RESOLUTION NO. 1711
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF ARCADIA, CALIFORNIA, APPROVING CONDITIONAL
USE PERMIT NO. 04-011 WITH A PARKING MODIFICATION TO
ALLOW A CHILDREN-LEARNING CENTER WITHIN THE
EXISTING 4,800 SQUARE FOOT UNIT AT 1313 S. BALDWIN
AVENUE.
WHEREAS, on June 28, 2004, a Conditional Use Permit application with a
parking modification was filed by Christine Yap, owner of the subject business, to
operate a children-Ieaming center within the existing 4,800 square foot unit at
1313 S. BalClwin Avenue; and,
WHEREAS, a public hearing was held on August 10, 2004, at which time
all interested persons were given full opportunity to be heard and present
evidence.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
ARCADIA RESOLVES AS FOLLOWS:
SECTION 1. That the factual data submitted by the Development
Services Department in the attached report is true and correct.
SECTION 2. This Commission finds:
1. That the granting of such Conditional Use Permit with a parking
modification will not be detrimental to the public health or welfare, or injurious to
the property or improvements in such zone or vicinity because the initial study did
not disclose any substantial adverse effects to the area affected by the proposed
project.
2. That the use applied for at the location indicated is a proper one for
which a Conditional Use Permit is authorized.
3. That the site for the proposed use is adequate in size and shape to
accommodate said use. All yards, spaces, loading, landscaping, parking, and
other features are adequate to adjust said use with the land and uses in the
neighborhood. The proposed project complies with all related zoning
requirements as set forth in the Arcadia Municipal Code.
4. That the site abuts a major street that is adequate in width and
pavement type to carry the kind of traffic generated by the proposed use.

5. That the granting of such Conditional Use Permit will not adversely
affect the comprehensive General Plan because the land use and current zoning
are consistent with the General Plan.
6. That the use applied for will not have a substantial adverse impact
on the environment, and that based upon the record as a whole there is no
evidence that the proposed project will have any potential for an adverse effect
on wildlife resources or the habitat upon which the wildlife depends.
SECTION 3. That for the foregoing reasons this Commission grants
Conditional Use Permit No. CUP 04-011 with a parking modification to operate a
children-learning center within the existing 4,800 square foot unit at 1313 S.
Baldwin Avenue, upon the following conditions:
1. The children-learning center will be restricted to the subject unit
(4,800 square feet) with a maximum of 12 students in each class from ages 6
months to 6 years old. The proposed lIse shall be operated and maintained in a
manner that is consistent with the proposal and plans submitted and approved
for CUP 04-011, and any expansion upon the use approved shall require
approval of a separate conditional use permit.
2. The business hours shall be limited from 9:00 a.m. to 6:00 p.m.,
seven days a week.
3. A separate sign design review application shall be submitted for all
new signs on the premises.
4. The 17 parking spaces that face the store frontage shall be
restricted to 1-hour parking.
5. Approval of CUP 04-011 shall not take effect until the property
owner(s) and applicants have executed and filed the Acceptance Form available
from the Development Services Department to indicate awareness and
acceptance of these conditions of approval.
6. The applicant shall defend, indemnify, and hold harmless the City
of Arcadia and its officers, employees, and agents from and against any claim,
action, or proceeding against the City of Arcadia, its officers, employees or
agents to attack, set aside, void, or annul any approval or condition of approval of
the City of Arcadia concerning this project and/or land use decision, including but

not limited to any approval or condition of approval of the City Council, Planning
Commission, or City Staff, which action is brought within the time period provided
for in Government Code Section 66499.37 or other provision of law applicable to
this project or decision. The City shall promptly notify the applicant of any claim,
action, or proceeding concerning the project and/or land use decision and the
City shall cooperate fully in the defense of the matter. The City reserves the
right, at its own option, to choose its own attorney to represent the City, its
officers, employees, and agents in the defense of the matter.
SECTION 4. The decision, findings and conditions contained in this
Resolution reflect the Commission's action of August 10, 2004, by the following
vote:

SECTION 5. The Secretary shall certify to the adoption of this Resolution
and shall cause a copy to be forwarded to the City Council of the City of Arcadia.

Conditional Use Permit No. 2004-011 to allow a children-learning
center at 1313 S. Baldwin Avenue.
SUMMARY
This application was filed by Ms. Christine Yap, owner of the subject business,
requesting a Conditional Use Permit with a parking modification to allow a
children-learning center at 1313 S. Baldwin Avenue (d.b.a. Kids Islands Inc.).
The Development Services Department recommends approval of the learning
center. and adoption of Resolution No. 1711 subject to the conditions of approval
outlined in the staff report.
GENERAL INFORMATION
APPLICANT: Christine Yap (Owner of subject business)
LOCATION: 1313 S. Baldwin Avenue
REQUEST: A Conditional Use Permit to operate a children-learning center
with a parking modification at .1313 S. Baldwin Avenue
(Burlington Coat Factory center).
LOT AREA: 391.720 (8.99 acres)

EXISTING LAND USE & ZONING:
The site is developed with the Burlington Coat Factory/Baby
Depot, Joann Fabrics, Ross department store, and various retail
shops and restaurants. The property is zoned C-2 and C-2 & H4
(along Baldwin Avenue).

BACKGROUND
The majority of the buildings that exist on the site were originally constructed in
1957.
The site originally had 771 parking spaces. However, in 1984, the on-site
parking areas were redesigned to provide 760 spaces. In May of 1999, 13
parking spaces were eliminated due to seismic retrofit within the parking
structure, a new trash enclosure, and additional handicapped parking spaces.
The site currently has 747 parking spaces (404 spaces within the two-story
parking structure with 181 spaces on the lower level and 223 spaces on the
upper level). As such, the number of parking spaces does not comply with the
current code requirements of 1,118 spaces for this center (including the subject
business).
The subject unit has been vacant since May of 2003. It was formerly occupied
by the Lighthouse Christian store since 1979,
PROPOSAL
The applicant is requesting to operate a children-Ieaming center that consists of
play, music, art, ballet, and tap dancing classes for children ages 6 months to 6
years old (d.b.a. Kids Islands Inc.). This unit occupies approximately 4,800
square feet within the existing 240,907 square foot shopping center, as shown on

the submitted site plan, and is located between John's Waltrip Music and I Cafe.
There will be a total of six 45-minute classes each day with a maximum of 12
students and 4 employees. Business hours will be from 9:00 a.m. to 6:00 p.m.,
seven days a week.
PARKING
A learning center for students that are not of high school age requires 1 parking
space for each employee and 1 space for every 5 students. Given that they will
have a maximum of 12 students at each class and 4 employees, a total of 7
parking spaces are required. The proposed use requires less parking than the
previous retail use that required 24 parking spaces (Le., a retail use requires 5
spaces per 1,000 square feet of gross floor area).
The attached "Parking Survey" was submitted by the property owner, which
indicates that the shopping center has a peak parking demand of 532 spaces
(count occurred' at 5:00 p.m. on Saturday, June 26, 2004). Based on random
observations by staff the parking areas are typically 72% full with ample parking
within the westerly portion of the site and within the parking structure. Also,
during several recent on-site vehicle counts by staff the maximum number of
occupied parking spaces adjacent to the retail shops were 72 spaces out of 242
spaces, and a maximum of 95 spaces out of 181 spaces on the first level of the
parking structure.
However, because the parking lot adjacent to this unit is typically full, the
Property Manager has proposed to restrict the 17 parking spaces that face the
store frontage to 1-hour parking. The purpose of this is to direct the customers to
park in the areas west of this lot or within' the parking structure where there are
available spaces.
ANALYSIS
Generally staff does not encourage uses that are deficient in parking; however,
because the proposed use requires less parking than the previous retail use or a
new retail tenant, the children-learning center will not have an adverse impact
upon the available on-site parking. As such, it is staff's opinion that the proposed
use is appropriate for the center, provided that the operation of such use remains
consistent with this application.
CODE REQUIREMENTS
All City requirements regarding disabled access and facilities, occupancy limits,
building safety, health code compliance, parking and site design shall be

complied with to the satisfaction of the Building Official, Community Development
Administrator, Fire Marshall, and Public Works Services Director.
Any exterior improvements, such as new signs shall be subject to architectural
design review and approval by the Development Services Division.
CEQA
Pursuant to the provIsions of the Califomia. Environmental Quality Act, the
Development Services Department has prepared an initial study for the proposed
project. Said initial study did not disclose any substantial or potentially substantial
adverse change in any of the physical conditions within the area affected by the
project including land, air, water, minerals, flora, fauna, ambient noise and
objects of historical or aesthetic significance. When considering the record as a
whole, there is no evidence that the proposed project will have any potential for
an adverse effect on wildlife resources or the habitat upon which the wiidlife
depends. Therefore, a Negative Declaration has been prepared for this project.
FINDINGS
Section 9275.1.2. of the Arcadia Municipal Code requires that for a Conditional
Use Permit to be granted, it must be found that all of the following prerequisite
conditions can be satisfied:
1. That the granting of such Conditional Use Permit will not be
detrimental to the public health or welfare or injurious to the property or
improvements in such zone or vicinity.
2. That the use applied for at the location indicated is properly one for
which a Conditional Use Permit is authorized.
3. That the site for the proposed use is adequate in size and shape to
accommodate said use, and all yards, spaces, walls, fences, parking,
loading, landscaping, and other features required to adjust said use
with the land and uses in the neighborhood.
4. That the site abuts streets and highways adequate in width and
pavement type to carry the kind of traffic generated by the proposed
use.
5. That the granting of such Conditional Use Permit will not adversely
affect the comprehensive General Plan.

RECOMMENDATIONS

Approval
The Planning Commission should move to adopt Conditional Use Permit
Application No. 04-011 and adopt Resolution No. 1711 approving a children.
learning center with a parking modification at 1313 S. Baldwin Avenue.
Denial
If the Planning Commission intends to deny this Conditional Use Permit and
parking modification, the Commission should state the specific reasons for denial
and direct staff to prepare the appropriate resolution incorporating the
Commission's decision and specific findings.

It is with great pleasure in having the opportunity to present myself to
you in this letter. Through my tenure in the City of Arcadia, 1 have found
myself with countless love and commitment for this wonderful.city. Thus, I
have pondered the idea of "KIDS ISLAND".
I am currently a loving mother of two beautiful girls, Amanda and
Heather. My dedication for my children has led me to create an environment
that will help them grow into healthy young adults. At a very young age, I
have always had a passion for children and the development of their lives.
Constantly, my time was spent volunteering at local day cares and
preschools. My love is not only restricted to my children, but to people and
children everywhere, especially for the community in which I am in iove
with. .
I have found that the City of Arcadia is in desperate need of a facility
such as "KIDS ISLAND". This city needs a facility that offers families and
the community a place that molds-creativity and cultural awareness, a place
that fosters values of citizenship and kindness, a place for the imagination at
play. I hope that you take into consideration that we are not only developing
the City of Arcadia but the future of our children. Again, I greatly appreciate

EVALUATION OF ENVIRONMENTAL IMPACTS:
1. A brief explanation is required for all answers .except "No Impact" answers that are
adequately supported by the information sources a lead agency cites in the parentheses
following each question. A"No Impact" answer is adequately supported if the referenced
information sources show that the impact simply does not apply to projects such as the one
involved (e.g" the project is not within a fault rupture zone). A "No Impact" answer should

Based on the use, the site has been deficient in parking for several decades; however the proposed
project will not create a potential impact since the proposed use requires less parking than the
prellious retail use (Christian Lighthouse). Additionally, each class will only be limited to 12 students
