RESOLUTION NO. 1719 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA GRANTING CONDITIONAL USE PERMIT NO. 04-017 TO ALLOW A RESTAURANT WITH SEATING FOR 40 PATRONS WITHIN AN EXISTING COMMERCIAL SHOPPING CENTER AT 1236 S, GOLDEN WEST AVE. WHEREAS, on November 18, 2004, a conditional use permit application was filed by Terresa Chien to allow a restaurant with seating for 40 patrons within an existing commercial shopping center (Development Services Department Case No, CUP 04-017) at property commonly known as 1236 S, Golden West Avenue, more particularly described as follows: Parcel 1: The westerly 3 acres of Lot 2 of Block "A", Santa Anita Land Company's Tract, in the City of Arcadia, as per map recorded in Book 6, Page 137 of Maps, in the office of the Los Angeles County Recorder excepting therefrom the northerly 12 feet of the westerly one-half of the easterly one acre of the westerly two acres of said Lot 2 conveyed to the City of Arcadia for the widening of Duarte Road, by deed recorded February 13, 1964 in Book-2347, Page 127 of Official Records. Parcel 2: The north 305 feet of that portion of Lot 3, Block "AD of the Santa Anita Land Company's Tract, in the City of Arcadia, as per map recorded in Book 6, Page 137 of Maps, in the office of the County Recorder of said County, lying westerly of the east line of the west 126 feet of the easterly 378 feet of said Lot3, WHEREAS, a duly noticed public hearing was held on December 14, 2004, at which time all interested persons were given full opportunity to be heard and to present evidence. NOW THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA RESOLVES AS FOLLOWS: SECTION 1. That the factual data submitted by the Development Services Department in the attached report is true and correct, Resolution 1719 Page 1 SECTION 2. This Commission finds: . 1. That the granting of such Conditional Use Pennit will not be detrimental to the public health or welfare, or injurious to the property or improvements in such zone or vicinity because the initial study did not disclose any substantial adverse effects to the area affected by the proposed project, 2. That the use applied for at the location indicated is a proper one for which a Conditional Use Pennit is authorized. 3. That the site for the proposed use is adequate in size and shape to accommodate said use. All yards, spaces, walls, fences, loading, landscaping and other features including the shared parking with the neighboring business, are adequate to adjust said use with the land and uses in the neighborhood, The proposed project complies with all related zoning requirements as set forth in the Arcadia Municipal Code, 4. That the site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use, 5, That the granting of such Conditional Use Permit will not adversely affect the . comprehensive General Plan because the land use and current zoning are consistent with the General Plan. 6. That the use applied for will not have a substantial adverse impact on the environment, and that based upon the record as a whole there is no evidence that the proposed project will have any potential for an advarse effect on wildlife resources or the habitat upon which the wildlife depends. SECTION 3. That for the foregoing reasons this Commission grants Conditional Use Permit No. CUP 04-017, to allow a restaurant with seating for 40 patrons within an existing commercial shopping center, upon the following conditions: 1, The use approved by CUP 04-017 is limited to a maximum of 40 seats, and any expansion upon the use approved shall require approval of a separate conditional use pennit. 2, The hours of operation on any day shall be between 11 :00 a,m, and 10:00 p,m. . Resolution 1719 Page 2 . . . 3, A separate sign design review application shall be submitted for all new signs on the premises. 4. The applicant shall defend, indemnify, and hold harmless the City of Arcadia and its officers, employees, and agents from and against any claim, action, or proceeding against the City of Arcadia, its officers, employees or agents to attack, set aside, void, or annul any approval or condition of approval of the City of Arcadia concerning this project and/or land use decision, including but not limited to any approval or condition of approval of the City Council, Planning Commission, or City Staff, which action is brought within the time period provided for in Government Code Section 66499.37 or other provision of law applicable to this project or decision, The City shall promptly notify the applicant of any claim, action, or proceeding concerning the project and/or land use decision and the City shall cooperate fully in the defense of the matter, The City reserves the right, at its own option, to choose its own attorney to represent the City, its officers, employees, and agents in the defense of the matter, 5. Noncompliance with the plans, provisions and conditions of approval for CUP 04-017 shall be grounds for immediate suspension or revocation of any approvals, which could result in the closing of the restaurant, 6, Approval of CUP 04-017 shall not take effect until the property owner(s}, and applicants have executed and filed the Acceptance Form available from the Development Services Department to indicate awareness and acceptance of these conditions of approval. SUMMARY This Conditional Use Permit application was submitted by Terrisa Chien to allow a restaurant with seating for 40 patrons within an existing commercial shopping center (President Square) at 1236 S. Golden West Ave. The Development Services Department is recommending approval of this application. subject to the conditions listed in this report, GENERAL INFORMATION APPLICANT: Terrisa Chien LOCATION: 1236 S. Golden West Ave. <in the President Square shopping center) REQUEST: A Conditional Use Permit to allow a restaurant with seating for 40 patrons in a 1,273 sq. ft, unit within the existing President Square shopping center, Proposed hours of operation are 11 :30 a,m, to 10:00 p.m" seven days a week. The unit in question has been recently utilized as a hair salon. SITE AREA: 240,930 square feet (5.53 acres) FRONTAGES: Approximately 637 feet on Golden West Avenue Approximately 378 feet on Duarte Road Approximately 378 feet on Naomi Avenue CUP 04-017 Decernber14,2004 Page 1 . EXISTING LAND USE & ZONING: This site is within the President Square shopping center, which includes the 99 Ranch Market, Full House restaurant: food court, and several retail and office uses. The entire shopping center is zoned C- 1&D SURROUNDING LAND USES & ZONING: North: Multiple-family residential; zoned R-3 South: Multiple-family residential; zoned R-3 East: Commercial retail center and a nonconforming apartment building; zoned C-2 West: Multiple-family residential and an automobile service station; zoned R-3 and C-2 respectively. GENERAL PLAN DESIGNATION: Commercial BACKGROUND The proposed restaurant would occupy a 1,273 square foot unit within the President Square shopping center, which was most recently utilized as a hair salon. The shopping center currently features approximately 50,400 square feet of retail uses, and 12,000 square feet of restaurant uses including a food court area. The existing restaurants and the food court were established by previous conditional use permit . approvals, PROPOSAL AND ANALYSIS The applicant is proposing to operate a Japanese "Shabu-Shabu" style restaurant, which involves customers cooking their own food at the table. Section 9275.1.53.5 of the Arcadia Municipal Code allows restaurants in the C-1 zone, subject to an approved Conditional Use Permit. Approximately 760 square feet of the 1,273 square foot unit would be used for seating area. The remaining floor area consists of the kitchen, restroom, and a storage area. Although the applicant is proposing a maximum of 40 seats, 37 seats are shown in the current seating configuration (see attached), According to the Building Official, the proposed restaurant could accommodate 43 patrons, based on the Building Code. The proposed hours of operation are 11 :30 a.m, to 2:30 p.m. and 5:00 p.m. to 10:00 p.m., seven days a week. Parkinq Seven parking spaces were required for the salon that previously occupied the subject commercial unit. using the required parking ratio of 5 spaces per 1,000 sq,ft. of floor area. The proposed restaurant use is required to provide 10 parking spaces per 1,000 sq,ft. of floor area, requiring 13 spaces for the 1,273 sq.ft. restaurant. . CUP 04-017 December 14, 2004 Page 2 1\ . . . There are 383 parking spaces onsite. Based on the code requirements, the existing uses require 372 parking spaces, The proposed restaurant would require an additional seven parking spaces, resulting in a total parking requirement of 379 spaces. Therefore, based on City parking requirements, the parking complies with code. The applicant submitted a parking survey including all 383 of the parking spaces in the shopping center (see attached). The survey was conducted from October 4 to October 17,2004 at fifteen-minute intervals beginning at 12:00 PM and ending at 2:00 PM, as lunchtime hours are typically the busiest at the President'Square shopping center. The survey indicates that there are an average of 61 spaces available out of 383 total onsite spaces during weekdays and an average of 14 spaces available during weekends. The busiesttime surveyed was Saturday, October 9, at 1 :00 PM, when it was indicated that only three spaces were available for the entire shopping center. According to the parking survey, the weekends were significantly busier, but there were still an average of 14 spaces available during the busy weekend lunchtime hours. According to the submitted parking survey, the center experiences a high rate of vehicular tumover; therefore, many people visit the center for short periods of time. Based on this information and the parking survey, the proposed restaurant should not result in a significant increase of traffic at the shopping center. Other Code Reauirements The applicant is required to comply with all development requirements and policies determined to be necessary by the Building Official, Fire Department, and Community Development Administrator. CEQA Pursuant to the provisions of the California Environmental Quality Act, the Development Services Department prepared an Initial Study for the proposed project. Said Initial Study did not disclose any substantial or potentially substantial adverse change in any of the physical conditions within the area affected by the project including land, air, water, minerals, flora, fauna, ambient noise and objects of historical or aesthetic significance, When considering the record as a whole, there is no evidence that the proposed project will have any potential for adverse effect on wildlife resources or the habitat upon which the wildlife depends, Therefore, a Negative Declaration has been prepared for this project. FINDINGS Section 9275.1.2 of the Arcadia Municipal Code requires that for a Conditional Use Permit to be granted, it must be found that all of the following prerequisite conditions can be satisfied: CUP 04-017 December 14, 2004 Page 3 . . . 1. That the granting of such Conditional Use Permit will not be detrimental to the public health or welfare or injurious to the property or improvements in su ch zone or vicinity. 2. That the use applied for at the location indicated is properly one for which a Conditional Use Permit is authorized. 3, That the site for the proposed use is adequate in size and shape to accommodate said use, and all yards, spaces, walls, fences, parking, loading, landscaping, and other features required to adjust said use with the larid and uses in the neighborhood. 4. That the site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. 5. That the granting of such Conditional Use Permit will not adversely affect the comprehensive General Plan; RECOMMENDATION The Development Services Department recommends approval of Conditional Use Permit Application No. CUP 04-017, subject to the following conditions: 1. The use approved by CUP 04-017 is limited to a maximum of 40 seats, and any expansion upon the use approved shall require approval of a separate conditional use permit. 2. A separate sign design review application shall be submitted for all new signs on the premises. 3.
