RESOLUTION NO. 1718
A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF ARCADIA, CALIFORNIA GRANTING
CONDITIONAL USE PERMIT NO. 04-016 TO UTILIZE THE
PROPERTY AT AN UNDEVELOPED lOT SOUTH OF 5640
PECK ROAD AS AN OUTDOOR BUS STORAGE FACILITY
WHEREAS, on November 15,2004, a conditional use permit application was filed by
la Canada Design Group to allow outdoor bus storage in conjunction with the proposed
expansion of the existing Foothill Transit facility (Development Services Department Case
No. CUP 04-016) at property commonly known as an undeveloped lot south of 5640 Peck
Roacl, more particularly described as follows:
lots 395 to 410 inclusive, per Chicago Park Tract, in the City of
Arcadia, County of los Angeles, State of California as per map
recorded in book 30, page 100 of miscellaneous records, in the
office of the County Recorder of Said County.
WHEREAS, a duly noticed public hearing was held on December 14, 2004, at which
time all interested persons were given full opportunity to be heard and to present evidence.
NOW THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA
RESOLVES AS FOllOWS:
SECTION 1. That the factual data submitted by the Development Services
Department in the attached report is true and correct.
SECTION 2. This Commission finds:
1. That the granting of such Conditional Use Permit will not be detrimental to the
public health or welfare, or injurious to the property or improvements in such zone or vicinity
because the initial study did not disclose any substantial adverse effects to the area
affected by the proposed project.
2. That the use applied for at the location indicated is a proper one for which a
Conditional Use Permit is authorized.

3. That the site for the proposed use is adequate in size and shape to
accommOdate said use. All yards, spaces, walls, fences, loading, landscaping and other
features including the shared parking with the neighboring business, are adequate to adjust
said use with the land and uses in the neighborhood. The proposed project complies with
all related zoning requirements as set forth in the Arcadia Municipal Code.
4. That the site abuts streets and highways adequate in width and pavement type
to carry the kind of traffic generated by the proposed use.
5. That the granting of such Conditional Use Permit will not adversely affect the
comprehensive General Plan because the land use and current zoning are consistent with
the General Plan.
6. That the use applied for will not have a substantial adverse impact on the
environment, and that based upon the record as a whole there is no evidence that the
proposed project will have any potential for an adverse effect on wildlife resources or the
habitat upon which the wildlife depends.
SECTION 3. That for the foregoing reasons this Commission grants Conditional Use
Permit No. CUP 04-016, to allow outdoor bus storage in conjunction with the proposed
expansion of the existing Foothill Transit facility, upon the following conditions:
1. That a mOdification is granted to allow 30'-0" tall light standards in lieu of the
20'-0" maximum height permitted (Sec. 9266.2.10).
2. The proposed perimeter walls shall be compatible in design and height with the
existing walls located onsite. All new fencing or walls shall not exceed a maximum of eight
(8) feet in height
3. Approval of CUP 04-016 shall not take effect until the property owner and
applicant have executed and filed the Acceptance Form available from the Development
Services Department to indicate awareness and acceptance of these conditions of
approval.
4. The applicant shall defend, indemnify, and hold harmless the City of Arcadia
and its Officers, employees, and agents from and against any claim, action, or proceeding
against the City of Arcadia, its officers, employees or agents to attack, set aside, void, or

annul any approval or condition of approval of the City of Arcadia concerning this project
. and/or land use decision, including but not limited to any approval or condition of approval
of the City Council, Planning Commission, or City Staff, which action is brought within the
time period provided for in Government Code Section 66499.37 or other provision of law
applicable to this project or decision. The City shall promptly notify the applicant of any
claim, action, or proceeding concerning the project and/or land use decision and the City
shall cooperate fully in the defense of the matter. The City reserves the right, at its own
option, to choose its own attorney to represent the City, its officers, employees, and agents
in the defense of the matter.
SECTION 4. The Secretary shall certify to the adoption of this Resolution and shall
cause a copy to be forwarded to the City Council of the City of Arcadia. I HEREBY
CERTIFY that this Resolution No. 1718 was adopted at a regular meeting of the Planning
Commission held on December 14, 2004, by the following vote:

SUBJECT: Conditional Use Permit Application No. CUP 04-016 to allow outdoor
bus storage in conjunction with the proposed expansion of the existing
Foothill Transit facility at 5640 Peck.Road.
SUMMARY
This application was submitted by La Canada Design Group to expand the existing
Foothill Transit bus storage facility. The existing transit facility is located in both the
City of Arcadia and the City of Irwindale; however, the proposed area of expansion is
solely within the City of Arcadia. Approval of this request would allow Foothill Transit
to expand the outdoor bus storage area. The Development Services Department is
recommending approval of this application, subject to the conditions listed in this
report.
GENERAL INFORMATION
APPLICANT: La Canada Design Group
LOCATION: 5640 Peck Road (Foothill Transit facility)
REQUEST: A Conditional Use Permit application to allow outdoor bus storage in
conjunction with the proposed expansion of the existing Foothill
Transit facility.
SITE AREA: The proposed area of expansion is approximately 1.4 acres, and
the existing Foothill Transit facility is 11.45 acres. .
FRONTAGES: The property in question is a landlocked parcel adjoining the Foothill
Transit facility, which has 500 feet of frontage on Peck Road.

The project site is an undeveloped parcel adjacent to the Foothill
Transit facility. The site is zoned M-1 & D: Planned Industrial.

GENERAL PLAN DESIGNATION: Industrial
BACKGROUND
The existing Foothill Transit bus maintenance and administration facility currently
operates on 11.45 acres of land within the City of Arcadia and the City of Irwindale
(1.26 acres in Arcadia, 10.19 acres in Irwindale). The portion of the existing transit
facility that is located in Arcadia is utilized for bus storage and was approved in 2000,
under CUP 00-016.
Pursuant to AMC Section 9275.1.53.2, any outdoor storage in the M-1 zone requires
a conditional use permit. The proposed transit facility expansion is intended for
outdoor bus storage, necessitating the conditional use permit.
PROPOSAL AND ANALYSIS
The property in question is a landlocked parcel surrounded by the Foothill Transit
facility to the east and north, and existing industrial development to the south and
west. Foothill Transit is proposing to expand their bus storage area by paving this
site, providing light standards, and securing the area with a perimeter wall. No bus
maintenance or fuel storage is proposed on the subject lot.
Walls and Fences
As part of the expansion, Foothill Transit is proposing to build an 8'_0" high block wall
adjacent to the westerly and southerly property lines. This wall shall be compatible in
design and height with the existing block wall that is adjacent to the easterly property
line. Foothill Transit is also proposing to remove a portion of the easterly block wall
to provide a chain link access gate. This gate will separate the existing bus storage
facility and the subject lot.
Liahtina
Light standards shall be placed within the project area to provide for safety and
seclJrity reasons. The proposed light standards are 30'-0" high, consistent with the

height of existing light standards at the transit facility. Although the M-1 Regulations
permit a maximum height of 20'-0" for light standards, staff feels that it is reasonable
to allow the new light standards to be the same height as the existing lights.
The proposed bus storage area is an expansion of the existing Foothill Transit
facility. This use is consistent with the adjacent land uses and with other uses
allowed within the M-1 zone. It is staffs opinion that the proposed use will be
compatible with other uses in the neighborhood and that the site will appropriately
accommodate the proposed use.
Code Reauirements
All City requirements regarding building safety, fire prevention, detection, and
suppression, and site design shall be complied with to the satisfaction of the Building
Official, Fire Department, and Community Development Administrator. Compliance
is to be determined by having fully detailed tenant improvement plans submitted for
plan check review and approval.
FINDINGS
Section 9275.1.2 of the Arcadia Municipal Code requires that for a Conditional Use
Permit to be granted, it must be found that all of the following prerequisite conditions
can be satisfied:
1. That the granting of such Conditional Use Permit will not be detrimental to the
public health or welfare or injurious to the property or improvements in such zone
or vicinity.
2. That the use applied for at the location indicated is properly one for which a
Conditional Use Permit is authorized.
3. That the site for the proposed use is adequate in size and shape to
accommodate said use, and all yards, spaces, walls, fences, parking, loading,
landscaping, and other features required to adjust said use with the land and
uses in the neighborhood.
4. That the site abuts streets and highways adequate in width and pavement type
to carry the kind of traffic generated by the proposed use.
5. That the granting of such Conditional Use Permit will not adversely affect the
comprehensive General Plan.
CEOA
The proposed use will not have a potential for causing a significant effect on the
environment and is, therefore, categorically exempt from CEOA per Section 15332.

RECOMMENDATION
The Development Services Department recommends approval of Conditional Use
Permit Application No. CUP 04-016 subject to the following conditions:
1. That a modification is granted to allow 30'-0" tall light standards in lieu of the
20'-0" maximum height permitted (Sec. 9266.2.10).
2. The proposed perimeter walls shall be compatible in design and height with
the existing walls located onsite. All new fencing or walls shall not exceed a
maximum of eight (8) feet in height
3. Approval of CUP 04-016 shall not take effect until the property owner and
applicant have executed and filed the Acceptance Form available from the
Development Services Department to indicate awareness and acceptance of
these conditions of approval.
4. The applicant shall defend, indemnify, and hold harmless the City of Arcadia
and its officers, employees, and agents from and against any claim, action, or
proceeding against the City of Arcadia, its officers. employees or agents to
attack, set aside, void, or annul any approval or condition of approval of the
City of Arcadia concerning this project andlor land use decision, including but
not limited to any approval or condition of approval of the City Council,
Planning Commission, or City Staff. which action is brought within the time
period provided for in Government Code Section 66499.37 or other provision
of law applicable to this project or decision. The City shall promptly notify the
applicant of any claim, action, or proceeding concerning the project and/or
land use decision and the City shall cooperate fully in the defense of the
matter. The City reserves the right, at its own option, to choOse its own
attorney to represent the City, its officers, employees, and agents in the
defense of the matter.
PLANNING COMMISSION ACTION
Approval
The Planning Commission should move to approve CUP 04-016 and adopt
Resolution No. 1718 to allow outdoor bus storage in conjunction with the
proposed expansion of the existing Foothill Transit facility at 5640 Peck Road.
Denial
If the Planning Commission intends to deny this Conditional Use Permit application,
the Commission should move for denial and direct staff to prepare a resolution
incorporating the Commission's decision and specific findings.

compacted grade. The old undocumented sub-grade was removed and new
fill material has been installed per Greenbook Standard Specifications for
Public Works Construction 1997.

BACKGROUND
The proposed restaurant would occupy a 1,273 square foot unit within the President
Square shopping center, which was most recently utilized as a hair salon. The
shopping center currently features approximately 50,400 square feet of retail uses, and
12,000 square feet of restaurant uses including a food court area. The existing
restaurants and the food court were established by previous conditional use permit
e approvals.
PROPOSAL AND ANALYSIS

The applicant is proposing to operate a Japanese "Shabu-Shabu" style restaurant,
which involves customers cooking their own food at the table. Section 9275.1.53.5 of
the Arcadia Municipal Code allows restaurants in the C-1 zone, subject to an approved
Conditional Use Permit.
Approximately 760 square feet of the 1,273 square foot unit would be used for seating
area, The remaining floor area consists of the kitchen, restroom, and a storage area.
Although the applicant is proposing a maximum of 40 seats, 37 seats are shown in the
current seating configuration (see attached). According to the Building Official, the
proposed restaurant could accommodate 43 patrons, based on the Building Code, The
proposed hours of operation are 11:30 a,m. to 2:30 p.m. and 5:00 p,m. to 10:00 p,m.,
seven days a week.
Parkinq
Seven parking spaces were required for the salon that previously occupied the subject
commercial unit, using the required parking ratio of 5 spaces per 1,000 sq.ft. of floor
area. The proposed restaurant use is required to provide 10 parking spaces per 1,000
sq.ft. of floor area, requiring 13 spaces for the 1,273 sq.ft. restaurant.

There are 383 parking spaces onsite, Based on the code requirements, the existing
uses require 372 parking spaces. The proposed restaurant would require an additional
seven parking spaces, resulting in a total parking requirement of 379 spaces.
Therefore, based on City parking requirements, the parking complies with code.
The applicant submitted a parking survey including all 383 of the parking spaces in the
. shopping center (see attached). The survey was conducted from October 4 to October
17, 2004 at fifteen-minute intervals beginning at 12:00 PM and ending at 2:00 PM, as
lunchtime hours are typically the busiest at the President Square shopping center. The
survey indicates that there are an average of 61 spaces available out of 383 total onsite
spaces during weekdays and an average of 14 spaces available during weekends, The
busiest time surveyed was Saturday, October 9, at 1 :00 PM, when it was indicated that
only three spaces were available for the entire shopping center. According to the
parking survey, the weekends were significantly busier, but there were still an average
of 14 spaces available during the busy weekend lunchtime hours.
According to the submitted parking survey, the center experiences a high rate of
vehicular turnover; therefore, many people visit the center for short periods of time.
Based on this information and the parking survey, the proposed restaurant should not
result in a significant increase of traffic at the shopping center,
Other Code Requirements
The applicant is required to comply with all development requirements and policies
determined to be necessary by the Building Official, Fire Department, and Community
Development Administrator.
CEQA
Pursuant to the provisions of the California Environmental Quality Act, the Development
Services Department prepared an Initial Study for the proposed project. Said Initial
Study did not disclose any substantial or potentially substantial adverse change in any
of the physical conditions within the area affected by the project including land, air,
water, minerals, flora, fauna, ambient noise and objects of historical or aesthetic
significance. When considering the record as a whole, there is no evidence that the
proposed project will have any potential for adverse effect on wildlife resources or the
habitat upon which the wildlife depends. Therefore, a Negative Declaration has been
prepared for this project.
FINDINGS
Section 9275.1,2 of the Arcadia Municipal Code requires that tor a Conditional Use
Permit to be granted, it must be found that all of the following prerequisite conditions
can be satisfied:

1, That the granting of such Conditional Use Permit will not be detrimental to the
public health or welfare or injurious to the property or improvements in such zone or
vicinity.
2. That the use applied for at the location indicated is properly one for which a
Conditional Use Permit is authorized.
3. That the site for the proposed use is adequate in size and shape to accommodate
said use, and all yards, spaces, walls, fences, parking, loading, landscaping, and
other features required to adjust said use with the land and uses in the
neighborhood.
4. That the site abuts streets and highways adequate in width and pavement type to
carry the kind of traffic generated by the proposed use,
5, That the granting of such Conditional Use Permit will not adversely affect the
comprehensive General Plan;
RECOMMENDATION
The Development Services Department recommends approval of Conditional Use
Permit Application No. CUP 04-017, subject to the following conditions:
1. The use approved by CUP 04-017 is limited to a maximum of 40 seats, and any
expansion upon the use approved shall require approval of a separate
conditional use permit.
2. A separate sign design review application shall be submitted for all new signs on
the premises.
3. The applicant shall defend. indemnify, and hold harmless the City of Arcadia and
its officers, employees. and agents from and against any claim, action, or
proceeding against the City of Arcadia, its officers, employees or agents to
attack, set aside, void, or annul any approval or condition of approval of the City
of Arcadia conceming this project and/or land use decision. including but not
limited to any approval or condition of approval of the City Council, Planning
Commission, or City Staff, which action is brought within the time period provided
for in Govemment Code Section 66499,37 or other provision of law applicable to
this project or decision. The City shall promptly notify the applicant of any claim,
action, or proceeding concerning the project and/or land use decision and the
City shall cooperate fully in the defense of the matter. The City reserves the
right, at its own option, to choose its own attomey to represent the City, its
officers, employees, and agents in the defense of the matter,

WHEREAS, on November 15, 2004, a conditional use permit application was filed by
La Canada Design Group to allow outdoor bus storage in conjunction with the proposed
expansion of the existing Foothill Transit facility (Development Services Department Case
No. CUP 04-016) at property commonly known as an undeveloped lot south of 5640 Peck.
Road, more particularly described as follows:
Lots 395 to 410 inclusive, per Chicago Park Tract, in the City of
Arcadia, County of Los Angeles, State of California as per map
recorded in book 30, page 100 of miscellaneous records, in the
office of the County Recorder of Said County.
WHEREAS, a duly noticed public hearing was held on December 14, 2004, at which
time all interested persons were given full opportunity to be heard and to present evidence.
NOW THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA
RESOLVES AS FOLLOWS:
SECTION 1. That the factual data submitted by the Development Services
Department in the attached report is true and correct.

BACKGROUND
The eXisting Foothill Transit bus maintenance and administration facility currently
. operates on 11.45 acres of land within the City of Arcadia and the City of Irwindale
(1.26 acres in Arcadia, 10,19 acres in Irwindale). The portion of the existing transit
facility that is located in Arcadia is utilized for bus storage and was approved in 2000,
under CUP 00-016.
Pursuant to AMC Section 9275,1.53.2, any outdoor storage in the M-1 zone requires
a conditional use permit. The proposed transit facility expansion is intended for
outdoor bus storage, necessitating the conditional use permit.
PROPOSAL AND ANALYSIS
The property in question is a landlocked parcel surrounded by the Foothill Transit
faCility to the east and north, and existing industrial development to the south and
west. Foothill Transit is proposing to expand their bus storage area by paving this
site, providing light standards, and securing the area with a perimeter wall, No bus
maintenance or fuel storage is proposed on the subject lot.
Walls and Fences
As part of the expansion. Foothill Transit is proposing to build an 8'-0. high block wall
adjacent to the westerly and southerly property lines. This wall shall be compatible in
design and height with the existing block wall that is adjacent to the easterly property
line. Foothill Transit is also proposing to remove a portion of the easterly block wall
to proVide a chain link access gate, This gate will separate the existing bus storage
facility and the subject lot.
Liahtinq
Light st~ndards shall be placed within the project area to provide for safety and
security reasons, The proposed light standards are 30'-0" high, consistent with the

height of existing light standards at the transit facility. Although the M-1 Regulations
permit a maximum height of 20'-0" for light standards, staff feels that it is reasonable
to allow the new light standards to be the same height as the existing lights.
The proposed bus storage area is an expansion of the existing Foothill Transit
facility. This use is consistent with the adjacent land uses and with other uses
allowed within the M-1 zone. It is staffs opinion that the proposed use will be
compatible with other uses in the neighborhood and that the site will appropriately
accommodate the proposed use.
Code Requirements
All City requirements regarding building safety, fire prevention, detection, and
suppression, and site design shall be complied with to the satisfaction of the Building
Official, Fire Department, and Community Development Administrator. Compliance
is to be determined by having fully detailed tenant improvement plans submitted for
plan check review and approval.
FINDINGS

Conditional Use Permit is authorized,

features including the shared parking with the neighboring business, are adequate to adjust
. said use with the land and uses in the neighborhood. The proposed project complies with all
related zoning requirements as set forth in the Arcadia Municipal Code.
4. That the site abuts streets and highways adequate in width and pavement type
to carry the kind of traffic generated by the proposed use.
S, That the granting of such Conditional Use Permit will not adversely affect the
comprehensive General Plan because the land use and current zoning are consistent with
the General Plan,
6. That the use applied for will not have a substantial adverse impact on the
environment, and that based upon the record as a whole there is no evidence that the
proposed project will have any potential for an adverse effect on wildlife resources or the
habitat upon which the wildlife depends.
SECTION 3, That for the foregoing reasons this Commission grants Conditional Use
Permit No, CUP 04-016, to allow outdoor bus storage in conjunction with the proposed
expansion of the existing Foothill Transit facility, upon the following conditions:
1, That a modification is granted to allow 30'-0" taillight standards in lieu of the
e 20'-0" maximum height permitted (Sec, 9266,2,10),
2. The proposed perimeter walls shall be compatible in design and height with the
existing walls located onsite. All new fencing or walls shall not exceed a maximum of eight
(8) feet in height
3. Approval of CUP 04-016 shall not take effect until the property owner and
applicant have executed and filed the Acceptance Form available from the Development
Services Department to indicate awareness and acceptance of these conditions of
approval.
4. The applicant shall defend, indemnify, and hold harmless the City of Arcadia
and its officers, employees, and agents from and against any claim, action, or proceeding
against the City of Arcadia, its officers, employees or agents to attack, set aside, void, or
annul any approval or condition of approval of the City of Arcadia conceming this project
and/or land use decision, including but not limited to any approval or condition of approval
of the City Council, Planning Commission, or City Staff, which action is brought within the
.

time period provided for in Government Code Section 66499.37 or other provision of law
. applicable to this project or decision. The City shall promptly notify the applicant of any
claim, action, or proceeding concerning the project and/or land use decision and the City
shall cooperate fully in the defense of !he matter. The City reserves the right, at its own
option, to choose its own attorney to represeot the City, its officers, employees, and agents
in the defense of the matter.
SECTION 4, The Secretary shall certify to the adoption of this Resolution and shall
cause a copy to be forwarded to the City Council of the City of Arcadia, r HEREBY
CERTIFY that this Resolution No. 1718 was adopted at a regular meeting of the Planning
Commission held on December 14, 2004, by the following vote:

36. The site as it exists is vacant with no structure, it is fairly flat with new
compacted grade. The old undocumented sub-grade was removed and new
fill material has been installed per Greenbook Standard Specifications for
Public Works Construction 1997.
37. The surrounding properties are industrial buildings. Foothill Transit site
including the proposed property is located adjacent to Irwindale flood
control basin. Proposed property does not have any impact on plants,
animals nor historical scenic aspects, it is used as a parking lot. See enclosed
photographs of the existing site.
