and 2
employees would require twelve (12) parking spaces.
There is a current on-site parking surplus of nine (9) spaces per code, and the
proposed use would reduce the surplus to two (2) spaces. The following is a break-
down of the parking requirements:

Both the applicant and the property owner conducted parking surveys that show a
surplus number of available on-site parking spaces. Staff has conducted several site
visits and confirmed such findings (see the attached parking survey).
CODE REQUIREMENTS
All City requirements regarding disabled access and facilities, occupancy limits,
building safety, health code compliance, parking and site design shall be complied
with to the satisfaction of the Building Official, Community Development
Administrator, Fire Marshall, and Public Wo.rks Services Director.
Any exterior improvements, such as any new signs, sign face changes, and awnings
shall be subject to architectural design review and approval by the Community
Development Division.
CEQA
Pursuant to the provIsions of the California Environmental Quality Act, the
Development Services Department has prepared an Initial Study for the proposed
project. Said Initial StUdy did not disclose any substantial or potentially substantial
adverse change in any of the physical conditions within the area affected by the
project including land, air, water, minerals, flora, fauna. ambient noise and objects of
historical or aesthetic significance that could not be made less than significant with
mitigation incorporation. When considering the record as a whole, there is no
evidence that the proposed project will have any potential' for adverse effect on
wildlife resources or the habitat upon which the wildlife depends. Therefore, a
Negative Declaration has been prepared for this project. .

FINDINGS
Section 9275.1.2 of the Arcadia Municipal Code requires that for a Conditional Use
Permit to be granted, it must be found that all of the following prerequisite conditions
can be satisfied:
1. That the granting of such Conditional Use Permit will not be detrimental to the
public health or welfare or injurious to the property or improvements in such
zone or vicinity.
2. That the use applied for at the location indicated is properly one for which a
Conditional Use Permit is authorized.
3. That the site for the proposed use is adequate in size and shape to
accommodate said use, and all yards, spaces, walls, fences, parking, loading,
landscaping, and other features required to adjust said use with the land and
uses in the neighborhood.
4. That the site abuts streets and highways adequate in width and pavement
type to carry the kind of traffic generated by the proposed use.
5. That the granting of such Conditional Use Permit will not adversely affect the
comprehensive General Plan.
RECOMMENDATION
The Development Services Department recommends denial of Conditional Use
Permit Application No. CUP 2004-015, because the proposed use does not comply
with the Building Code requirements.
If the Planning Commission determines that based on the evidence presented this is
an appropriate use at this site and moves to approve Conditional Use Permit
Application No. CUP 2004-015, staff recommends the folloWing conditions of
approval:
1. There shall be no more than thirty (30) students and two (2) employees at any
one time.
2. The students shall be restricted to high school age (16 years old) and over.
3. The hours of operation shall be 10:00 a.m. to 6:00 p.m., Monday through
Friday, 11 :00 a.m. to 3:00 p.m. on Sundays.
4. The parking lot shall be restriped and landscaped per the Arcadia Municipal
Code, subject to the approval of the Development Services Department.
5. The use approved by CUP 2004-015 is limited to the tutoring center. The

required prerequisite conditions for a Conditional Use Permit, and direct staff

to prepare a resolution incorporating th.e Commission's decision and specIfic
findings.
Approval
If the Planning Commission intends to approve Conditional Use Permit Application
No. CUP 2004-015, the Commission should move to file the Negative Declaration,
state the supporting findings, and direct staff to prepare a resolution incorporating
the Commission's decision, specific findings, and any conditions of approval.

L.A. Institute is founded based on our mission that is to help solving this
nation's educational crisis and to maintain its cultural and economic vitality.
We support local teachers and schools, work with students to help them
improve their math, reading, writing skills so that they can focus on higher
level learning activities in the classroom. We help students to Improve their
self-confidence, and develop a love of learning in a motivating environment
after school and weekends. Our program includes personal coaching, positive
coaching, positive reinforcement,and a customized curriculum that adapts to
every child's learning.
For the office site that we are applying for conditional permit for has five
rooms. One of the rooms is going to be the student counseling room. One
room is for instructor. The rest of the three rooms are going to be
tutoring/small group tutoring rooms. Our normal business hours are from
lOam to 6pm, Monday to Friday; Sunday from 11am to 3pm. Students will
be consisted of students from Kindergarten to High School, age from 6 years
old up to 18 years old, who need individual attention and want to improve
their academic ability. Since we provide quality learning targeting each
individual student's weakness, students will come at different times as
designed by Instructor. Maximum J:Ql;atoccupancy fo~e~~ree classrooms
will be 10.t.., n students. There will be two staffs.., in the office site: one
is a receptionist, and one Is a full-time instructor.
